Foodborne Infections And The Global Food Supply: Improving Health At Home And Abroad, Robert V. Tauxe
Foodborne Infections And The Global Food Supply: Improving Health At Home And Abroad, Robert V. Tauxe
Vanderbilt Journal of Transnational Law
In recent years, fourteen percent of the U.S. food supply has been imported from other countries, including many fresh and perishable foods. Although most outbreaks of illness and individual cases are related to foods from the United States, large and unusual outbreaks have been traced to imported foods that were likely contaminated in the country of origin. Investigation of these outbreaks requires collaboration across several disciplines as well as across international borders. Successful investigation can not only control the original problem, but can also inform public authorities in both countries about the need for strategies to prevent similar outbreaks from …
Liberalizing Trade In Agriculture And Food Security--Mission Impossible?, Christine Kaufmann, Simone Heri
Liberalizing Trade In Agriculture And Food Security--Mission Impossible?, Christine Kaufmann, Simone Heri
Vanderbilt Journal of Transnational Law
The Agreement Establishing the World Trade Organization (WTO) foresees that trade should be conducted with a view to raising standards of living. It is undisputed that raising living standards contributes to the implementation of the right to food. Indeed, state parties to the WTO have obligations regarding the right to food not only under the international trade system, but also under the human rights regime. All WTO state parties are bound by customary human rights law, and most have ratified the International Covenant on Economic, Social, and Cultural Rights, of which Article 11 contains the most important codification of the …
Say What You Mean: Improved Drafting Resources As A Means For Increasing The Consistency Of Interpretation Of Bilateral Investment Treaties, Kelley Connolly
Say What You Mean: Improved Drafting Resources As A Means For Increasing The Consistency Of Interpretation Of Bilateral Investment Treaties, Kelley Connolly
Vanderbilt Journal of Transnational Law
Following the demise of international recognition of the Hull Rule as the standard governing foreign direct investment, countries throughout the world have turned to bilateral investment treaties (BITs) to govern direct investment relationships. BITs allow countries to bind themselves credibly to commitments by granting substantive rights to investors and offering remedies for violations of those rights, thereby incentivizing new investments and facilitating economic ventures. The recent dramatic increase in disputes arising under BITs has shaken the legitimacy of these agreements. Arbitration panels interpret these documents inconsistently, which disparately impacts developing nations negatively. The inconsistent interpretations rob BITs of clarity and …

Australian youth engage in behaviour that threatens their health and wellbeing. National surveys report that about a third of young Australians have tried an illicit drug. High rates of substance use and risky sexual behaviour among young Australians suggest that effective prevention efforts based on empirical evidence need to be expanded. Church-associated organisations are an untapped resource that could be used to improve the health and welfare of young people. We describe eight evidence-based elements to consider in designing strategies to prevent high-risk behaviour in young people.
The Arrival Of The "Have-Nots" In International Arbitration, Catherine A. Rogers
The Arrival Of The "Have-Nots" In International Arbitration, Catherine A. Rogers
Faculty Scholarship
Much has been written about the have-nots in domestic litigation and domestic arbitration, with an apparent assumption that their fate was mainly a domestic affair. In recent years, however, internet commerce has brought consumers to the international market, an increasingly globalized workforce has generated a class of international employees, and the link between international trade and human rights has revealed a host of victims. The arrival of these 'have-nots' in international arbitration means that previously latent questions about international arbitration's integrity as a system and role as a mechanism for transnational regulatory governance have been brought to the fore.

The Effect Of Survey-Based Sentiment Measures On The Predictability And Volatility Of Stock Returns Conditioned On The Payout Yield And Issue Yield, Darryl Philip Samsell
The Effect Of Survey-Based Sentiment Measures On The Predictability And Volatility Of Stock Returns Conditioned On The Payout Yield And Issue Yield, Darryl Philip Samsell
Theses and Dissertations in Business Administration
Survey-based sentiment indexes from the American Association of Individual Investors, Investors' Intelligence, and the Yale University International Center for Finance show strong in-sample monthly return predictability and are strong factors in explaining the cross-sectional variation in monthly returns and in explaining the excess volatility in returns beyond that explained by cash flow fundamentals proxied by the payout yield and the issue yield from Boudoukh, et al. (2007). These finding are robust to the use of numerous methods of sentiment variable computation. Sentiment is a more significant factor during the period from January 1997 to December 2005 when U.S. stock valuations …
Two Essays On Corporate Spin-Offs, Yingchou Lin
Two Essays On Corporate Spin-Offs, Yingchou Lin
Theses and Dissertations in Business Administration
This dissertation investigates two possible sources that contribute to the gains of corporate spin-offs. In the first essay, I investigate the relation between the value created by corporate spin-offs and the misvaluations of the parent firms and their spun-off divisions. I argue that spin-offs could create value even though the efficiency of the firm remains unchanged. Corporate spin-offs could be driven by the desire to correct the undervaluation of the parent firm or the spun-off unit. Thus, the gains of spin-offs should be highly correlated with the degree of misvaluation. By examining a 263 corporate spinoffs sample in the period …
Instruments Of Accommodation: The Military Chaplaincy And The Constitution, Robert W. Tuttle, Ira C. Lupu
Instruments Of Accommodation: The Military Chaplaincy And The Constitution, Robert W. Tuttle, Ira C. Lupu
GW Law Faculty Publications & Other Works
This essay addresses the proliferation of constitutional issues involving the military chaplaincy. The authors query how the chaplaincy is consistent with the Establishment Clause of the Constitution's First Amendment and note that the answer generally derives from one or more of the following paradigms: (1) Establishment Clause history; (2) Public funding of religion; or (3) Governmental display of religious messages. They suggest that an adequate approach for Establishment Clause analysis of the military chaplaincy requires a different framework. To that end, Part I of this essay describes Katcoff v. Marsh, the most important decision on the constitutionality of the military …
Red Families V. Blue Families, Naomi R. Cahn, June Carbone
Red Families V. Blue Families, Naomi R. Cahn, June Carbone
GW Law Faculty Publications & Other Works
The "culture wars," as they play out in high profile Supreme Court decisions and legislative fights over abortion and same-sex marriage, are first and foremost about family values. Central to these differences - and the focus of the article - is the fact that different families in different parts of the country are leading different lives. The one clear, organizing principle that distinguishes the two systems: age of family formation. The defining characteristic of what we term the "new middle class morality" is delay in family formation until the late twenties or early thirties. This new morality, which correlates more …

Behavioral Biology, The Rational Actor Model, And The New Feminist Agenda, Naomi R. Cahn, June Carbone
GW Law Faculty Publications & Other Works
In this paper, we will incorporate gender consciousness into critiques of the rational actor model by revisiting Carol Gilligan's account of moral development. Economics itself, led by the insights that have come from game theory, is reexamining trust, altruism, reciprocity and empathy. Behavioral economics, defined as "the combination of psychology and economics that investigates what happens in markets in which some of the agents display human limitations and complications," further explores the implications of a more robust conception of human motivation. We argue that the most likely source for a comprehensive theory will come from the integration of behavioral economics …
Trade And The Environment In The Wto, Steve Charnovitz
Trade And The Environment In The Wto, Steve Charnovitz
GW Law Faculty Publications & Other Works
The linkage between trade and the environment stands out as an important challenge in global economic governance. Over the past decade, the WTO devoted considerable attention to this issue and included it on the agenda of the Doha Round. In parallel, the jurisprudence on trade and the environment has experienced significant advances. This study provides an overview of the main institutional changes at the WTO and of the developments in the jurisprudence most relevant to the interaction between the environment and trade. Specifically, this study focuses on GATT Article XX and takes note of many positive (and a few negative) …
The Effects Of An Educational Intervention Lesson On Fourth And Fifth Grade Students’ Ability To Sustain Effort (Pace) During A Modified 1-Mile Run Test, Rick Schupbach
Dissertations and Theses @ UNI
The primary purpose of this study was to investigate the effect of an educational intervention lesson on fourth and fifth grade students' ability to sustain effort (pace) in an identified target heart rate zone during a modified I -mile run test. It was hypothesized that after participating in the intervention, students would be able to sustain effort in their target heart rate zone more consistently than before receiving the educational program. Computerized heart rate measures were obtained for fourth and fifth grade students by the use of Polar E600 watches during pretest and posttest modified 1 -mile runs. The data …

The Many Faces Of Darlene Jespersen, Michael Selmi
The Many Faces Of Darlene Jespersen, Michael Selmi
GW Law Faculty Publications & Other Works
This essay was written for a symposium on the case Jespersen v. Harrah's Operating Co., in which Darlene Jespersen challenged Harrah's policy that required its female employees to wear makeup. In this essay, I explore the applicable case law, focusing specifically on the emerging law of sexual stereotyping to explain why the law was unwilling to recognize Jespersen's claim. In addition, I suggest that Jespersen's case is symptomatic of the way in which we have come to expect too much both from work and from courts. The workplace is typically not a place to express our identities and the fact …
Privacy's Other Path: Recovering The Law Of Confidentiality, Daniel J. Solove, Neil M. Richards
Privacy's Other Path: Recovering The Law Of Confidentiality, Daniel J. Solove, Neil M. Richards
GW Law Faculty Publications & Other Works
The familiar legend of privacy law holds that Samuel Warren and Louis Brandeis invented the right to privacy in 1890, and that William Prosser aided its development by recognizing four privacy torts in 1960. In this article, Professors Richards and Solove contend that Warren, Brandeis, and Prosser did not invent privacy law, but took it down a new path. Well before 1890, a considerable body of Anglo-American law protected confidentiality, which safeguards the information people share with others. Warren, Brandeis, and later Prosser turned away from the law of confidentiality to create a new conception of privacy based on the …

The photoproduction of prompt photons, together with an accompanying jet, has been studied in ep collisions at a centre-of-mass energy of 318 GeV with the ZEUS detector at HERA using an integrated luminosity of 77 pb-1. Cross sections were measured for the transverse energy of the photon and the jet larger than 5 and 6 GeV, respectively. The differential γ+jet cross sections were reconstructed as functions of the transverse energy, pseudorapidity and xγobs, the fraction of the incoming photon momentum taken by the photon-jet system. Predictions based on leading-logarithm parton-shower Monte Carlo models and next-to-leading-order (NLO) QCD generally underestimate the …

A search for stop production in R-parity-violating supersymmetry has been performed in e+p interactions with the ZEUS detector at HERA, using an integrated luminosity of 65 pb-1. At HERA, the R-parity-violating coupling λ' allows resonant squark production, e+d→̃ q. Since the lowest-mass squark state in most supersymmetry models is the light stop, ̃t, this search concentrated on production of ̃t, followed either by a direct R-parity-violating decay, or by the gauge decay to b̃x1+. No evidence for stop production was found and limits were set on λ'131 as a function of the stop mass in the framework of the minimal …

A Case Study Using Guided Reading And Teacher Read-Alouds While Monitoring English Language Learners' And Native English Speakers' Reading Achievement, Kelsey M. Baker
Dissertations and Theses @ UNI
The number of English Language Learners (ELLs) in the United States continues to increase (U.S. Census Bureau, 2002); therefore, schools and educators are affected by the growing differences in students' language skills, prior experiences, and progress. This research addresses the need for understanding ELLs and how ELLs benefit from adults effectively reading aloud to them. Further research is needed on effective reading instruction for ELLs for several reasons. First, teachers are becoming ELL teachers by default and feel overwhelmed because of the responsibility to teach both language and content (Gersten, 2002). Second, an achievement gap exists between ELLs and native …

Machining Process Changes As A Function Of Surface Roughness, Specific To Machining Cylindrical Bores, Thomas Patrick Olsen
Machining Process Changes As A Function Of Surface Roughness, Specific To Machining Cylindrical Bores, Thomas Patrick Olsen
Dissertations and Theses @ UNI
Manufacturing professionals are challenged everyday to produce products to higher quality standards in a way that is economical and efficient. Manufacturing needs to minimize non value added costs such as reducing inventory, (non machined and finished goods), reduce work in process, and most of all eliminate waste. To exist, customers must be satisfied at the time of purchase and throughout the products lifecycle. To be competitive and remain a world class manufacture, companies must be flexible and be willing to change. Single point flexible manufacturing versus fixed spindle rigid machining greatly improves the ability to make changes. If a process …

Significance Of The General Public For Public Relations: A Study Of The Blogosphere's Impact On The October 2006 Edelman/Wal-Mart Crisis, Sergei Golitsinski
Dissertations and Theses @ UNI
The focus of this study is the general public and its significance in a public relations context. The study questions one of the fundamental principles of public relations, according to which organizations communicate only with those publics which have the potential to cause them negative consequences. The general public, according to -this principle, is considered insignificant and even nonexistent. This study's hypothesis is that new communication technologies have given the general public the power to cause direct negative consequences for organizations. To evaluate this hypothesis, the study examines the October 2006 Edelman/Wal-Mart crisis caused by the "Wal-Marting Across America" blog. …

We provide an additional justification for the pro-defendant bias in Anglo-American criminal procedure that supplements the most commonly forwarded justifications to date. The most commonly forwarded rationale for the prodefendant bias is that the costs of false convictions-specifically, the sanctioning and deterrence costs associated with the erroneous imposition of criminal sanctions-are greater than the costs of false acquittals. We argue that this rationale provides at best a partial justification for the extent of prodefendant procedural rules. Under our justification, prodefendant protections serve primarily as constraints on the costs associated with rent seeking in the law enforcement process. The theory developed …

This Article tracks the ongoing adaptation of U.S. contract law to the 1990s’ contraction of the welfare state. Some courts strive to compensate for the shortage of welfare services and to pursue redistributive goals. This Article provides examples of this trend and then analyzes the non-linear relation between doctrines, judicial redistribution, and welfare politics in both case law and scholarship. Finally, this Article discusses the role of socially sensitive judicial discourse in light of contemporary welfare politics and explains its continuing importance.
