A Venture In Native American Shield Making, Mary Margaret Hinojosa Jan 2007

A Venture In Native American Shield Making, Mary Margaret Hinojosa

Graduate Student Theses, Dissertations, & Professional Papers

Hinojosa, Mary, Master of Arts, Summer 2007 Integrated Arts and Education Change in Focus Chairperson: Dr. Randy Bolton Our school district has an exceptionally low rate of parental involvement in the educational process of our students. Establishing a “Parent Corner” in the lobby of our school would aid in the solution of this dilemma. What a perfect undertaking for a final project. The intent of this project would be to make parents feel welcome, comfortable and a part of their child’s educational experience. From the beginning it was apparent things were not going to work out as planned. Some items …

Action-Oriented Sustainable Agriculture Education: Attitudes Towards Nutrition And Agricultural Practices In Guaimaca, Honduras, Sarah Lynne Potenza Jan 2007

Action-Oriented Sustainable Agriculture Education: Attitudes Towards Nutrition And Agricultural Practices In Guaimaca, Honduras, Sarah Lynne Potenza

Graduate Student Theses, Dissertations, & Professional Papers

Agricultural policies and global economic forces negatively affect many small-scale farmers in developing countries, resulting in widespread micronutrient malnutrition and environmental degradation. This study explores the connections between these issues, and the efficacy of using participatory education on sustainable agriculture to address them at a local level. Specifically, it evaluates an action-oriented education and sustainable agriculture program in Honduras, from the perspective of the participants and my own participation, as a means to improve agricultural practices and rural nutrition among subsistence farmers. As in many developing countries, access to land, poor soil conditions, steep hillsides, adverse climatic conditions, and limited …

The Tongue River Bison Jump (24rb2135): The Technological Organization Of Late Prehistoric Period Hunter-Gatherers In Southeastern Montana, Joseph Shawn Hamilton Jan 2007

The Tongue River Bison Jump (24rb2135): The Technological Organization Of Late Prehistoric Period Hunter-Gatherers In Southeastern Montana, Joseph Shawn Hamilton

Graduate Student Theses, Dissertations, & Professional Papers

Bison hunting has long been recognized as a key element of the lifeways of American Indians of the Northwestern Plains. Bison served as an integral component for food, shelter, tools, and clothing. It is no surprise that the importance bison hunting, as a socioeconomic institution, is revealed in the archaeological record of this region. A study of the material culture, most often lithic tools, found at prehistoric bison kills and processing sites allows archaeologists to draw inferences about the technology associated with the procurement of such vital animals. An investigation of bison jump, trap or pound lithic assemblage can provide …

Probing Isoforms Of The Prion Protein Through Tyrosine Nitration, Christopher William Lennon Jan 2007

Probing Isoforms Of The Prion Protein Through Tyrosine Nitration, Christopher William Lennon

Graduate Student Theses, Dissertations, & Professional Papers

The prion protein (PrP) has multiple stable isoforms. When PrP misfolds, it aggregates and causes neurological disease and death in mammals. The structure of the non-pathogenic isoform has been determined while the structures of the disease related isoforms are unknown. The nitration labeling patterns of three PrP isoforms with peroxynitrite and tetranitromethane, as detected by mass spectrometry, are reported. Two conserved tyrosine residues (tyrosines 149 and 150) are not labeled by either reagent in the normal cellular form of the prion protein but these residues become reactive after the protein has been converted to one of two aggregated isoforms. Another …

Impacts Of White, Roy A. Schotland Jan 2007

Impacts Of White, Roy A. Schotland

Georgetown Law Faculty Publications and Other Works

Changes in judicial elections stem from four identifiable causes. First, court decisions involve increasingly higher stakes and more serious consequences. The U.S. Senate confirmation battles also reflect this cause. Second, non-candidate groups, many from out of state, bring in enormous sums of money which often leads to ugly, even damaging, campaigns. Third, the first two causes are making judicial campaigns more like non-judicial campaigns, bringing new elements to judicial campaigns: campaign consultants and a win-at-any-cost approach.

Domain And Forum: Public Space, Public Freedom, Rebecca Tushnet

Georgetown Law Faculty Publications and Other Works

The particular problems of content and viewpoint discrimination rarely surface in copyright, though some people have argued that fair use implicates them. Nonetheless, one important lesson for copyright from public forum doctrine is that First Amendment law can take some - though not many - speech-related options off the table. In this brief comment, I argue that analogies between copyright law and public forum doctrine highlight important shared commitments to free and robust public discourse, but also substantial practical barriers to judicial enforcement of those commitments.

Conservation Of Leopards In Ayubia National Park, Pakistan, Asad Lodhi Jan 2007

Conservation Of Leopards In Ayubia National Park, Pakistan, Asad Lodhi

Graduate Student Theses, Dissertations, & Professional Papers

Lodhi, Asad M.S. May 2007 Wildlife Biology Conservation of leopard in Ayubia National Park, Pakistan Committee Chair: Dr. Daniel H. Pletscher Large carnivores are important for biodiversity and ecosystem function, yet are very difficult to conserve because of their large home ranges and conflicts with humans. I examined human-leopard conflicts in and near Ayubia National Park, Pakistan, to provide management recommendations for the conservation of leopards. Persecution of leopards by humans has been on the rise primarily due to depredation on livestock and risk to human lives. Since 1989, 16 humans have either been killed or injured in and around …

Constraints And Opportunities Of Conservation Easements As A Tool For Agricultural Preservation In The Blackfoot Valley, Montana, Megan Huth Jan 2007

Constraints And Opportunities Of Conservation Easements As A Tool For Agricultural Preservation In The Blackfoot Valley, Montana, Megan Huth

Graduate Student Theses, Dissertations, & Professional Papers

Huth, Megan, M.S., May 2007 Resource Conservation The Constraints and Opportunities of Conservation Easements as a Tool for Agricultural Preservation in the Blackfoot Valley, Montana Chairperson: Jill Belsky Conservation easements have historically been used by land trusts and government agencies to preserve private land from development and subdivision, to preserve unique geological features, and protect fish and wildlife habitat. The national and Montana state conservation easement legislation does not explicitly state agricultural land as a conservation value that they aim to preserve. As such, land trusts and government agencies that are the holders of conservation easements do not typically identify …

A Modern Examination Of Marcus Goldstein’S Mexican Immigrant Population Data: Comparisons Of Mexican-Born And U.S.-Born Children And Adults Living In 1930’S America And Mexico, Amanda Katelin Gango Jan 2007

A Modern Examination Of Marcus Goldstein’S Mexican Immigrant Population Data: Comparisons Of Mexican-Born And U.S.-Born Children And Adults Living In 1930’S America And Mexico, Amanda Katelin Gango

Graduate Student Theses, Dissertations, & Professional Papers

Modern statistical methods were employed in order to test the statistical validity and conclusions of Marcus Goldstein’s (1943) original data consisting of nineteen different anthropometric measurements on two different groups of individuals, Mexican immigrants and their children residing in the San Antonio, Texas area and Mexican natives living in central and northern Mexico. Using independent samples T-tests, an analysis of covariance, and an RMET analysis, significant differences among variables compared between Mexican natives and Mexican immigrants and their U.S. born children were identified and interpreted. Variation was attributed to geographical location and length of time spent in the United States. …

Development Of Fecal Dna Sampling Methods To Assess Genetic Population Structure Of Greater Yellowstone Bison, Florence Marie Gardipee Jan 2007

Development Of Fecal Dna Sampling Methods To Assess Genetic Population Structure Of Greater Yellowstone Bison, Florence Marie Gardipee

Graduate Student Theses, Dissertations, & Professional Papers

The bison (Bison bison) of Yellowstone National Park (YNP) and Grand Teton National Park (GTNP) represent two of only three remaining populations of plains bison that have no evidence of hybridization with cattle. Therefore, these bison are an important source for ecological and genetic restoration of wild bison. Little is known regarding genetic population structure and gene flow among the Greater Yellowstone Area (GYA) bison herds. I evaluated the feasibility of fecal DNA sampling for genetic analyses of wild bison populations. I used matched blood and fecal samples from eight radio-collared bison from Hayden Valley breeding group (YNP), and multiplex …

Food Supply Chains And Food-Miles: An Analysis For Selected Conventional, Non-Local Organic And Other-Alternative Foods Sold In Missoula, Montana, Kimberly Spielman Jan 2007

Food Supply Chains And Food-Miles: An Analysis For Selected Conventional, Non-Local Organic And Other-Alternative Foods Sold In Missoula, Montana, Kimberly Spielman

Graduate Student Theses, Dissertations, & Professional Papers

The spatial patterns of the conventional food supply chain have played a significant role in increasing the amount of miles food travels before being consumed. As a result, this has increased the amount of energy that is required to transport food from the farm to the table. The food supply chain links production to consumption. However, as food-miles increase, this link becomes obscure. The food supply chain can be described as having two very distinct parts: the conventional food supply chain and the alternative food supply chain. Business consolidation, and large-scale production, processing, distribution and retail characterize the conventional food …

Influence Of Mycorrhizal Inoculation Treatments On Native Tree And Shrub Survival In A Floodplain, Flathead Indian Reservation, T. Rene Kittle Jan 2007

Influence Of Mycorrhizal Inoculation Treatments On Native Tree And Shrub Survival In A Floodplain, Flathead Indian Reservation, T. Rene Kittle

Graduate Student Theses, Dissertations, & Professional Papers

Mycorrhizal inoculum treatments of two marketed products, Mycopak and Biogrow, were tested against forest soil, and a control treatment on biomass and survival of Populus tremuloides, Salix bebbiana, Populus trichocarpa, and Cornus stolonifera during the summer of 2003 and 2004. Because these seedlings are difficult to establish on cobbled riparian floodplains, the species and treatments were tested on two Jocko River floodplains. The Powell site was plowed in the spring of 2003 prior to planting, and the Stranahan site remained unplowed but treated with the broad leaf herbicide 2,4-D amine, in the fall of 2002. Seedlings were planted in the …

Knowledge And Use Of Native Trees By Local Forest Users: Implications For A Philippine Protected Area, Noah Jackson Jan 2007

Knowledge And Use Of Native Trees By Local Forest Users: Implications For A Philippine Protected Area, Noah Jackson

Graduate Student Theses, Dissertations, & Professional Papers

This thesis examines the forest knowledge of non-indigenous, local forest users in the Northwest Panay Protected Area located on the island of Panay in Central Philippines, and the opportunities and constraints to integrating this knowledge into local conservation efforts. The research is based on participant observation, interviews, and sketch maps involving eleven key forest users and interviews with representatives from the three local conservation organizations. Local forest knowledge is discussed through three themes: geographic or area knowledge (GAK), forest ecology knowledge (FEK), and tree species-specific knowledge (TSK). Tree species-specific knowledge, particularly knowledge of seeds and germaplasm transfer, was the component …

Lobachevski Illuminated: Content, Methods, And Context Of The Theory Of Parallels, Seth Braver Jan 2007

Lobachevski Illuminated: Content, Methods, And Context Of The Theory Of Parallels, Seth Braver

Graduate Student Theses, Dissertations, & Professional Papers

In the 1820's, Nikolai Ivanovich Lobachevski discovered and began to explore the world's first non-Euclidean geometry. This crucial development in the history of mathematics was not recognized as such in his own lifetime. When his work finally found a sympathetic audience in the late 19th century, it was reinterpreted in the light of various intermediate developments (particularly Riemann's conception of geometry), which were foreign to Lobachevski's own way of thinking about the subject.

Because our modern understanding of his work derives from these reinterpretations, many of Lobachevski's most striking ideas have been forgotten. To recover them, I have produced an …

Negotiated Forgiveness In Parent-Child Relationships: Investigating Links To Politeness, Wellness And Sickness, Jennifer Lynn Geist Jan 2007

Negotiated Forgiveness In Parent-Child Relationships: Investigating Links To Politeness, Wellness And Sickness, Jennifer Lynn Geist

Graduate Student Theses, Dissertations, & Professional Papers

Upon experiencing conflict in a relationship, individuals have a variety of response options. While one can seek revenge or avoid that person, another option – forgiveness – can repair the relationship and foster health for both relationship partners. In coming together to confront the conflict and move beyond it, relational partners negotiate forgiveness in interpersonal interactions to accommodate face needs. In doing so, individuals must communicate by seeking forgiveness from and granting it to their relational partners. While much research has pointed to the health benefits associated with forgiving, little has explored the role communicating specifically plays in later received …

A Taxonomic Survey Of Lamp Flora (Algae And Cyanobacteria) In Electrically Lit Passages Within Mammoth Cave National Park, Kentucky, Thomas Smith, Rick Olson Jan 2007

A Taxonomic Survey Of Lamp Flora (Algae And Cyanobacteria) In Electrically Lit Passages Within Mammoth Cave National Park, Kentucky, Thomas Smith, Rick Olson

International Journal of Speleology

A taxonomic survey of the lamp flora from electrically lit passages in Mammoth Cave, Mammoth Cave National Park, identified 28 species. Overall, cyanobacteria were dominant represented by 14 species (50% of the total), green algae had eight species (29%), and six diatoms species (21%) were present. There was not a correlation between species diversity and temperature, but there is a general trend of increasing diversity with warmer temperatures. There were two algal or cyanobacterial species identified in this study that overlapped with previous studies. There is a lack of continuity between previous studies only having one species identified in more …

The Forum Defendant Rule In Arkansas, Scott Dodson Jan 2007

The Forum Defendant Rule In Arkansas, Scott Dodson

Faculty Publications

Section 1441(b) of the removal statute prohibits removal of a diversity case if a defendant is a citizen of the state in which the case was originally filed. The bar to removal is known as the Forum Defendant Rule. Is removal in violation of the Forum Defendant Rule a jurisdictional or nonjurisdictional defect? The characterization matters because a jurisdictional defect can be raised at any time, while a nonjurisdictional defect must be raised within a specific period of time or is waived. The Supreme Court has not resolved the characterization, but a number of circuit courts, including the Eighth Circuit, …

Capital Punishment In The United States, And Beyond, Paul Marcus Jan 2007

Capital Punishment In The United States, And Beyond, Paul Marcus

Faculty Publications

This article explores the controversial topic of capital punishment, with a particular focus on its longstanding application in the United States. The use of the death penalty in the US has been the subject of much criticism both domestically and internationally. The numerous concerns addressed in this article relate to the morality of the punishment, its effectiveness, the uneven application of the penalty, and procedural problems. The US Supreme Court has confirmed the constitutionality of capital punishment while striking down particular uses of the death penalty. The US is not, however, alone in executing convicted defendants. Capital punishment is still …

Energy Flow In A Floodplain Aquifer Ecosystem, Brian Reid Jan 2007

Energy Flow In A Floodplain Aquifer Ecosystem, Brian Reid

Graduate Student Theses, Dissertations, & Professional Papers

We developed an energy budget to identify energy sources for the invertebrate community of a large 20 km2 floodplain aquifer, based on biomass distributions, organismal respirometry, in situ community respiration, mesocosm and microcosm experiments, stable isotopes and invertebrate gut contents. The invertebrate respiration scaling exponent was 0.474 (+/- 0.068, 95% CI) across six orders in body mass, which is significantly lower than the ¾ power scaling predicted by metabolic theory. Invertebrate production was dominated by copepods (Diacyclops, Acanthocyclops, Bryocamptus), Stygobromus amphipods, and amphibiont stoneflies, and ranged from 26.9 to 4200 mg C/m3 sediment/year. Production and density showed a U-shaped response …

Old Icelandic Gaglviðr, Aurelijus Vijūnas Jan 2007

Old Icelandic Gaglviðr, Aurelijus Vijūnas

Quidditas

This essay discusses a debated word form gaglviðr occurring in stanza 42 of the Old Icelandic poem VÄluspá 'The Prophesy of the Seeress'. The noun gaglviðr is problematic both from the semantic point of view (Old Icelandic gagl 'gosling', viðr 'tree; forest' 'gosling forest'?), and because it possesses a variant spelling galgviðr ('gallows' tree;’gallows' forest') which occurs in another manuscript containing the same poem. In the present paper, the form gaglviðr is considered to be the correct and the original form of this word, whereas the form galgviðr is interpreted as a scribal error. Various existing semantic analyses of the …

Twentieth-Century Illustrators’ Interpretations Of The Works Of Rabelais, Margaret Harp Jan 2007

Twentieth-Century Illustrators’ Interpretations Of The Works Of Rabelais, Margaret Harp

Quidditas

Gustave Doré's mid-nineteenth-century illustrations of François Rabelais's oeuvre have become as well-known as the text itself: their fanciful details capture the literally larger-than-life personality of the French sixteenth-century humanist's protaganist-giants, Pantagruel and Gargantua. Equally intrigued by the thematic complexity and imaginative narrative of this Renaissance masterpiece, subsequent artists and illustrators of Rabelais continue to create new and unexpected artistic representations. This paper presents the illustrations of a lesser-known twentieth-century French wood engraver, Jean Chièze. His notable contributions to a 1935 commemorative edition of Pantagruel simultaneously highlight the medieval woodcut, emphasize the playful tone of Rabelais's narrative and allude to contemporary …

Confucian Creatures, Sarah Cutler Jan 2007

Confucian Creatures, Sarah Cutler

BYU Asian Studies Student Journal

From the tortoise shells used in ancient divination to the colorful camels of Tang tombs and from companionable oxen of the rice fields to singing birds in their cages, animals have been a significant part of Chinese culture. Perhaps most intriguing to the Western mind are the fanciful mythological animals of China adorning temple roofs, tomb walls, and traditional stories. Study of these creatures reveals a deep insight into Chinese culture for not only do the traditions about them indicate the ideas humans have about the animal world, but also the animals themselves are symbolic of various ideas maintained by …

The Swiss And The Nazis: How The Alpine Republic Survived In The Shadow Of The Third Reich, Stephen P. Halbrook Jan 2007

The Swiss And The Nazis: How The Alpine Republic Survived In The Shadow Of The Third Reich, Stephen P. Halbrook

Swiss American Historical Society Review

While surrounded by the Axis powers in World War II, Switzerland remained democratic and, unlike most of Europe, never succumbed to the siren songs and threats of the Nazi goliath. This book tells the story with emphasis on two voices rarely heard. One voice is that of scores of Swiss who lived in those dark years, told through oral history. They mobilized to defend the country, labored on the farms, and helped refugees. The other voice is that of Nazi Intelligence, those who spied on the Swiss and planned subversion and invasion. Exhaustive documents from the German Military Archives reveals …

From Meaning To Form: An Alternative Model Of Functional Syntax, Arto Mustajoki Jan 2007

From Meaning To Form: An Alternative Model Of Functional Syntax, Arto Mustajoki

Russian Language Journal

The purpose of this article is to introduce a model for a meaning-based functional syntax. A full description of the model may be found in our recent monograph (Mustajoki 2006b). Work on the model has been carried out in the Department of Slavonic and Baltic Languages and Literature at the University of Helsinki over the last fifteen years. Given that the above-mentioned book and various shorter publications (Mustajoki 1997, 1999, 2003a, 2003b, 2004) have appeared in Russian, it seems appropriate to give a short overview of the model in English. The only presentation of the model in English thus far …

The Public's Right To Fair Use: Amending Section 107 To Avoid The "Fared Use" Fallacy, Wendy J. Gordon, Daniel Bahls Jan 2007

The Public's Right To Fair Use: Amending Section 107 To Avoid The "Fared Use" Fallacy, Wendy J. Gordon, Daniel Bahls

Utah Law Review

We also suggest that § 107 drop its potentially restraining first clause,156 and that it identify fair use as a right. These changes would further underline the importance of fair use, by making clear that it can playa role in cases involving the DMCA, that fair use is a crucial part of any conflicts analysis under preemption, and that the burden of proving all elements of fair use need not rest on the defendant. As the Supreme Court has said of the public's ability to copy unpatented inventions, the public's ability to "copy and to use" is a "right that …
