Modeling The Eu-Us Cereal Trade - The Post 'Agenda 2000' Analysis, Sachin Chintawar Jan 2007

Modeling The Eu-Us Cereal Trade - The Post 'Agenda 2000' Analysis, Sachin Chintawar

LSU Master's Theses

Significant changes in attitudes toward farm policy and trade have occurred within the European Union and the United States in the past decade. Trade negotiations under the General Agreement on Tariff and Trade (GATT) specifically the Agreement on Agriculture (AoA) and later under the Doha Round of the World Trade Organization (WTO) have bought about considerable changes in the market structure in the cereals trade. Bilateral trade has further been impacted by the cessation of concession treaties like the Blair House Accord that expired at the end of the 2004 marketing year (WTO). Domestic budget pressures in the United States …

I Met You, Momoko Kimura Jan 2007

I Met You, Momoko Kimura

The I MET YOU piece provided the perfect opportunity for me to pull together all my thoughts and tell people who have made difference in my life “I’m so glad I met you.” I …

The Search Interest In Contract, Joshua Fairfield Jan 2007

The Search Interest In Contract, Joshua Fairfield

Articles by Maurer Faculty

Parties often do not negotiate for contract terms. Instead, parties search for the products, terms, and contractual counterparties they desire. The traditional negotiation-centered view of contract leads courts to try to determine the meaning of the parties where no meaning was negotiated and to waste time determining the benefits of bargains that were never struck. Further, while courts have ample tools to validate specifically negotiated contract terms, they lack the tools to respond to searched-for terms. Although the law and literature have long recognized that there is a disconnect between the legal fictions of negotiation and the reality of contracting …

Evidentiary Wisdom And Blinders In Perspective: Thoughts On Misjudging, Elaine W. Shoben Jan 2007

Evidentiary Wisdom And Blinders In Perspective: Thoughts On Misjudging, Elaine W. Shoben

Scholarly Works

Empirical studies serve to enlighten the law, even when they simply confirm the wisdom of existing rules. Chris Guthrie's article, Misjudging, primarily serves that useful function—confirming the wisdom of existing rules—even though the author sought to establish something different. Guthrie's article applies insights from cognitive psychology to the resolution of legal disputes and presents some empirical proof of the effect of the application. He concludes that three sets of “blinders”—informational, cognitive, and attitudinal—affect the ability of judges to reach correct resolutions of disputes. He therefore recommends further appreciation of the ability of arbitration and mediation to avoid some of the …

Toward A History Of Children As Witnesses, David S. Tanenhaus, William Bush Jan 2007

Toward A History Of Children As Witnesses, David S. Tanenhaus, William Bush

Scholarly Works

This brief essay offers a selective overview of recent trends in the historical scholarship on American childhood from the origins of the American Revolution to the early years of the Cold War. This overview of the literature has two purposes. First, it highlights recent socio-cultural scholarship that presents substantive challenges to the conventional ways of understanding the history of children and the law. Second, in so doing, it points out that legal histories concerned solely with doctrinal matters can, and often do, present a limited and distorted window into the past. Instead, the essay argues that the place of children, …

Characterization Of Polyethylene Glycol Hydrogels For Biomedical Applications, Anushree Datta Jan 2007

Characterization Of Polyethylene Glycol Hydrogels For Biomedical Applications, Anushree Datta

Synaptic Boojums: Lewis Carroll, Linguistic Nonsense, And Cyberpunk, Jennifer Kelso Farrell Jan 2007

Synaptic Boojums: Lewis Carroll, Linguistic Nonsense, And Cyberpunk, Jennifer Kelso Farrell

LSU Doctoral Dissertations

Tracing a line from Lewis Carroll to 20th-century science fiction and cyberpunk, this project establishes an alternate genealogy based on the use of linguistic nonsense. Science fiction, rather than being merely a genre defined by specific narrative devices or character traits, is instead a language in and of itself. And like any language, it must be learned in order to be understood. Carroll used nonsense as a means of subverting conventional 19th-century opinions of language and, and by extension, society. Carroll was so successful at this that in 1937 American psychiatrist Paul Schilder discussed the dangers to a child's mind …

Nature, Nurture, Mythology: A Cultural History Of Dutch Orangism During The First Stadholderless Era, 1650-1672, Greg Alan Beaman

LSU Master's Theses

Through its military and political service to the United Provinces of the Netherlands during the course of the Dutch struggle for independence from Spain, the house of Orange came to occupy a special place in Dutch culture. The image of the house of Orange in Dutch political culture followed a trajectory of cultural assimilation from the sixteenth century to the early eighteenth century, whereby Orange's continued service linked it inextricably to certain aspects of Dutch culture. Having granted the house of Orange legitimacy as political leaders, the Dutch people went about incorporating Orange into the heart of their cultural spirit. …

The CS-PFP10 scores were compared to the Western Ontario and McMaster Universities OA Index (WOMAC), The Knee Society’s Clinical Rating System (KSS), and the Short Form 36-item health survey (SF-36) physical function scores. It was hypothesized that at least moderate associations between the CS-PFP10 test scores and the WOMAC, KSS, and SF-36 scores in TKA candidates …

Liquidity And Speculative Trading: Evidence From Stock Price Adjustments To Quarterly Earnings Announcements, Hsiao-Fen Yang Jan 2007

Liquidity And Speculative Trading: Evidence From Stock Price Adjustments To Quarterly Earnings Announcements, Hsiao-Fen Yang

LSU Doctoral Dissertations

This dissertation studies whether stock price reactions to quarterly earnings announcements depend on stock liquidity. Baker and Stein (2004) and Scheinkman and Xiong (2003) develop models showing that liquidity can be affected by investor sentiment or speculative trading. With short-sale constraints, liquid stocks have more trading from optimistic, overconfident investors and tend to be overvalued. In this study, we hypothesize that if a liquid stock is overpriced due to intensive speculative trading, the overpricing should be corrected partially or fully after quarterly earnings announcements which convey the information about the fundamental value of stocks and synchronize investors' adjustment to mispricing. …

Opting Out: Procedural Fair Use, Michael Mattioli Jan 2007

Opting Out: Procedural Fair Use, Michael Mattioli

Articles by Maurer Faculty

This article explores the advantages of opt-out plans, and identifies a critical shortcoming in Copyright's doctrine of Fair Use. The discussion is fueled by a current controversy: In December of 2004, Google, Inc. announced its plan to digitally scan thousands of copyrighted books as part of a massive new digital indexing service. Hedging against possible litigation, Google provided a free and easy opt-out procedure for authors who didn't want their books scanned. Despite this measure, two major authors' groups have sued Google, claiming the opt-out plan imposes an unfair burden. This article explores the fairness of established opt-outs in contract …

Effect Of Adapted Phonic Faces Story Books On Phonological Skills Of Children With Severe Expressive Language Disorders, Meher Hormazd Banajee

LSU Doctoral Dissertations

Although No Child Left Behind (2001) encourages the inclusion of all children within the regular curriculum, children with severe speech and physical disabilities rarely are provided with the literacy education provided to grade-level peers. This study taught alphabetic skills to three children with severe speech and physical impairments in the context of traditional alphabet books versus Phonic Faces Storybooks. Both storybooks were converted into e-books using Microsoft Office PowerPoint (Microsoft Office, 2003) and accessed using a single rocking lever switch. Two graphemes were selected based on incorrect responses from the pretest administration of the The Phonological Awareness Test (Roberson & …

The Vulnerability To Coaching Across Measures Of Malingering, Adrianne M. Brennan Jan 2007

The Vulnerability To Coaching Across Measures Of Malingering, Adrianne M. Brennan

LSU Doctoral Dissertations

Neuropsychologists are increasingly called upon to conduct evaluations with individuals involved in personal injury litigation. While the inclusion of malingering measures within a test battery may help clinicians determine whether a client has put forth full effort, attorney coaching may allow dishonest clients to circumvent these efforts. The purpose of this study was to determine the degree to which frequently used measures of effort are susceptible to coaching as well as to explore and classify strategies undertaken by coached analogue malingerers. Additionally, potential improvements in the external validity of the simulation design were explored.

Twenty-two SVI applications were made to test fields from 2002-2005 using two aircraft …

A Liquid Lens Based On Electrowetting, Jihwan Park Jan 2007

A Liquid Lens Based On Electrowetting, Jihwan Park

LSU Master's Theses

A primary goal of this work is to develop and characterize a novel liquid lens based on electrowetting. A droplet of silicone oil confined in an aqueous solution works as a lens. Electrowetting then controls the shape of the confined silicone oil, and the focal length may be varied upon an applied electric potential. The planar lens design is employed for easy integration of a lens system into a microfluidic device. The achievements of this work are to develop an electrowetting-based planar liquid lens without an off-the-plane electrode structure and to demonstrate the planar liquid lens with variable focal length …

The Apologia Of Franchino Gafurio: A Critical Edition And Translation, Patrick Joseph Kaufman Jan 2007

The Apologia Of Franchino Gafurio: A Critical Edition And Translation, Patrick Joseph Kaufman

LSU Master's Theses

Franchino Gafurio’s Apologia (Turin, 1520) is one musical treatise in a series of works that constituted the famous “pamphlet war” between he and Giovanni Spataro. The dispute originated with the publication of Bartholomeo Ramis de Pareia’s Musica practica (Bologna, 1482). Unconventional and unapologetically critical, Ramis rejected venerated musical traditions in an attempt to align music theory with contemporary music practice. He opposed the Pythagorean division of the monochord and Guidonian solmization syllables, and instead proposed a division which produced pure thirds, and a solmization system based on the octave. His iconoclastic proposals and his highly sarcastic tone called forth a …

The Influence Of Controllability On College Women's Efficacy And Attributions In Physical Activity, Julie Franks Gill Jan 2007

The Influence Of Controllability On College Women's Efficacy And Attributions In Physical Activity, Julie Franks Gill

LSU Doctoral Dissertations

There is evidence that individuals’ attributional patterns are important determinants of behavior. Controllability had been identified as an influential dimension of causal attributions. When individuals believe their actions have an effect, or control, on the outcome of an event, they are more likely to engage in a behavior. Contingency of feedback can be used to manipulate perceptions of controllability. The purpose of this study was to investigate the effect of controllability on causal attributions, efficacy, and performance in an exercise setting, using a design that accounts for explanatory styles. It was hypothesized that non-contingent outcomes on an initial task would …

In Defense Of Mandatory Arbitration (If Imposed On The Company), Jean R. Sternlight Jan 2007

In Defense Of Mandatory Arbitration (If Imposed On The Company), Jean R. Sternlight

Scholarly Works

Having spent much of her academic life battling companies' mandatory imposition of binding arbitration on consumers and employees, the author now switches gears. This Article contemplates whether mandatory binding arbitration is acceptable if imposed by the government on companies (governmental mandatory arbitration) rather than by companies on their employees and consumers (private mandatory arbitration). Specifically, the Article considers the possibility of statutes that would provide little guys (consumers and employees) with an opportunity to take their disputes to binding arbitration rather than litigation. If the little guys chose arbitration over litigation, post-dispute, companies would have to agree to such arbitration, …

LSU Doctoral Dissertations

This research deals with an experimental and numerical investigation of the frictional and thermal behavior of pin-bushing pairs, operating at reciprocating sliding motion or under heavy loads. Large interfacial temperatures developed due to frictional heating can cause failure. Therefore, numerical prediction and analysis of the surface temperature under various operating conditions are important. Laboratory tests using a pin-bushing tester provided measurements of the friction coefficient and temperature. Hard coated and plain (uncoated) bushings, both made of induction hardened stainless steel, were tested. Lower coefficient of friction and surface temperature were observed in the case of the coated bushing. In the …
