This Article first discusses the advent of technology like Brain Fingerprinting and its kin, and their impact on cognitive autonomy. The Article then posits the question, what would the Constitution have to say about evidentiary inquiries into the mind through the use of such technology? The author argues that current Fourth Amendment jurisprudence, including Katz v. United States, is inadequate to address such …

Of Elephants And Embryos: A Proposed Framework For Legal Personhood, Jessica Berg

UC Law Journal

What is a person? What responsibilities or obligations do we have to entities that we recognize as persons under the law? These are not simply theoretical questions. Questions of legal personhood have already faced courts and legislatures and are likely to become more relevant as technology advances.

Legal personhood has largely been ignored outside of the corporate context. Yet there is a pressing need to answer the question of what constitutes a person. This Article's focus is on legal status and the ways in which the law should recognize rights and interests of certain entities.

There are two bases for …

The Health Insurance Debate In Canada: Lessons For The United States?, Mary Anne Bobinski Jan 2007

The Health Insurance Debate In Canada: Lessons For The United States?, Mary Anne Bobinski

Faculty Articles

This Essay begins with an intentionally ambiguous title. Are comparisons to Canada relevant and useful for policy-makers in the United States and, if so, what lessons can we learn? Part II of this Essay highlights some of the risks and benefits of cross-border comparisons between the United States and Canada. In Part III, I analyze some of the key data points often cited in comparing the two health care systems. Part IV explores the current Canadian debate about private health insurance. Finally, in Part V, I focus on the lessons from Canada for the health insurance debate in the United …

A Constitutional Significance For Precedent: Originalism, Stare Decisis, And Property Rights, Polly J. Price Jan 2007

A Constitutional Significance For Precedent: Originalism, Stare Decisis, And Property Rights, Polly J. Price

Faculty Articles

The discussions in this Article proceed as follows. Part I briefly introduces several areas of contemporary debate for which this inquiry is relevant. In Part II, I examine previous scholarly evaluations of the doctrine of precedent in the formative period. I provide an alternative explanation for the adoption by American courts of rhetoric favoring stare decisis, one that links the rhetoric used by these courts with the predominant property discourse of the Founding period and with the Marshall Court’s subsequent emphasis on vested rights and the Contracts Clause. I suggest that the stare decisis property rule gained widespread acceptance as …

Final Frictives*-S And *-H In Proto T'In Lexicon, Theraphan L-Thongkum Jan 2007

Final Frictives*-S And *-H In Proto T'In Lexicon, Theraphan L-Thongkum

Manusya, Journal of Humanities

Final /-s/ does not exist in modern T ʾ in; however, *-s in Proto-T ʾ in can be reconstructed. The distinction between *-s and *-h in Proto-T ʾ in phonology is suggested by two types of final correspondences, i.e., *-s has become /-yh/ in Mal but /-t/ in Pray, and *-h has been kept as /-h/ in both Mal and Pray. This fact was pointed out by Filbeck in 1978; however, no Proto-T ʾ in forms were reconstructed by him. To show a clearer picture of the phonological history of T ʾ in, 68 Proto-T ʾ in forms were reconstructed, …

We studied the needs of incoming students because we wanted to find out how they can more effectively acclimate to CSUMB's unique culture. Our goal was to produce an addition to the current CSUMB website containing information that we and other students found lacking to our acclimation to CSUMB. We also applied for a capstone grant to try and make a booklet to distribute the information in more than one media. We did not get the grant and all our information is being presented in the form of a website. We used the information provided by the CSUMB Prospective Student …

Assessing Baxi’S Thesis On The Emergence Of A Trade-Related Market-Friendly Human Rights Paradigm: Recent Evidence From Nigerian Labour-Led Struggles, Obiora Chinedu Okafor

Articles & Book Chapters

The objective of the article is to assess some of the sub-claims that emerge from Baxi’s thesis on an emergent trade-related market-friendly human rights paradigm in the light of the available evidence regarding the intense contestations and confrontations that have occurred between Nigeria’s politically and economically transitional Obasanjo regime and a local labour-led coalition. The piece sets out to ascertain the contextual and localised validity of these ‘Baxian’ sub-claims, within the wider context of the government vs. labour confrontations in Nigeria during the neo-liberal socio-economic reforms undertaken in that country between 1999 and 2005.
