In The Dark: A Consumer Perspective On Fcc Broadcast Indecency Denials, Genelle I. Belmas, Gail D. Love, Brian C. Foy

Federal Communications Law Journal

Indecency regulation has been a hot political and social topic since Janet Jackson revealed her breast during the 2004 Super Bowl halftime show. The number of indecency complaints the FCC receives each year continues to rise. Moreover, to further complicate matters, in 2007 the Second Circuit overturned the FCC policy that so-called "fleeting expletives" would be considered indecent. However, there has been no systematic review of the complaints from the perspective of the complainant. How has the FCC managed its increasing indecency complaint load, and what does it tell consumers who have taken the time to write formal complaints about …

The Ecological Boundaries Of Six Carolina Bays: Community Composition And Ecotone Distribution, Lorrie Laliberte, James O. Luken, John J. Hutchens Jr., Kevin S. Godwin

Biology

Community and environmental gradients within the ecological boundaries of Carolina bay wetlands may provide important information on the interaction between Carolina bays and associated uplands, and may also provide guidance for improved management. We established twelve 30-m transects on the sloping rims of each of six Carolina bays in northeastern South Carolina to characterize the community gradient, as well as important environmental factors producing this gradient. Mid-points of the transects were placed on jurisdictional wetland boundaries. Hydrology, soil properties, and plant species composition were measured within these transects. On average, transects included an elevation change of 0.6 m that corresponded …

College of Graduate Studies: Theses & Dissertations

This thesis examines mark-making techniques in my art and surveys the literary and musical works that inspired it. An historical examination of the role of mark-making in art will be undertaken, beginning with Paleolithic cave art, continuing with Native American petroglyphs and pictographs, and concluding with three contemporary visual artists whose marks have influenced my work: Jean-Michel Basquiat, Cy Twombly, and Susan Rothenberg. Finally, my artistic process is explained through references to the materials and rituals used to create a body of art. This thesis researches the meaning behind artistic marks, and how marks are made in my paintings and …

Creating Nomads: The Importance Of Education In Forming The Multitude, Cecil Steven Page

College of Graduate Studies: Theses & Dissertations

Education in the United States continues to focus on creating students to become good local citizens and this needs to change due to the globalized world in which we live. Through a poststructuralist lens and utilizing the works of Micheal Hardt and Antonio Negri this work examines the major institutions that control our world. This work examines the relationship between trans-national corporations and non-governmental organizations and the need for greater transparency in contributions. I propose that one of the major forces in Empire is the World Bank due to the loans that are made and the repayment agreements that are …

Occurrence And Biological Effect Of Exogenous Steroids In The Elkhorn River, Nebraska, Usa, Alan S. Kolok, Daniel D. Snow, Satomi Kohno, Marlo K. Sellin, Louis J. Guillette Jr.

Nebraska Water Center: Faculty Publications

Recent studies of surface waters in North America, Japan, and Europe have reported the presence of steroidogenic agents as contaminants. The current study has three objectives: 1) to determine if steroidogenic compounds are present in the Elkhorn River, 2) to determine if sediments collected from the Elkhorn River can act as a source of steroidogenic compounds to aquatic organisms, and 3) to determine if site-specific biological effects are apparent in the hepatic gene expression of fathead minnows. Evidence was obtained using three approaches: 1) deployment of polar organic chemical integrative samplers (POCIS), 2) deployment of caged fathead minnows, and 3) …

Modulatory Efferent Morphology And Target Allocation With Co-Innervating Leech Motor Neurons, James Melchior Dec 2007

Modulatory Efferent Morphology And Target Allocation With Co-Innervating Leech Motor Neurons, James Melchior

Masters Theses

The leech, Hirudo, has two efferents that converge upon the heart tube (HT) muscle; the segmentally iterated heart excitor motor neurons (HE), and the modulatory heart accessory neurons (HA). Using intracellular dye injections and antibody labeling, we were able to visualize and distinguish the morphologies of these two efferents. We found that HA(5) provides dense coverage of the anterior segments of heart tube muscle and extends along the HT into the posterior segments 6 and 7, while HA(6) projects centrally for several segments before extending into the periphery. HA(5) and HA(6) homologs show little or no overlap on HT …

Phylogenetic Relationships Within Coleeae (Bignoniaceae Juss.), Andreina Carvajal Dec 2007

Phylogenetic Relationships Within Coleeae (Bignoniaceae Juss.), Andreina Carvajal

College of Graduate Studies: Theses & Dissertations

On Madagascar, Bignoniaceae is represented by tribes Coleeae (4 genera/58 species) and Tecomeae (4 genera/15 species). Species of Coleeae occur in assemblages of sympatric, locally endemic species. The purpose of this study was to explore the phylogenetic relationships within Coleeae. In order to do so, techniques such as PCR by using universal primers for waxy nuclear gene, agarose electrophoresis, cloning and sequencing were performed. A total of 26 taxa were successfully amplified. Sequences were analyzed using three different phylogenetic programs (Maximum parsimony, maximum likelihood and Bayesian analysis) resulting in various phylogenetic trees. Main conclusions drawn from this work are: 1. …

Analysis Of Compelling And Constraining Forces Experienced By Georgia High School Principals Implementing Smaller Learning Communities, Martin Gregory Waters Dec 2007

Analysis Of Compelling And Constraining Forces Experienced By Georgia High School Principals Implementing Smaller Learning Communities, Martin Gregory Waters

College of Graduate Studies: Theses & Dissertations

The research on smaller learning communities is extensive, and the benefits are documented, compelling, and persuasive. While the practice can become the engine for higher achievement, stakeholders must adjust to a new paradigm of school operations. In many cases, prior procedures and traditions must be abandoned to achieve academic, social, and school environmental goals. Several unknown factors exist in Georgia's high schools as administrators attempt to find programs and procedures to meet the needs of rapidly growing and diverse student populations. First, little is known about the experiences of Georgia high school principals implementing smaller learning communities, nor the forces …

Glycosaminoglycan Stabilization In Bovine Pericardium, Lauren Browne Dec 2007

Glycosaminoglycan Stabilization In Bovine Pericardium, Lauren Browne

All Theses

Glutaraldehyde crosslinked bovine pericardium has been used for fabrication of bioprosthetic heart valves as well as cardiac patches for soft tissue repair. However, calcification and limited mechanical stability result in shortened life for the prostheses. Previous research has shown that glutaraldehyde crosslinking does not stabilize glycosaminoglycans (GAGs) and that GAGs are lost from porcine bioprosthetic heart valves[1]. Bovine pericardial tissue is composed of an amorphous network of collagen and elastin fibers, proteoglycans, and GAGs. The GAGs of bovine pericardium include dermatan sulfate, chondroitin sulfate, and hyaluronan [2].
It is hypothesized that Glut does not stabilize GAGs in pericardium and loss …

Use Of Native Seed Mixtures To Improve Erosion Control And Wildlife Habitat On Log Landings Following Timber Harvest In The Upper Elk Watershed Of West Virginia, Lisa R. Tager

Graduate Theses, Dissertations, and Problem Reports (ETD)

Foresters in West Virginia follow BMP guidelines by reseeding retired log landings with inexpensive grasses that quickly provide erosion control. However, these grasses typically are not native nor do they provide high quality forage for wildlife. I developed 3 native seed mixtures for log landing reclamation that would maintain sediment control, as well as enhance wildlife habitat. These mixtures included an erosion control mixture, a wildlife mixture, and a wildflower mixture. I assessed sediment control, biomass production, vegetation structure, forage quality, and small mammal usage of my native mixtures and a commonly used, nonnative traditional mixture in 2005 and 2006. …

Expression Profiling Of Oocyte Specific Genes, Transcription Factors And Micrornas During Early Embryonic Development In Rainbow Trout (Onchorhyncus Mykiss), Raghuveer K. Ramachandra

Graduate Theses, Dissertations, and Problem Reports (ETD)

Genes specifically expressed in oocytes are important for the development of oocytes and early embryos. By analyzing ESTs from a rainbow trout oocyte cDNA library, we identified a novel EST sequence that does not show homology to any sequences in the GenBank. Analysis of tissue distribution by RT-PCR revealed that this gene was only expressed in unfertilized oocytes. Sequencing of the EST clone identified a cDNA of 3163 bp. Northern blot analysis showed the novel gene has a single transcript of 3.4 kb. Additional 5' sequence was obtained by 5' RACE, extending the novel cDNA to 3333 bp. Analysis of …

The New Legal Realism, Cass R. Sunstein, Thomas J. Miles Dec 2007

The New Legal Realism, Cass R. Sunstein, Thomas J. Miles

Public Law and Legal Theory Working Papers

The last decade has witnessed the birth of the New Legal Realism—an effort to go beyond the old realism by testing competing hypotheses about the role of law and politics in judicial decisions, with reference to large sets and statistical analysis. The New Legal Realists have uncovered a Standard Model of Judicial Behavior, demonstrating significant differences between Republican appointees and Democratic appointees, and showing that such differences can be diminished or heightened by panel composition. The New Legal Realists have also started to find that race, sex, and other demographic characteristics sometimes have effects on judicial judgments. At the same …

Ralbp1 In Stress Resistance, Kenneth Drake Dec 2007

Ralbp1 In Stress Resistance, Kenneth Drake

Chemistry & Biochemistry Dissertations - Archive

Ralbp1 is a multi-specific transporter of glutathione conjugates as well as unconjugated amphiphilic toxins. Because glutathione conjugates are major metabolites of toxic lipid peroxidation products generated as a consequence of oxidant and radiant stress, the hypothesis is put forth that the function of Ralbp1 in-vivo and in vitro should be to protect organisms from chemical stress by removing toxic chemicals. Studies described in this dissertation were designed to prove this hypothesis. We tested the hypothesis by examining whether the inhibition or augmentation of Ralbp1 would sensitize or protect cells and whole animals from the toxic effects of chemicals and radiation. …

Shipibo Hunting And The Overkill Hypothesis, Warren M. Hern Dec 2007

Shipibo Hunting And The Overkill Hypothesis, Warren M. Hern

Tipití: Journal of the Society for the Anthropology of Lowland South America

The "overkill" hypothesis, as promulgated by Paul Martin and others, is supported by evidence of asynchronous extinction of megafauna and other species in North America associated with the arrival of Pleistocene hunters in the Western Hemisphere. In this essay, further evidence—based on observations made of the response of a small party of Shipibo hunters in the upper Peruvian Amazon—is offered in support of the hypothesis. These observations were made during an exploratory tripinto the headwaters of a remote Amazonian tributary, a pristine area not occupied by human beings that was plentiful with wildlife. The Shipibo aggressively took the opportunity to …

Genome-Wide Transcriptional Profiling Of The Cyclic Amp-Dependent Signaling Pathway During Morphogenic Transitions Of Candida Albicans, Yong-Sun Bahn, Matthew Molenda, Janet F. Staab, Courtney A. Lyman, Laura J. Gordon, Paula Sundstrom

Dartmouth Scholarship

Candida albicans is an opportunistic human fungal pathogen that causes systemic candidiasis as well as superficial mucosal candidiasis. In response to the host environment, C. albicans transitions between yeast and hyphal forms. In particular, hyphal growth is important in facilitating adhesion and invasion of host tissues, concomitant with the expression of various hypha-specific virulence factors. In previous work, we showed that the cyclic AMP (cAMP) signaling pathway plays a crucial role in morphogenic transitions and virulence of C. albicans by studying genes encoding adenylate cyclase-associated protein (CAP1) and high-affinity phosphodiesterase (PDE2) (Y. Frontier Settlement And Community Development In Richardson, Burt, And Platte Counties, Nebraska, 1854–1870, Nicholas Joseph Aieta

Department of History: Dissertations, Theses, and Student Research

The Nebraska Territory was established in 1854. Consisting of lands that encompass modern-day Nebraska, South Dakota, North Dakota, Wyoming, Colorado, and parts of Montana, the region was quite extensive. Originally, this land was part of the Louisiana Purchase, and some of the land had been reserved for Native American relocation following various treaties of the 1830s and 1840s. As pressures mounted to open the land for white settlement, both Nebraska and Kansas were established as territories in 1854.

The objective of this research is to examine the foundations of community in Nebraska Territory during the years 1854-1870. Specifically, this dissertation …
