A Constitutional Significance For Precedent: Originalism, Stare Decisis, And Property Rights, Polly J. Price

The discussions in this Article proceed as follows. Part I briefly introduces several areas of contemporary debate for which this inquiry is relevant. In Part II, I examine previous scholarly evaluations of the doctrine of precedent in the formative period. I provide an alternative explanation for the adoption by American courts of rhetoric favoring stare decisis, one that links the rhetoric used by these courts with the predominant property discourse of the Founding period and with the Marshall Court’s subsequent emphasis on vested rights and the Contracts Clause. I suggest that the stare decisis property rule gained widespread acceptance as …

The military’s approach to innovation management extends beyond traditional distinctions between internal and external innovation modes. Summarizing specific innovation strategies available to managers develops recognition of this growing reality. The article concludes with resulting lessons that can be more widely adopted by managers.

John Adams was central to the founding of the United States and has held enduring interest among many generations including his own. The foundation of Adams as a historical character was constructed both by people he interacted with personally and by the turmoil of politics, casting him in roles with conflicting results. The purpose of this study is to examine the various means, by which the gospel spread across the word throughout the first three hundred years of the Church’s existence. Though some biblical texts will be referenced, the primary focus of this study is upon the post-Apostolic, pre-Constantinian years. This study is descriptive in nature. Though contemporary secondary source literature will be consulted, I will draw predominantly from the historical documents written circa A.D. 100-300 and Eusebius’ Ecclesiastical History.

Nineteenth-Century Britain was known for its political and military power – the British Empire – but also for its religious fervor. This religious spirit was prominent in England and throughout the British Empire, through the creation of Protestant mission organizations that sent missionaries throughout the world. China presented a unique mission field for early British missionaries, as it was not a formal part of the British Empire and it had such a large population of people who had never been exposed to Protestant Christianity. The years 1842 to 1866 were the formative period of the British Protestant mission in China. …

In 1922, with the issuance of the Churchill White Paper, the British government committed itself to assuming the responsibilities of the Balfour Declaration and create a bi-national state in the Mandated territory of Palestine. By 1939, the British, represented by the Mandatory Authority, found themselves trapped between a Palestinian-based Zionist movement, itself torn between two competing factions, and a Palestinian Arab nationalist movement whose leadership had collapsed. The internal split between Revisionist Zionism under Ze’ev Jabotinsky and Mainstream Zionism under Chaim Weizmann and, later, David Ben-Gurion prevented the British government from negotiating with a cohesive Zionist organization. A Non-Traditional Traditionalist: Rev. A. H. Sayce And His Intellectual Approach To Biblical Authenticity And Biblical History In Late-Victorian Britain, Roshunda Lashae Belton

The relationship between science and religion was a dominant topic in late-Victorian Britain. This is exemplified in the debate over biblical authenticity and bible history. After 1860 higher criticism, the textual examination of the biblical texts became a prominent issue of discussion in British society. Higher critics brought into question the authorship and authenticity of the Pentateuch, particularly that of Genesis. One significant contributor to this debate was Oxford educator and Assyriologist Rev. Archibald Henry Sayce, who firmly believed that philology, history and, particularly, archeology provided the evidence necessary to validate the accuracy of biblical texts. This dissertation focuses on the indigneous geography of the Missouri River Valley of the Dakotas. Since Lewis and Clark's expedition in 1804, this landscape has been transformed by two externally introduced components, reservations and reservoirs. To move the native tribes out of the way of an expanding American empire in the mid-19th century, the U.S. Government confined the tribes to territories, then to reservations, which grew smaller as each new wave of Euro-American immigration launched more land-taking by the federal government. This dissertation is a sociolinguistic study examining the phonetic variation in the speech of four generations of Cajun French women, living in four Louisiana parishes: Avoyelles, Lafourche, St Landry and Vermillon. Based on the Gold 1975 corpus and the Dubois 1997 Cajun French corpus available at LSU, a sample of 29 speakers was chosen for the analysis of five traditional phonetic variables: O in front of nasals MM/NN and liquids R and L, Œ in front of R, E in front of R and at the third person ending of the imparfait, J in lexical words, personal pronoun JE, and …

The period between 1880 and 1920 was one of the most dynamic in the history of medicine. Morbidity and mortality rates for infectious diseases dropped quickly. Concurrently, miasmatic theory gave way to germ theory. Many of these dynamic changes occurred in the urban centers of North America, which were also entering into a period of dramatic growth and change. Following the 1905 completion of infrastructure improvements intended to improve public health in Washington, D.C., typhoid fever rates unexpectedly increased. Representation In Kenya, Its Diaspora, And Academia: Colonial Legacies In Constructions Of Knowledge About Kenya's Coast, Jesse Benjamin

This paper explores the construction of knowledge in Kenya in the context and aftermath of colonialism and underdevelopment. Those communities that were politically and economically marginalized in Coast Province over the past century were also displaced in terms of academic opportunities, resulting in fewer social science scholars from Mijikenda and other non-Swahili communities in both Kenyan and diaspora universities. Underdevelopment studies in Africa and Kenya are briefly reviewed, and the colonial history of asymmetric social relations at coastal Kenya is traced. Finally, key debates over identity and history are examined within this context and shown to be exacerbated by diasporic …

State aid to private schools has been a controversial issue in Australia since the beginning of European settlement. This was true in all colonies' and remains a national issue in the twenty-first century. At various times colonial governments chose to provide to private schools, principally those operated by the Catholic and major churches. This thesis proceeds from an analysis of practice and critical commentary to claim that the opportunities presented to some architectural practices by the advent of ubiquitous digital technology have not been properly exploited. The missed opportunities, it claims, can be attributed largely to the retention of a model of time and spaces as discrete design parameters, which is inappropriate in the context of the widening awareness of social interconnectedness that digital technology has also facilitated. This thesis presents a study of Nevada City, Montana to examine the eligibility potential for a historic district nomination to the National Register of Historic Places (NRHP). Founded in 1863, Nevada City experienced a gold mining heyday from 1863-1869. As easily attainable placers diminished and strikes were reported elsewhere, the town was nearly abandoned. Many of the remaining buildings were demolished, used for firewood, or salvaged by Nevada City's remaining residents. Senator Charles Bovey began preservation work in 1944 at nearby Virginia City, Montana. Bovey had already amassed several buildings and countless artifacts that he had on display at the …

The U.S. and Turkey signed the Lausanne Treaty in 1923 and established equal relations. In 1927, the U.S. Senate rejected this treaty. The Coolidge administration, however, ignored the Senate's rejection and activated the Treaty shortly thereafter. This study was conducted to determine why the Lausanne Treaty was rejected and how it survived. Under investigation were: the origins of the U.S. foreign policy in the Near East, the Lausanne Conference negotiations, and the American public's reaction to the Lausanne Treaty. The American book publishing industry shapes the character of American intellectual life. While the newspaper and television industries have been accused of and investigated for bias and lowering America’s intellectual standards, book publishing has gone largely unexamined by scholars. The existing studies of the publishing industry have focused on finance, procedure and history. “There are few ‘theories’ of publishing – efforts to understand the ‘whys’ as well as the ‘hows.’ Few scholarly scientists have devoted significant scholarly attention to publishing” (Altbach and Hoshino, xiii).
