International Union, U.A.W. V. Johnson Controls: The History Of Litigation Alliances And Mobilization To Challenge Fetal Protection Policies, Caroline Bettinger-Lopez, Susan P. Sturm

The Supreme Court's decision in Johnson Controls is the culmination of a long legal campaign by labor, women's rights, and workplace safety advocates to invalidate restrictions on women's employment based on pregnancy. This campaign powerfully demonstrates the use of amicus briefs as opportunities to link the efforts of groups with overlapping agendas and to shape the Supreme Court's understanding of the surrounding empirical, social and political context. But Johnson Controls also provides important lessons about the narrowing effects and fragility of litigation-centered mobilization. Fusarium head blight (FHB) of wheat and barley has reached epidemic proportions in the United States. FHB in the United States is mainly caused by Fusarium graminearum within the Fusarium species complex. Current methods such as crop rotation and the use of fungicides to control outbreaks have been poor at best. Knowledge of the organism's genome could focus and further research for new methods to control this pathogenic fungus. This study seeks to create a genetic linkage map from an intraspecific cross of the isolates Z-3939 and Z-4243, both isolated from the fields of Kansas. Black students who attend school regularly, participate in the classroom experience — by either participating in class and/or turning in homework, take “AP” classes, and who perform well on tests are, not uncommonly, accused of “acting white.” This happened to me as a child, it has happened to my children and it has happened to black youth I have interviewed throughout the country. This Article explores the practice within the black community of blacks who attack — verbally and sometimes physically — other blacks simply because the latter perform well in school. In 2006 the law of war experienced two major shock waves. The first was the decision of the Supreme Court in Hamdan, which represented the first major defeat of the President's plan, based on an executive order of November 2001, to use military tribunals against suspected international terrorists. The majority of the Court held the procedures used in the military tribunal against Hamdan violated common article three of the Geneva Conventions. A plurality offour, with the opinion written by Justice Stevens, based their decision as well on afar-reaching interpretation of the substantive law of war. They held that conspiracy …

Claims of judicial activism are common, from both the right and the left, but they are seldom scrutinized closely. Prior tests of judicial activism have involved simply counting the number of cases in which justices vote to invalidate statutes. This data provides a rough guide but omits any consideration of the judicial legitimacy of the statute - a decision to strike down a plainly unconstitutional statute is appropriate judicial behavior. To provide a better test, we adjust the count of statutory invalidations for each justice of the Burger Court, based upon the degree to which the votes show a consistent …

Abortion and equality are a common pairing; courts as well as legal scholars have noted the importance of abortion and a woman's ability to control whether and when she has children to her ability to participate fully and equally in society. Abortion and administrative regulation, on the other hand, are a more unusual combination. Most restrictions on abortion are legislatively imposed, while guarantees of reproductive freedom are constitutionally derived, so administrative law does not frequently figure in debates about access to abortion.

Resistance Of The Target Islet Tissue To Autoimmune Destruction Contributes To Genetic Susceptibility In Type 1 Diabetes., Natasha J. Hill, Aleksandr Stotland, Michelle Solomon, Patrick Secrest, Elizabeth Getzoff, Nora Sarvetnick

Type 1 diabetes occurs when self-reactive T lymphocytes destroy the insulin-producing islet beta cells of the pancreas. The defects causing this disease have often been assumed to occur exclusively in the immune system. We present evidence that genetic variation at the Idd9 diabetes susceptibility locus determines the resilience of the targets of autoimmunity, the islets, to destruction. Susceptible islets exhibit hyper-responsiveness to inflammatory cytokines resulting in enhanced cell death and increased expression of the death receptor Fas. Fas upregulation in beta cells is mediated by TNFR2, and colocalization of TNFR2 with the adaptor TRAF2 in NOD beta cells is altered. …

This paper asks whether an aesthetics of Paleolithic tools is possible, and if so, what it might be. The application of our own aesthetic sensibilities to artifacts of prehistory is not difficult. We easily recognize and appreciate their visual and tactile qualities. The more complicated questions that the paper explores are whether we can uncover the aesthetic sensibilities of their makers and, if we cannot, whether aesthetic examination of prehistoric tools from our own perspectives is adequate or useful. This essay explores the relations between perception, phenomenology and art practice. The object of my inquiry is the kind of perceptual repertoire available to the artist in relation to his art, which extends beyond the technical means available to art making in its varying forms. I invoke an artist's innate perception as the source and locus of art's creation. This creation of art also has an outward or phenomenological dimension. Purpose: This research evaluated relationships among hospital types (Magnet versus non-Magnet), nurse manger leadership attributes, and staff registered nurse autonomy. Hypothesis: Magnet hospital status would be related to positive nurse manager leadership attributes which would be related to greater clinical nurse autonomy and nurse manager leadership would mediate relationships between hospital status and clinical nurse autonomy. Conceptual Basis and Background: Structural Contingency Theory modified in the Nursing Systems Outcomes Research model was the research model for conceptualizing the structure-environment-effectiveness relationship. This Essay, which was written for the Ohio State Law Journal's symposium on Election Law and the Roberts Court, examines the Court's decision in League of United Latin American Citizens (LULAC) v. Perry. The Essay explores two ways of reading LULAC: first as a racial representation case and second as a case concerned with representation itself. The essay argues that politics not race is the majority's worry in LULAC and that the case is the first application of Justice Kennedy's representation rights concept first introduced in Vieth.

In this dissertation I examine “gay” life in the Philippines by focusing on a longstanding friendship group of same-sex attracted middle-class young men living in Metro Manila who identify as bakla/gay/homosexual. I explain how dynamics of gender and sexuality including identity expression are conceptualised, articulated and negotiated through the interphase of Philippine culture, social class, economic status and the cultural appropriation and adaptation of elements of Western gay discourse and lifestyle. Soil Fertility And Productivity Relationships In Rice Production System, Bangladesh, S Rahman, Rj Parkinson

This paper presents an econometric analysis of the influence of soil fertility status on productivity and resource use in rice production utilizing survey data from 21 villages in three agro-ecological regions of Bangladesh. Detailed crop husbandry input-output data were collected from 380 paddy rice (Oryza sativa) farmers. Data collected included fertilizer, pesticide, labour, animal power services, irrigation, farm capital assets and rice yield. The soil fertility status in each region was determined by analysis of soil organic carbon, available nitrogen, phosphorus and potassium concentration. The purpose of this experimental study was to determine which of three methods of vocabulary instruction, including the common approach method, a combination of the common approach method and keyword method, and a combination of the common approach method and the keyword/illustration method of instruction was most effective in teaching mathematics vocabulary over the course of two mathematical units. Grade eight students (N=60) from two rural middle schools who scored at the basic level on the 2006 Maryland School Assessment (MSA) in mathematics and reading participated in this experimental study. Christine Wicker, a senior religion reporter for The Dallas Morning News, captures an intriguing aspect of the spirit of Robert Greenleaf and the servant-leadership movement he created in her essay, Seeking the Soul of Business. Wicker observes that "None dare call it religious! But a management philosophy catching on at companies across America sounds so much like religion that adherents are sometimes at pains to make the difference clear. This is spirituality. Ethics. Hypoxia inducible factor-1 is a heterodimeric basic-loop-helix transcription factor composed of two subunits, HIF-1alpha and HIF-1beta. HIF-1beta is constitutively expressed in cells, while HIF-1alpha is upregulated by hypoxia as well as growth factors and oncogenes. In this study we focus on the regulation of HIF-1alpha expression by phosphatidylinositol-3 kinase (PI3K), and novel functions of HIF-1alpha. Chapter 1 of this dissertation, consists of background and a brief review of the literature regarding PI3K signaling and HIF-1alpha. Chapter 2 focuses on the observation that basal HIF-1alpha expression is upregulated in ovarian cancer and the mechanism by which PI3K regulates this effect. Chapter …

The pesticide 3,4-dichloropropionanilide (propanil or alternatively, DCPA) is a post-emergent herbicide predominantly used for the control of weeds on commercial rice crops worldwide. The US Environmental Protection Agency report on "Pesticides Industry Sales and Usage in 2001" ranked propanil as the 17th most used herbicide in the US. It is applied on the fields via groundboom sprayers or aerial equipment suppressing photosynthesis and carbon fixation of a growing plant. The primary target of herbicide exposure is personnel working in the manufacturing and application who are required to wear personal protective equipment to minimize the exposure.
