This paper discusses the various ways in which interviewing and counseling skills may be assessed. It proceeds on the assumption that such skills are integral to competent lawyering and that they ought to be taught and evaluated in law school. After briefly describing the American legal context in which these skills might be taught, the paper begins with a discussion of One-on-One Teacher Feedback. This method might be used for learning purposes or for grading purposes or both. In either case, there should be criteria distributed with notice to the students. Today, jurisdiction over immigration law is by no means well defined by clear limits. Limitations on jurisdiction have bred a multitude of litigation. The number of federal court cases reviewing removal orders has increased 970% in the past ten years. As of September 2005, the immigration cases represented 18% of the appellate civil docket.

Congress and the courts are not alone in augmenting the number of immigration cases in the federal courts. Congress has also urged the agencies enforcing the immigration laws to increase enforcement, to reduce backlogs and to make removal more swift and certain. At the same time …

The Authoritative Moment: Exploring The Boundaries Of Interpretation In The Recognition Of Queer Families, Kris Franklin

This article examines the boundaries of judicial interpretation as courts struggle to define the families formed by lesbians, gay men and transexuals. It compares the jurisprudence of numerous state courts examining queer families in different contexts. The article identifies three interwoven components of judicial reasoning: "lex" reasoning, grounded in the jurisdiction's binding and persuasive law; factual reasoning in which the courts must categorize queer families as analogous to those the law already recognizes or instead as something quite new and distinct; and finally methodological reasoning, in which courts self-consciously examine the boundaries of their own interpretive authority. The aeration effectiveness of a diffused oxygen system was compared with that of a tractor-powered paddlewheel during eight harvests of channel catfish Ictalurus punctatus at Top Cat II Fishery in Chicot County, Arkansas. Dissolved oxygen and water temperature data were collected from a grading net aerated by the diffused oxygen system, from a grading net aerated by a paddlewheel, and from the open culture pond between the two grading nets and were not significantly different. However, comparison of estimated oxygen consumption by the biomass confined in each grading net indicated that the aeration effectiveness of the diffused oxygen system equaled …

This paper uses data taken from chat logs within a first person shooter game, Quake Online, in order to explore the performance of gender online. Previous research has shown how physicality is given a position of importance in institutions where masculinity is developed and reproduced such as sports and war; cyberspace offers the opportunity of divorcing the performance of masculinity from the body. Based on research conducted with a multiplayer gaming group, this article introduces and critically outlines the phenomenon of lanning, the practice where computer game players get together to play each other over a local area network or LAN. The author argues that lanning presents a significant challenge to a number of ingrained assumptions about computer gaming. Primary amongst these is that lanning entails players meeting, not just in the virtual world of a game, but also face to face, dealing a blow to theories that gamers are anti-social. This chapter compares the experience of gaming and the experience of reading, and explores what that comparison might tell us about each. More specifically, it applies methods of literary analysis to the study of two narrative activities situated near the border of reading and gaming: Electronic hyperfictions and role-playing games. Miller first reviews literary theories of reader response and interactivity and notes how these have informed recent critical discussions of literary hyperfiction. Adult concerns about video games erupted in the 1990s when parents and politicians came forward with claims that Doom, Mortal Kombat, Killer Instinct and games like them were partially responsible for the rash of school shootings in predominantly white, middle class communities. The author of this chapter argues that arcade games serve the national interest by entertaining consumer-citizens and creating a consumer-based demand for military technology. Despite over twenty years of studies, scholars have yet to identify a productive theoretical model for the video game that does not depend on a fragmentary understanding of its form. Following Pierre Bourdieu's contention that the purpose of criticism is to understand cultural products as distinct scientific objects, and Marshall McLuhan's theory that the message and formative power of media are the media themselves, this study attempts to generate a foundational critical understanding of the video game.
