Death Of Procedural Safeguards: Prior Restraint, Due Process And The Elusive First Amendment Value Of Content Neutrality, Edward L. Carter, Brad Clark

In recent years, federal courts eroded the procedural safeguards required for prior restraint licensing schemes established in Freedman v. Maryland. The Supreme Court of the United States stated that the dangers of prior restraint were accounted for by content neutrality. But a close examination of federal courts of appeals opinions since 2002 reveals that erosion of procedural safeguards may threaten speech interests. First, procedural safeguards have not been required, in some cases, even for content-based prior restraints. Second, courts of appeals have held that, in the context of content-neutral prior restraints, the First Amendment no longer requires a time limit …

During 2001-2002, a formal study was conducted jointly by Brigham Young University's Office of Planning and Assessment (OPA) and the Harold B. Lee Library (HBLL) to determine the value of the library to the university community. The study described in this paper was undertaken at a time when some experts were predicting the demise of the academic library, and university administrators were questioning the need for new building, budget, and personnel requests. Size regulation is a crucial feature in many biological systems, with misregulation leading to dysplasia or hyperplasia. The recent discovery of counting factor (CF) in Dictyostelium discoideum will lead to a greater understanding of how the system regulates the size of a group of cells. In this paper we mathematically model the known effects of CF using two different models: a cellular automata model and a discrete continuum hybrid model. With the use of these models we are able to understand how modulation of adhesion and motile forces by CF can facilitate stream breakup. In addition, the modelling suggests a …

Use Of Thermally Induced Higher Order Modes Of A Microcantilever For Mercury Vapor Detection, Gregory P. Nordin, Michael A. George, Ashwini R. Kadam

We demonstrate the use of thermally induced higher order modes of a microcantilever as an alternate detection technique by studying Au-Hg interactions. The first four thermally induced flexural modes - i.e., the fundamental and first three higher order modes - have been examined for two different Au coatings. In the first case, 50 nm thick Au is sputter deposited along the entire length of a rectangular Si microcantilever. In the second case the Au is confined to a 30 µm length at the tip of the Si microcantilever. In both cases the microcantilever spectral response and deflection has been studied …

For an adult, learning a second language can be a complex and demanding task. Differences between one’s native language and the target language can contribute to the complexity of the task. One significant way in which languages can differ is the system of gender. The difference between gender in English and Spanish provides a challenge for adult native English speakers learning Spanish as a second language. Alexander Neibaur was a man of many talents. An educated man and gifted poet, he was fluent in seven languages. One account describes Neibaur as "a small, thin man, with a round ruddy face, with sharp eyes." He was also unusual inasmuch as he was Utah's first dentist and matchmaker, and the first known male Jewish convert to Mormonism; and he left the only known contemporary diary account of Joseph Smith's first vision experience. This work was supported primarily by the MRSEC program of the National Science Foundation under Award Number DMR-0079996. Microstructure controls the properties of most useful materials. Thus an ability to control microstructure through the processing of materials is a key to optimization of materials performance. Most materials are polycrystalline and their grain structure is a very important aspect of their microstructure. Thanks to their complexity there is a great variety of grain boundary types even in relatively isotropic materials such as the cubic metals. Simply describing the crystallography requires five (macroscopic) parameters (e.g. disorientation and inclination). Evidently, acquiring a knowledge …

This work was supported primarily by the MRSEC Program of the National Science Foundation under DMR-0079996. Most studies in crystal plasticity are based upon Taylor's original 1938 work. Within Taylor's framework the dependence of yield strength on microstructure, beyond lattice orientation, is carried within the critical resolved shear stress for slip. Thus, as the grain size decreases, the critical resolved shear stress is required to increase. This increase in critical resolved shear stress is applied, uniformly across the entire interior of the slipping grains according to the basic assumption of the model (uniform plastic strain or strain rate). The objective of this paper is to explore the feasibility of using multiple low-altitude, short endurance (LASE) unmanned air vehicles (UAVs) to cooperatively monitor and track the propagation of large forest fires. A real-time algorithm for tracking the perimeter of a fire with an on-board infrared sensor is developed. Using this algorithm, we develop a decentralized multiple-UAV approach to monitoring the perimeter of the fire. The UAVs are assumed to …

This study explored the interaction between place-based education, school culture, and leadership at one elementary school in an inner city section of Boston, MA. The centerpiece is a stand alone research portrait that tells a story about how an external program, a willing and ready school community, and a skillful school leader reinforced each other to achieve a shared vision under challenging conditions. From an under-subscribed school in chaos and lacking focus, the subject school transformed into a vibrant, highly sought school with a pervasive, environmentally-oriented culture and curriculum. Leadership is a personal process that involves creating communities and influencing change through relationships of influence. This research explores one aspect of leadership, that of self-disclosing. The self-disclosure of leaders affects all aspects of leadership. Self-disclosure is personal in that people’s voices are unique and come from their sense of self. The appropriate use of self-disclosure can facilitate increased self-awareness, and greater mental and physical health. Leaders can influence change by the strategic sharing of their disclosures. The purpose of this study was to identify the critical aspects in coaching outcomes as perceived by experienced coaches in the United States in both business and life coaching settings. Nineteen coaches provided a total of 109 critical incidents that led the client to the coaching process. Six dimensions of coaching emerged from the coding process; personal philosophies of coaching, coach functions, the coaching process, breakdown and success factors, precipitating factors and outcomes of coaching. A model was constructed to depict the relationship of the dimensions to one another. The personal philosophy of the coach influenced every other dimension. The …

This study addresses a gap in scholarship on leadership styles in the Deaf community. There is an invisible style of leadership differing from the mainstream culture not previously addressed in the literature at any depth. My study is composed of three interlocking parts; the practice of anthropology: fieldwork, analysis, and presentation. The foundation for my fieldwork, is an "archeology of the structure of the perceived world" (Merleau-Ponty), using the holding environment of the rehearsal process and the structural process of an acting technique called Del-Sign.
