Doctrines Of Waste In A Landscape Of Waste, John A. Lovett Nov 2007

Doctrines Of Waste In A Landscape Of Waste, John A. Lovett

Missouri Law Review

While I do not deny that classic waste cases - conflicts between life tenants and future interest holders over alleged instances of voluntary waste - are less common today than they used to be (but perhaps not as uncommon as some might think), my goals in this article are to reawaken readers to the importance of waste doctrine, to suggest that the great days of waste may not be completely in the past, to recommend some new uses for waste cases as teaching tools, and generally to urge a renewed appreciation for waste - an appreciation that Dale Whitman, for …

Tipping Point: Missouri Single Subject Provision, Alexander R. Knoll Nov 2007

Tipping Point: Missouri Single Subject Provision, Alexander R. Knoll

Missouri Law Review

The Missouri single subject provision, which requires that each bill enacted by the Missouri Legislature contain a single subject, is one of the great equalizers in backroom politics. Simply put, it is a hurdle that prevents legislators from hijacking the legislative process by attaching an unrelated provision to a proposed bill. This is a practice that many of our Federal legislators find to be a daily occurrence, but one that our state politicians are prevented from doing under the single subject provision of the Missouri Constitution. However, even with the broad prohibition outlined in the single subject provision, for the …

Slurred Speech And Double Vision: Missouri's Supreme Court Is Unsteady On Dwi Standard, Alison K. Spinden Nov 2007

Slurred Speech And Double Vision: Missouri's Supreme Court Is Unsteady On Dwi Standard, Alison K. Spinden

Missouri Law Review

Supreme Court Justice Potter Stewart observed that "[t]he art of being a judge, if there is such an art, is in announcing clear rules in the context of... infinitely varied cases, rules that can be understood and observed by conscientious government officials. This might be excellent advice for Missouri's judges to consider. After nearly fifteen years of struggling to formulate the proper standard for appellate review of a trial court's finding of probable cause, courts appear to be as unsettled on the issue as ever. In no context is this clearer than in cases involving charges of driving while intoxicated …

Some Challenges For Legal Pragmatism: A Closer Look At Pragmatic Legal Reasoning, Andrew J. Morris Nov 2007

Some Challenges For Legal Pragmatism: A Closer Look At Pragmatic Legal Reasoning, Andrew J. Morris

Northern Illinois University Law Review

This article draws on the literature of legal pragmatism to identify distinctive characteristics of pragmatic reasoning. It then conducts a methodical comparison of pragmatic reasoning with more principled reasoning, which the article identifies as reasoning that gives normative force to formal legal reasons. The article conducts this comparison based on five criteria: (1) generality versus contextuality; (2) level of decision costs; (3) effect on rate of true judicial error; (4) effect on predictability; and (5) effect on judicial legitimacy.

On Internal Cone Cracks Induced By Conical Indentation In Brittle Materials, J. Yan, Anette M. Karlsson, X. Chen Nov 2007

On Internal Cone Cracks Induced By Conical Indentation In Brittle Materials, J. Yan, Anette M. Karlsson, X. Chen

Mechanical Engineering Faculty Publications

The conditions for cone cracks to develop due to a conical indentation are investigated. Axisymmetric numerical simulations, based on the finite element method, are conducted, assuming a linear-elastic, perfectly plastic material. A superposition scheme is employed to simulate a range of crack geometries, including various lengths and orientations. The results indicate that the class of cracks investigated is prone to develop internally in brittle materials. Based on a reversed analysis, a new technique is proposed for measuring the fracture toughness in bulk material and thick coatings through one simple indentation test when the cone crack appears.

Predicting The Prison Misconducts Of Women Offenders: The Importance Of Gender-Responsive Needs, Emily M. Wright, Emily J. Salisbury, Patricia Van Voorhis Nov 2007

Predicting The Prison Misconducts Of Women Offenders: The Importance Of Gender-Responsive Needs, Emily M. Wright, Emily J. Salisbury, Patricia Van Voorhis

Criminology and Criminal Justice Faculty Publications

The needs of women offenders may be qualitatively different than the needs of male offenders. The “pathways” and “gender-responsive” perspectives of female offending have recently garnered attention in both practitioner and scholarly arenas. The pathways perspective focuses attention on the co-occurrence and effects of trauma, substance abuse, dysfunctional relationships, and mental illness on female offending, while the gender-responsive perspective also suggests that problems related to parenting, childcare, and self-concept issues are important needs of women offenders. Few studies have examined whether or not these are risk factors for poor prison adjustment. With a sample of 272 incarcerated women offenders in …

Comparison Of Probabilistic Boolean Network And Dynamic Bayesian Network Approaches For Inferring Gene Regulatory Networks, Peng Li, Chaoyang Zhang, Edward J. Perkins, Ping Gong, Youping Deng Nov 2007

Comparison Of Probabilistic Boolean Network And Dynamic Bayesian Network Approaches For Inferring Gene Regulatory Networks, Peng Li, Chaoyang Zhang, Edward J. Perkins, Ping Gong, Youping Deng

Faculty Publications

Background: The regulation of gene expression is achieved through gene regulatory networks (GRNs) in which collections of genes interact with one another and other substances in a cell. In order to understand the underlying function of organisms, it is necessary to study the behavior of genes in a gene regulatory network context. Several computational approaches are available for modeling gene regulatory networks with different datasets. In order to optimize modeling of GRN, these approaches must be compared and evaluated in terms of accuracy and efficiency.

Results: In this paper, two important computational approaches for modeling gene regulatory networks, …

Robot-Assisted Prostate Brachytherapy, Yan Yu, Tarun Podder, Y D. Zhang, W S. Ng, V Misic, J Sherman, L Fu, D Fuller, D J. Rubens, J D. Strang, R A. Brasacchio, E M. Messing

Department of Radiation Oncology Faculty Papers

Abstract: In contemporary brachytherapy procedures, needle placement at the desired target is challenging due to a variety of reasons. A robot-assisted brachytherapy system can potentially improve needle placement and seed delivery, resulting in enhanced therapeutic delivery. In this paper we present a 16 DOF (degrees-of-freedom) robotic system (9DOF positioning module and 7DOF surgery module) developed and fabricated for prostate brachytherapy. Strategies to reduce needle deflection and target movement were incorporated after extensive experimental validation. Provisions for needle motion and force feedback were included into the system for improving robot control and seed delivery. Preliminary experimental results reveal that the prototype …

Characterization Of Polymorphic Microsatellite Loci For The Invasive Monk Parakeet (Myiopsitta Monachus), M. A. Russello, V. Saranathan, S. Buhrman-Deever, J. Eberhard, A. Caccone Nov 2007

Characterization Of Polymorphic Microsatellite Loci For The Invasive Monk Parakeet (Myiopsitta Monachus), M. A. Russello, V. Saranathan, S. Buhrman-Deever, J. Eberhard, A. Caccone

Faculty Publications

Microsatellite loci were characterized for the monk parakeet (Myiopsitta monachus) from a GTn-enriched genomic library. Twelve of 14 microsatellite loci were polymorphic, averaging 6.7 alleles per locus across the 20 individuals genotyped. Mean expected heterozygosity was 0.72, with locus-specific values ranging from 0.53 to 0.90. An equally high multilocus probability of identity (2.48 × 10-12) was revealed for this set of loci. In addition, all 12 loci were demonstrated to cross-amplify to varying extents within three additional parrot genera suggesting their potential utility for population-level studies in a broad range of Neotropical psittacines. © 2007 The Authors.

Allying For Peace: Treaty Obligations And Conflict Between Allies, Andrew G. Long, Timothy Nordstrom, Kyeonghi Baek Nov 2007

Allying For Peace: Treaty Obligations And Conflict Between Allies, Andrew G. Long, Timothy Nordstrom, Kyeonghi Baek

Faculty Publications

We argue that certain provisions of alliance treaties can signal credible commitments to a peaceful relationship among members and establish institutional mechanisms that promote the settlement of disagreements through peaceful negotiation. Nonaggression, peaceful dispute settlement, military institutionalization, and permanent organization provisions should increase the duration of peace between alliance members; we test our hypotheses with a duration model. The analysis generally supports our expectations except that alliances that create permanent organizations, even those specifically established to arbitrate disagreements, are associated with shorter durations of peace. We conclude with some implications of our argument for the study of military alliances and …

Contract Law And Its Potential Impact On Parole And Probation Searches, Michael Chmelar Nov 2007

Contract Law And Its Potential Impact On Parole And Probation Searches, Michael Chmelar

Northern Illinois University Law Review

When considering a defendant's motion to reconsider his sentence or motion to reduce his sentence, Illinois courts apply principals of contract law to hold the defendant to his negotiated plea agreement. However, courts only utilize contract law to enforce the sentence length and not other material terms of a negotiated plea. Specifically, Illinois courts have not enforced search conditions in probation or parole orders when challenged through a motion to quash and suppress. The failure to extend the use of contract principals to the search term of a sentence could create a conflict with how courts enforce negotiated pleas. In …

Are There Rearrangement Hotspots In The Human Genome?, Max A. Alekseyev, Pavel A. Pevzner Nov 2007

Are There Rearrangement Hotspots In The Human Genome?, Max A. Alekseyev, Pavel A. Pevzner

Faculty Publications

In a landmark paper, Nadeau and Taylor [18] formulated the random breakage model (RBM) of chromosome evolution that postulates that there are no rearrangement hotspots in the human genome. In the next two decades, numerous studies with progressively increasing levels of resolution made RBM the de facto theory of chromosome evolution. Despite the fact that RBM had prophetic prediction power, it was recently refuted by Pevzner and Tesler [4], who introduced the fragile breakage model (FBM), postulating that the human genome is a mosaic of solid regions (with low propensity for rearrangements) and fragile regions (rearrangement hotspots). However, the rebuttal …

Some Questions For The Barrier Theory, Alan Rubel Nov 2007

Some Questions For The Barrier Theory, Alan Rubel

San Diego Law Review

Having set out the basics, Rickless considers several questions one might pose for the Barrier Theory. For example, must the barrier be solid? No. Must the barrier be erected by, rather than merely used by, the rightholder? No. Must the barrier be morally permissible in the first instance? No. While Rickless's answers seem correct, I think that they raise some concerns about the Barrier Theory.

Toward Informational Privacy Rights, Adam D. Moore Nov 2007

Toward Informational Privacy Rights, Adam D. Moore

San Diego Law Review

In this paper I will offer several arguments in support of the view that individuals have moral claims to control personal information. Coupled with rights to control access to one's body, capacities, and powers, or physical privacy rights, we will have taken important steps toward a general right to privacy. In Part I, a definition of privacy is offered along with an account of the value of privacy. Simply put, privacy - defined as control over access to locations and information - is necessary for human well-being. In Part II, an attempt to move beyond claims of value to claims …
