Negligence In The Air: The Duty Of Care In Climate Change Litigation, James Salzman, David Hunter
Negligence In The Air: The Duty Of Care In Climate Change Litigation, James Salzman, David Hunter
Faculty Scholarship
The prospect of tort litigation against private parties has been gaining increasing attention by lawyers. While only three such cases have been filed thus far, observers (including the organizers of this symposium) clearly expect the number to increase significantly. Indeed, if successful, these and future cases will have a huge impact on the industries sued and, as hopeful lawyers have mused, could make the tobacco litigation look small by comparison. But will these cases succeed? As law students all dutifully learn in their first year Torts class, a prima facie negligence claim must satisfy four elements - duty, breach, causation, …

The primary mission of the law school library is to meet the information needs of the faculty and students of the institution it supports. In addition to their role in educating future lawyers, law schools are the major producers of scholarly literature in law and rely on academic law libraries to provide the resources and support needed for research and publication. Beyond support for the core functions of legal education and research, the specific missions of law school libraries vary depending on the size and missions of law schools of different types. Differences among law schools result in differences among …

Over a billion people in the world lack access to safe drinking water1. While numerous technological, medical, and educational solutions have been implemented for the benefit of disadvantaged communities, there is no 'magic bullet'. Instead, development agencies must partner directly with these communities to address their public health needs through appropriate technology solutions, backed up by education and assessment. The "Bring Your Own Water (BYOW) Treatment System" developed by the Engineers Without Borders-USA chapters at the University of Colorado at Boulder Chapter (EWB-CU) and the Johnson Space Center (EWB-JSC) is uniquely designed to address the water treatment requirements of two …

Beware The ‘Monological Imperatives’: Scholarly Writing For The Reader, Joan A. Magat
Beware The ‘Monological Imperatives’: Scholarly Writing For The Reader, Joan A. Magat
Faculty Scholarship
This article describes principles of effective academic writing - offered not as edicts, but as guidelines - for legal scholars in particular. The overall focus is style, but the discussion begins with observations of format. These are followed by a few stylistic principles that govern clear and effective writing. None of these principles is a revelation to the student of method or to the accomplished writer. But for the academic writer less focused on or less familiar with such principles, being aware of and practicing them can clear the fog from syntax, illuminate the writer's thesis and its development, and …
Reforming Punishment Of Financial Reporting Fraud, Samuel W. Buell
Reforming Punishment Of Financial Reporting Fraud, Samuel W. Buell
Faculty Scholarship
Present sentencing law in criminal cases of financial reporting fraud is embarrassingly flawed. The problem is urgent given that courts are now regularly sentencing corporate offenders, sometimes (but sometimes not) to extremely punitive terms of imprisonment. Policing of fraud by multiple jurisdictions in a federal system means that principled sentencing law is necessary not only for first-order policy reasons but also for coordination of sanctioning efforts. Proportionality and rationality demand that sentencing law have an agreed scale for measuring cases of financial reporting fraud in relation to each other, a sound methodology for fixing a given case on that scale, …

Senescence is a permanent growth arrest that restricts the lifespan of primary cells in culture, and represents an in vitro model for aging. Senescence functions as a tumor suppressor mechanism that can be induced independent of replicative crisis by diverse stress stimuli. RNase-L mediates antiproliferative activities and functions as a tumor suppressor in prostate cancer, therefore, we examined a role for RNase-L in cellular senescence and aging. Ectopic expression of RNase-L induced a senescent morphology, a decrease in DNA synthesis, an increase in senescence-associated -galactosidase activity, and accelerated replicative senescence. In contrast, senescence was retarded in RNase-L-null fibroblasts compared with …

The Value Of Seizure Semiology In Lateralizing And Localizing Partially Originating Seizures, Mohammed M. Jan
The Value Of Seizure Semiology In Lateralizing And Localizing Partially Originating Seizures, Mohammed M. Jan
Neurosciences
Diagnosing epilepsy depends heavily on a detailed, and accurate description of the abnormal transient neurological manifestations. Observing the seizures yields important semiologic features that characterize epilepsy. Video-EEG monitoring allows the identification of important lateralizing (left versus right), and localizing (involved brain region) semiologic features. This information is vital for identifying the seizure origin for possible surgical interventions. The aim of this review is to present a summary of important semiologic characteristics of various seizures that are important for accurate seizure lateralization and localization. This would most likely help during reviewing video-EEG recorded seizures of intractable patients for possible epilepsy surgery. …

Spinal Intramedullary Cavernous Hemangioma, Tarig S. Al-Khuwaitir, Hassabo B. Mohammed, Ali G. Al-Ghamdi, Ruslan A. Rzayev
Neurosciences
The spinal cord can be involved in a variety of disease processes. These can be congenital or acquired. An acute onset of symptoms usually allows a defined set of causes to be considered including trauma, ruptured vascular anomalies, demyelination, and myelitis. Intramedullary cavernous hemangioma of the spinal cord is a congenital or acquired vascular malformation, and one of the rare causes of hematomyelia. We present such a case, and discuss the symptoms, diagnosis, and suggested best treatment options based on a review of present day literature.

Variant Structures Potent To Compress The Median Nerve In The Arm, Srinivasa R. Bolla, Venkata R. Vollala, Mohandas Rao, Sudarshan Surendran
Neurosciences
The most commonly known nerve compression syndrome is carpal tunnel syndrome, in which the median nerve is compressed at the wrist. Along with the pathological processes, some of the anatomically variant structures can also compress the nerves and often leads to confusion in the diagnosis and treatment if one is unaware of such possible anatomical variants. Here, we present a case of possible median nerve compression by an additional belly of coracobrachialis and a fascial sheet from the brachialis, and we also discuss the other possible structures that can compress the median nerve.
