Generalized Grievances And Judicial Discretion, Mark Gabel

UC Law Journal

Few scholars have questioned the common assumption that the generalized grievances doctrine is simply a prohibition on obtaining federal court standing based on one's status as a taxpayer or a citizen. This Note attempts to show that the current doctrine is actually somewhat broader than that, although the Supreme Court has refused to define its outer limits precisely.

This Note traces the history of the generalized grievances principle from its origins in the 1920s to today, arguing that the concept was not originally intended to be a stand-alone limitation on federal court standing. Rather, it was simply a facet of …

The conversion of farmland near cities to other human uses is a global trend that challenges our long-term capacity to provide food, fiber, and ecosystem services to a growing world population. If current trends continue in the United States, the population will reach 450 million by the year 2050. At the same time, an accelerating change in land use will reduce today’s two acres per person of farmland to less than one acre per person. This is scarcely enough to produce food for our domestic population, without any food available for export – even assuming advances in technology. We need …

To date, the use of mitochondrial DNA in forensic analysis has relied on the presence of variations in the control region to differentiate between samples. One problem that this analysis has shown is the occurrence of common Haplogroup H haplotypes or identical sequences. Thus, there is a need to enhance the distinguishing power of this type of analysis. One option has been to investigate the mitochondrial coding region for polymorphisms that could differentiate between samples with identical control region haplotypes. Wetlands of the Prairie Pothole Region exist in a matrix of grassland dominated by intensive pastoral and cultivation agriculture. Recent conservation management has emphasized the conversion of cultivated farmland and degraded pastures to intact grassland to improve upland nesting habitat. The consequences of changes in land-use cover that alter watershed processes have not been evaluated relative to their effect on the water budgets and vegetation dynamics of associated wetlands. We simulated the effect of upland agricultural practices on the water budget and vegetation of a semipermanent prairie wetland by modifying a previously published mathematical model (WETSIM). This article describes the mediated American Sing Language (ASL) presentation of technical vocabulary and definitions within the context of a web-based astronomy course for first year students at the National Technical Institute for the Deaf at Rochester Institute of Technology (Rochester, NY). Deaf students showed achievement gains with fewer astronomy misconceptions. Also, student ratings of instructor ASL skill, as reported on the student rating system, were higher after students used the ASL vocabulary videos.

Poverty, Gender, and Youth

Using data from the 2004 National Survey of Adolescents conducted in Burkina Faso, Ghana, Malawi, and Uganda, this Population Council working paper investigates the timing of two key transitions in adolescence—school exit and premarital sex—among those who remain enrolled in school at the beginning of adolescence (age 12). Girls appear more vulnerable to dropout once they become sexually mature and once they engage in premarital sex. While girls were found to be less likely than boys, at any given age and controlling for other covariates, to have had premarital sex (except in Ghana), school enrollment and the timing of school …

Laboratory Evaluation Of Dunaliella Tertiolecta As A Candidate Algal Species For Tertiary Wastewater Treatment Of Nitrogen And Phosphorus-Laden Effluents Impacting Marine Environments, Ashley Juanika Belle

Dunaliella tertiolecta was evaluated to determine the effectiveness of utilizing the algal species to reduce the nutrient load of saline wastewater during tertiary treatment. Nutrient uptake studies performed using f/2-Si medium illustrated that Dunaliella tertiolecta favored phosphate uptake over nitrate-nitrogen. Over a 7-day observational period, total phosphorus concentration was reduced by over 97% and the kinetic rate of uptake observed was approximately 0.5 - 1 mg/L/day. Daily nitrate-nitrogen concentrations were highly variable and a model could not be determined to predict uptake behavior. In heavily concentrated nutrient loads, the algae still favored phosphate uptake. However as the nutrient load increased …

High Frequency Measurements Of Soil Carbon Dioxide Flux At Harvard Forest, Stephen C. Phillips

Soil carbon dioxide flux was measured by automatic chambers at Harvard Forest over a four-year period, 2003-2006. The autochambers were installed along a moisture gradient from upland to wetland soils. In 2003, fluxes from the upland and mid-slope chambers exceeded the fluxes from the wetland margin. In 2004-2006, the mid-slope fluxes were significantly larger than both the upland and wetland margin chambers. The differences in flux between chamber location were most pronounced in the late summer and early fall. Residuals from a non-linear temperature regression exhibit a distinct seasonal pattern in 2003, 2004, and 2006, but not in 2005. On …

The disaster in New Orleans due to Hurricane Katrina showcased the city's many environmental problems. The industrial history of the city, subsidence of the city causing it to be below sea-level, and the fact that the city is protected by levees and pumps were critical elements of the disaster and played a large role in the emergency response. The disaster led to an enormous emergency response by many entities, but the Federal Emergency Management Agency (FEMA) has the lead in these actions. Restoration efforts within the coastal zone of southern Louisiana have assumed greater importance in the wake of recent storms and ever increasing sea level rise. A poorly studied geomorphic structure known as the Caminada-Moreau maritime beach ridge complex exists along the southeastern Louisiana coastline between Grand Isle and the Port of Fourchon. Active subsidence in the area has reduced the overall elevation of these structures, decreasing the live cover of its most noticeable feature, stands of Quercus virginiana (live oak), along the ridge spines.
