No Chance To Prove Themselves: The Rights Of Mentally Disabled Parents Under The Americans With Disabilities Act And State Law, Dale Margolin Cecka

This article explores the relationship between state child welfare laws that terminate parental rights and the federal Americans with Disabilities Act (ADA). The article begins by analyzing the application of the ADA to termination of parental rights proceedings against parents with mental disabilities. It then surveys state child welfare laws, focusing on the treatment of parents under New York State law. The article concludes by advocating for a change to reflect the principles of the ADA in state laws and in practice.

Questioning The Per Se Standard In Cases Of Concerted Monopsony, Alan Devlin

Instances in which purchasers collude to depress price raise complex enforcement issues if one adheres literally to the widely accepted consumer welfare standard in antitrust analysis. One might imagine that reduced input costs above will translate into lower prices below. However, in-depth economic analysis reveals a counter-intuitive insight: the reduction in price upstream may lead to an inefficient supply-side substitution in production, resulting in higher levels of marginal cost and, hence, downstream prices. Whether downstream harm to consumers ultimately transpires depends on a host of variables including the price elasticity of demand facing sellers in the downstream market, the upstream …

The management of speech impairment of unknown origin in children requires SLPs to make important clinical decisions around assessment, analysis, diagnosis and intervention. Ideally, clinicians should be guided in their decision making by evidence. Over thirty years ago, this was a relatively straightforward task. Most children’s speech problems were assessed, analysed and treated from an articulation perspective. Since the paradigm shift from articulation to phonology, clinical decision making has become more challenging. This challenge is in part due to the increase in possible approaches. [H]igh recidivism rates shows that the threat of jail time alone is not sufficient to curb sex crimes. With this in mind, legislators sought to find other ways that would protect potential victims. Community notification laws were the first policy to be implemented. Community notification methods included press releases, flyers, phone calls, door-to-door contact, neighborhood meetings, and Internet sites, which informed citizens of the name, location, and/or other information of persons who had been convicted of sex crimes.

Communication among managers, the public, and scientists is the key to successful ecosystem management; however, the varied perspectives and interests of these groups can make such communication difficult. One way to achieve effective communication is to develop a common knowledge base by combining syntheses of key scientific results with information-rich visual elements. Within a management landscape, integrated environmental assessments provide a useful framework for evaluating resources and directing management efforts. The integrated assessment process involves (1) initial investigation, (2) development of a conceptual framework, (3) data navigation, (4) environmental report cards, and (5) science communication. Contemporary deficit reduction and fiscal responsibility are central to the economic wellbeing of future generations as well as their ability to freely decide their own policy priorities. Many scholarly publications and popular commentary on budget policy describe the obstacles to deficit reduction and political leaders' unwillingness to address the nation's long-term fiscal problems. However, current discussions of budget deficits and the national debt have not been informed by a comprehensive empirical analysis of attempts to reduce the deficit. This paper examines the current law and urges the greater regulation of the post-mortem human tissue industry. Part II illustrates the many post-mortem uses of the human body. Part III describes several post-mortem misuses and abuses of donor cadavers, organs and tissue resulting from a gap in current regulation. Part IV lays out the entities involved in the oversight of the tissue banking industry and explains the current state of regulation, including pending legislation and its potential effectiveness in addressing past shortcomings.
