The Last Civilian Court—Martial And Its Aftermath, Roger J. Miner '56

Military Law

Judge Miner here describes his defense of a person he believes to be

the last civilian tried by court martial. The trial was conducted in

Korea in 1958 during Judge Miner's service as an officer in the

Judge Advocate General's Corps of the United States Army.

Although a challenge to the jurisdiction of the court martial was

rejected and the civilian defendant convicted of violating a currency

regulation, the conviction was set aside for another reason urged at

trial-the inadvertent repeal of the at-issue regulation. The Article

Removal---or, the exile and forced migration of marginalized cultural and racial groups from one region of the British Empire and, later, the United States, to another less volatile region---emerged as a key tool in the construction of the Anglo-American Atlantic World. British officials used removal to secure the empire, ridding the realm of Catholic menaces, black insurgents, challenges to the throne and the brutal conflicts between English colonists and Native Americans. American leaders, after the conclusion of the American Revolution, viewed removal as a viable solution to the problem of slavery and the potential troubles induced by freeing the slaves. …

This dissertation looks at the ways that Native Americans appropriated alphabetic literacy for their own purposes in the colonial period. Studies of Native writing tend to begin with the Mohegan preacher Samson Occom whose A Sermon Preached by Samson Occom (1772) is the first known publication by a Native author on the North American continent. This work, however, locates Occom near the end of a series of earlier Native contacts with the written word, the fragments of which are scattered throughout the archive of the colonizer. The extensive research into responses to terrorism has focused on the effects of individual characteristics on reactions to past terrorism events. This literature has largely omitted two issues: the impact of terrorism event features, and reactions to possible future terrorism events. The first purpose of this dissertation was to account for the effects of event features as well as subjective evaluations on responses to terrorism events. The second purpose of this dissertation was to compare reactions to past and future terrorism scenarios.

This thesis provides methods for nonparametric analysis and design of incoherent adaptive CFAR detectors. Adaptive CFAR detectors, both parametric and nonparametric, require a reference sample to learn the statistical properties of the noise. An important issue but one that is often overlooked is the need to choose a reference sample that is representative of the noise in the test cell. An approach to dynamically choose these windows is developed and studied. A powerful test for randomness based on the Mann-Kendall rank test is employed in this approach. 'Subterranean Evil' And 'Tumultuous Riot' In Buganda: Authority And Alienation At King's College, Budo, 1942, Carol Summers

History Faculty Publications

Staff petitions, sexual and disciplinary scandal and open riot pushed Buganda's leaders to close Budo College on the eve of Kabaka (King) Muteesa II's coronation. The upheaval at the school included a teachers' council that pro-claimed ownership of the school, student leaders who manipulated the headmaster through scandal and school clubs and associations that celebrated affiliation over discipline. Instead of enacting and celebrating imperial partnership and order in complex, well-choreographed coronation rituals, the school's disruption delineated the fractures and struggles over rightful authority, order and patronage within colonial Buganda, marking out a future of tumultuous political transition.

Plains Indian cultures have left numerous forms of Native drawings in the form of painted and drawn clothing, robes, tipis and tipi liners, shields and shield covers, calendars, ledger books, religious and historical drawings, and maps. Native drawings of geographic features are distinguished from other forms of drawings by their focus on the concept of territory rather than on occasional individual features such as a hill or river. The Great Plains roots of Ralph Ellison, Gwendolyn Brooks, Langston Hughes, Cornel West, Ornette Coleman, Charlie Parker, and Jay McShann make emphatic the region's importance in African American history and culture. Like their counterparts in the American South, these artists migrated to Chicago and New York where they became leaders in the nation's cultural life.

German Heritage And Culture In Louise Erdrich's The Master Butchers Singing Club, Thomas Austenfeld

Reid's discussion of the formal properties of Erdrich's work helps explain the author's popular appeal. Mewing easily between urban and rural settings, between reservation culture and mainstream culture, Erdrich has been evoking the various sets of social and historical circumstances that define the lives of contemporary Native Americans in the Great Plains. In The Master Butchers Singing Club (2003), Erdrich turns her attention explicitly to her own part-German ancestry and fictionalizes it, thereby bringing a n element of both thematic and autobiographical relevance into prominence.

In the last two decades of his life Bent became a prolific letter-writer as well; more than five hundred of his letters survive in various archives. His chief correspondents were Grinnell, with whom he collaborated in shaping the foundational texts of Cheyenne history and ethnography, and George Hyde, who also worked with Grinnell and supplied him with a great deal of information gleaned from his own far more extensive correspondence with Brent. One of the most frequently quoted comments on judicial reform is the late New Jersey Chief Justice Arthur T. Vanderbilt’s remark, “Judicial reform is not for the short-winded.” Vanderbilt’s remark illustrates a key point about judicial selection reform. Reforms do not occur simply because someone or some group in a state decides that change in the system of selection is desirable; rather, it is necessary for key interest groups in the judicial politics of a state to reach a sufficient political consensus that change can occur. Stunned by the terrorist attacks of September 11, 2001, the Bush administration adopted a new National Security Strategy in September 2002. The UK government took a similar stance. This new strategy calls for anticipatory attacks against potential enemies with uncertain capacities and intentions, even before their threat is imminent. Rather than wait for evidence of weapons of mass destruction, it shifts the burden of proof, obliging ‘‘rogue’’ states to show that they do not harbor weapons of mass destruction or terrorist cells, or else face the possibility of attack. Combatant Status Review Tribunals: Flawed Answers To The Wrong Question, Joseph Blocher

This Comment argues that the Combatant Status Review Tribunals were not competent to deny Prisoner of War status because they were charged only with identifying enemy combatants, a broad category that by its own terms includes many POWs. Given the substantial overlap between the definitions of "enemy combatant" and "POW," a CSRT's affirmative enemy combatant determination actually supports a detainee's POW status. Thus, even after their enemy combatant status has been adjudicated by the CSRTs, Guantánamo detainees should still be treated as presumptive POWs.

Articles

At the heart of transitional justice discourse is an ongoing conversation about accountability for human rights violations that occur in a context of regime repression or violent conflict. That accountability dialogue has generally been preoccupied with attempts to define the forms of political violence that should be addressed by various formal and informal mechanisms, such as trials and other truth-seeking processes. This Article will examine the multiple ways in which transitional justice processes have conceptualized political violence, and how that maps onto a gendered understanding of violence experiences and accountability mechanisms in a transitional context.
