Ennobling Direct Democracy, Sherman J. Clark Jan 2007

Ennobling Direct Democracy, Sherman J. Clark

University of Colorado Law Review

In this essay, Professor Clark argues that we should be attentive to the effect that direct democracy might have on our public character. Building upon earlier work, Clark suggests that the initiative in particular threatens to debase us by undercutting a crucial character trait which might best be called "responsibility-taking." The bulk of this essay is devoted to explaining what this means, and why it matters. Why should we care about the effect of political processes on public character? Why is this particular trait important and worth preserving? How is it threatened by direct democracy? In conclusion, and by way …

Representation And The Spatial Bias Of Direct Democracy, Daniel A. Smith Jan 2007

Representation And The Spatial Bias Of Direct Democracy, Daniel A. Smith

University of Colorado Law Review

Daniel Smith analyzes whether direct democracy favors urban and suburban voters' interests at the expense of rural voters' interests. After reviewing existing academic literature on the (sub)urban rural divide in direct democracy contests, the author performs an empirical analysis of county-level voting data on numerous recent Colorado ballot initiatives. The author concludes that there is a significant regional bias concerning popular votes on ballot initiatives, and that rural communities of interest will likely continue to be tyrannized by (sub)urban majorities in statewide ballot contests

When Good Voters Make Bad Policies: Assessing And Improving The Deliberative Quality Of Initiative Elections, John Gastil, Justin Reedy, Chris Wells Jan 2007

When Good Voters Make Bad Policies: Assessing And Improving The Deliberative Quality Of Initiative Elections, John Gastil, Justin Reedy, Chris Wells

University of Colorado Law Review

A majority of United States citizens reside in states that allow voters to directly decide questions of public policy through an initiative or referendum process. Although originally instituted as a check on elitist legislatures, the initiative process has generated its own set of electoral problems. Voters may find themselves under informed or confused about complex public policy issues, while interest groups attempt to manipulate the public with misinformation campaigns. In an examination of research findings from a 2006 statewide poll of likely voters in Washington, this article explores public perceptions, misperceptions and choices in initiative and referendum elections. The authors …

The Citizen Assembly: An Alternative To The Initiative, Kevin O'Leary Jan 2007

The Citizen Assembly: An Alternative To The Initiative, Kevin O'Leary

University of Colorado Law Review

The Citizen Assembly is a superior alternative to direct mass democracy and the initiative. Building on the ideas of James Madison and Thomas Jefferson, it is possible to combine the traditional town hall and the Internet to fashion a new understanding of representative government that bridges the enormous gap that now exists between the political elite and the average voter. The assembly reform would increase opportunities for meaningful and intelligent participation by average citizens and improve public decisions. This article explains how a national network of citizen assemblies would work.

Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon Jan 2007

Climate Change And The Poorest Nations: Further Reflections On Global Inequality, Ruth Gordon

University of Colorado Law Review

This article considers climate change from the perspective of the Third World and more particularly from the vantage point of the poorest nations in the international system. It concludes that those nations that are the most geographically and economically vulnerable will also have the least impact on mechanisms to halt the progress of this impending disaster. Hence, climate change is examined as yet another chapter in Third World powerlessness. Despite the fact that low-income nations participate in international deliberations, they do so from an exceedingly weak position that puts them in the untenable position of being on the receiving end …

Indigenous People And Environmental Justice: The Impact Of Climate Change, Rebecca Tsosie Jan 2007

Indigenous People And Environmental Justice: The Impact Of Climate Change, Rebecca Tsosie

University of Colorado Law Review

The international dialogue on climate change is currently focused on a strategy of adaptation that includes the projected removal of entire communities, if necessary. Not surprisingly, many of the geographical regions that are most vulnerable to the effects of climate change are also the traditional lands of indigenous communities. This article takes the position that the adaptation strategy will prove genocidal for many groups of indigenous people, and instead argues for recognition of an indigenous right to environmental selfdetermination, which would allow indigenous peoples to maintain their cultural and political status upon their traditional lands. In the context of climate …

Mammals And Amphibians Of Southeast Alaska, S.O. Macdonald, Joseph A. Cook Jan 2007

Mammals And Amphibians Of Southeast Alaska, S.O. Macdonald, Joseph A. Cook

Special Publications

This report continues the process of documenting the 82 species of mammals and 8 amphibians known to occur, or have recently occurred, In Southeast Alaska. Species accounts are based on a review of the literature, examination of specl mens and associated field notes at natural history museums, and a series of expeditions we conducted through 1999 through the University of Alaska Museum of the North. Our primary conclusion from this survey is that information as basic as distribution and taxonomic status is unavailable for most species of mammals and amphibians. Most species are poorly documented with 53% of mammals represented …

Bilan Et Perspectives De Recherche Sur La Sst Des Jeunes Travailleurs, Élise Ledoux, Marie Laberge Jan 2007

Bilan Et Perspectives De Recherche Sur La Sst Des Jeunes Travailleurs, Élise Ledoux, Marie Laberge

Travailleurs De La Construction Ayant Une Dorso-Lombalgie : Évaluation De L'Implantation D'Un Programme De Collaboration Précoce En Réadaptation, Marie-José Durand, Diane Berthelette, Patrick Loisel, Jocelyne Beaudet, Daniel Imbeau

Surveillance De L'Asthme Professionnel Chez Des Travailleurs Dans Des Secteurs À Risque, Denyse Gautrin, Jean-Luc Malo, Claire Infante-Rivard, Heberto Ghezzo

This scholarly project focused on advancing an athlete's community re-integration, specifically back into the sporting community. Presently, there is a gap in existing occupational therapy services for persons with amputations between the completion of inpatient rehabilitation and the return to full community re-integration, particularly for the sports competitor. This scholarly project product is a manual of sequential therapeutic activities for athletes who have the goal of returning to the occupation of sports participation. This product is intended to …

An Occupational Therapy Intervention Program Addressing The Needs Of Older Adults As They Transition To New Living Situations, Judith M. Sokol Jan 2007

An Occupational Therapy Intervention Program Addressing The Needs Of Older Adults As They Transition To New Living Situations, Judith M. Sokol

Occupational Therapy Capstones

As individuals age and approach retirement, face life changes (loss of spouse or significant others), or health changes, they often make the decision to relocate. Responses may vary; but frequently stress, depression, and anxiety are experienced to the level that they impede a healthy adjustment. This can lead to diminished self-care, difficulty engaging in meaningful occupation, and isolation. Older adults may experience a poor sense of personal mastery within their new environment, contributing to feelings of low self esteem, sadness, grief secondary to loss, anger, and loneliness.

The purpose of this scholarly project was to address the pre-relocation needs and …

Parkinson's Disease And Occupational Therapy: Evidence Based Practice, Gordon Stubbings, Tiffany Vliem

Occupational Therapy Capstones

The therapeutic benefit of occupational therapy with Parkinson's disease has not been studied in great detail. The purpose of this Scholarly Project was to provide extensive and comprehensive evidence-based information about Parkinson's disease as it applies to occupational therapists. This information was utilized to generate clinical guidelines in the form of a user-friendly manual meant for practicing OTs in treating Parkinson's disease.

An extensive literature review was performed using PubMed to determine current evidence-based practice that occupational therapists and other rehabilitation therapists were currently using. Following the review of literature, a needs assessment was completed per survey directed towards practicing …

Occupation-Based Interventions For Clients With Chemical Addiction Issues, Amanda Sylling, Alyson Wilhelmi Jan 2007

Occupation-Based Interventions For Clients With Chemical Addiction Issues, Amanda Sylling, Alyson Wilhelmi

Occupational Therapy Capstones

Based on data from an extensive literature review and survey methodology, a product was developed to assist occupational therapists (O.T. 's) in providing individualized occupation-based interventions for clients dealing with substance abuse/dependence. Although the value of occupation-based interventions focusing on occupational performance and function has been established (Law, 2002), the literature suggests that O.T.'s working in substance abuse treatment environments generally provide group-based intervention consisting primarily of preparatory activities (Rychtarik et al., 2000). Because substance abuse often becomes a primary occupation for individuals with substance abuse issues (Stoffel & Moyers, 2004), it is imperative that O.T.'s address and support healthy …

Quality Of Life Occupational Therapy Measurement Tool For Patients With Lymphedema/Chronic Venous Edema, Marsha Waind Jan 2007

Quality Of Life Occupational Therapy Measurement Tool For Patients With Lymphedema/Chronic Venous Edema, Marsha Waind

Occupational Therapy Capstones

The objective of this project was the development of a tool in the form of a patient questionnaire to be used by Occupational Therapists (OT) treating patients with lymphedema/chronic venous edema. This questionnaire was designed to identify life factors beyond limb volume reduction and activity independence that correlate with the patients' perceptions of an improved quality of life, therefore promoting Health Related Quality of Life (HRQoL).

Literature reviewed supported the premise that attainment of the typical OT goals of activity completion will not accomplish the desired result of lymphedema treatment, nor will lymphedema goal attainment of reduced limb measures achieve …

Self-Consistent Analyses For Potential Conduction Block In Nerves By An Ultrashort High-Intensity Electric Pulse, R. P. Joshi, A. Mishra, Q. Hu, K. H. Schoenbach, A. Pakhomov Jan 2007

Self-Consistent Analyses For Potential Conduction Block In Nerves By An Ultrashort High-Intensity Electric Pulse, R. P. Joshi, A. Mishra, Q. Hu, K. H. Schoenbach, A. Pakhomov

Bioelectrics Publications

Simulation studies are presented that probe the possibility of using high-field (>100kV ∕ cm), short-duration (∼50ns) electrical pulses for nonthermal and reversible cessation of biological electrical signaling pathways. This would have obvious applications in neurophysiology, clinical research, neuromuscular stimulation therapies, and even nonlethal bioweapons development. The concept is based on the creation of a sufficiently high density of pores on the nerve membrane by an electric pulse. This modulates membrane conductance and presents an effective "electrical short" to an incident voltage wave traveling across a nerve. Net blocking of action potential propagation can then result. A continuum approach based …
