This paper examines the right of states to broadcast propaganda by satellite in times of war. In exploring this issue, the author addresses the hypothetical question of whether a state may use DBS technology to broadcast a commercial news program, such as CNN, into an enemy state in wartime as part of a larger campaign to win the support of the civilian population. The author begins by establishing that that the consent of a receiving state is required prior to such broadcasts, whether in peacetime or in times of war. The relationship between student dispositions and content regarding historically marginalized cultures was studied. Research explored how the delivery by the teacher on challenging subjects would have a direct result on student dispositions and learning. The research supported the need to change the current approach of teaching United States history into a transformative model where students are challenged to think about history from different perspectives. Implications for curriculum delivery are discussed.

This Article will focus on the narrower questions of whether obtaining secret intelligence-that is, without the consent of the state that controls the information-is subject to international legal norms or constraints, and what restrictions, if any, control the use of this information once obtained. Traditional approaches to the question of the legitimacy of spying, when even asked, typically settle on one of two positions: either collecting secret intelligence remains illegal despite consistent practice, or apparent tolerance has led to a "deep but reluctant admission of the lawfulness of such intelligence gathering, when conducted within customary normative limits.” Other writers have …

For many peoples in the developing world, "homeland security" has a meaning very different from its post-September 11 meaning in the United States. In many cases, peoples who have a shared cultural conception of "territory" within nation-states have begun to adopt the dominant Western property paradigm of land titling to formalize their rights to that territory. Many view this paradigm and the individualization of property rights it facilitates as an inevitable outcome of the inexorable march of social evolution, evidenced by the end of the twentieth century collapse of communism. The Enlightenment era conception of fungible individual property emerged triumphant. …

Regulating The Business Of Insurance: Federalism In An Age Of Difficult Risk, Robert H. Jerry Ii, Steven E. Roberts

Although the United States has not established a much-needed and increasingly discussed national catastrophe policy, most significant points in current risk management strategies involve significant federal coordination and control. The authors suggest that a regulatory model that defers to the states with respect to the regulation of the insurance aspects of difficult risks is no longer viable, and an enhanced federal role in insurance regulation specifically -- and in risk management more generally -- is both necessary and appropriate with respect to difficult risks.

Michael Howard takes the title of his recent essay, The Invention of Peace, from the nineteenth-century jurist and historian of comparative law Henry Maine, who wrote that "war appears to be as old as mankind, but peace is a modem invention."' We moderns tend to assume that the great wars of the nineteenth and twentieth centuries were aberrant eruptions marring the peaceful status quo, but the opposite better describes the long view. The purpose of this thesis is to examine how the Nazi State used visual forms of propaganda in order to convey certain gender-specific policy aims to women living in the Third Reich. This will be accomplished by using the novel scholarly approach (referred to as the New Intentionalist approach) that these policy aims were not only fulfilling a State-centered need, but they also were reflecting a desire and a voice of agreement within the German population of women. In the history of Western philosophy, Martin Heidegger is the only philosopher after Plato and Aristotle to have seriously investigated the question of being. Instead of dwelling on particulars as previous philosophers did, Heidegger probes the question of being by investigating the being of the investigator of being. This being is Dasein, understood as human existence. Dasein is not just a thinking thing (res cogitans) or a political animal (politicus animalus), but essentially a being-in-the-world. Dasein has two modes of existence in its being-in-the-world -- inauthentic existence and authentic existence.

Ethnicity, the influence of stereotyping – whether it is overt or not - and personal identity intersect on a daily basis. But what is ethnicity? One could argue that it is a flexible idea, or as Weber (1968) notes, a matter of “subjective belief” (p. 389). According to Troper and Weinfeld (1987) “the definition of an ethnic group involves a sense of shared history, real or imagined (p. 106).” I include these two definitions of ethnicity because they both acknowledge the subjective nature of ethnic identity. Reflecting on subjectivity, however, raises questions concerning the interplay between ethnicity and stereotyping. To …
