The Influence Of Refugee Status On Palestinian Identity And The Impact Of Identity On Durable Solutions To The Refugee Problem, Michaela S. Clemens
The Influence Of Refugee Status On Palestinian Identity And The Impact Of Identity On Durable Solutions To The Refugee Problem, Michaela S. Clemens
Nebraska Anthropologist
Over the last fifty years the Israeli-Palestinian conflict has generated massive numbers of refugees. The scale and longevity of the conflict has made the Palestinian refugee problem the most protracted and largest refugee situation in the world today (Merhab et al. 2006). The processes of becoming a refugee and living as a refugee have had direct impacts on the formation of Palestinian identity. In this paper, I examine the influence of refugee status on identity and discuss how this identity affects potential solutions to the protracted refugee situation. I offer a brief historical background to the creation of Palestinian refugees. …
Overcoming The United States' Policy On The Exclusion Of Hivpositive Noncitizens: How Asylum Cases Are Beginning To Open Previously Locked Doors, Amy Vaughn
Nebraska Anthropologist
In 1987, the United States Congress enacted a policy that prohibited HIV-positive noncitizens from entering the United States for both temporary visits and immigration. Nearly two decades later, the policy still stands, making the United States one of only a handful of countries that still enforces such an exclusionary policy. Several international health organizations, including the World Health Organization, have condemned the HIV ban as "irrational and without public health justification" (Goldberg 1998). In 1993, the U.S. Department of Health and Human Services attempted to remove HIV from the exclusion list based on the fact that it is not transmitted …

Mastery Learning And The Essentials Of Critical Care Orientation : A Heuristic Participant Evaluation, Mitchell J. Seal
University of the Pacific Theses and Dissertations
This study employed a heuristic -participant evaluation of the instruction of the web-based Essentials of Critical Care Orientation (ECCO) program using two research questions: (1) How well does the ECCO adhere to Bloom's theory of mastery learning and instruction; and (2) What effect, if any, does this have on the participant RN? Evaluation findings demonstrated that the ECCO is 66 hours of expository instruction with little to no meaningful feedback, correction, or enrichment activity, is not well aligned, and has significant design flaws related to objectives and transfer of instruction and to the processes of instruction. This results in the …

Applicability Of Borman Decision Tree Its Management Tool To Other Expressway Systems, Ahmed S. Soliman, Robert Bertram Jacko, Barry K. Partridge
JTRP Technical Reports
An empirical model called the Traffic Air Quality Model (TAQ) was developed from meteorological and PM2.5 measurements adjacent to the Borman Expressway in Northwest Indiana to estimate PM2.5 road emissions. It concluded that on average a 74% improvement in air quality is expected (based on reduction of mass emitted per mile [g/mi]) when the average Borman speed range is improved from < 30 mph to >50 mph. An additional 39% (on average) improvement in the PM_2.5 emissions on the Borman Expressway was found when traffic flow speeds increased from 55 mi/h to 75 mi/h. The TAQ model was found to perform well when tested …

Grounded Theory : Latino Mental Health Providers' Perceptions Of The Mental Health Beliefs Of Latino Clients, Marcelle Santiago-Serrano
PCOM Psychology Dissertations
This study explores the mental health beliefs of Latinos through the eyes of Latino Mental Health Providers. Many Latinos have a view of psychologists as a "healer." This view was explored relative to that of the cognitive behavioral approach, which has a strong emphasis on its self-help approach to therapy. In addition to its self-help qualities, Cognitive Behavioral Therapy (CBT) is recognized for its effectiveness in the mental health treatment of diverse ethnic/cultural populations. However, the CBT philosophy may seem at times, to be contradictory to many Latinos' beliefs that the therapist's role is as a "healer." A five item …

The article begins by situating offshore outsourcing in the framework of relationships created in the context of delivery of legal services. This framework is used, in turn, to construct a structure of analysis for the ethical implications of offshore outsourcing. Lawyers who outsource to offshore …

Empathy And Cognitive Flexibility As Correlates Of Forgiveness, Rebecca Bennett Katovsich
Dissertations
Problem. For the past three decades, there has been a growing body of literature related to the topic of forgiveness. The idea that empathy, consisting of both emotional and cognitive aspects, plays an integral role in the process of forgiveness is widely supported in the literature, although there is limited empirical evidence for this claim. Beyond interest in examining the relationship between forgiveness and empathy, this research also aimed to explore the role of cognitive flexibility in the forgivenessprocess, considering both the intrapersonal and interpersonal dimensions of cognitive flexibility.
Method. The Enright Forgiveness Inventory, Interpersonal Reactivity Index, and the NEO …

Governing Catastrophes: Security, Health And Humanitarian Assistance, David P. Fidler
Articles by Maurer Faculty
Recent catastrophes, and predictions of an increasing potential for more, have stimulated thinking about the best policy responses to these threats. This article explores how security concepts influence catastrophe governance. The article considers how globalization affects thinking about catastrophes and describes ways in which catastrophes have been conceptualized as governance challenges, such as the human rights approach to the provision of health and humanitarian assistance. The article explains how health and humanitarian assistance experienced ‘‘securitization’’ in the post-cold war period, a development that challenges rights-based strategies and creates complex and controversial implications for the prevention, protection and response functions of …

The Psychology Of Motivation In Sport, Nicholas Salomone
The Psychology Of Motivation In Sport, Nicholas Salomone
Whittier Scholars Program
The purpose of this paper is to give a general overview of motivation theory in sport psychology. Beginning with self-confidence in sport, the basic models will be presented, showing how each built upon the last to create a more and more comprehensive and reliable structure for the measurement and evaluation of motivational style. From there, the models of causal attribution, which have evolved from Heider’s 1958 unidimensional structure to Weiner’s revised multidimensional models, will be covered. Nicholls’ (1984) goal perspective theory will then be discussed with emphasis on types of goal orientation and their positive and negative connotations. The self-determination …

Special Issues Raised By Rape Trials, Aviva A. Orenstein
Articles by Maurer Faculty
Rape cases reveal core conflicts in the space where evidence, law, and ethics intersect. Such conflicts include the tension between victim protection and the rights of the accused, the challenges attorneys face trying to negotiate the demands of sensitive and emotionally difficult cases, and the role of the law in counteracting stereotypes and bias.
In this essay, I will begin by presenting the cultural milieu surrounding rape allegations, briefly reviewing attitudes towards perpetrators and victims. Next, I will attempt to capture the legal zeitgeist concerning rape, focusing on two recent phenomena: the reversal of false rape convictions based on DNA …

Analyzing The Friedman Thesis Through A Legal Lens: Book Review Essay Assessing Thomas L. Friedman's The World Is Flat, Jayanth K. Krishnan
Articles by Maurer Faculty
In his best-selling book, The World Is Flat, Thomas Friedman assesses how globalization has affected the political, economic, and social landscapes of both the developed and developing world. For Friedman, globalization is emboldening people in countries, like in India, to make societal and governmental demands that are similar to those made by Americans in the United States.
This Essay seeks to add a new layer to the debate over Friedman’s flattening-world thesis. Focusing on India, in particular, I shall argue that as the trajectory of India’s economic development appears on the rise, the sad reality is that …

Scholarly Discourse, Public Perceptions, And The Cementing Of Norms: The Case Of The Indian Supreme Court And A Plea For Research, Jayanth K. Krishnan
Articles by Maurer Faculty
For economic and nuclear reasons, India has received considerable attention over the last decade from observers in the United States. But attuned Americans are well-aware of India's rich culture and status as a shining constitutional democracy for most of its post-1947 independent history. For all that India has accomplished, however, its public has long viewed its government officials with great disdain. At the same time, a fascinating norm exists in this society which holds one institution in exceedingly high regard - the Indian Supreme Court.
In this article, I seek to examine what accounts for this counter-intuitive norm. As opposed …
