Effects Of Rural High School Size And Socioeconomic Status On Achievement Of Tenth Graders, Peter W. O'Rourke Jan 2006

Effects Of Rural High School Size And Socioeconomic Status On Achievement Of Tenth Graders, Peter W. O'Rourke

All-Inclusive List of Electronic Theses and Dissertations

The current emphasis on the equal access to a qualityEducation for all children, highlighted in the federal No Child Left Behind (NCLB) legislation and Public Law 221 in Indiana has stimulated much discussion on the ability of schools urban, suburban, and rural to meet this challenge. Moreover, the thrust of currentEducational initiatives in Indiana emphasize the closing of achievement gaps between various student cohorts; of particular interest is the capacity of rural high schools to reduce this gap for economically disadvantaged students. The purpose of this study was to investigate the effects of enrollment size and socioeconomicstatus (SES) as measured …

Constitutional Tipping Points: Civil Rights, Social Change, And Fact-Based Adjudication, Suzanne B. Goldberg Jan 2006

Constitutional Tipping Points: Civil Rights, Social Change, And Fact-Based Adjudication, Suzanne B. Goldberg

Faculty Scholarship

This Article offers an account of how courts respond to social change, with a specific focus on the process by which courts "tip" from one understanding of a social group and its constitutional claims to another. Adjudication of equal protection and due process claims, in particular, requires courts to make normative judgments regarding the effect of traits such as race, sex, sexual orientation, or mental retardation on group members' status and capacity. Yet, Professor Goldberg argues, courts commonly approach decisionmaking by focusing only on the 'facts" about a social group, an approach that she terms 'fact-based adjudication." Professor Goldberg critiques …

Electronic Journal for Inclusive Education

Ethnicity, the influence of stereotyping – whether it is overt or not - and personal identity intersect on a daily basis. But what is ethnicity? One could argue that it is a flexible idea, or as Weber (1968) notes, a matter of “subjective belief” (p. 389). According to Troper and Weinfeld (1987) “the definition of an ethnic group involves a sense of shared history, real or imagined (p. 106).” I include these two definitions of ethnicity because they both acknowledge the subjective nature of ethnic identity. Reflecting on subjectivity, however, raises questions concerning the interplay between ethnicity and stereotyping. To …

Working With Movies And Plays: A Hands-On Study Of Film, Theatre, And Adaptations, Matt Balke Jan 2006

Working With Movies And Plays: A Hands-On Study Of Film, Theatre, And Adaptations, Matt Balke

Senior Honors Theses and Projects

To gain increased ability in working with movies, two films were made, one of which was an adaptation of a novel. An adaptation of that adaptation was also made in the form of a play, in an effort to gain greater theatrical skill. Using the experience of working on a similar story in the form of both a movie and a play, the similarities and differences of the two mediums were compared and contrasted. These projects were also used, along with some research, to gain increased theoretical and practical knowledge of what goes into making a good adaptation. It was …

Understanding Celebrity And The Public Sphere, Lelia Rosalind Green Jan 2006

Understanding Celebrity And The Public Sphere, Lelia Rosalind Green

Research outputs pre 2011

However, he argues, this is a cause for celebration because the 'old model' ('modernist' construction) of the public sphere suited and benefited an influential minority in society (white, middle-class, educated males) and the new model of the ('postmodern') public sphere increasingly engages the sectors of society systematically excluded and marginalised by modernity's view of what the public sphere should be and does. An Introduction was pitched as a starting point for debate and thus wasn't explicitly addressed to me-after all, I've studied and written on the public sphere myself.18 McKee's book was consequently an unexpected treat and all the more …

Amicus Brief Of Constitutional Law Professors David L. Faigman And Ashutosh A. Bhagwat, Et Al. In The Case Of Gonzales V. Carhart, David L. Faigman, Ashutosh A. Bhagwat, Kathrny Davis

UC Law Constitutional Quarterly

This is an amici curiae brief submitted to the United States Supreme Court in the Gonzales v. Carhart and Gonzales v. Planned Parenthood cases (i.e., the partialbirth abortion cases) argued during the October, 2006 Term. The question the brief addresses is whether the Supreme Court should defer to congressional findings of fact, when the factual questions at issue help to determine the scope of a basic, constitutional right. The argument presented in the brief is as follows:

The question of what level of deference is owed legislative findings of fact in constitutional litigation is not new. It divided the Court …

Genetic Music, Ryan Becker Jan 2006

Genetic Music, Ryan Becker

Theses

Algorithmic music composition has long been an active area of research in computer science, but the need for a human element only recently began to be more widely acknowledged. Interactive Evolutionary Computing (IEC), made popular by Karl Sims, effectively solves many high dimension problems, like music composition, involving creative and subjective elements. This work applies several Genetic Algorithm (GA) and Genetic Programming (GP) approaches, inspired by Karl Sims, to algorithmic music composition. The implementation of these IEC algorithms is described and their effectiveness compared.

Web-Based 3-D Theatre Seating Charts And Ticket Reservation Application, Patrick Henstebeck Jan 2006

Web-Based 3-D Theatre Seating Charts And Ticket Reservation Application, Patrick Henstebeck

Theses

Seating charts for theatres and stadia have always been an important part of buying tickets to a staged event, despite offering little information about the view from any particular seat. While the internet has increased the potential to provide this information, most official arena websites and online ticket brokers still only provide the standard two-dimensional diagram whose detail is limited to the approximate location of each section and which offers no guidance as to the height or slope of the section, nor any warning of any obstructing objects that would depreciate a seat s true value. The few three-dimensional models …

School Connectedness: Using School Websites To Foster A Sense Of Belonging In School, Valerie L. Mergler

Theses

The current study explored the relationships between adolescents' internet use, feelings of school connectedness, social anxiety, and interest in the school's website. Participants were 8th (n = 121) and 11th (n = 71) grade students from a rural upstate New York, middle and high school. Data was collected using the Social Use of the Internet Survey, which was designed to measure participants' internet use, interest in the school's website, feelings of school connectedness and loneliness. No significant mean differences were present between the 8th and 11th grade groups on school connectedness and on interest in the school's website. Multiple regression …

Diversifying A Tourist Destination Through Experiences: The Case Of Long Lake, The Adirondack Park, New York, Bozana Zekan Jan 2006

Diversifying A Tourist Destination Through Experiences: The Case Of Long Lake, The Adirondack Park, New York, Bozana Zekan

Theses

Demand for experiences is a major trend in the tourism industry that came as a response to commoditization of services. As many destinations have similar (or same) services in place, it became difficult for travelers to diversify one destination from another. What is nowadays happening is that travelers are no longer satisfied with traditional services only and instead seek something that they did not have a chance to experience elsewhere. Challenge that destinations consequently face is to answer travelers' demand for diversified experiences and at the same time to differentiate themselves from their competition. Hence, this study addresses how destinations …

Exploring Disqualification Of Counsel In Texas: A Balancing Of Competing Interests The Fifth Annual Symposium On Legal Malpractice And Professional Responsibility., Rebecca Simmons, Manuel C. Maltos Jan 2006

Exploring Disqualification Of Counsel In Texas: A Balancing Of Competing Interests The Fifth Annual Symposium On Legal Malpractice And Professional Responsibility., Rebecca Simmons, Manuel C. Maltos

St. Mary's Law Journal

Uncertainty over conduct which results in disqualification can be costly and the laws relating to disqualification may be widely known but their application is difficult. Rigid application of irrebuttable presumptions and imputation of knowledge may result in disqualification of a client’s chosen counsel. Even if an attorney succeeds in opposing a motion to disqualify, the resulting costs and delay may damage the attorney-client relationship more than if the attorney had simply declined the representation. Motions to disqualify usually arise from conflicts of interest involving former clients. The law of disqualification, in this instance, is well developed and largely based on …

Horizontal Agreements: Concept And Proof, George A. Hay Jan 2006

Horizontal Agreements: Concept And Proof, George A. Hay

Cornell Law Faculty Publications

It is well established that, absent some very special circumstances, agreements on price or certain other terms of trade by otherwise competing entities (i.e., "horizontal agreements") are unlawful per se under the Sherman Act. In practical effect, once the fact of the horizontal agreement has been established, an adverse impact on competition is presumed, and therefore that the plaintiff is spared the burden of proving such an impact. The principal task for plaintiffs in such cases, therefore, is establishing the existence of an agreement.

In the ideal world (from plaintiffs' perspective), there would be "hard" evidence of a "formal" agreement. …

How To Conduct A Coverage Exercise: A Rapid Assessment Tool For Programs And Services, Carey Meyers, Solene Lardoux

Poverty, Gender, and Youth

A coverage exercise (CE) is a simple, low-cost, rapid assessment tool that can be used to profile who is reached by a given service or group of service providers or organizations with a common clientele operating within a particular geographic area. This tool was developed by the Population Council to assist programs servicing youth, but it can be used for other beneficiaries as well. A CE collects data on a variety of characteristics including gender, schooling status, living arrangements, work status, and marital status of those benefiting from a program or service. It also enables program staff and managers to …
