Caregivers In The Courtroom: The Growing Trend Of Family Responsibilities Discrimination, Joan C. Williams, Stephanie Bornstein

This Articles describes how attorneys bringing FRD claims face a threshold conceptual issue:How should plaintiffs frame FRD cases under existing discrimination law when neither "mother" nor "parent" is a protected classification? The solve this threshold issue, this Article suggests that FRD cases need not be shoehorned into protections for pregnancy nor require individual accommodations to be litigable. FRD cases can be litigated as straightforward gender discrimination cases under Title VII or under a variety of existing laws.

Multi-Dimensional Seismic Imaging Using The Inverse Scattering Series, Fang Liu, Arthur B. Weglein, Kristopher A. Innanen, Bogdan Nita

The inverse scattering series (ISS) is a comprehensive multidimensional theory for processing and inverting seismic reflection data, that may be task-separated such that meaningful sub-problems of the seismic inverse problem may be accomplished individually, each without an accurate velocity model. We describe a task-separated subseries of the ISS geared towards accurate location in depth of reflectors, in particular the mechanisms of the series that act in multiple dimensions. We show that some 2D ISS imaging terms have analogs in previously developed 1D ISS imaging theory (e.g., Weglein et al., 2002; Shaw, 2005) and others do not; the former are used …

I was given a speaker's dream brief: to talk about whatever I wanted so long as it had something to do with the theme of the conference - intellectual property ("IP"). A few suggestions were made in a nice, non-authoritarian way. These could, of course, have been treated the way IP lawyers usually proceed, i.e., by entirely ignoring them. That is called purposive construction, and Canadian and British courts do it all the time. Over the last two decades, the northern Gulf of Mexico has undergone tremendous growth and development that has resulted in extensive and ongoing habitat modification. We had the opportunity to survey the main channels and bayous of three coastal estuarine basins for the presence and coverage of the invasive Phragmites australis (common reed). The occurrence and area of P. australis was highly variable among the lower Pascagoula River, Back Bay of Biloxi, and St. Louis Bay basins, with the largest amount of coverage (0.489 km(2)) found within the lower Pascagoula River basin and the smallest in Back Bay of Biloxi …

Use Of Policy, Education, And Enforcement To Reduce Binge Drinking Among University Students: The Nu Directions Project, Ian Newman, Duane F. Shell, Linda J. Major, Thomas A. Workman

Department of Educational Psychology: Faculty Publications

This paper describes a program, conducted over a 5-year period, that effectively reduced heavy drinking and alcohol-related harms among university students. The program was organized around strategies to change the environment in which binge drinking occurred and involved input and cooperation from officials and students of the university, representatives from the city and the neighborhood near the university, law enforcement, as well as public health and medical officials. In 1997, 62.5% of the university’s approximately 16,000 undergraduate student population reported binge drinking. This rate had dropped to 47% in 2003. Maxwell presents the results of a survey of 405 employers, which queried them about jobs requiring no more than a high school education and no more than one year of work experience. These data allow her to establish the link between skills and low-skilled jobs and to reveal the current state of the labor market facing low-skilled workers. The data also highlights the knowledge and skills that employers require in low-skilled jobs and the abilities that individuals who apply for those jobs bring to the table.

In this Essay, I want to unearth some subordinated strands in the Rehnquist Court's free speech jurisprudence. For example, the Rehnquist Court allowed Congress to regulate campaign finance in ways subject to credible First Amendment objections, and to impose obligations on cable television systems that would almost certainly be unconstitutional were they imposed on newspapers. These decisions, I suggest, do not rest simply on the kind of deference to legislative judgment that fits comfortably into a system of strong-form review. Rather, they represent what I call a managerial model of the First Amendment, which accords legislatures a large role in …

Conflicts between wildlife and human interests have increased in recent decades due to growing human populations and the resulting expansion of anthropogenic pressures into wildlife habitat. Our overall objectives were to evaluate the the potential impacts of wildlife on transportation in Indiana and vice-versa. The results presented in this final report summarize two aspects of our research: the impact of automotive traffic on wildlife (“road kill”; Part I), and the wildlife hazards present at general aviation airports around the state (“airstrike”; Part II). Lee Hoiby has written almost a hundred songs, nearly all of them in English, but an interesting and growing subset of his oeuvre is settings of French texts. This document delves deeply into six of them: the sets Three French Songs (formerly Trois Poèmes de Rimbaud, 1982) and Chants d’Exil (2002). The study begins with brief biographical and stylistic synopses, including an examination of the influence of Schubert’s songs on Hoiby’s own. Structural Elegance And Harmonic Disparity In Selected Solos By Jazz Trumpeters Freddie Hubbard And Woody Shaw, Edward Rex Richardson

Freddie Hubbard and Woody Shaw were two of the greatest figures in the jazz trumpet pantheon from their emergence in the 1960s until the 1980s. They were both unusual personalities; almost as well known for their volatility as for their instrumental virtuosity and creativity. Their association was characterized by competition and a certain degree of discomfort: Shaw, born nearly seven years after Hubbard, was often compared to his elder in a fashion that seemed to denigrate the younger trumpeter’s originality; he in turn often denied that he’d ever been directly influenced by Hubbard, in what appears to have been an …
