This Essay, which was written for the Ohio State Law Journal's symposium on Election Law and the Roberts Court, examines the Court's decision in League of United Latin American Citizens (LULAC) v. Perry. The Essay explores two ways of reading LULAC: first as a racial representation case and second as a case concerned with representation itself. The essay argues that politics not race is the majority's worry in LULAC and that the case is the first application of Justice Kennedy's representation rights concept first introduced in Vieth.

The purpose of this experimental study was to determine which of three methods of vocabulary instruction, including the common approach method, a combination of the common approach method and keyword method, and a combination of the common approach method and the keyword/illustration method of instruction was most effective in teaching mathematics vocabulary over the course of two mathematical units. Grade eight students (N=60) from two rural middle schools who scored at the basic level on the 2006 Maryland School Assessment (MSA) in mathematics and reading participated in this experimental study. This dissertation comprises a series of studies that use sedimentary records combined with regional geophysics to explore and expand our understanding of the central Arctic Ocean throughout the Cenozoic. Recovered from the Lomonosov Ridge during the Integrated Ocean Drilling Program Expedition 302 (Arctic Coring Expedition; ACEX), the sediment cores provide the only long term marine geologic record from the central Arctic Ocean and offer the first means for integrating and reinterpreting over 30 years of predominantly geophysical data collection. Results from a stress history analysis reveal that there is no evidence for largescale erosional events in the sediments from the …

This paper provides a critical examination of the dynamic connection between archaeological research and programs of political and religious agendas in Israel and Palestine. This examination contributes to recent discipline-wide discussions concerning the powerful impact of archaeological research in areas of political and religious turmoil. The first section of this paper notes the absence of an Islamic counterpart to Biblical archaeology. While there is no archaeology that attempts to prove literal interpretations of the Qur'an, the rather complex archaeology advanced by Albert Glock (1984; 1994; 1995) serves to meet the needs of marginalized Palestinian villagers. The purpose of this study was to examine the relationship between religious dogmatism and support for civil liberties of atheists and homosexuals. Utilizing data from the 2002 GSS, the assertions of the theory of religious dogmatism (Jelen & Wilcox 1990) were tested by utilizing three increasing measure of religiosity: religious preference, church attendance, and Biblical perception in predicting support for atheist and homosexual civil liberties. The results support the notion of religious dogmatism as influencing acceptance of nonconformist civil liberties, with Biblical perception being the most potent predictor. The military occupation of Nicaragua was one of the Calvin Coolidge administration’s most unpopular foreign policies. Upon the death of President Warren G. Harding in 1923, Coolidge inherited the White House and a Nicaraguan withdrawal plan set up years earlier. As planned, the United States monitored the Nicaraguan national elections in 1924, and withdrew its occupation force in 1925. When the country collapsed into civil war a few months later, the Coolidge administration ordered the Marines back into Nicaragua to restore order. Coolidge and his Secretary of State, Frank B. Diel (24-hour) cycling of dissolved ions has been linked to various mechanisms such as fluctuations in temperature and photosynthetically-mediated pH. Yttrium and the rare earth elements (YREE) appear to fluctuate in response to temperature. After selecting a field site based on pH and temperature screening, five sampling events were undertaken: each involved hourly or bihourly sampling with concurrent stage, pH and temperature logging. For all events, YREE increased during the nighttime and decreased during the daytime. Dissolved Fe and Mn exhibited similar trends at one of the two sampled locations. Speciation models suggest that sulfate and carbonate-bound YREE species dominate …

The purpose of this qualitative research study (Yin, 2003) was to understand National Heritage Areas (NHA) evolution as interorganizational domains and to explore the role of the National Park Service (NPS) as a NHA federal partner. Information gained from literature reviews of the management sciences and partnership theory led to the development of an a priori model of the evolutionary stages of NHAs? interorganizational domain development. An emergent model was then elaborated and specified using data from case study analysis (Yin) of the developmental histories of five NHAs. The objective of this dissertation is two fold. Firstly, the dissertation tests how well econometric and spatial analysis can be integrated for conducting industrial cluster analysis. Based on input-output and spatial autocorrelation based multivariate techniques, the dissertation develops a methodological approach for detecting spatially and economically linked industries. The dissertation then operationalizes this methodololigcal framework and applies tit to identify clusters in the U.S. at different geographical scales. Multiple sclerosis (MS) is a progressive disorder of the central nervous system producing a varied range of symptoms affecting physical, cognitive, and sensory functioning. The variability and unpredictability of impairments, their duration and intensity on a day to day basis, and ongoing health impacts present formidable challenges to securing and maintaining employment. Research suggests, despite having recent and extensive work histories, as many as 70-80 percent of individuals with MS are unemployed after diagnosis. This dissertation examines the coupling of GIS and immersive visualization (IV). This study was premised on the hypothesis that linking IV and GIS could potentially enhance a user’s visual-cognitive capacity to perceive, analyze, and understand complex geospatial data. A loosely-coupled GIS-IV system was developed and subsequently tested by professional soil scientists in soil boundary mapping and soil map update case studies. Soil boundary mapping is essentially a visualization enterprise involving the creation of cognitive models representing the relationship between soil and observable environmental features. This study focuses on the conflict that emerged in the 1930s and 1940s between the British colonial government officials and the African farmers in Vihiga, Western Kenya, over approaches to land management. The colonial state was more than convinced that unprecedented soil erosion in most of the African reserves across the Colony was to blame for much of the social and economic problems that those areas were experiencing. Because tobacco smoking causes 430,000 U.S. deaths annually, wide-reaching smoking bans are needed. Bans reduce cigarette consumption, encourage cessation, protect nonsmokers from second-hand smoke, and promote an attitude that smoking is undesirable. Therefore, bans may prevent future generations from suffering many smoking-related health problems. The federal government has not implemented widereaching smoking bans so it falls on individual states, counties, or communities to devise appropriate smoking policy. To date, smoking policy has been determined by legislators, who may have conflicts that prevent them from acting in the publics best interest. Comparative Ecology Of The Golden-Winged Warbler And Blue-Winged Warbler On Reclaimed Mines In Southeastern Kentucky, Laura L. Patton

The golden-winged warbler (Vermivora chrysoptera) inhabits lower elevations on reclaimed surface mines in Kentucky, an indication of recent range expansion in this imperiled species. In 2004 and 2005, I compared breeding habitat between the golden-winged warbler and blue-winged warbler (V. pinus) in eastern Kentucky at landscape, territory, and nest site scales. Distance to forest edge averaged 38 m for the golden-winged warbler and 33 m for the blue-winged warbler. Maximum territory size averaged 1.5 ha for the golden-winged warbler and 2.1 ha for the blue-winged warbler. Environmental regulatory policy in the U.S. is a mixture of federal, state, and local activity and impacts. This is true of air quality regulations, which are governed at the federal level by the Clean Air Act. This dissertation analyzes both the political economy of federal environmental regulations and the empirical effects of ozone regulations under the Clean Air Act.A political economy model is developed that offers a motivation for political support of national environmental policy that regulates strictly local pollution. Are the U.S. capital markets losing their competitiveness? A fascinating question, but what does it mean and how can it be intelligently assessed? This Article will explore the newly popular thesis that draconian enforcement and overregulation are injuring the United States and will offer a sharply contrasting interpretation: higher enforcement intensity gives the U.S. economy a lower cost of capital and higher securities valuations. This higher intensity attracts some foreign listings, but deters others.

The Soil and Water Assessment Tool (SWAT) is a process-based, watershed-scale model with a hydrologic response unit (HRU) as the basic computation element, which makes it difficult to accurately represent riparian buffers using their physical parameters (e.g., vegetation structure). On the other hand, the field-scale Riparian Ecosystem Management Model (REMM) provides the opportunity to consider details of hydrologic processes within a riparian buffer zone. In the decades following its publication in 1922, T.S. Eliot's Waste Land has become an epitome of the modernist sensibility and situation. This thesis challenges the poem's dominance and dictate over the canon of modernist poetry persisting in the academic discourse and general cultural awareness. Focusing on two post-WWII sequences by Eliot's younger contemporaries, David Jones' s Anathemata (1952) and Basil Bunting's Briggflatts (1966), this study explores alternative models and inspirative sources of the modernist poetic sequence.
