An Alternative Strategy For Building Sales Of Computers: Generic Advertising, Min Lu, Steven M. Thompson, Yanbin Tu
An Alternative Strategy For Building Sales Of Computers: Generic Advertising, Min Lu, Steven M. Thompson, Yanbin Tu
Management Faculty Publications
Frequent upgrading and aggressive price-cutting have become standard practice in the computer sector. While necessitated in part by declining production costs and a highly competitive market, these strategies have also served to make computers more affordable, growing the size of the overall market. Recently downturns in the sales of computers motivate us to examine the impact of these strategies on overall sales growth. We find evidence to suggest that excessive upgrading and overly aggressive price-cutting can be detrimental to overall sales growth. We also find that the computer sector exhibits characteristics that suggest that generic advertising would be an effective …
On The Uses Of Cultural Knowledge, Sheila Miyoshi Jager Dr.
On The Uses Of Cultural Knowledge, Sheila Miyoshi Jager Dr.
Books, Monographs & Collaborative Studies
The author explores the role that cultural knowledge must play in thinking about a new strategy for counterinsurgency. Although the importance of cultural awareness and understanding of adversary societies has been widely recognized as essential to operations and tactics on the battlefield, its significance has been largely ignored in formulating the broader strategic goals of counterinsurgency. The author highlights the importance of culture, and cultural awareness, in formulating a broad strategy for counterinsurgency which also has wide-ranging implication for U.S. foreign policy.

Africom's Dilemma: The "Global War On Terrorism" "Capacity Building," Humanitarianism, And The Future Of U.S. Security Policy In Africa, Robert G. Berschinski Mr.
Books, Monographs & Collaborative Studies
Africa is a continent of growing economic, social, political, and geostrategic importance. The establishment of a new Combatant Command for Africa–AFRICOM–marks an important milestone in the evolution of relations between the United States and the governments of Africa. Through AFRICOM, the U.S. Department of Defense will consolidate the efforts of three existing command headquarters as it seeks a more stable environment for political and economic growth in Africa. In line with this goal, AFRICOM is pioneering a bold new method of military engagement focused on war prevention, interagency cooperation, and development rather than on traditional war fighting. The author contends …
Identifying Mechanistic Models Of Spatial Behavior Using Pattern-Based Modeling: An Example From Lizard Home Ranges, Andrew J. Tyre, Gregory D. Kerr, Brigitte Tenhumberg, C. Michael Bull
Identifying Mechanistic Models Of Spatial Behavior Using Pattern-Based Modeling: An Example From Lizard Home Ranges, Andrew J. Tyre, Gregory D. Kerr, Brigitte Tenhumberg, C. Michael Bull
School of Biological Sciences: Faculty Publications
Landscape and population level patterns form through the aggregation of responses of individual organisms to heterogeneity. Spatial organization within a population can range from random overlap of individual home ranges, to completely exclusive territories, with most populations falling somewhere between these two extremes. A fundamental question in behavioral ecology concerns the factors that influence the degree of spatial overlap of home ranges, and the processes that determine how likely it is that an individual will access resources over its home range. However, traditional experimental methods are not always practical or possible. Pattern-based modeling is an alternative, non-intrusive technique for explaining …

Learning Multiple Languages In Groups, Sanjay Jain, Efim Kinber
Learning Multiple Languages In Groups, Sanjay Jain, Efim Kinber
School of Computer Science & Engineering Faculty Publications
We consider a variant of Gold’s learning paradigm where a learner receives as input different languages (in the form of one text where all input languages are interleaved). Our goal is to explore the situation when a more “coarse” classification of input languages is possible, whereas more refined classification is not. More specifically, we answer the following question: under which conditions, a learner, being fed different languages, can produce grammars covering all input languages, but cannot produce grammars covering input languages for any . We also consider a variant of this task, where each of the output grammars may not …

Health Care Law, Sean P. Byrne, Paul Walkinshaw
Health Care Law, Sean P. Byrne, Paul Walkinshaw
University of Richmond Law Review
Arguably, no other field of law in Virginia matches the complexity, magnitude, and universality of health care. It therefore comes as little surprise that Virginia's legislative and judicial branches of government devoted substantial attention to health care law issues in 2006 and 2007. Between April 2006 and April 2007 the time period covered by this article the Supreme Court of Virginia decided a large number of cases directly affecting health care law in the Commonwealth. The 2007 legislative session also addressed a host of health care issues and those with the most impact are summarized herein. These judicial and legislative …

Antitrust Process And Vertical Deference: Judicial Review Of State Regulatory Inaction, Jim A. Rossi
Antitrust Process And Vertical Deference: Judicial Review Of State Regulatory Inaction, Jim A. Rossi
Vanderbilt Law School Faculty Publications
Courts struggle with the tension between national competition laws, on the one hand, and state and local regulation, on the other--especially as traditional governmental functions are privatized and as economic regulation advances beyond its traditional role to address market monitoring. This Article defends a process-based account of the antitrust state-action exception against alternative interpretations, such as the substantive efficiency-preemption approach that Richard Squire recently advanced, and it elaborates on what such a process-based account would entail for courts addressing the role of state economic regulation as a defense in antitrust cases. It recasts the debate as focused around delegation issues …
Blinking On The Bench: How Judges Decide Cases, Chris Guthrie, Jeffrey J. Rachlinski
Blinking On The Bench: How Judges Decide Cases, Chris Guthrie, Jeffrey J. Rachlinski
Vanderbilt Law School Faculty Publications
How do judges judge? Do they apply law to facts in a mechanical and deliberative way, as the formalists suggest they do, or do they rely on hunches and gut feelings, as the realists maintain? Debate has raged for decades, but researchers have offered little hard evidence in support of either model. Relying on empirical studies of judicial reasoning and decision making, we propose an entirely new model of judging that provides a more accurate explanation of judicial behavior. Our model accounts for the tendency of the human brain to make automatic, snap judgments, which are surprisingly accurate, but which …
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban
Vanderbilt Law School Faculty Publications
Contrary to the common wisdom among criminal law scholars, empirical evidence reveals that people's intuitions of justice are often specific, nuanced, and widely shared. Indeed, with regard to the core harms and evils to which criminal law addresses itself-physical aggression, takings without consent, and deception in transactions-the shared intuitions are stunningly consistent across cultures as well as demographics. It is puzzling that judgments of moral blameworthiness, which seem so complex and subjective, reflect such a remarkable consensus. What could explain this striking result?
The authors theorize that one explanation may be an evolved predisposition toward these shared intuitions of justice, …
The Structure Of Search Engine Law, James Grimmelmann
The Structure Of Search Engine Law, James Grimmelmann
Cornell Law Faculty Publications
Search engines are the new linchpins of the Internet, and a new body of law - search engine law - will increasingly determine the shape of the Internet. Making sensible search policy requires a clear understanding of how search works, what interests are at stake, and what legal questions intersect at search. This article offers the first comprehensive overview of search engine law, which it organizes into a systematic taxonomy. It then demonstrates the dense legal interrelationships created by search by discussing a series of important themes in search engine law, each of which cuts across many doctrinal areas.
