Federal and state governments in the United States use income and payroll taxes as their primary tools to collect revenue. In the rest of the world, governments also use income and payroll taxes, but rely much more heavily than does the United States on taxing consumption. Consumption taxes take many forms, including general sales taxes, value-added taxes, and excise taxes on the consumption of specific items including gasoline, alcohol, tobacco products, firearms, air travel, telephone communication, and others. A Gambling Paradox: Why An Origin-Neutral 'Zero-Quota' Is Not A Quota Under Gats Article Xvi, Donald H. Regan

In US-Gambling, the Appellate Body held that an origin-neutral prohibition on remote gambling (which is how they mostly viewed the United States law) was "in effect" a "zero-quota", and that such a "zero-quota" violated GATS Article XVI:2. That holding has been widely criticized, especially for what critics refer to as the Appellate Body's "effects test". This article argues that the Appellate Body's "in effect" analysis is not an "effects test" and is not the real problem. The real mistake is regarding a so-called "zero-quota" as a quota under Article XVI. That is inconsistent with the ordinary meaning of the word …

Overdraft fees now make up more than half of banks' earnings on consumer checking accounts. In the past century, overdrafts have gone from the banker's scourge to the banker's profit center as bankers have learned that there is much to be made on these short term loans at breathtaking interest rates. I note that the federal agencies have been complicit in the growth of this form of lending. I propose that the banks and the agencies recognize the reality and attempt to mitigate these rates by encouraging the development of a competitive market.

Part I of this Article describe s Pope John Paul II’s teaching on capital punishment as based on the Scriptures and expressed in Evangelium Vitae and the Catechism. Part II examines the authority with which this doctrine was issued. Part III suggests that this teaching represents the “traditional teaching of the Church,” although a “more perfect expression” of that teaching than has heretofore been recognized. Part I introduces the central themes in the law of federal question jurisdiction. It describes the prevailing interpretations of the constitutional and statutory texts governing the federal courts' jurisdiction to adjudicate disputes involving questions of federal law, and it explores the reasons for the establishment of such jurisdiction. This Part also introduces the well-pleaded complaint rule and examines the reasons for its adoption by the Supreme Court. Feminist Film And The Dilemma Of Killing Us Softly, Joanne Morreale

This essay traces the trajectory of Killing Us Softly, the classic feminist film critique of images of women in advertising. All four versions of the film from 1979 to 2001 provide insight into the social/historical context of the women's movement and its influence on advertising while simultaneously illustrating the influence of advertising on feminist discourse. As the original 1979 film is transformed in 1987, 2000, and 2001, this article analyzes its formal and strategic shifts in order to assess how feminist pedagogical films can best serve as tools for achieving social and political change.

While the new requirements of the Sarbanes-Oxley Act might seem like an excellent step towards improving the honesty, integrity, and reputation of the corporate accounting world, the actual implementation of these regulations is proving to be quite a headache for public companies and their auditors. Over the last 50 years, the United States has been pouring money into foreign aid, yet this aid has failed to bring the poor out of poverty. Micro finance institutions claim to they are able to increase the wealth of the poor. This paper will compare micro finance's ability to alleviate poverty against traditional uses of foreign aid. The results of this paper are while the profitability of micro finance is not clear, independent studies indicate that it has been successful in bringing the poor out of poverty. The Private Rates Of Return To Undergraduate Education By Major, Nick Johnson

The private returns to undergraduate education are important to understand for high school graduates trying to decide between the work force and college. The IRR method is the best measure of the private returns to education because it allows for important variables to be accounted for and includes the time value of money. Using data from the National Longitudinal Study of 1972, there are large differences in the returns to college by major. This model allows the returns to college to vary by college selectivity and, through ability, within an individual major.

End Natural Life Sentences For Juveniles, Jeffrey A. Fagan

In 2005, the U.S. Supreme Court in Roper v. Simmons (125 S. Ct. 1183) banned executions of persons who commit capital murder before they reach age 18. Roper overturned death sentences for 72 people in 18 states (Streib, 2005). Most (but not all) were resentenced to natural life or life in prison without the possibility of parole (or JLWOP). Juvenile justice advocates now want to extend Roper’s maturity heuristic, proportionality analysis, aversion to errors, and deference to international laws and norms to argue for a constitutional ban on natural life sentences for adolescent offenders.
