"Unrighteous Compact": Louisa May Alcott's Resistance To Contracts And Promises In Moods, Nina Bannett
"Unrighteous Compact": Louisa May Alcott's Resistance To Contracts And Promises In Moods, Nina Bannett
Publications and Research
Alcott’s first adult novel, Moods, initially published in 1864, presents oral promises between women as extralegal alternatives to standard legal contracts between men and women. In the 1864 edition of Moods, Alcott's protagonist, Sylvia Yule, fails to understand the constraints of marriage as a type of contract, and the results are dramatic. In fact, Alcott undermines the idealized marriage plot so crucial to her later, wildly popular works like Little Women (1868-69). In the 1864 Moods, Alcott boldly questions both legal contracts and oral promises characteristic of nineteenth-century conceptions of romantic love and heterosexual friendship.
The Canon Of American Legal Thought, Robert E. Rodes
The Canon Of American Legal Thought, Robert E. Rodes
Journal Articles
Professors Kennedy and Fisher have put together a book containing twenty essays, most of them first published in law reviews. They are elegantly presented, and each is preceded by an introductory essay by one of the editors, which provides background information on the author, analyzes the piece lucidly and succinctly, and situates it in the development of American legal thought. Each piece is also preceded by a bibliography, which further situates it by describing the rest of the author's work and summarizing the commentary it has evoked. All the works are given in full, adding considerably to what can be …
Aging America, Thomas L. Shaffer
Aging America, Thomas L. Shaffer
Journal Articles
Professor Sarah Harper's assessment of the legal, political, medical, and economic issues associated with old age in the United States heralded the theme for this Symposium, "Aging America." Her analysis turns, as she puts it, on "a fundamental shift in the demographic structure of society. No longer will it be the norm to have large numbers of young and small numbers of old,"1 as it was when I was a boy (age 11 on V.J. Day, 1945).
"Rather, we are entering a world where age groups will be distributed more or less equally across society-an age-symmetric society."

Chest Radiographs In Acute Pulmonary Embolism, Ali Bin Sarwar Zubairi, Shahid Javed Husain, Muhammad Irfan, Kulsoom Fatima, Muhammad Atif Zubairi, Muhammad Islam
Department of Medicine
Background: Pulmonary embolism (PE) is a serious clinical entity carrying significant morbidity and mortality. Clinically, it is a difficult condition to diagnose and remains under treated condition in Pakistan due to non-availability of objective tests and lack of awareness among physicians. This study was conducted to determine the chest radiographic presentation in known cases of acute PE presenting to a tertiary care hospital.
Methods: Hospital records of patients with a diagnosis of acute PE were reviewed from June 2000 until June 2004. Fifty diagnosed cases of acute PE on Spiral Computed tomography (CT) of the chest demonstrating an intraluminal-filling defect …
Resource Allocation Within The National Aids Control Program Of Pakistan: A Qualitative Assessment Of Decision Maker's Opinions, Sara Husain, Masood Kadir, Zafar Fatmi
Resource Allocation Within The National Aids Control Program Of Pakistan: A Qualitative Assessment Of Decision Maker's Opinions, Sara Husain, Masood Kadir, Zafar Fatmi
Community Health Sciences
Background:
Limited resources, whether public or private, demand prioritisation among competing needs to maximise productivity. With a substantial increase in the number of reported HIV cases, little work has been done to understand how resources have been distributed and what factors may have influenced allocation within the newly introduced Enhanced National AIDS Control Program of Pakistan. The objective of this study was to identify perceptions of decision makers about the process of resource allocation within Pakistan's Enhanced National AIDS Control Program.
Methods:
A qualitative study was undertaken and in-depth interviews of decision makers at provincial and federal levels responsible to …

Pluralism, Dialogue, And Freedom: Professor Robert Rodes And The Church-State Nexus, Richard W. Garnett
Pluralism, Dialogue, And Freedom: Professor Robert Rodes And The Church-State Nexus, Richard W. Garnett
Journal Articles
The idea of church-state separation and the image of a wall are at the heart of nearly every citizen's and commentator's thinking about law and religion, and about faith and public life. Unfortunately, the inapt image often causes great confusion about the important idea. What should be regarded as an important feature of religious freedom under constitutionally limited government too often serves simply as a slogan, and is too often employed as a rallying cry, not for the distinctiveness and independence of religious institutions, but for the marginalization and privatization of religious faith.
How, then, should we understand church-state separation? …

Erastian And High Church Approaches To The Law: The Jurisprudential Categories Of Robert E. Rodes, Jr., M. Cathleen Kaveny
Journal Articles
It is a great honor for me to have been asked to contribute to this issue of the Journal of Law and Religion focusing on the work of my colleague and friend, Robert E. Rodes, Jr. In June 2006, Professor Rodes celebrated his fiftieth anniversary as a member of the faculty of Notre Dame Law School. His long career has marked him as a founding father of interdisciplinary scholarship at the intersection of faith, law, and morality—the very sort of scholarship which this journal is dedicated to fostering and preserving.
The topics that Professor Rodes has considered over the years …
Pilgrim Law: Overcoming False Consciousness Through The Witness Of London's Economic Migrants, Vincent D. Rougeau
Pilgrim Law: Overcoming False Consciousness Through The Witness Of London's Economic Migrants, Vincent D. Rougeau
Journal Articles
The article discusses the author's view on the works and beliefs of Robert E. Rodes Jr. He considered faith and professional life as the powerful link on Rodes works and cited three points of reflection on the matter which includes on Rodes' concept of "Pilgrim Law" that has been influential on the author's works, thinking about the relationship between the professional roles of a lawyer and a call to a lived Christian faith. He believed that the Rodes' book "Pilgrim Law" took a formidable task on extending the principles of the theology of liberation to American jurisprudence and became an …
From Family To Individual And Back Again, Margaret F. Brinig
From Family To Individual And Back Again, Margaret F. Brinig

Loving v. Virginia has been thought of in many ways: as an important step toward full equality for African-Americans, as, more generally, a statement about the suspect classification of race, as a declaration about the fundamental nature of marriage, and as a critical addition to the construction of the right to privacy (as well as, of course, exemplified in the validation of the Lovings' own marriage).
In my contribution to the first Loving symposium, I wrote about the increasing tendency of the Supreme Court, following the 1967 decision, to treat the rights of intimacy as belonging to the individual adults …
On Hart's Ways: Law As Reason And As Fact, John M. Finnis
On Hart's Ways: Law As Reason And As Fact, John M. Finnis
Journal Articles
This address at the Hart Centenary Conference in Cambridge in July 2007 reflects on foundational elements in Hart's method in legal philosophy. It argues that his understanding of what it is to adopt an internal point of view was flawed by (a) inattention to the difference between descriptive history (or biography or detection) and descriptive general theory of human affairs, (b) inattention to practical reason as argument from premises, some factual but others normative (evaluative) in their content, and (c) relative inattention to the deliberations of law-makers as distinct from subjects of the law. These flaws contributed to a concept …

Recruiting and retaining quality teachers specific for high-poverty schools in urban areas is a national concern, especially in light of the "No Child Left Behind" federal legislation. The educational realities, detrimental effects of poverty, and human despair that often depress low-income communities can prove to be quite overpowering for many teachers new to the profession and significantly contribute to high levels of teacher absenteeism, attrition rates, and teacher shortages. Examining this issue through a new lens, that being through the eyes of effective urban high-poverty school educators, has the potential to spark spirited conversations and debates among policy makers and …
Missouri's Nonpartisan Court Plan From 1942 To 2005, Charles B. Blackmar
Missouri's Nonpartisan Court Plan From 1942 To 2005, Charles B. Blackmar
Missouri Law Review
Missouri's Constitution of 1821 provided for the appointment of all superior court judges by the governor, in the manner which prevailed in most of the states then members of the union. With the advent of Jacksonian democracy, a feeling developed that all persons holding important public positions should be elected by the voters, and most of the states opted for the popular election of trial and appellate judges. In 1848, Missouri amended its constitution to provide for popular election of all judges, including judges of the Supreme Court, on partisan tickets at the regular biennial elections. Missouri continued to elect …

Journal of Social, Behavioral, and Health Sciences
Changes associated with the Youth Fit For Life physical activity intervention were assessed with 5- to 12-year-old children in after-school care ( N = 477). Body mass index (BMI), strength, and flexibility significantly improved over 12 weeks. Initial BMI was negatively related to observed changes, r = -.29, p < .001. Significant within-group improvements in tension, vigor, and physical self-concept scores, and levels of voluntary moderate-to-vigorous physical activity/week were also found in the 9- to 12-year-olds (n = 91). Multiple regression analysis indicated that changes in physical self-concept, exercise self-efficacy, and general self scores explained a portion of the variance in changes in voluntary physical activity that approached significance, R2 = .08, F = 2.55, p = .06. Revisions and extensions of the protocol were suggested.

BACKGROUND: Snake venoms are complex mixtures of pharmacologically active proteins and peptides which belong to a small number of superfamilies. Global cataloguing of the venom transcriptome facilitates the identification of new families of toxins as well as helps in understanding the evolution of venom proteomes.
RESULTS: We have constructed a cDNA library of the venom gland of a threatened rattlesnake (a pitviper), Sistrurus catenatus edwardsii (Desert Massasauga), and sequenced 576 ESTs. Our results demonstrate a high abundance of serine proteinase and metalloproteinase transcripts, indicating that the disruption of hemostasis is a principle mechanism of action of the venom. In addition …

Relations Of Changes In Self-Efficacy, Exercise Attendance, Mood, And Perceived And Actual Physical Changes In Obese Women: Assessing Treatment Effects Using Tenets Of Self- Efficacy Theory, James J. Annesi, Jennifer L. Unruh, Ann C. Whitaker
Journal of Social, Behavioral, and Health Sciences
Obese and sedentary women ( N = 76) initiated an exercise and nutrition program based on self-efficacy theory. Significant within-group improvements in body fat, waist size, and body mass index were found over 6 months. Changes in Physical Self-Concept (task self-efficacy) and Exercise Self-Efficacy (self-regulatory efficacy) scores, together, accounted for a significant portion of the variance in exercise session attendance, R2 = .24, F = 11.67, p < .001, with both significantly contributing to the overall explained variance. Exercise attendance was significantly related to changes in Body Areas Satisfaction (β = .39) and Total Mood Disturbance (β = -.27) scores. Findings suggested a path from increased self-efficacy, to exercise attendance, to improvements in body satisfaction and overall mood. Suggestions for replication and extensions were given.

Neuroimaging, Entrapment, And The Predisposition To Crime, O. Carter Snead
Journal Articles
Professor Tovino's (2007) paper is a welcome contribution to the emerging body of scholarship on the issues arising at the nexus of cognitive neuroscience (and neuroimaging in particular) and the law. It is a useful overview of the various ways in which neuroimaging might affect a wide array of legal questions. Though many of the issues that Tovino discusses are at present quite speculative (as she acknowledges), it is always wise to take advantage of the rare opportunity to reflect on the legal, ethical, and public policy implications of developments in biotechnology before they are upon us. In that spirit, …

Context: Tens of millions of Americans use herbal products and/or dietary supplements, yet scant data are available regarding the purity, safety, or efficacy of these substances. A better understanding of usage trends and patient attitudes toward self-initiated supplementation is vital to obtaining accurate and complete medical history data.
Objective: To survey Americans aged approximately 60 years and older regarding their use of herbal products and dietary supplements and their attitudes and knowledge regarding the safety of these popular substances.
Methods: A face-to-face, 35-item survey was administered to 267 men and women residing in the Kansas City, Mo-metropolitan area. Researchers documented …

Infection with Mycobacterium tuberculosis (TB) induces pulmonary immunopathology mediated by classical Th1 type of acquired immunity with hepatic involvement in up to 80% of disseminated cases. Since PPAR agonists cause immune responses characterized by a decrease in the secretion of Th1 cytokines, we investigated the impact of activating these receptors on hepatic pathology associated with a well-characterized model of Th1-type pulmonary response. Male Fischer 344 rats were either maintained on a drug-free diet (groups I and II), or a diet containing diethylhexylphthalate (DEHP), a compound transformed in vivo to metabolites known to activate PPARs, for 21 days (groups III and …
The Freedom Of The Church, Richard W. Garnett
The Freedom Of The Church, Richard W. Garnett
Journal Articles
This Article focuses on what the American theologian and Jesuit John Courtney Murray called a Great Idea, whose entrance into history marked the beginning of a new civilizational era. That idea was libertas ecclesiae, or the freedom of the Church. It served, according to Harold Berman, as the catalyst for the first major turning point in European history and as the foundation for nearly a millennium of political theory. And, this Article suggests, it remains a crucial component of any plausible and attractive account of religious freedom under and through constitutionally limited government. It is tempting to assume or expect …
Secrecy And Access In An Innovation Intensive Economy: Reordering Information Privileges In Environmental, Health, And Safety Law, Mary L. Lyndon
Secrecy And Access In An Innovation Intensive Economy: Reordering Information Privileges In Environmental, Health, And Safety Law, Mary L. Lyndon
University of Colorado Law Review
This article examines the law concerned with access to information that is commercially valuable when it is kept secret but is also essential to environmental, health, and safety (EHS) risk evaluation. EHS law stimulates sustainable economic activity, including new technologies, and thus complements intellectual property law. Access to EHS information is essential to risk management, but current disclosure obligations are unclear, as the law is a patchwork of familiar but ill-fitting concepts and entitlements. The article discusses the current law that affects disclosure, taking into account recent changes in the technological and economic landscape. It also describes the contrasting uses …

Post A Message And Go To Jail: Criminalizing Internet Libel In Japan And The United States, Salil K. Mehra
University of Colorado Law Review
In the United States, criminal libel is all but dead. American law professors only write about it to denounce the continued existence of rarely enforced criminal libel statutes. In Japan, however, criminal libel laws have become vital tools in policing injurious speech on the Internet. Defamatory posts lead to police intervention and even arrest. Because the United States is considering regulation of online speech, potentially including criminal penalties, we can learn from the experience of Japan. From a positive perspective, this Article explains why Japan applies such laws to the Internet. From a normative perspective, the Article addresses why broadly …
Methodology For Estimating The Magnitude, And Spatial And Temporal Variation Of Irrigation Demand On The Floridan Aquifer System Within The Upper East Coast Planning Area, Florida, Elizabeth Quinn
Electronic Theses and Dissertations 2000 - 2009
A method was developed to estimate the magnitude and spatio-temporal variation of agricultural demand from the Floridan Aquifer System (F AS) in the Upper East Coast (UEC) planning area, Florida. The Irrigation Program (IP) is designed to compute total irrigation requirements and model demand from permitted water sources. Historical Natural Resources Conservation Service well-flow data are used in calibration. The IP is most sensitive to spatio-temporal variation of water levels in major canals and the range of days for the wet and dry season. The magnitude of deficit in simulated and historical withdrawal from the FAS is 199,000 fe/day. This …

Learning And Leading: Approaches To Leadership Self-Development Among Women Executives Of Philanthropic Organizations, Theresa N. Liddell
Electronic Theses and Dissertations 2000 - 2009
The purpose of this grounded theory study was to explore the selfdevelopment of women executives of philanthropic organizations to determine their approaches to learning for leading. Women occupy 1.4% to 53% of the executive positions in the U.S. depending on the sector, yet little is known about their learning needs and strategies. The research questions asked how these women executives learned to develop successfully in their positions and what informal learning strategies they used. This study explored the perspectives of 22 women executives of philanthropic organizations in South Florida and Western Washington. The foundations represented by the participants varied widely …

Metaphors Pilgrims Live By: Metaphor Systems Of The Modern Pilgrimage, Todd N. Valdini
Electronic Theses and Dissertations 2000 - 2009
Pilgrimages have produced volumes of textual reflections by pilgrims and outside observers. These writers represent a wide variety of disciplines from travel theorists to travel bloggers, medieval historians to modern anthropologists and sociologists. The findings of this study reveal two major complex metaphor systems: one based on a series of interlaced existential metaphors orbiting the nuclear LIFE IS A JOURNEY and the other stemming from a network of economic metaphors of MORAL ACCOUNTING. The symbolic exchange embedded in these metaphorical systems reflects the human desire for a meaningful and worthy life. These mutually supporting complex systems of metaphor reveal an …
