Commentary: Basque Avenues Toward Peace: Building The New Road To A New Dawn, A New Beginning, J. P. Linstroth

Peace and Conflict Studies

Excerpt

With the declaration of a permanent ceasefire by "Basque Homeland and Freedom" (Euskadi Ta Askatasuna, ETA) on the 22nd of March to begin on the 24th of March of this year, a new dawn breaks in Basque history and Basque politics. There may be those who doubt this peace but I remain hopeful that the Basques will be able to reconcile their internal differences and begin this journey anew. The Spanish Prime Minister Jose Luis Rodriguez Zapatero has agreed to begin talks on the Basque ceasefire beginning this summer 2006 and many in the Basque region are expectant of …

(Whatever Happened To) The Ada's Record Of Disability Prong(?), Alex B. Long Nov 2006

(Whatever Happened To) The Ada's Record Of Disability Prong(?), Alex B. Long

Scholarly Works

The ADA's record of disability prong is the prong least likely to be used by ADA plaintiffs in claiming protection under the Act. Between the years 2000 and 2004, ADA and Rehabilitation Act plaintiffs in federal court who alleged employment discrimination relied upon the record of disability prong less than one-third as often as the actual and perceived disability prongs in claiming disability status. Nor have ADA plaintiffs enjoyed any greater success when asserting coverage under the record of disability prong during that time period. Congress, the Equal Opportunity Commission (EEOC), and the federal courts bear much of the blame …

Hepatitis C virus (HCV) contains two membrane-associated envelope glycoproteins, E1 and E2, which assemble as a heterodimer in the endoplasmic reticulum (ER). In this study, predictive algorithms and genetic analyses of deletion mutants and glycosylation site variants of the E1 glycoprotein were used to suggest that the glycoprotein can adopt two topologies in the ER membrane: the conventional type I membrane topology and a polytopic topology in which the protein spans the ER membrane twice with an intervening cytoplasmic loop (amino acid residues 288 to 360). We also demonstrate that the E1 glycoprotein is able to associate with the HCV …

Idea Sharing: Teaching Entertainment Or A Second Language?: Reflections On Learner Expectation And Learner Behavior In And Out Of The Classroom, Phil Stokes Nov 2006

Idea Sharing: Teaching Entertainment Or A Second Language?: Reflections On Learner Expectation And Learner Behavior In And Out Of The Classroom, Phil Stokes

PASAA

I make two explicit assumptions and two unfashionable arguments in this paper. The first assumption is that learning a skill necessarily involves repetition, and repetition is boring. The second assumption is that mastering a skill requires a certain discipline of patience, dedication and practice, and that mistakes and 'failures' are an inevitable part of the learning process. From these assumptions I argue first, somewhat unfashionably, that students should not be misled into expecting all language learning to be 'fun'; believing that one can master a second language by only playing games and engaging in ever-entertaining activities is, I argue, counter-productive …

Fixing Fair Use, Michael W. Carroll Nov 2006

Fixing Fair Use, Michael W. Carroll

Working Paper Series

The fair use doctrine in copyright law balances expressive freedoms by permitting one to use another’s copyrighted expression under certain circumstances. The doctrine’s extreme context-sensitivity renders it of little value to those who require reasonable ex ante certainty about the legality of a proposed use. In this Article, Professor Carroll advances a legislative proposal to create a Fair Use Board in the U.S. Copyright Office that would have power to declare a proposed use of another’s copyrighted work to be a fair use. Like a private letter ruling from the IRS or a “no action” letter from the SEC, a …

Charting Developments Concerning Punitive Damages: Is The Tide Changing?, John Y. Gotanda Nov 2006

Charting Developments Concerning Punitive Damages: Is The Tide Changing?, John Y. Gotanda

Working Paper Series

This essay discusses a number of developments outside of the United States concerning punitive damages, which may ultimately signal a change in the way other countries view American awards of such damages.

To date, courts in many countries have refused to recognize and enforce American punitive damages awards on the ground that they violate the host country’s public policy. In most civil law countries, such as France and Germany, penal damages can only be ordered in criminal proceedings; a civil award of such damages has been viewed as contrary to ordre public. In common law countries, while punitive damages generally …

The Decreasing Ontological Density Of The State In Catholic Social Doctrine, Patrick Mckinley Brennan Nov 2006

The Decreasing Ontological Density Of The State In Catholic Social Doctrine, Patrick Mckinley Brennan

Working Paper Series

Over the last century-plus, Catholic social thought has gradually reduced the ontological density of the state, to the point that the state now appears to have only a tentative grasp on the natural law basis of its legitimacy. During the first part of the twentieth century, Catholic social doctrine tended to view the legitimate state as a participant in the divine rule; although draped in a sacred mantle, the state was subject to the limits imposed by the divine and natural law. In response to the totalitarian states’ transgressing of those limits at mid-century, Catholic thinkers reduced the scope and …

Original Intent In The First Congress, Louis J. Sirico Jr. Nov 2006

Original Intent In The First Congress, Louis J. Sirico Jr.

Working Paper Series

Most of the literature on this country’s Founding Era concludes that at least in the very early years, the Founders did not look to original intent to construe the Constitution. However, this study looks not at what the Founders said they believed, but how they acted. In the First Federal Congress, the members did use arguments based on original intent. This study identifies their originalist arguments and categorizes them into five rhetorical categories. It concludes that these arguments did not dominate the debates, but were one type of argument among many.

Of Apples And Trees: Adoption And Informed Consent, Ellen Wertheimer Nov 2006

Of Apples And Trees: Adoption And Informed Consent, Ellen Wertheimer

Working Paper Series

This article argues that the doctrine of informed consent should apply to the process of adopting a child. There is substantial evidence that all adopted children are at higher risk of learning disabilities and mental health problems than nonadopted children. The article first summarizes the social science evidence demonstrating these risks and discusses some of the reasons why more extensive studies have not yet been done. The article then turns to the law of informed consent as created and applied in the contexts of medicine and law, and concludes that informed consent doctrine should apply to the process of adoption. …

The Real (Sentencing) World: State Sentencing In The Post-Blakely Era, Douglas A. Berman, Steven L. Chanenson Nov 2006

The Real (Sentencing) World: State Sentencing In The Post-Blakely Era, Douglas A. Berman, Steven L. Chanenson

Working Paper Series

Soon after the Supreme Court in Blakely v. Washington declared certain judicial fact-finding within a state sentencing guideline system unconstitutional, Justice O’Connor described the Court’s decision as a “Number 10 earthquake.” But two years after the Blakely ruling, the case’s broader impact and meaning for state criminal justice systems around the country has been largely overshadowed by developments in the federal sentencing system. Nevertheless, this is an exciting time for state sentencing. By granting review in yet another state sentencing case, California v. Cunningham, this past spring, the Supreme Court brings state issues to the national stage once more.

State …

The Soul Of Politics: The Reverend Jim Wallis's Attempt To Transcend The Religious/Secular Left And The Religious Right, Bohn David Lattin, Stephen Underhill Nov 2006

The Soul Of Politics: The Reverend Jim Wallis's Attempt To Transcend The Religious/Secular Left And The Religious Right, Bohn David Lattin, Stephen Underhill

Communications Faculty Research

Preacher and social activist Jim Wallis has written and spoke out against what he identified as the polarizing effects between the Religious/Secular Left and the Religious Right. His first hook The Soul of Politics: A Practical and Prophetic Vision for Change (1995) reveals Wallis's attempt to create a rhetorical vision that transcends the polarizing political ideologies of the Left and Right. An analysis of Wallis's rhetoric reveals that while his rhetorical goal was laudable the message, built in the form of a jeremiad, lacked consistency and failed to transcend the Frames of Acceptance of both the Left and the Right.

A Case Study On Grid Performance Modeling, Amy Apon, Baochuan Lu, Larry Dowdy, Frank Robinson, Doug Hoffman, Denny Brewer

Publications

The purpose of this case study is to develop a performance model for an enterprise grid for performance management and capacity planning1. The target environment includes grid applications such as health-care and financial services where the data is located primarily within the resources of a worldwide corporation. The approach is to build a discrete event simulation model for a representative work-flow grid. Five work-flow classes, found using a customized k-means clustering algorithm characterize the workload of the grid. Analyzing the gap between the simulation and measurement data validates the model. The case study demonstrates that the simulation model can be …

Kosovo, Country Profile Nov 2006

Kosovo, Country Profile

The Journal of Conventional Weapons Destruction

From 1998 to 1999, an internal struggle known as the Kosovo Conflict caused Kosovo, a U.N.-administered province of Serbia, to become littered with mines and unexploded ordnance, including cluster-bomb units. Since the conflict ended, mines and UXO have claimed hundreds of victims in Kosovo. Today, very little of the original contamination remains thanks to the success of Kosovo's excellent mine-action program.

A Change Of Heart, Dahib Mohamed Odwaa

The Journal of Conventional Weapons Destruction

Geedka Dheenta is a small village in Somaliland located 45 kilometres (28 miles) east of Hargeisa in a mountainous area on the road between Hargeisa and Berbera. With a population of approximately 390 inhabitants according to the Landmine Impact Survey conducted in 2003, its citizens usually go to Hargeisa (the capital of Somaliland) to sell their products. The villagers’ main income is from small irrigation farms surrounding the village where they raise fruits and vegetables such as pawpaw, oranges, greens, and tomatoes, as well as some livestock. During the civil war that broke out in Somalia in 1988, this farming …

Changes In Understory Vegetation Of A Ponderosa Pine Forest In Northern Arizona 30 Years After A Wildfire, Amanda L. Bataineh, Brian P. Oswald, Mohammad M. Bataineh, Hans M. Williams, Dean W. Coble

Faculty Publications

Wildland fires can cause shifts in understory species composition and production. Many studies have examined short-term changes in understory vegetation following a wildfire; however, very few long term studies are available. The objective of this study was to examine changes in understory (herb and shrub) species composition and production since the 1972 Rattle Burn wildfire on the Coconino National Forest near Flagstaff, Arizona. Understory species composition and production were originally sampled in 1972, 1974, and 1980 and were re-sampled during July and August of 2002 and 2003 on 30 plots in each of four sites: high severity burn, low severity …

Inverse Flood Risk Modelling Of The Upper Thames River Basin, Predrag Prodanovic, Slobodan P. Simonovic Nov 2006

Inverse Flood Risk Modelling Of The Upper Thames River Basin, Predrag Prodanovic, Slobodan P. Simonovic

Water Resources Research Report

This report aims to present an alternate approach to climate change impact mod- elling of water resources. The focus of the project is on the analysis of existing wa- ter resources management guidelines specifically targeting critical hydrologic events (extreme floods in this case). The critical hydrologic events are converted to their corresponding meteorologic conditions via use of an event based hydrologic model. The local climatic signal is generated by use of a non-parametric weather generator linked to outputs from a global climate model for three climate scenarios, and their corresponding frequency curves generated. Then, a critical hydrologic event of inter- …

Water Resources Research Report

This report aims to present an alternate approach to climate change impact mod- elling of water resources. The focus of the project is on the analysis of existing water resources management guidelines specifically targeting critical hydrologic events (ex- treme droughts in this case). The critical hydrologic events are converted to their corresponding meteorologic conditions via use of an appropriate hydrologic model (continuous based hydrologic model for drought analysis). The local climatic signal is generated by use of a non-parametric weather generator linked to outputs from a global circulation model for three climate scenarios, and their corresponding fre- quency curves generated. …

Altered Placental And Fetal Expression Of Igfs And Igf-Binding Proteins Associated With Intrauterine Growth Restriction In Fetal Sheep During Early And Mid-Pregnancy., Barbra De Vrijer, Meredith L Davidsen, Randall B Wilkening, Russell V Anthony, Timothy Regnault

Paediatrics Publications

The insulin-like growth factors (IGFs) are postulated to be altered in association with the development of intrauterine growth restriction (IUGR). The present studies examined placental and fetal hepatic mRNA concentration of components of the IGF system at two time points (55 and 90 d gestational age, dGA; Term 147 dGA) in a hyperthermia (HT)-induced sheep model of placental insufficiency-IUGR. Maternal plasma insulin and IGF-I were constant at 55 and 90 dGA and were unaffected by treatment. Umbilical vein insulin concentrations tended to be reduced at 90 dGA following HT exposure. Caruncle IGF-I mRNA was increased at 90 dGA in HT …

This study examined the functionality of the medial temporal lobe (MTL) and posterior cingulate (PC) in mild cognitive impairment amnestic type (MCI), a syndrome that puts patients at greater risk for developing Alzheimer disease (AD). Functional MRI (fMRI) was used to identify regions normally active during encoding of novel items and recognition of previously learned items in a reference group of 77 healthy young and middle-aged adults. The pattern of activation in this group guided further comparisons between 14 MCI subjects and 14 age-matched controls. The MCI patients exhibited less activity in the PC during recognition of previously learned items, …
