The Next ‘New Wave’: Law-Genre Documentaries, Lawyering In Support Of The Creative Process, And Visual Legal Advocacy, Regina Austin
Fordham Intellectual Property, Media and Entertainment Law Journal
This Article challenges stereotypes and misconceptions about law-genre documentaries. Part I will propose a working definition of law-genre documentaries because such a categorization is a necessary precursor to thinking or writing about the relevance of documentary films to lawyers, law students, and anyone interested in law and the pursuit of justice. The Article will go on from there to describe in Part II the various rhetorical or narrative styles or modes of filmmaking that documentarians employ. Although these styles or modes contribute to the impenetrability of documentary films, an understanding of their limitations can open up documentary films to critical …

Nt 614 Exegesis Of The Gospel Of Mark, Ben Witherington
Syllabi
The Gospel of Mark is one of the most fascinating documents in the NT canon, and as the earliest Gospel written it provides a unique window into the life of Jesus and his earliest disciples, written up in the form of an ancient biography with some rhetorical skill, but reflecting the Jewish apocalyptic mindset and eschatology so prevalent in that era amongst early Jews. In this course we will seek to do justice to both the Jewish content and Greco-Roman form of this Gospel which is addressed to Christians under duress in Rome shortly before the fall of Jerusalem in …

Book Review: How To Cure A Fanatic, Rory J. Conces
Philosophy Faculty Publications
How to Cure a Fanatic by the internationally acclaimed novelist and peace activist Amos Oz, is a book I took with me on a recent trip to the Balkans. I decided to read the book and write my review in my flat on Gradacacka Street in the Otoka neighborhood of Sarajevo, given the book’s topic and the problems that have plagued the people of Bosnia for the past fifteen years.

Shoring Up The Citadel (At-Will Employment), Matthew W. Finkin
Hofstra Labor & Employment Law Journal
The third draft of parts three and four of the proposed Restatement of Employment Law was circulated in April, 2006. The draft was prefaced by a statement of the Executive Director of the American Law Institute explaining the project's purpose: to simplify the law, to clarify the doctrine underpinning it, and to bring the law into line with evolving economic and social developments. This essay takes a hard look at these two parts - governing contractual job security and discharge for reasons violative of public policy - from the perspective of these desiderata. It argues that the rules set out …

Unilateral-Modification Provisions In Employment Arbitration Agreements, Michael L. Demichele, Richard A. Bales
Unilateral-Modification Provisions In Employment Arbitration Agreements, Michael L. Demichele, Richard A. Bales
Hofstra Labor & Employment Law Journal
Unilateral-modification clauses give one party the unfettered right to amend or reject the underlying contract, often with neither notice to nor consent from the other party. State and federal courts are divided on the issue of whether employment arbitration agreements subject to such clauses are enforceable (and the courts holding the arbitration agreements are unenforceable are divided on which of several contract law doctrines apply). The majority of courts refuse to compel arbitration when the employer's unilateral-modification rights create a lack of consideration, a non-mutual agreement, an illusory promise to arbitrate, or an unconscionable agreement. A minority of courts find …

Baseline Household Survey: Dadu District, Pakistan Initiative For Mothers And Newborns (Paiman)
Reproductive Health
The Pakistan Initiative for Mothers and Newborns (PAIMAN) is a five-year project funded by the United States Agency for International Development (USAID). PAIMAN is committed to assisting the Government of Pakistan in implementing the full spectrum of interventions necessary to address maternal and neonatal health issues. USAID has provided a grant to implement PAIMAN in ten districts of Pakistan’s four provinces. The goal of the project is to reduce maternal, newborn, and child mortality. The project calls for a multipronged and integrated strategic approach combining individual health care with public health and community-based interventions. To ensure that success is properly …
Pollen Wall Ultrastructure Of Araceae And Lemnaceae In Relation To Molecular Classifications, Michael Hesse
Pollen Wall Ultrastructure Of Araceae And Lemnaceae In Relation To Molecular Classifications, Michael Hesse
Aliso: A Journal of Systematic and Floristic Botany
A comparative ultrastructural study of Araceae pollen walls was conducted for the first time. The results are based mainly on investigations by transmission electron microscopy of 101 species in 70 genera (out of a total of 105 genera), while pollen of 83 genera with 219 species were studied by scanning electron microscopy, generally without acetolysis. Special attention was given to Lemnaceae (including Limnobiophyllum) considered to be closely related to Araceae (especially to Pistia). The ultrastructural pollen wall characters are mostly in accordance with and strongly support the morphological classifications and the arrangement of genera within recent molecular trees. …

A Reappraisal Of Phylogentic Relationships In The Monocotyledon Family Hydrocharitaceae (Alismatidae), Donald H. Les, Michael L. Moody, Connie L. Soros
Aliso: A Journal of Systematic and Floristic Botany
The diverse, aquatic Hydrocharitaceae have defied stable classification for nearly two centuries. Anatomical and morphological convergence characterize many aquatic plants and undoubtedly have hindered the ability of researchers to ascertain accurately those features representing reliable phylogenetic markers within Hydrocharitaceae. Most prior classifications of the family have emphasized few characters to define major taxonomic subdivisions (i.e., they were highly artificial). Previous studies using molecular data have shown that DNA sequences provide novel indications of phylogeny not indicated previously by morphologically based classifications; however, they have not yet recommended alterations to the classification for the family. We conducted a more comprehensive phylogenetic …
Stem Anatomy Of Climbing Palms In Relation To Long-Distance Water Transport, P. Barry Tomlinson
Stem Anatomy Of Climbing Palms In Relation To Long-Distance Water Transport, P. Barry Tomlinson
Aliso: A Journal of Systematic and Floristic Botany
Palms lack secondary growth so their primary vascular system is long-lived and must be minimally vulnerable to dysfunction. For water movement, the axial xylem must be well defended against cavitation. Climbing palms can be very long and represent a maximum solution to transport problems. How is this demonstrated in their anatomy? This article contrasts stem vascular anatomy in a canelike "tree palm" (Rhapis excelsa) with that in the American climbing palm Desmoncus and the Old World rattan genus Calamus. Rhapis, representing the basic classical palm vasculature, has a continuously integrated vascular system determined by branching of the axial …
The Evolutionary And Biogeographic Origin And Diversification Of The Tropical Monocot Order Zingiberales, W. John Kress, Chelsea D. Specht
The Evolutionary And Biogeographic Origin And Diversification Of The Tropical Monocot Order Zingiberales, W. John Kress, Chelsea D. Specht
Aliso: A Journal of Systematic and Floristic Botany
Zingiberales are a primarily tropical lineage of monocots. The current pantropical distribution of the order suggests an historical Gondwanan distribution, however the evolutionary history of the group has never been analyzed in a temporal context to test if the order is old enough to attribute its current distribution to vicariance mediated by the break-up of the supercontinent. Based on a phylogeny derived from morphological and molecular characters, we develop a hypothesis for the spatial and temporal evolution of Zingiberales using Dispersal-Vicariance Analysis (DIVA) combined with a local molecular clock technique that enables the simultaneous analysis of multiple gene loci with …
The Taxation Of Income Available For Discretionary Use, Deborah A. Geier
The Taxation Of Income Available For Discretionary Use, Deborah A. Geier
Law Faculty Articles and Essays
The signature tax policy tension of the last two decades (at least) has been whether the federal tax base ought to reach income or only consumption. At the individual level, the current Internal Revenue Code (payroll taxes aside) incorporates an income tax base with numerous consumption tax components - provisions that allow either immediate deduction of a non-consumption capital expenditure (as under a cash-flow consumption tax), such as qualified pension plan and IRA savings, or exclusion of the returns to capital (as under a wage tax), such as the exclusion for home sale gain and Section 103 interest. (A more …
