Death Of Procedural Safeguards: Prior Restraint, Due Process And The Elusive First Amendment Value Of Content Neutrality, Edward L. Carter, Brad Clark

In recent years, federal courts eroded the procedural safeguards required for prior restraint licensing schemes established in Freedman v. Maryland. The Supreme Court of the United States stated that the dangers of prior restraint were accounted for by content neutrality. But a close examination of federal courts of appeals opinions since 2002 reveals that erosion of procedural safeguards may threaten speech interests. First, procedural safeguards have not been required, in some cases, even for content-based prior restraints. Second, courts of appeals have held that, in the context of content-neutral prior restraints, the First Amendment no longer requires a time limit …

During 2001-2002, a formal study was conducted jointly by Brigham Young University's Office of Planning and Assessment (OPA) and the Harold B. Lee Library (HBLL) to determine the value of the library to the university community. The study described in this paper was undertaken at a time when some experts were predicting the demise of the academic library, and university administrators were questioning the need for new building, budget, and personnel requests. This study explored the interaction between place-based education, school culture, and leadership at one elementary school in an inner city section of Boston, MA. The centerpiece is a stand alone research portrait that tells a story about how an external program, a willing and ready school community, and a skillful school leader reinforced each other to achieve a shared vision under challenging conditions. From an under-subscribed school in chaos and lacking focus, the subject school transformed into a vibrant, highly sought school with a pervasive, environmentally-oriented culture and curriculum. Leadership is a personal process that involves creating communities and influencing change through relationships of influence. This research explores one aspect of leadership, that of self-disclosing. The self-disclosure of leaders affects all aspects of leadership. Self-disclosure is personal in that people’s voices are unique and come from their sense of self. The purpose of this study was to identify the critical aspects in coaching outcomes as perceived by experienced coaches in the United States in both business and life coaching settings. Nineteen coaches provided a total of 109 critical incidents that led the client to the coaching process. Six dimensions of coaching emerged from the coding process; personal philosophies of coaching, coach functions, the coaching process, breakdown and success factors, precipitating factors and outcomes of coaching. This study addresses a gap in scholarship on leadership styles in the Deaf community. There is an invisible style of leadership differing from the mainstream culture not previously addressed in the literature at any depth. My study is composed of three interlocking parts; the practice of anthropology: fieldwork, analysis, and presentation. The foundation for my fieldwork, is an "archeology of the structure of the perceived world" (Merleau-Ponty), using the holding environment of the rehearsal process and the structural process of an acting technique called Del-Sign. Leading and teaching both involve processes that permit others to transform their thinking. Yet there has been little systematic, empirical research to connect the two. This exploratory study examines K-12 educational leadership asking: What are the similarities and differences in the ways school administrators think about "leading" compared to the ways teachers think about "teaching"? The purpose of this study was to identify predictors of leadership using a newly developed assessment for leadership selection within the healthcare industry by comparing assessment scores to supervisor rankings of the subjects. The study population consisted of 195 employees of 11 different hospitals. Each of the participants completed the Healthcare Leadership Inventory (HLI) assessment; their immediate supervisors completed performance ratings for them. None of the instruments were designed by the researcher. The dependent variable of the study was the supervisor-provided factor of Promotion Potential. This curriculum action research study begins by raising the question of whether environmental studies programs within higher education should launch activist training programs for public interest advocates and grassroots organizers working for nonprofit organizations focused on environmental protection, corporate accountability, and social justice. Usability is a key component of websites that are commercially successful. Interactivity has been inconclusively linked to website usability. This study strengthens the theoretical understanding of how interactivity affects usability by measuring user satisfaction—a subconstruct of usability—across bookstore and e-card websites. We build on theoretical models from Liu and Shrum [17] and Khalifa and Liu [15]. Users were asked to perform tasks of varying levels of interactivity at bookstore and e-card websites. Measures were obtained for the user’s expectations of, desires for, and satisfaction with the websites. Results indicate that interactivity is successfully able to increase website satisfaction. This research addressed the recycling of cement kiln dust (CKD), a by-product of cement manufacturing. While significant quantities of CKD are generated every year, its utilization in construction has been to this day quite limited. Additionally, the issue of reusing already landfilled CKD has remained almost completely unexplored. The work made use of three fresh CKDs collected at different instances from the same U.S. plant, as well as CKD obtained from different locations in a 12 year old landfill adjacent to the plant. Cracking in concrete bridge decks can result in increased susceptibility to deterioration. As cracks provide direct routes for the ingress of deleterious elements to the reinforcement and superstructure, cracking can lead to reduced service lives for bridge structures. Several factors affect the extent of cracks which develop in bridge decks; however, relatively few are within the control of the designer. This study investigated whether individual differences in learners’ age of arrival (AOA) and length of residence (LOR) in a country where a second language (L2) is spoken determine the relationship between L2 perception and production. In the first experiment, 40 Korean learners of English and 10 native English speakers participated in vowel perception and production tasks in English. Results demonstrated that the relationship between perception and production depended on learners’ AOA, not LOR. Learning Second-Language Suprasegmentals: Effect Of L2 Experience On Prosody And Fluency Characteristics Of L2 Speech, Wendy Baker, Pavel Trofimovich

This study examines effects of short, medium, and extended second language (L2) experience (3 months, 3 years, and 10 years of United States residence, respectively) on the production of five suprasegmentals (stress timing, peak alignment, speech rate, pause frequency, and pause duration) in six English declarative sentences by 30 adult Korean learners of English and 10 adult native English speakers. Acoustic analyses and listener judgments were used to determine how accurately the suprasegmentals were produced and to what extent they contributed to foreign accent. Research on the influence of gender on language across different cultures has mostly concentrated on qualitive measures of analysis. These measures demonstrate that there are differences in rhetorical and literary style across world Englishes in both the inner and outer circle. Using Biber's multidimensional analysis (1988) to examine a large corpus of world English literatures written in Indian, West African, Britain, Anglo-American and Mexican American varieties of English, this paper examines whether quantitative analyses can also be insightful and useful in the examination of the influence of gender on language and in expanding our understanding of what "bilingual creativity" entails. …

IN the First quarter of 2003, employers took 1,508 mass layoff actions. this trend continues in 2005. there are many reasons for these layoffs, including bankruptcy, business ownership change, financial difficulty, reorganization, domestic or overseas relocation, model change over, product line discontinuation, weather-related reasons, and so on. The employment market is tight right now, and professionals are forced to expand their job searches beyond their geographic areas. Many professionals who have a family look for jobs in the suburbs, trying to avoid congestion and pollution. The U.S. Census shows an increase in nontraditional families also moving to the suburbs.
