When Iraq regains political stability, major reconstruction projects will have to be funded and local businesses will need financing in order to gain a foothold in the new economy. In order to attract the necessary capital, the Iraqi law of secured transactions must be reformed to allow for lenders to take security in the assets of their borrowers. However, the challenge of reforming Iraqi commercial law is complicated by the requirement under the new Iraqi Constitution that any new statutes enacted by the Iraqi legislature must comply with the principles of Islamic law. Humane Education, Dissection, And The Law, Marcia Goodman Kramer

Animal Law Review

Students regularly encounter animal dissection in education, yet humane education receives little attention in animal law. This article analyzes the status of humane education laws in the United States. It discusses the range of statutory protections, from student choice laws to bans on vivisection. The article then analyzes the litigation options for students who do not wish to dissect, including constitutional claims and claims arising under student choice laws. The article concludes by calling for additional legislation to protect students who have ethical objections to dissection.

Living resources in the deep sea have attracted increased attention over the past few decades. As science and technology advance our ability to explore these areas, the extent of marine biodiversity being discovered is astonishing. Unfortunately, beyond national boundaries this abundance of life is largely unprotected. This article will explore the current legal regime governing marine biodiversity in areas beyond national jurisdiction. It will identify gaps in the regime and suggest a solution in the form of a framework for an implementation agreement to the United Nations Convention on the Law of the Sea. The story of King Solomon includes the often-told tale of two women, both claiming ownership of one baby, who come before the king’s court in order to resolve their quarrel as to which of them is the true mother. This article recounts a modern-day King Solomon story: the “baby” is the animals left behind during Hurricane Katrina; the two mothers claiming ownership of the “baby” are the original owners of the animals and those who adopted the animals after the hurricane; and the role of King Solomon is played by judges in the custody dispute cases that arose after the …

Privatizing Eminent Domain: The Delegation Of A Very Public Power To Private, Non-Profit And Charitable Corporations , Asmara Tekle Johnson

In an age of privatization of many governmental functions such as health care, prison management, and warfare, this Article poses the question as to whether eminent domain should be among them. Unlike other privatized functions, eminent domain is a traditionally governmental and highly coercive power, akin to the government’s power to tax, to arrest individuals, and to license. It is, therefore, a very public power.

This Article examines the use of history in legal interpretation through an empirical analysis of one of the most prominent examples of historical evidence in law: citations to The Federalist in Supreme Court Justices' published opinions. In particular, the Article examines a phenomenon that has occurred frequently over the last two decades, but has thus far been virtually ignored: the citation by different Justices to the same historical source (such as The Federalist) to support divergent or opposing historical interpretations of legal meaning. Effects Of Letter Transposition In Subliminal Primes On Perceived Content Of Abstract Images, C.S. Bailey, Amanda K. Harsin, Suzie Heffernan

The Journal of Undergraduate Research

Subliminal presentation of a stimulus can influence responses to later stimuli. This effect is known as priming. The current study used Microsoft PowerPoint as a novel, low-cost paradigm to present experimental stimuli. Thirty-one undergraduate participants viewed a PowerPoint presentation that contained conditions with no, with unscrambled, and with center-scrambled sexually-themed messages. The effects of gender, counterbalancing, and type of message on perceived sexual content in experimenter-made inkblots was assessed. The current study failed to find any significant differences or interaction effects between any of the variables. A post-hoc analysis revealed a significant priming effect. Vibration Analysis Of A Boat And Dock, Annicka Gunderson

A structure is designed to withstand the maximum force that will be applied. In this case a boat dock is examined as a spring system. This exercise uses a typical design for a lake side boat dock, tires for buoys, and an average fishing boat. Vibration analysis can predict when the highest forces will occur. A solution can be found to graph the motion of the dock. In addition to the analytical solution, the MATLAB program is used to visualize the vibrations. With these tools the magnitude and timing of forces can be verified.

Impacts Of Davisco's Lake Norden Cheese Plant, Linnea C. Swanson

This paper addresses the regional impact of the Davisco Foods International cheese plant in Lake Norden, South Dakota. Since opening in November 2003, the $40 million plant has exerted a growing influence on dairying throughout eastern South Dakota and adjacent areas, as well as influencing the community of Lake Norden, the cultural landscape, the economy, and the environment in various ways. Each topic is investigated from a geographic perspective based primarily on field research. As the plant continues to expand, its impact on the covered topics deepens, both negatively and positively.

Bovine viral diarrhea virus (BVDV) is a common virus among cattle, and there are many different strains of the virus. BVDV can cause mucosal disease in infected cattle. There are lab strains of BVDV used for testing, but there are also wild-type viruses that may develop within a herd or population. These wild-type strains can be dangerous due to cross contamination between herds. This project compares serum samples from two different herds on the basis of the antibody response to a wild-type virus isolated from a persistent infected animal in one of the herds. Multiple modulating genes and environmental factors have been implicated in the pathogenesis of high-altitude pulmonary edema (HAPE). However, at the present time, there exists an incomplete understanding of the molecular mechanisms and pathways which underlie constitutional susceptibility. Genome-wide measurements of gene expression in peripheral blood mononuclear cells (PBMCs) were performed using microarray technology. Comparison of gene expression profiles of HAPE-susceptible and resistant individuals resulted in the identification of several previously undescribed candidate genes. RhoA and Rho-kinase (ROCK), regulators of vascular smooth muscle contraction, were differentially regulated in the HAPE-susceptible cohort, as compared to both HAPE-resistant patients with acute mountain sickness …

In 1869, a mere four years after the end of the Civil War and during a time when Southern sentiment ran high in Washington, D.C., three African-American physicians applied for membership into the all-white Medical Society of the District of Columbia (MSDC). Though meeting all eligibility requirements, they were denied admission into this society based solely on their race. Objective: Although highly active antiretroviral therapy (HAART) resolves a significant proportion of anemia among HIV-patients in Western cohorts, outcomes may vary in developing countries, due to a higher prevalence of nutritional deficiencies, intestinal parasites, tuberculosis, and opportunistic infections. The purpose of this study is to describe the prevalence of, factors associated with, and influence of HAART on, anemia among HIV-infected individuals in South India. Methods: To examine factors associated with anemia, the first-recorded hemoglobin values for adults who visited an HIV tertiary care center in Chennai, India between January 1996 and April 2006 were collected (n=7069). Switchgrass has future potential in the Southern Plains as a dedicated cellulosic biofuels crop. In the near and intermediate terms, an economically viable use for switchgrass needs to be found. In May 2007, the Noble Foundation Agricultural Division successfully established a 30-acre field of switchgrass at the Red River Demonstration and Research Farm. Beginning in April 2008, we will evaluate the utilization and value of switchgrass for stocker cattle. Switchgrass may have value for stockers because of its early spring availability, high yields, perennial life form, wide adaptability and low fertilization requirements.
