Hiding Evidence From The Boss: Attorney-Client Privilege And Company Computers, Kelcey Nichols

Recent court decisions in In re Asia Global Crossing, Ltd., People v. Jiang, and Curto v. Medical World Communications have held that attorney-client privilege can protect certain information located on an employer-issued computer from disclosure if the employee had a reasonable expectation of privacy. This Article provides a brief background on attorney-client privilege and explores the factors courts consider when determining whether an employee has this reasonable expectation. These factors include the scope of employer monitoring, the employer-employee agreement pertaining to the computer, the presence of password-protection, the location of the computer, and the relevancy of the evidence …

To Serve And Protect: Do Businesses Have A Legal Duty To Protect Collections Of Personal Information?, Derek A. Bishop

Commercial, governmental, and nonprofit organizations are more frequently reporting instances of data security breaches. This has, in turn, raised fears of identity theft. In some limited instances, companies that maintain large amounts of personal information—such as credit reporting agencies—have been subject to statutory duties to protect that personal information. In some instances, such legislation has also permitted a private cause of action for breach of these duties. Legislatures have expanded these statutes to encompass, at least to a limited degree, all business entities that collect personal information. Recent precedent indicates that courts may follow this trend by declaring security breaches …

Seventeen percent of the average monthly cellular phone bill in 2004 was comprised of federal, state, and local taxes. As the number of wireless subscribers across the nation continues to increase, states, cities, and counties are increasingly seizing upon cellular taxation as a panacea for budget shortfalls. The Maryland Tax Court’s recent decision in T-Mobile USA, Inc. v. Department of Finance for Baltimore City held state and county taxes on the sale of individual cellular lines as legal excise taxes rather than illegal sales taxes. This thesis involves the investigation of the effects of Calcium Magnesium Acetate (CMA) deicers on Portland cement mortar bars. In addition to mass-loss, length change, pulse velocity and soak solution pH, the thesis also contains a rigorous chemical analysis of the mortar completed at the National Institute of Standards and Technology (NIST) in Gaithersburg, MD. The research completed at NIST was done using a technique known as X-ray Mapping. The X-ray techniques were employed to determine the exact nature of the damage caused by CMA. Among older adults with Alzheimer`s disease, 61% to 88% experience problematic passivity (Kolanowski, 1995), which has been linked to a loss of functional abilities (Colling, 1999). In order to prevent this functional decline, social isolation, and development of problematic passivity guidelines can be deduced from the Need-driven Dementia-compromised Behavior (NDB) model for identifying the causes of passive behavior, which can be addressed when designing specialized therapeutic recreation programs.

The National Council of Teachers of Mathematics suggests that formal proportional reasoning instruction take place during grades five through eight (1989). While extensive research has explored both pre-instructional and intra-instructional student proportional thinking strategies, little research has been done on post-instructional proportional thinking strategies used by high-school aged students. As proportional reasoning is fundamental for success in Algebra and other advanced mathematics, it seems relevant to verify that these students retain their reasoning abilities and can apply them in both high school and college mathematical situations.

The primary purpose of this study was to determine the likelihood that the type of financial assistance a student receives is a predictor of retention at a two-year college. The institution utilized in the study is a mid-size, public, two-year college in South Carolina. The effects of five distinct types of financial assistance on retention were investigated. Cranial placodes are ectodermal regions that contribute extensively to the vertebrate peripheral nervous system. The development of the ophthalmic trigeminal (opV) placode, which gives rise only to sensory neurons of the ophthalmic lobe of the trigeminal ganglion, is a well-studied model of sensory neuron development. While key differentiation processes have been characterized at the tissue and cellular levels, the molecules governing opV placode development have not been well described. This study identifies the canonical Wnt signaling pathway as a regulator of opV trigeminal placode development. Objective: To determine the extent to which coaching over the telephone is an effective method in promoting the loss of body weight and body fat percentage. Research Methods and Procedures: Over a period of four months, in a randomized, double blind, placebo-controlled study, 120 overweight and obese (BMI 25-35 kg/m²) adults either received telephone coaching or no coaching. In addition, each participant was randomly assigned to take a supplement or placebo daily. Body weight and body fat percentage were measured at baseline, two months, and four months. This dissertation uses phenomenology, along with a constructionist framework, to explore the ways an ethnic community in central Texas constructs and communicates its cultural identity. The first goal of this study (RQ1) was to describe how the people of Norse, Texas experience ethnicity. The second goal of this study (RQ2) was to discover how this ethnicity was communicatively constructed and maintained. The third goal of this study (RQ3) was to learn how the relationship between ethnic identity and communication contributes to the creation of shared meanings within the community. Mathematics Research Reports

The paper concerns new aspects of generalized differentiation theory that plays a crucial role in many areas of modern variational analysis, optimization, and their applications. In contrast to the majority of previous developments, we focus here on generalized differentiation of parameter-dependent objects (sets, set-valued mappings, and nonsmooth functions), which naturally appear, e.g., in parametric optimization and related topics. The basic generalized differential constructions needed in this case are different for those known in parameter-independent settings, while they still enjoy comprehensive calculus rules developed in this paper.

While many developments have taken place around supporting the model coding task of simulation, there are few tools available to assist in the conceptual modelling phase. Several authors have reported the advantages of using process modelling tools in the early phases of a simulation project.

This paper provides an overview of process modelling tools in relation to their support for simulation, categorizing the tools into formal method and descriptive methods. A conclusion from this review is that none of the tools available adequately support the requirements gathering phase of simulation. This is not surprising as none of the process modelling …
