Reinforcing Refugee Protection In The Wake Of The War On Terror, Edwin Odhiambo Abuya Jan 2007

Reinforcing Refugee Protection In The Wake Of The War On Terror, Edwin Odhiambo Abuya

Faculty Articles

This article examines how the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) can be used as a practical tool to enhance the protection of persons who have fled their home States in search of asylum in the wake of the global "war on terror." It compares and contrasts provisions of CAT to similar provisions contained in international refugee law. This article contends that, in some respects, the protection provisions of CAT are wider than those found in international refugee law, and, in other respects, narrower than those found in international refugee law. It concludes …

Past Reflections, Future Insights: African Asylum Law And Policy In Historical Perspective, Edwin Odhiambo Abuya Jan 2007

Past Reflections, Future Insights: African Asylum Law And Policy In Historical Perspective, Edwin Odhiambo Abuya

Faculty Articles

This article argues that an understanding of the evolution of asylum is an essential ingredient in the search for ideas and perspectives to the plight facing forced migrants. Using Kenya as a case study, the paper evaluates the extent to which procedures used to determine claims for asylum, protection outcomes and entitlements met international human rights and refugee law standards. It is contended that limited resources, porous boundaries and the mass movement of asylum seekers have compromised the level of protection offered to those who seek surrogate protection in African states like Kenya. In conclusion, critics in the area of …

Although both of these practices have roots in the last century," no doubt of late they have become more widespread and pronounced.

Textual Strategies To Resist Disappearance And The Mothers Of Plaza De Mayo, Alicia Partnoy

Modern Languages and Literatures Faculty Works

In her paper "Textual Strategies to Resist Disappearance and the Mothers of Plaza de Mayo" Alicia Partnoy draws attention to the ways the Mothers of the Plaza de Mayo use literature as both a form of protest and as a way to build solidarity. Focusing on four texts written by the Mothers, Partnoy attempts to correct the lack of attention that this literary work has drawn. Partnoy suggests that in addition to the forms of public protest engaged by the Mothers, their literary activities also play a central role in their efforts. In fact, their use of the literary form …

The Land Of The Free: Human Rights Violations At Immigration Detention Facilities In America, Caitlin J. Mitchel Jan 2007

The Land Of The Free: Human Rights Violations At Immigration Detention Facilities In America, Caitlin J. Mitchel

LLM Theses and Essays

In America today, aliens who commit even minor visa violations can be detained in one of many immigration detention facilities throughout the U.S. These detainees may be transferred to a facility far away from their homes, families, and attorneys. While imprisoned in these detention facilities, some detainees are treated as and housed with criminals. Their substantive and procedural rights are limited and their human rights are violated. The U.S. laws that should protect them are the very laws that strip them of their rights to court proceedings, challenges of decisions regarding detention, and judicial review. By issuing substantial reservations, declarations, …

Ethiopia's Sovereign Right Of Access To The Sea Under International Law, Abebe T. Kahsay

LLM Theses and Essays

Since Eritrea’s secession from Ethiopia there has been continuous opposition by intellectuals and the opposition to the government’s policy of making Ethiopia a landlocked country. Some totally reject the secession, while others accept the independence as a "fait accompli" and voice concern over the lack of an outlet to the sea, and still others acknowledge the right of self-determination and secession of Eritrea but denounce the inconsistency of the application of the Transitional Charter regarding the Red Sea Afar and the Algiers Agreement for denying Ethiopia its legitimate right to access to the sea and allege that the government is …

The model capture functionality at the level of mesoscopic as well as microscopic level and it is merged with process algebra’s producer consumer theory. The model is also formalized using Process algebra equations. This paper focuses on complex situational activity diagrams enhancing the expressivity by refining at the abstraction levels. Performance requirement is annotated by the UML profile for …

Gardening Programs In Schools: A Proposed Solution To Reverse The Consequences Of The Current American Food Culture, Charlotte Grace Blessey Jan 2007

Gardening Programs In Schools: A Proposed Solution To Reverse The Consequences Of The Current American Food Culture, Charlotte Grace Blessey

Soviet Language Policy In Uzbekistan: How The Role Of Russian Has Changed Through Soviet Times And Independence, Mary Catherine Boehmer

Honors Theses

This thesis examines the progression of Soviet language policy in Uzbekistan and its effects. It also examines how the perception of Russian has changed in post-Soviet Uzbekistan and Uzbeks now view their own language as a direct result of language policy. I based my research on the research of others and the interview of a former Peace Corps volunteer who lived in both Tashkent and Andijon for a total period of two years. Through my investigation, I discovered how the Central Asian languages were formed on the basis of language, how Soviet leaders used both Russian and ethnic languages to …

Dynamics Of Transcriptional Repression By Λ Cro Repressor In Vivo, Dustin Land Markle Jan 2007

Dynamics Of Transcriptional Repression By Λ Cro Repressor In Vivo, Dustin Land Markle

Honors Theses

Cro is a regulatory protein that participates in the life cycle switch of bacteriophage lambda (X). While wild-type Cro is produced as a single domain polypeptide monomer, two monomers must assemble to form a dimer before Cro can act as a functional transcriptional repressor. We suspect that dimerization of Cro monomers determines, in part, the dynamics of the activity of the protein in vivo. Rate and equilibrium constants for dimerization of several Cro variants have already been determined in vitro,, and dimerization of Cro monomers is slow relative to other similar proteins. This study is concerned with exploring the in …

This article analyzes civil society participation in the free trade debate by focusing on networks that opposed the Central American Free Trade Agreement (CAFTA) in El Salvador. Drawing on documents, observations, and semi-structured interviews with civil society leaders, two kinds of opposition coalitions are identified. “Critic negotiators,” emphasizing active engagement and policy research, used the limited participation space opened by authorities to push for reform. “Transgressive resisters,” repudiating the formal consultation process, deployed confrontational tactics and posed more fundamental challenges. This work uses social movement theory to explore coalition resource mobilization, the role of movement entrepreneurs, strategic decision-making, mechanisms linking …
