Foraging Preferences Of Captive Canada Geese Related To Turfgrass Mixtures, Brian E. Washburn, Scott C. Barras, Thomas W. Seamans

Overabundant populations of Canada geese (Branta canadensis) cause economic and safety concerns associated with collisions with civil and military aircraft. Habitat management techniques that reduce the use of airfield habitats by geese might reduce these concerns. The objective of this study was to determine if captive Canada geese exhibited a foraging preference between a vegetation mixture consisting mostly of perennial ryegrass (Lolium perenne) and white clover (Trifolium repens) versus an endophyte-infected tall fescue- (Festuca arundinacea) based vegetation mixture. We established 6 paired plots of perennial ryegrass-dominated and tall fescue-dominated mixtures at NASA …

This Article examines the authority of California local governments to "license" firearms possession-i.e., the authority to permit or deny the possession of firearms and/or ammunition within a locality's geographical limits. As such, the relevant case law makes clear that local governments may not ban handguns and other firearms that state law does not forbid the law-abiding adult citizenry from possessing.

This Comment illustrates that moving to a first-to-file system of patent priority would greatly benefit the biotechnology industry and the United States patent system. A first-to-file system would promote the innovative goals of the patent system by encouraging early public disclosure and providing greater certainty of protection.

Domain Names Triggering Internet Pop-Up Advertisements: A "Use In Commerce" Under The Lanham Act, Joan Obispo Arbolante

University of San Francisco Law Review

This Comment proposes that URLs used to trigger pop-up ads constitute a "use in commerce" under the Lanham Act because they are used more than as a "pure machine-linkingfunction" and are more than public keys to access websites. Accordingly, despite some federal cases precedent that involve narrow definitions of "use in commerce" - a requirement to bring a successful trademark infringement suit. This Comment suggests that these narrow holdings is that internet advertising developers can now design technology to avoid the narrow definition of "use in commerce" and thereby avoid liability for trademark infringement.

This Article highlights the litigation before the Supreme Court in Massachusettes v. EPA, which was brought by a variety of states and other plaintiffs in order to mitigate the effects of climate change under the Clean Air Act. As such, it explores the relevant arguments before the Court, what the Court decided, and how that decision may affect the EPA's role in mitigating climate change.

In continuation of its generous support to the Regional Initiative for Sustainable Economy Programme, known as RISE, the Government of Japan has agreed to extend the duration of the programme until June 2007. This USD 12.7-million programme is fully funded by the Government of Japan under the Peace Building Grant Aid scheme, and has been in operation in Balkh, Nangarhar and Kandahar provinces. The actual implementation of the RISE activities started in March 2006 initially for the period of one year, and was recently extended until June 2007. Pets such as dogs, cats and fish were popular in many other countries (Marx et al., 1988; Gammonley, 1991; Brodie & Biley, 1999; PIAS, 2002). In Hong Kong, pet owners increased to 0.26 million (Census and Statistics Department, 2006). Dating back to 1980s, a research study reported the association between pet ownerships and health benefits for humans (McNicholas et al., 2005). According to the report, domesticated pets brought a sense of companionship and provided pet owners with pleasure. Mastery Learning And The Essentials Of Critical Care Orientation : A Heuristic Participant Evaluation, Mitchell J. Seal

This study employed a heuristic -participant evaluation of the instruction of the web-based Essentials of Critical Care Orientation (ECCO) program using two research questions: (1) How well does the ECCO adhere to Bloom's theory of mastery learning and instruction; and (2) What effect, if any, does this have on the participant RN? Evaluation findings demonstrated that the ECCO is 66 hours of expository instruction with little to no meaningful feedback, correction, or enrichment activity, is not well aligned, and has significant design flaws related to objectives and transfer of instruction and to the processes of instruction. Problem. Various guidelines for assessment have been developed in an effort to promote academic quality and integrity for educational programs that recognize experiential learning. The purpose of this present study was to determine the extent to which experiential learning and assessment, through portfolio development, help adult students in a graduate-degree program demonstrate graduate-level learning and competency.

Method. This qualitative single-case study used the assessment processes and outcomes elements of the Jackson and Maclsaac process model to analyze the use of reflective practice and the use of portfolios in a graduate education program. This article examines offshore outsourcing of legal and law-related services as the newest twist in the international market for legal services. We consider the impact of offshore outsourcing on the profession generally and analyze the ethical issues raised by offshore outsourcing, both as it exists today and as the practice may develop in the future. The article begins by situating offshore outsourcing in the framework of relationships created in the context of delivery of legal services. Rape cases reveal core conflicts in the space where evidence, law, and ethics intersect. Such conflicts include the tension between victim protection and the rights of the accused, the challenges attorneys face trying to negotiate the demands of sensitive and emotionally difficult cases, and the role of the law in counteracting stereotypes and bias.

In this essay, I will begin by presenting the cultural milieu surrounding rape allegations, briefly reviewing attitudes towards perpetrators and victims. For economic and nuclear reasons, India has received considerable attention over the last decade from observers in the United States. But attuned Americans are well-aware of India's rich culture and status as a shining constitutional democracy for most of its post-1947 independent history. For all that India has accomplished, however, its public has long viewed its government officials with great disdain. At the same time, a fascinating norm exists in this society which holds one institution in exceedingly high regard - the Indian Supreme Court.

BACKGROUND: Turner syndrome (TS) is associated with a neurocognitive phenotype that includes selective nonverbal deficits, e.g., impaired visual-spatial abilities. We previously reported evidence that this phenotype results from haploinsufficiency of one or more genes on distal Xp. This inference was based on genotype/phenotype comparisons of individual girls and women with partial Xp deletions, with the neurocognitive phenotype considered a dichotomous trait. We sought to confirm our findings in a large cohort (n = 47) of adult women with partial deletions of Xp or Xq, enriched for subjects with distal Xp deletions. The buildings of and around downtown Las Cruces reflect the unique blend of cultures and activities found within the city. Or at least it did. Today, many of the Art-Deco theaters, the historic brick structures and pueblo-style buildings sit vacant. Drab facades and limited businesses fronting the Main Street Mall now characterize the landscape, creating a challenge for Las Cruces city officials and downtown property owners. To rejuvenate the current lackluster and uninviting state of Main Street in Las Cruces, the New Mexico Main Street Program contracted with the Design, Planning and Assistance Center (DPAC), based at the School of …
