The Criminal Justice Response To Elder Abuse In Nursing Homes: A Routine Activities Perspective, Brian K. Payne, Randy R. Gainey Jan 2006

The Criminal Justice Response To Elder Abuse In Nursing Homes: A Routine Activities Perspective, Brian K. Payne, Randy R. Gainey

Sociology & Criminal Justice Faculty Publications

Politicians and researchers have begun to pay more attention to elder abuse in recent times. Most of the research on elder abuse has focused on cases of abuse perpetrated by family members, treating the phenomenon as a social problem, but it is increasingly being conceptualized as a crime problem. The current study examines elder abuse in nursing homes from a criminological perspective. Using routine activities theory as a guide, particular attention is given to the criminal justice system's response to abusive activities committed by nursing home employees. In all, 801 cases of abuse investigated by Medicaid Fraud Control Units are …

Sex In The City Of God, Diana Macalintal Jan 2006

Sex In The City Of God, Diana Macalintal

School of Theology and Seminary Graduate Papers/Theses

The Church does not canonize saints; it canonizes causes, lifestyles, and attitudes. This is increasingly evident in the causes for lay people, especially married couples. Although it has made recent strides toward a more balanced theology of sexuality, the Catholic Church will not be comfortable canonizing happily married, sexually active couples until Mary is valued as a disciple and not exclusively as a virgin. Through an examination and evaluation of the explicit and implicit theology of sexuality as found in Scripture, Church teaching, and the canonization process, this paper will propose a new theology of sexuality based on a re-visioning …

Newfound Religion: Mothers, God, And Infanticide, Susan Ayres Jan 2006

Newfound Religion: Mothers, God, And Infanticide, Susan Ayres

Faculty Scholarship

This essay focuses on cultural constructions of infanticide and psychosis, especially cases in which the mother heard delusional commands to kill her children. Part I examines the background of the Yates, Laney, and Diaz cases. Part II explores whether these mothers can be seen paradoxically as feminist subjects of empowerment rather than as victims. This essay argues that psychotic mothers have been disempowered and silenced, so their acts cannot be seen as subversive feminist gestures. Part III, however, arguest that the legal trials of Laney and Diaz demonstrate a possible subversion through trial strategy. These two trials more fully told …

Justice Rehnquist And The Dismantling Of Environmental Law, Robert L. Glicksman, James May Jan 2006

Justice Rehnquist And The Dismantling Of Environmental Law, Robert L. Glicksman, James May

GW Law Faculty Publications & Other Works

Chief Justice William H. Rehnquist was uniquely situated to have a profound impact on the development of federal environmental law - both because of the overlap of his tenure with the development of the field of environmental law and because of his four-decade tenure on the U.S. Supreme Court, more than one-half of which was as Chief Justice. Before his death on September 3, 2005, Rehnquist heard the vast majority of the Court`s environmental cases during the modern environmental era, penning opinions in 25% of them, and affording him an opportunity to shape environmental law, especially during its formative years, …

Rapid Cellular Signalling And Dose Dependent Cellular Pathways Induced In Hpv-G Cells Exposed To Medium Borne Factors, Paula Maguire Jan 2006

Rapid Cellular Signalling And Dose Dependent Cellular Pathways Induced In Hpv-G Cells Exposed To Medium Borne Factors, Paula Maguire

Doctoral

The aim of this thesis was to investigate rapid signalling events and dose dependent activation of cellular pathways in unirradiated human keratinocyte (HPV-G) cells exposed to bystander signal molecules in vivo and in vitro. HPV-G cells were exposed to irradiated cell conditioned medium (ICCM) ranging from 5mGy to 5Gy ICCM. Cellular events investigated included intercellular calcium, reactive oxygen species (ROS), mitochondrial membrane potential, cytochrome c release, caspase 3 and 8 activity, Bcl-2 expression and mitochondrial proliferation. Apoptosis levels and clonogenic survival were also determined in order to understand the cellular outcome of the activated pathways. It was found that exposure …

Analysis Of The Mouse And Human Acyl-Coa Thioesterase (Acot) Gene Clusters Shows That Convergent, Functional Evolution Results In A Reduced Number Of Human Peroxisomal Acots., Mary Hunt, Anna Rautanen, Maria Westin, Thomas Svensson, Stefan Alexson Jan 2006

Analysis Of The Mouse And Human Acyl-Coa Thioesterase (Acot) Gene Clusters Shows That Convergent, Functional Evolution Results In A Reduced Number Of Human Peroxisomal Acots., Mary Hunt, Anna Rautanen, Maria Westin, Thomas Svensson, Stefan Alexson

Articles

The maintenance of cellular levels of free fatty acids and acyl-CoAs, the activated form of free fatty acids, is extremely important as imbalances in lipid metabolism have serious consequences for human health. Acyl-CoA thioesterases (ACOTs) hydrolyze acyl-CoAs to the free fatty acid and CoASH, and thereby have the potential to regulate intracellular levels of these compounds. We have previously identified and characterized a mouse ACOT gene cluster, comprised of six genes that apparently arose by gene duplications, encoding acyl- CoA thioesterases with localizations in cytosol (ACOT1), mitochondria (ACOT2) and peroxisomes (ACOT3-6). However, the corresponding human gene cluster contains only three …

Potential Of Vibrational Spectroscopy In The Diagnosis Of Human Tumours., Eoghan O'Faolain Jan 2006

Potential Of Vibrational Spectroscopy In The Diagnosis Of Human Tumours., Eoghan O'Faolain

Doctoral

Just fewer than 20,000 people are annually diagnosed with some form of cancer in Ireland and one in three people are likely to contract some form of cancer by age 74. With the number of cases increasing at an annual rate of 2%, the early detection and treatment of cancer is becoming increasingly important. Both IR and Raman spectroscopy offer the potential for real time, quantitative detection of cancer and even precancer. This study investigates the potential of Raman and Fourier transform infrared, both benchtop and synchrotron spectroscopies for the detection of cervical cancer. The tissue was classified and its …

Spears For Hire: The Utilization And Motivations Of Greek Mercenaries In The Archaic And Classical Ages., Stephen Kyle Tadlock Jan 2006

Spears For Hire: The Utilization And Motivations Of Greek Mercenaries In The Archaic And Classical Ages., Stephen Kyle Tadlock

Honors Theses

Greek mercenaries were widespread in the Mediterranean in the Archaic and Classical periods. This thesis examines the mercenaries themselves and the kingdoms that employed them in order to discover both why mercenaries turned to the service and why rulers hired them. The focus is primarily on Greek hoplites serving in the kingdoms of Persia and Egypt, although other mercenaries and other employers are also considered. Most of the sources used in this study were Greek literary works in translation, although some use was made of archaeological, epigraphical and rhetorical evidence. The ancient sources used were chosen based upon previous readings …

Questioning The Banana Republic: A Comparative Case Study Of The Implications For Local Workers Of The United Fruit Companies' Operations In Ecuador And Colombia, Ryan Kenneth Bullock Jan 2006

Questioning The Banana Republic: A Comparative Case Study Of The Implications For Local Workers Of The United Fruit Companies' Operations In Ecuador And Colombia, Ryan Kenneth Bullock

Honors Theses

The market for internationally traded bananas has grown considerably throughout the 20“^ century, with bananas being grown almost entirely in developing countries and the vast majority of imports destined for developed countries’ markets. Historically, the global banana trade has been dominated by just a few large transnational corporations (TNCs), and if there has been once constant in the evolution of the global banana market in the Americas throughout the twentieth century, then it has been the United Fruit Company. The role of the United Fruit Company within the global banana market has been the subject of significant study and analysis, …

Flannery O'Connor's Depiction Of Baptism, The Eucharist, And Marriage: The Convergence Of The Orthodox With The Unorthodox, Karen Elizabeth Brickey Jan 2006

Flannery O'Connor's Depiction Of Baptism, The Eucharist, And Marriage: The Convergence Of The Orthodox With The Unorthodox, Karen Elizabeth Brickey

Honors Theses

For my thesis 1 researched the Southern Catholic writer Flannery O’Connor by reading almost all of her fiction - all ten short stories in her collection, A Good Man is Hard to Find; all nine short stories in her later collection. Everything That Rises Must Converge; her short story, “The Partridge Festival;” and her two novels, Wise Blood and The Violent Bear It Away - eight non-fiction prose pieces, a collection of about two hundred of her letters, and eleven criticism books. I came to see that O’Connor’s strong Christian faith and her loyalty to the Catholic Church defined her …

The Campaign To Restrict The Right To Respond To Terrorist Attacks In Self-Defense Under Article 51 Of The U.N. Charter And What The United States Can Do About It, Gregory E. Maggs Jan 2006

The Campaign To Restrict The Right To Respond To Terrorist Attacks In Self-Defense Under Article 51 Of The U.N. Charter And What The United States Can Do About It, Gregory E. Maggs

GW Law Faculty Publications & Other Works

Article 51 of the United Nations Charter preserves the right of nations to use military force in self-defense. This broad language would appear to allow nations to use military force in self-defense in response to "armed attacks" by terrorists. But a significant problem has developed over the past twenty years. In a series of resolutions and judicial decisions, organs of the United Nations have attempted to read into Article 51 four very significant and dangerous limitations on the use of military force in self-defense. These limitations find no support in the language of Article 51, they do not accord with …

Estoppel And Textualism, Gregory E. Maggs Jan 2006

Estoppel And Textualism, Gregory E. Maggs

GW Law Faculty Publications & Other Works

How might judges who purport to adhere to textualism justify their use of estoppel to affect the application of statutes that say nothing about estoppel? This essay addresses this question. It considers six possible arguments that courts have made or might make to rationalize the recognition of unwritten exceptions to statutes in the name of estoppel. These arguments include the following: (1) Even though the statutory provision at issue says nothing about estoppel, some other legislation expressly authorizes courts to invoke equitable principles, including estoppel; (2) The legislation contains an implied term authorizing the application of estoppel principles; (3) Courts …

Observed Web Robot Behavior On Decaying Web Subsites, Joan A. Smith, Frank Mccown, Michael L. Nelson Jan 2006

Observed Web Robot Behavior On Decaying Web Subsites, Joan A. Smith, Frank Mccown, Michael L. Nelson

Computer Science Faculty Publications

We describe the observed crawling patterns of various search engines (including Google, Yahoo and MSN) as they traverse a series of web subsites whose contents decay at predetermined rates. We plot the progress of the crawlers through the subsites, and their behaviors regarding the various file types included in the web subsites. We chose decaying subsites because we were originally interested in tracking the implication of using search engine caches for digital preservation. However, some of the crawling behaviors themselves proved to be interesting and have implications on using a search engine as an interface to a digital library.

Getting Back To Basics: Some Thoughts On Dignity, Materialism, And A Culture Of Racial Equality, Christopher A. Bracey Jan 2006

Getting Back To Basics: Some Thoughts On Dignity, Materialism, And A Culture Of Racial Equality, Christopher A. Bracey

GW Law Faculty Publications & Other Works

Dignity is the most compelling value in racial reform. Racial inequality is expressed as an ongoing attempt to deny minorities dignity. Dignity requires that to truly have freedom and equality, each of us has equal ability to exercise our fundamental freedoms. In order to ensure that this is possible, persons must possess the material wherewithal to exercise that freedom. The government, in order to combat racial inequality, must ensure that persons have the capability to live a “safe, well-nourished, productive, educated, social, and politically and culturally participatory life of normal length.” This approach requires structural changes in the obligations of …

The Cul De Sac Of Race Preference Discourse, Christopher A. Bracey Jan 2006

The Cul De Sac Of Race Preference Discourse, Christopher A. Bracey

GW Law Faculty Publications & Other Works

Affirmative action policy remains a contentious issue in public debate despite public endorsement by America’s leading institutions and validation by the United States Supreme Court. But the decades old disagreement is mired in an unproductive rhetorical stalemate marked by entrenched ideology rather than healthy dialogue. Instead of evolving, racial dialogue about the relevance of race in university admissions and hiring decisions is trapped in a cycle of resentment.

In this article, I argue that the stagnation of race preference discourse arises because the basic rhetorical themes advanced by opponents have evolved little over 150 years since the racial reform efforts …

Reserving, Edward T. Swaine Jan 2006

Reserving, Edward T. Swaine

GW Law Faculty Publications & Other Works

The law of treaty reservations - which enables states to ask that their multilateral obligations be tailored to their individual preferences - has been controversial for over fifty years, and is at present subject to pitched battles within (and between) the International Law Commission and numerous other international institutions. There is broad agreement that existing scheme under the Vienna Convention on the Law of Treaties involves a sharp tradeoff between honoring the unalloyed consent of non-reserving states (that is, those agreeing to the treaty as originally negotiated, which may object to proposed reservations) and respecting the conditioned consent of reserving …

Splai: Computational Finite Element Model For Sensor Networks, Ruzana Ishak, Shadaruddin Salleh, Stephan Olariu, Mohd.Ismail Abdul Aziz

Computer Science Faculty Publications

Wireless sensor network refers to a group of sensors, linked by a wireless medium to perform distributed sensing task. The primary interest is their capability in monitoring the physical environment through the deployment of numerous tiny, intelligent, wireless networked sensor nodes. Our interest consists of a sensor network, which includes a few specialized nodes called processing elements that can perform some limited computational capabilities. In this paper, we propose a model called SPLAI that allows the network to compute a finite element problem where the processing elements are modeled as the nodes in the linear triangular approximation problem. Our model …

Overcoming The Fear Of Guns, The Fear Of Gun Control, And The Fear Of Cultural Politics: Constructing A Better Gun Debate, Donald Braman, Dan M. Kahan Jan 2006

Overcoming The Fear Of Guns, The Fear Of Gun Control, And The Fear Of Cultural Politics: Constructing A Better Gun Debate, Donald Braman, Dan M. Kahan

GW Law Faculty Publications & Other Works

The question of how strictly to regulate firearms has convulsed the national polity for the better part of four decades, and in this article Donald Braman and Dan M. Kahan conclude that the best way to engender productive debate is to investigate deeper than the statistics and address the competing American social attitudes on guns themselves: guns symbolizing honor, human mastery over nature, and individual self-sufficiency on the one hand, and guns creating the perpetuation of illicit social hierarchies, the elevation of force over reason, and the expression of collective indifference to the well-being of strangers on the other. Braman …

Transition Rule Elicitation Methods For Urban Cellular Automata Models, Junfeng Jiao, Luc Boerboom Jan 2006

Transition Rule Elicitation Methods For Urban Cellular Automata Models, Junfeng Jiao, Luc Boerboom

Research Collection College of Integrative Studies

In this chapter, transition rules used in urban CA models are reviewed and classified into two categories: transition potential rules and conflict resolution rules. Then, four widely used rule elicitation methods: Regression analysis, Artificial Neural network (ANN), Visual calibration, and Analytical Hierarchy Processing – Multi Criteria Evaluation (AHP-MCE) are discussed. Most of these methods are data driven methods and can be used to elicit the transition potential rules in the urban CA models. In the following, three possible rule elicitation methods: Interview, Document analysis, and Card sorting are explained and demonstrated. These three methods are driven by knowledge and can …
