Terrorizing Bodies, Chris Gutierrez Jan 2007

Terrorizing Bodies, Chris Gutierrez

Reconstruction: Studies in Contemporary Culture

Beginning with one single body painted by Gustave Courbet in 1866 and one temple destroyed on September 11th, this paper moves to consider the far reaching impact that the War on Terror has on the entire social body. By paying attention to the unknowable status of both the events and the perpetrators of terrorism, it will be argued that the overwhelming ambiguity of terrorism and counter-terrorist activity has allowed the War on Terror to return to prior discourses of racism and homophobia to mark the corporeal otherness it hopes to confront. Here, images from Abu Ghraib prison, joke pictures forwarded …

Standard Setting In Human Rights: Critique And Prognosis, Makau Wa Mutua Jan 2007

Standard Setting In Human Rights: Critique And Prognosis, Makau Wa Mutua

Journal Articles

This article interrogates the processes and politics of standard setting in human rights. It traces the history of the human rights project and critically explores how the norms of the human rights movement have been created. This article looks at how those norms are made, who makes them, and why. It focuses attention on the deficits of the international order, and how that order - which is defined by multiple asymmetries - determines the norms and the purposes they serve. It identifies areas for further norm development and concludes that norm-creating processes must be inclusive and participatory to garner legitimacy …

Ecosystem-Based Fisheries Management Of Seamount And Deep-Sea Coral Reefs In U.S. Waters: Conceptual Models For Proactive Decisions., R. Y. George, T. A. Okey, John K. Reed, R. P. Stone Jan 2007

Ecosystem-Based Fisheries Management Of Seamount And Deep-Sea Coral Reefs In U.S. Waters: Conceptual Models For Proactive Decisions., R. Y. George, T. A. Okey, John K. Reed, R. P. Stone

Faculty Scholarship

Commercial fishing activities, primarily bottom trawling, have severely damaged vulnerable sea-floor communities such as undersea coral gardens and the summits of seamounts. Recreational fishing can also affect ecosystems adversely. The United States Ocean Commission (2004) recommended that fisheries be managed to protect marine ecosystems and their functions. The eight regional fisheries management councils in the United States under the jurisdiction of the National Marine Fisheries Service lack a sufficiently detailed understanding of ecosystem structure and function and of the target stocks and managed fisheries for making decisions that protect the stocks and ecosystems while allowing fisheries to proceed. Because the …

Open-Ended Interviews, Power, And Emotional Labor, Elizabeth A. Hoffmann Jan 2007

Open-Ended Interviews, Power, And Emotional Labor, Elizabeth A. Hoffmann

Department of Sociology Faculty Publications

This article investigates the power dynamics of the interview process and the connected emotional labor, drawing on examples from a recent study on workplace grievances in which most data collection was through open-ended interviews. By exploring the shifts of power and the emotional labor demands in the qualitative, open-ended interview, this article emphasizes that power shifts and emotions within the interview are, themselves, important data. A greater awareness of shifts in interviewer/interviewee power and emotional labor in the interview context helps the researcher better understand the nuances of the data, provides the researcher with more information about the interviewee and …

Distanciation And The Recontextualization Of Space: Finding One’S Way In A Small Western Community, Lisa Gabbert Jan 2007

Distanciation And The Recontextualization Of Space: Finding One’S Way In A Small Western Community, Lisa Gabbert

English Faculty Publications

In the 1990s, the city of McCall, Idaho, and the surrounding region implemented the Rural Addressing System. The system assigned a name to every street and a number to every house and erected visible signage for both. Although a seemingly minor bureaucratic operation, the Rural Addressing System is a concrete example of Anthony Giddens's concept of space distanciation, and as such, it is a significant component of modernity and globalization. By investigating the impact of the Rural Addressing System on this region—particularly on the ways in which people give directions and think about space there—this article sheds light on how …

Working Towards Restorative Justice In Ethiopia: Integrating Traditional Conflict Resolution Systems With The Formal Legal System, Julie Macfarlane Jan 2007

Working Towards Restorative Justice In Ethiopia: Integrating Traditional Conflict Resolution Systems With The Formal Legal System, Julie Macfarlane

Cardozo Journal of Conflict Resolution

This paper considers how the multiple realities of dispute resolution in any environment affect the work of conflict resolution practitioners. Conflict resolution practitioners are almost always invited in by representatives of the formal legal system, and their work generally focuses on managing - and perhaps reforming - this system. In practice, they cannot ignore the existence of parallel informal systems of conflict resolution that may undermine or distract from the formal state system. These may include structured alternatives to law, such as religious tribunals or community mediation programs. There may be other, more informal but equally significant family or community-based …

"Khmer Pride": Being And Becoming Khmer-American In An Urban Migrant Education Program, Theresa Ann Mcginnis Jan 2007

"Khmer Pride": Being And Becoming Khmer-American In An Urban Migrant Education Program, Theresa Ann Mcginnis

Journal of Southeast Asian American Education and Advancement

This article focuses on the ways an urban migrant education program becomes a space where middle school Khmer students can explore who they are as Khmer youth living in an urban American context. I discuss how the youth are able to take a transformative, interactional stance to the literacy and sign-making practices within the program. I argue that the Khmer youth's identities are reflected within these literacy and expressive practices. Further, I suggest the experiences of these Khmer middle school children of agricultural workers provide rich examples of how immigrant youth draw on a variety of cultural resources (from urban …

An Analysis Of Wars Of The Romani, A Flemish Tapestry From The Late Sixteenth Century, Theodore Brooks Hughes Jan 2007

An Analysis Of Wars Of The Romani, A Flemish Tapestry From The Late Sixteenth Century, Theodore Brooks Hughes

Graduate Student Theses, Dissertations, & Professional Papers

Among the treasures of the Montana Museum of Art and Culture is a lovely and elaborate work of art entitled Wars of the Romani, a Flemish tapestry woven in the last third of the 16th century. It is a large weaving, 10’ x 15’, portraying two armies intertwined in merciless combat. The specific subject matter of Wars of the Romani is unknown, but a standard displaying the Roman eagle held aloft in the background indicates the presence of the Roman legions. The tapestry displays rushing horsemen mounted on vigorous horses, marching spearmen, and supine warriors, imagery common to Flemish battle …

A Comprehensive Case Report Of University Of Montana Forensic Collection Case #141, Yasuko Takebe Jan 2007

A Comprehensive Case Report Of University Of Montana Forensic Collection Case #141, Yasuko Takebe

Graduate Student Theses, Dissertations, & Professional Papers

UMFC case #141 was acqired in spring 2006, as a commercially prepared anatomical specimen, reportedly from the Peoples Republic of China. It is a nealy complete skeleton that exhibits severe trauma of hte lower limbs. I reviewed the literature on methods of estimating age from the skeleton, because age is difficult to estimate for this case nad presents an interesting challenge. I then proceeded to estimate sex, ancestry, age, stature, and weight. I conclude that UMFC #141 is a White male, 39 to 45 years old, 5'0" to 5'4" in height, 110 to 161 pounds in weight. Healed fractures of …

Paleolithic Flints: Is An Aesthetics Of Stone Tools Possible?1, Riva Berleant Jan 2007

Paleolithic Flints: Is An Aesthetics Of Stone Tools Possible?1, Riva Berleant

Contemporary Aesthetics (Journal Archive)

This paper asks whether an aesthetics of Paleolithic tools is possible, and if so, what it might be. The application of our own aesthetic sensibilities to artifacts of prehistory is not difficult. We easily recognize and appreciate their visual and tactile qualities. The more complicated questions that the paper explores are whether we can uncover the aesthetic sensibilities of their makers and, if we cannot, whether aesthetic examination of prehistoric tools from our own perspectives is adequate or useful. The paper is based on study of Paleolithic flints from French archaeological sites dating from about 500,000 years ago to about …

On The Legal Consequences Of Sauces: Should Thomas Keller’S Recipes Be Per Se Copyrightable?, Christopher Buccafusco Jan 2007

On The Legal Consequences Of Sauces: Should Thomas Keller’S Recipes Be Per Se Copyrightable?, Christopher Buccafusco

Articles

The restaurant industry now takes in over $500 billion a year, but recent courts have been skeptical of the notion that one of its most valuable assets, original recipes, are subject to copyright protection. With more litigation looming and the contours of the debate insufficiently mapped out, this article establishes the appropriate groundwork for analyzing the copyrightability of recipes. I show that, contrary to recent appellate court opinions, recipes meet the statutory requirements for copyrightability. I argue, by analogizing to musical compositions, that written recipes work to satisfy the fixation requirement of copyright law just as musical notation does for …

Urban Danish Foodways And Ethnic Marketing Strategies In Bien, 1900-1950, Catrine Kyster Christensen Giery Jan 2007

Urban Danish Foodways And Ethnic Marketing Strategies In Bien, 1900-1950, Catrine Kyster Christensen Giery

The Bridge

Food culture is an integral part of popular culture. Fabio Parasecoli defines popular culture as “the totality of ideas, values, embodied experiences, representations, material items, practices, social relations, organizations, and institutions that are conceived, produced, experienced, and reciprocally connected within environments influenced by markets and consumption, with or without the specific economic goal of reaping a profit.” When food culture appears in the semi-public sphere—for example, in grocery stores, restaurants, bars, butcher stores, and bakeries, it demarcates a space where the desires and strategies of businessmen and consumers meet. Consumers want the products they need at an affordable price, and …

Building Culture, Community, And Morality: A Case Study Of Constructivist Leadership In The Creation Of A Junior High Football Team., Mark Edward Tankersley

Graduate Theses, Dissertations, and Problem Reports (ETD)

This research focused upon parents, educators, and community members’ ability to influence school culture, build community, and affect student morality while engaged in a constructivist leadership model in the creation of a junior high football team. The research was conducted in one school located in a Mid-Atlantic state. I was a teacher at that school during the time the study was conducted. A qualitative case study method was chosen in order to answer the how and why questions. Multiple sources of data were collected from observations, documents, and interviews with three parents, four educators, and three community members all associated …

Bishopness, Lauren Goodwin Slaughter Jan 2007

Bishopness, Lauren Goodwin Slaughter

Graduate Student Theses, Dissertations, & Professional Papers

The publication of "Edgar Allen Poe & the Juke-Box" modifies Elizabeth Bishop’s established oeuvre in ways that demonstrate the anxiety throughout her work regarding the concealment of sexual difference—a concealment she often takes part in. As the poems reveal, by putting emphasis on particular kinds of clothing, Bishop emphasizes the necessary—but flawed—methods for that concealment. Black stockings, gloves, sailors hats, and other garments of traditional gender representation work as useful metaphors, symbolically engaging the construction of the literary image accepted in the academy which has produced the unified notion of “Bishopness” some critics still wish to uphold. When themes of …

Hunters In The Garden: Yup’Ik Subsistence And The Agricultural Myths Of Eden, Benjamin Kuntz Jan 2007

Hunters In The Garden: Yup’Ik Subsistence And The Agricultural Myths Of Eden, Benjamin Kuntz

Graduate Student Theses, Dissertations, & Professional Papers

Yup’ik writers and Yup’ik subsistence offer valuable challenges, parallels, and alternative models to mainstream nature writing’s discourse surrounding human relationships to the land, a discourse that carries an inherent agricultural bias. An introduction to western Alaska’s Nunivak Island provides context for Chapter 1, which demonstrates the fluidity of cultural, geographical, and historical margins through discussion of the works of Yup’ik journalist John Active and historian and ethnographer James Clifford. Chapter 2 provides an overview of Yup’ik subsistence centered around the community of Bethel, Alaska, then subjects mainstream nature writing, represented mostly by Wendell Berry, to critiques supplied by Canadian anthropologist …

The Faith Of Christ, Gaye Strathearn Jan 2007

The Faith Of Christ, Gaye Strathearn

Faculty Publications

AT THE 1988 MEETING OF THE Pauline Theology Group, a debate exploded that had been slowly percolating since the time of Martin Luther.¹ The debate focused on the translation and associated theological implications of eight passages (Romans 3:22, 26; Galatians 2:16, 20; 3:22, 26; Ephesians 3:12; Philippians 3:9).² Each of these passages consists of a phrase with the Greek word pistis (“faith”) in a genitive construction with a title for Jesus.³ Paul uses seven of them in his discussions of justification, showing how a believer is “made righteous.” The eighth passage, Ephesians 3:12, uses the genitive construction to describe how …

Project Camelot And Military Sponsorship Of Social Science Research: A Critical Discourse Analysis, Ryan Hunt Jan 2007

Project Camelot And Military Sponsorship Of Social Science Research: A Critical Discourse Analysis, Ryan Hunt

Electronic Theses and Dissertations

"Project Camelot" was an ambitious social science research project conceived and funded by the Army, one whose scope and level of funding was unprecedented as of its inception in 1964. It was created in order to examine the potential for "internal war" and insurgency in the "developing countries" of the world, and to identify actions that the U.S. and its allies could take to prevent or suppress such insurgencies. Historians have described the Project as an event of particular importance in the history of American social science, and have argued that it is related to significant changes in their structure …

Dialogic Communication In Collaborative Problem Solving Groups, Robert B. Innes Jan 2007

Dialogic Communication In Collaborative Problem Solving Groups, Robert B. Innes

International Journal for the Scholarship of Teaching & Learning

Discourse, especially dialogic communication between students in collaborative problem-solving groups, plays a central role in educational reforms informed by learning science. This study examined the quality of discourse in problem-based learning groups in a university course. The study found a low incidence of high quality dialogue (dialogic communication, elaboration and co-construction of ideas, productive disciplinary discourse) in 12 one-hour planning meetings. The most competent students took leadership in groups and made the majority of the conceptual contributions. Although there was a reasonable amount of time spent connecting theories to cases, there was little time spent in high-level analysis and very …
