A Feeling For The Micro-Organism: Structure On A Small Scale. Biofilms On Plant Roots, Nancy Fujishige

Biofilms are structured communities of bacterial cells enclosed in a self-produced polymeric matrix and adherent to an inert or living surface; they have clinical, industrial and environmental impacts. Biofilms that are established by bacteria on plants are found on the surfaces of roots, leaves, seeds and internal vascular tissues where the microbes live in commensal, mutualistic or parasitic/pathogenic associations with their host. The study of the structure of plant-associated biofilms has been considerably helped by the development of techniques using fluorescent markers coupled with confocal scanning laser microscopy as well as scanning electron microscopy. Deletion Analysis Of Fum Genes Involved In Tricarballylic Ester Formation During Fumonisin Biosynthesis, Robert A. E. Butchko, Ronald D. Plattner, Robert H. Proctor

Fumonisins are carcinogenic mycotoxins produced by the maize ear rot pathogen Gibberella moniliformis (anamorph Fusarium verticillioides). These toxins consist of a linear polyketide-derived backbone substituted at various positions with an amine, one to four hydroxyl, two methyl, and two tricarballylic ester functions. In this study, we generated and characterized deletion mutants of G. moniliformis for five genes, FUM7, FUM10, FUM11, FUM14, and FUM16 in the fumonisin biosynthetic gene cluster. Functional analysis of mutants in four genes, predicted to encode unrelated proteins, affected formation of the tricarballylic esters. It has been almost 10 years since Joan Bennett suggested that fungal biologists create a ‘‘wish list’’ for fungal genome sequences (Bennett JW. White paper: Genomics for filamentous fungi. Fungal Genet Biol 1997; 21: 3–7). The availability of over 200 review papers concerning fungal genomics is a reflection of significant progress with a diversity of fungal species. Although much progress has been made, the use of genomic data to study mycotoxin synthesis and function, pathogenesis and other aspects of fungal biology is in its infancy. ‘Goldmine’ big bluestem [Andropogon gerardii Vitman.] (Reg. no. CV-14, PI 641702) was released in May 2004 by the USDA-ARS and the Agricultural ResearchDivision, Institute of Agriculture and Natural Resources, University of Nebraska. Goldmine is a perennial warm-season grass cultivar that produces forage with moderately improved in vitro dry matter digestibility (IVDMD), protein concentration, and improved forage yields in some hay management systems. Animal gains from Goldmine were greater than its parent cultivar when utilized by beef cattle in well-managed grazing systems. Goldmine was tested as Kaw C3.

Dispersal of the southwestern corn borer, Diatraea grandiosella Dyar, was examined by release and recapture of dye-marked adults and by capture of feral adults in and around 50-ha center pivot irrigated fields of Bacillus thuringiensis (Bt) maize. Pheromone and blacklight traps were used to capture the adults. In 1999, 2000, and 2001, a total of 177, 602, and 1,292 marked males, and 87, 231, and 1,045 marked females were released in four irrigated Bt maize fields, respectively. Recapture beyond release point was 2.13, 6.17, 3.16, and 17.91% for males and 0, 0, 2.23, and 4.18% for females in the four …

The objective of this research was to assess BMP performance and implementation in Lincoln, Nebraska. In order to accomplish this objective, four tasks were established: sampling of stormwater runoff at eight sites located upstream of Holmes Lake, inspecting BMPs at construction sites in Lincoln, sampling and analysis of soil phosphorus levels in the Holmes Lake watershed, and conducting discussions with professionals involved with stormwater management in Lincoln. Based on the information collected during these tasks, several recommendations regarding the BMP assessment process are made including: recommendations for sampling site selection, an inexpensive flow monitoring method, and a rapid construction site …

Tegman V. Accident & Medical Investigations, Inc.: The Re-Modification Of Modified Joint And Several Liability By Judicial Fiat, Victor J. Torres

This Note explores the Tegman decision in the context of joint and several liability between negligent and intentional actors within Washington State. Part II places Washington tort law into perspective, including the doctrine of joint and several liability, both before and after the Tort Reform Act of 1986. Part III discusses the Tegman decision, methods used in other jurisdictions for dealing with similar situations, and potential solutions to the problems posed by the Tegman holding. Finally, Part IV concludes and urges both the court to reconsider its ruling in Tegman and the legislature to clarify its intent.

In his law review article, Professor Henry Hart responded to the questions of whether Congress had unlimited control of federal jurisdiction and whether this control was consistent with other provisions in the Constitution. Though Professor Hart's article has been widely debated, his overarching thesis is generally accepted: Congress' power to restrict Supreme Court jurisdiction is bound by the requirement that the Court's “essential functions” may not be trammeled, but Congress' power to restrict lower federal court jurisdiction is broad. This Comment will build on Professor Hart's thesis, arguing that the essential functions of the federal judiciary are broader than what …

The Limitations Of Legislatively Imposed Damages Caps: Proposing A Better Way To Control The Costs Of Medical Malpractice, Nancy L. Zisk

This Article considers whether state damages caps are constitutional and examines recent studies suggesting that damages caps are not achieving their intended goals. Given the mounting evidence against the effectiveness of damages caps and the questions about their constitutional validity, this Article proposes moving away from legislative caps on damages. Instead, this Article argues for a modified market model based on a combination of improved care, which would include improvements in service; better peer review; and, if necessary, legislation which would be designed to protect the confidentiality of peer review, reduce frivolous lawsuits, and regulate insurance rate increases. One of the central issues in the field of conflict resolution concerns the degree to which we can define a mediated or negotiated outcome as successful. How do we know that an outcome meets the criteria of success? How can we evaluate it? For example, how would we define the conclusion of the Camp David talks, where President Carter so ably mediated between the parties, and which produced a historic agreement between Israel and Egypt in 1978? As the strategic economic partner of the Southern Mediterranean (MEDA) region, the European Union (EU) seeks to promote effective mechanisms of development through increased industrial cooperation in order to create a Euro-Mediterranean area of shared prosperity. The first Euro-Mediterranean Conference of Ministries of Industry, held in June of 1996 in Brussels, listed among its priority objectives 1) the formation of a fair judicial and administrative framework for investment; and 2) the establishment and support of Small and Medium Enterprises (SMEs) through the development of regional networks. Begging For Justice? Or, Adaptive Jurisprudence? Initial Reflections On Mandatory Adr To Enforce Women's Rights In Rwanda, Phyllis E. Bernard

This Article presents the author's personal reflections on the promise and perils involved in blending rules of modern law with traditional values of African culture. The project began from a basic premise that both Americans and Rwandans should proceed with caution when expanding the privatization of public justice. Nevertheless, an outside observer's caution must be balanced with respect for a nation's right to self-determination, even when those choices may clash with generally accepted ADR theory as developed in the United States. This Article suggests that we can all learn much from Rwanda's bold, pragmatic experiment in redefining the essential nature …
