Federal laws that regulate state institutions give rise to what the Supreme Court has described as the oldest question of constitutional law. In recent years, the Court has confronted questions of congressional power to regulate state legislatures and executives, but has not directly confronted any question of congressional power to regulate state courts. Since the Founding, questions of congressional power to regulate state court jurisdiction of Article III cases have arisen - most notably, congressional power to assign jurisdiction of federal criminal cases to state courts. We establish the existence of an optimal control for a general class of singular control problems with state constraints. The proof uses weak convergence arguments and a time rescaling technique. The existence of optimal controls for Brownian control problems, associated with a broad family of stochastic networks, follows as a consequence.

This paper considers the problem of prediction in a panel data regression model with spatial autocorrelation in the context of a simple demand equation for liquor. This is based on a panel of 43 states over the period 1965-1994. The spatial autocorrelation due to neighboring states and the individual heterogeneity across states is taken explicitly into account. We compare the performance of several predictors of the states demand for liquor for one year and five years ahead. The estimators whose predictions are compared include OLS, fixed effects ignoring spatial correlation, fixed effects with spatial correlation, random effects GLS estimator ignoring …

This paper develops a novel asymptotic theory for panel models with common shocks. We assume that contemporaneous correlation can be generated by both the presence of common regressors among units and weak spatial dependence among the error terms. Several characteristics of the panel are considered: cross sectional and time series dimensions can either be fixed or large; factors can either be observable or unobservable; the factor model can describe either cointegration relationship or a spurious regression, and we also consider the stationary case. On The Existence Of Infinitely Many Closed Geodesics On Orbifolds Of Revolution, Joseph Borzellino, Christopher R. Jordan-Squire, Gregory C. Petrics, D. Mark Sullivan

Using the theory of geodesics on surfaces of revolution, we introduce the period function. We use this as our main tool in showing that any two-dimensional orbifold of revolution homeomorphic to S2 must contain an infinite number of geometrically distinct closed geodesics. Since any such orbifold of revolution can be regarded as a topological two-sphere with metric singularities, we will have extended Bangert’s theorem on the existence of infinitely many closed geodesics on any smooth Riemannian two-sphere. In addition, we give an example of a two-sphere cone-manifold of revolution which possesses a single closed geodesic, thus showing that Bangert’s result …

This paper presents a dynamic manufacturing planning and control (MPC) system that can maintain agility through the ability to dynamically switch between different policies due to varying market strategies. The dynamic behavior of the developed system is investigated by studying the effect of the time based parameters on responsiveness and cost effectiveness of the system reflected in the natural frequency and the damping of its different configurations. Results showed that the agility requirements are directly affected by the time based parameters of the MPC system: production lead time, capacity scalability delay, and shipment time. This paper presents a dynamic model and analysis for one of the major characteristics of reconfigurable manufacturing systems (RMSs) capacity scalability. The dynamic model is analyzed using its transfer function. Dynamic characteristics associated with the delay in capacity scalability and how to minimize this delay are discussed using control approaches. The problem of how to supply exact capacity in response to market changes is also examined by solving the dynamic problem of the production offset phenomenon in RMSs. The effect of work in process as a damping factor for production disturbances during capacity scalability is addressed. Finally, a general capacity …

Although industrial sales is widely discussed in both practitioner and academic circles, no clear definition of “industrial” has been established. We present a definition of industrial sales that distinguishes it from other sales domains, and we draw from a panel of industrial sales executives and a random sample of industrial sales managers to generate and evaluate the importance of a comprehensive list of knowledge, skills, and value competencies that are required for success in industrial sales. Technical competencies, while important, were rated relatively less so than selling- and customer-related competencies. Does blogging have anything to do with legal scholarship? Could blogging transform the legal academy? This paper suggests that these are the wrong questions. Blogs have plenty to do with legal scholarship--that's obvious. But what blogs have to do with legal scholarship isn't driven by anything special about blogs qua weblogs, qua collections of web pages that share the form of a journal or log. The relationship between blogging and the future of legal scholarship is a product of other forces--the emergence of the short form, the obsolesce of exclusive rights, and the trend towards the disintermediation of legal scholarship. …

When the United Nations commission investigating Darfur issued its report in January 2005, it concluded that the Darfur atrocities represented war crimes and crimes against humanity, but not genocide. This had the harmful effect of deflating efforts to mobilize political support to halt the Darfur atrocities. But the Commission's conclusion was based entirely on technicalities in the legal definitions of the international crimes, not on denial that extermination is going on in Darfur. In this paper, the author argues that the legal and popular meanings of genocide have diverged in harmful ways: where laymen understand that mass killings and rapes …

Perhaps to no one’s surprise, a recent survey found that most Americans know far more about television hits than they know about the United States Constitution. For instance, 52% of Americans surveyed could name at least two characters from The Simpsons, and 41% could name at least two judges from American Idol. Meanwhile, a mere 28% could identify more than one of the rights protected by the First Amendment.

My goal in this Essay is simply to lay out the criticisms of the use of non-U.S. law in constitutional interpretation, so as to identify what might be correct (not much, in the end) in those criticisms. I discuss criticisms based on theories of interpretation, on the claim that reference to non-U.S. law is merely decoration playing no role in generating outcomes, on the role the Constitution has in expressing distinctively American values, and on the proposition that judges are unlikely to do a good job in understanding - and therefore in referring to - non-U.S. law. This report discusses the findings of a Georgetown Law International Women’s Human Rights Clinic fact-finding team that traveled to Ghana, Africa in March 2003 to investigate domestic violence. The report reviews the contours of the domestic violence problem in Ghana and outlines the ways in which Ghanaian law and procedure was insufficiently addressing the problem at the time. Its chief findings include that the Ghanaian laws existing in 2003 inadequately punished perpetrators and protected victims of domestic violence and that court and police enforcement of the existing law was lacking, including because the government was allowing the removal of domestic …

Although nepotism is not a new subject, there are not many studies addressing the psychological issues associated with the phenomenon, particularly in the workplace. The idea of “new nepotism” has emerged with the notion that some offspring have chosen the same profession as their parents, and have not been forced into a career decision or made an opportunistic decision regardless of their ability to perform. The purpose of this study was to explore workplace nepotism using an empirical research approach. Time-domain appraoches to time-scale modification are popular due to their ability to produce high quality results at a relatively low computational cost. Within the category of time-domain implementations quite a number of alternatives exist, each with their own computational requirements and associated output quality. Governments in all parts of the world are withdrawing in practice from meeting the legal duty to provide refugees with the protection they require. While states continue to proclaim a willingness to assist refugees as a matter of political discretion or humanitarian goodwill, many appear committed to a pattern of defensive strategies designed to avoid international legal responsibility toward involuntary migrants. Some see this shift away from a legal paradigm of refugee protection as a source of enhanced operational flexibility in the face of changed political circumstances. Professor Emeritus David Chambers launched Michigan Law’s South Africa externship program 10 years ago just as that country was emerging from apartheid and beginning to function under its new constitution, adopted in 1996. Here Chambers recalls how the externship program began. Now the Wade H. Part I compares the terms and conditions in the purchase orders of the Original Equipment Manufacturers (OEMs) and highlights important differences in the substance of these boilerplate provisions. It argues that these differences cannot be easily reconciled with the prediction that sophisticated parties draft the most efficient boilerplate terms. Part II examines how these forms are drafted, how their terms are negotiated, and how the OEMs guard their terms from erosion. This Article argues that less liability for auditors in certain areas might encourage more accurate and useful financial statements, or at least equally accurate statements at a lower cost. Audit quality is promoted by three incentives: reputation, regulation, and litigation. When we take reputation and regulation into account, exposing auditors to potentially massive liability may undermine the effectiveness of reputation and regulation, thereby diminishing integrity of audited financial statements. The relation of litigation to the other incentives that promote audit quality has become more important in light of the sea change that occurred in the regulation of the auditing profession …
