Sox And Whistleblowing, Terry Morehead Dworkin

The language of the Sarbanes-Oxley Act ("SOX") leaves no doubt that Congress intended whistleblowing to be an integral part of its enforcement mechanisms. The Act attempts to encourage and protect whistleblowers in a variety of ways, including providing for anonymous whistleblowing, establishing criminal penalties for retaliation against whistleblowers, and clearly defining whistleblowing channels. Unfortunately, these provisions give the illusion of protection for whistleblowers without effectively providing it. There is increasing evidence that virtually no whistleblower who has suffered retaliation and pursued remedies under SOX has been successful. Over the past thirty years, a significant amount of research from a variety of social science disciplines has considered tax compliance. Economists, psychologists, and sociologists have contributed to the discussion, offering research and, at times, conflicting explanations regarding whether a person is likely to comply with his obligation to file an accurate tax return. The unifying theme among this research is a search for explanatory reasons which are the factors that lead to non-compliance. In broad terms, the economic models of tax compliance assume rational behavior, and that people will coldly consider compliance from the perspective as to whether the …

The judges of the Supreme Court of Louisiana issued a court order, in the year 1840, mandating a required reading course of legal materials for prospective bar applicants. Included in the list of materials was Sir William Blackstone's Commentaries on the Laws of England. Louisiana's legal system has, from its inception, been based on the civil law, a system tracing its roots back to Rome. The other organized system of law is the common law, which originated in the customs and judicial decisions of England, and is the legal system followed in the other forty-nine states. Evaluation Of The New Jersey Access Initiative Mentor Program, Tasha R. Binet
Theses and Dissertations
The purposes of this study were to (a) evaluate the effectiveness of the New Jersey Access Initiative Mentor Program and (b) determine if an increased number of sessions of ancillary, psychosocial services was related to improved treatment retention, periods of abstinence and decreased number of relapses with opiate-addicted participants. Correlational analyses were planned utilizing data collected and recorded in the NJAI database by program staff; however, analyses were unable to be performed due to a large amount of incomplete and missing data. This Article answers this question with the following jurisprudential hypothesis: many legal outcomes can be explained, and future cases predicted, by asking a very simple question, is there a plausible legal result in this case that will significantly affect the interests of the legal profession (positively or negatively)? If so, the case will be decided in the way that offers the best result for the legal profession.
The article presents theoretical support from the new institutionalism, cognitive psychology and economic theory. The Article then gathers and analyzes supporting cases from areas as diverse as constitutional law, torts, professional responsibility, employment …

In 2003, the U.S. Department of Health and Human Services, Children’s Bureau issued a program instruction that requires states to conduct a reassessment. The purpose of the reassessment is to update each state’s earlier assessment of court performance in processing child welfare cases and also to determine what progress has been made since the original assessments.
