Long-Term Effects Of A Physical Activity Intervention In High School Girls, Russell R. Pate, Ruth P. Saunders, Rod K. Dishman, Cheryl L. Addy, Marsha Dowda, Dianne S. Ward

Background - Physical activity decreases during childhood and adolescence, and physical activity levels are significantly lower in females than males, particularly during adolescence. Schools are attractive settings in which to implement interventions designed to promote physical activity in girls and young women, but few studies have tested the sustained effects of such interventions.
Design - Cross-sectional. Data were collected in 2002-2003 and analyzed in 2006-2007.
Setting/Participants - 1594 adolescent girls in 22 high schools.
Intervention - The intervention, Lifestyle Education for Activity Program (LEAP), was designed to increase physical activity in 9th grade girls through two channels: changes in …

Invisible Actors: Genetic Testing And Genetic Discrimination In The Workplace, Susannah Carr

Current federal and state law is inadequate to protect employees from employer's misuse of their genetic information. Genetic information is knowledge of a person's genome that indicates a predisposition towards an illness, disease, or medical condition, where symptoms of the condition have yet to manifest themselves. Federal law protections are insufficient, and relevant state laws vary in their scope and application. Not only are employees unevenly protected across the United States, but varying standards also make complying with the law difficult for interstate employees.
To give employees sufficient protection and to facilitate employer compliance, Congress should pass a law specifically …

Constitutional Law—Equal Protection & Due Process—Is The Arkansas Supreme Court Abandoning Judicial Federalism?, Alexander Justiss

This note examines the history of judicial federalism by discussing the history of its use, as well as the analytical models that have been produced by its various adoptive jurisdictions. The development of these models has given courts much authority in determining the scope of individual rights within their respective jurisdictions. Further, a discussion follows that explores the criticisms directed at the use of such authority.
This note also examines the Arkansas Supreme Court's adoption and use of judicial federalism as a necessary safeguard against governmental infringements on individual rights, particularly those involving the right to privacy. Although such cases …

The article examines the critical issue of institutional choice in drafting professional responsibility rules for attorneys, focusing on the implications of the Sarbanes-Oxley Act of 2002. It argues that understanding which institution—Congress, administrative agencies, federal courts, or self-regulatory bodies like the ABA—should draft these rules is essential for effective reforms. The analysis evaluates the strengths and weaknesses of each institution, emphasizing factors such as authority, expertise, and susceptibility to external influence. The article ultimately advocates for delegation to institutions with greater institutional competence, depending on the context, to ensure balanced and effective rulemaking.

Search And Seizure On Steroids: United States V. Comprehensive Drug Testing And Its Consequences For Private Information Stored On Commercial Electronic Databases, Aaron Seiji Lowenstein

The Ninth Circuit's decision in United States v. Comprehensive Drug Testing erodes Fourth Amendment protections by allowing government agents to search and seize private information from commercial electronic databases without a warrant or particularized suspicion, raising significant concerns about privacy rights in the digital age. The ruling permits the government to retain and use evidence beyond the scope of the original warrant, undermining constitutional safeguards and disproportionately impacting industries like healthcare. The decision highlights the tension between law enforcement needs and individual privacy, with the dissent warning of far-reaching consequences for personal data security.

One area where states have developed expertise is in the registration and tracking of greenhouse gas (“GHG”) emissions. Even though tracking GHG emissions has recently become a mainstream federal issue, Wisconsin has long been a leader in this area. Since 1993, Wisconsin has required any facility that emits more than 100,000 tons of carbon dioxide (“CO2”) to report its emission levels to the state Department of Natural Resources. It is the only state with such a requirement. Additionally, dozens of sources that fall well below the threshold voluntarily report their emissions, providing the state with a detailed, multi-year profile of …

The U.S. bipartisan trade compromise, concluded on May 10, 2007, was the first to create enforceable labor and environmental standards to be applied to the pending Free Trade Agreements (“FTAs”) with Peru, Panama, Colombia, and Korea. In 1994, the North American Free Trade Agreement (“NAFTA”), signed by the United States, Mexico, and Canada, broke new ground with the mention of sustainable development in its preamble. NAFTA was the first multilateral trade agreement to include environmental protection. Satellite imagery revealed that the Arctic sea ice cover fell to its lowest level in recorded history during the 2007 melting season, opening up the Northwest Passage. As the ice cover diminishes, the long sought wish of trade is becoming a reality—a shortened global shipping route through the northern waters. Polar bears depend on this same ice for their habitat, access to food, and breeding sites. Experts predict that two-thirds of the world’s polar bears will disappear by 2050.

Influence Of Stress And Dietary Natural-Source Vitamin E On Nonspecific Immunocompetence, Tissue Tocopherol Composition, And Postslaughter Fillet Oxidative Stability In Sunshine Bass, Jesse Trushenski, Christopher Kohler

We evaluated the effects of stressor exposure and super-requirement levels of RRR-atocopheryl acetate (natural-source vitamin E [NSVE]) on production performance and nonspecific immunocompetency of juvenile sunshine bass (female white bass Morone chrysops X male striped bass M. saxatilis). Stressor exposure elicited physiological changes consistent with the generalized stress response, and the magnitude of responses generally mirrored stressor severity. Stressor exposure resulted in lower fillet peroxides and greater aldehydes after short-term frozen storage, whereas increasing dietary NSVE was associated with a nonsignificant reduction in aldehydes after long-term storage. Fillet a-tocopherol content increased linearly with dietary NSVE, exceeding reported tissue levels …

Several academic and non-academic factors can influence the academic performance of National Collegiate Athletic Association (NCAA) Division I athletes. Researchers have attempted to determine what non-academic variables might help to explain the college academic performance of college athletes. The non-cognitive variables of a strong support person or role model, involvement in the community, and positive self-concept positively predicted college academic performance. If influential role models do not care how the college athlete performs academically, the college athlete’s academics will suffer.

Local government ordinances requiring the implementation of green building standards in public buildings are increasingly common. Most of these ordinances adopt the Leadership in Energy and Environmental Design (LEED) Green Rating System, promulgated by the U.S. Green Building Council (USGBC).This paper surveys local government ordinances and resolutions requiring public green building and discusses the possible variations and options available to a local government seeking to draft public green building regulations.

Law & Politics: The Case Against Judicial Review Of Direct Democracy, Corey A. Johanningmeier

This Note argues against strong judicial review of direct democracy. Judicial review has been the dominant answer in legal scholarship for the perceived danger of majoritarian tyranny in any democratic system. But Progressive movements throughout American history, as well as a growing number of respected law professors, have questioned the assumption that courts or even legislatures are better protectors of discrete and insular minorities than the rights-respecting populace. Although the vast majority of legal scholarship still displays a crippling cynicism about popular competence, this view cannot continue to block progressives from participating in initiative campaigns.
