Ricoeur’S Critical Hermeneutics And The Psychotherapeutic Model Of Critical Theory, Francis J. Mootz Iii Jan 2006

Ricoeur’S Critical Hermeneutics And The Psychotherapeutic Model Of Critical Theory, Francis J. Mootz Iii

Scholarly Works

This paper seeks to extend Ricoeur’s acclaimed mediation of the Gadamer-Habermas debate. Freud’s psychoanalytic practice was an important touchstone for the debate, and Ricoeur’s reading of Freud provides a key to his critical intervention in the debate. The emerging postmodern account of psychotherapeutic practice provides a model of the critical hermeneutics that Ricoeur championed. Bringing Ricoeur’s insights to bear on this model, we can advance the questioning spurred by the Gadamer-Habermas debate without pretending to bring closure to the unending conversation of thinking.

Instituting Innocence Reform: Wisconsin's New Governance Experiment, Katherine R. Kruse Jan 2006

Instituting Innocence Reform: Wisconsin's New Governance Experiment, Katherine R. Kruse

Scholarly Works

The DNA exoneration cases of the past two decades have provided a window into what hasn't been working in the criminal justice system and an agenda for criminal justice reform. The challenge currently facing the innocence reform community is to translate this agenda into concrete reforms that institute and sustain best practices for the investigation and prosecution of crimes, while allowing flexibility for the understanding of best practices to continue to evolve. In 2005, Wisconsin underwent a breathtaking course of legal reform in two of the problem areas that have plagued wrongful convictions: mistaken eyewitness identification and false confession. The …

A STUDY OF THE DECISION TO REMOVE CHILDREN FROM THEIR PARENTS BY CHILD WELFARE SUPERVISORS

by Charles F. Lorbeer

Dissertation Chair: Dr. Aqueil Ahmad

Committee Members: Dr. Aqueil Ahmad, Dr. Robert Butters, and Dr. Ashakant Nimbark,

The goal of this study was to analyze the decision by child welfare supervisors to remove children from their parents. This was accomplished by studying the effect that three specific factors have on that decision. The three factors were 1) physical abuse, 2) domestic violence and substance abuse, and 3) availability of services to help the family.

Decision theory provided the conceptual framework for …

Investigating The Processing Style Account Of The Effects Of Naval Processing On Face Recognition Performance, Nicola Jane Weston Jan 2006

Investigating The Processing Style Account Of The Effects Of Naval Processing On Face Recognition Performance, Nicola Jane Weston

School of Psychology Theses

Engaging in Navon processing prior to face recognition influences recognition performance (Macrae & Lewis, 2002; Perfect, 2003; Weston & Perfect, 2005). Past research has shown that global Navon processing can improve face recognition accuracy whereas local Navon processing impairs it. One explanation, and the dominant one in the literature, is that the Navon letter task elicits holistic and featural processing styles which map onto the holistic and featural processing used in face recognition. However, this theory has not been extensively tested in the literature. This thesis investigates whether processing style can explain the effects caused by the Navon letter task, …

Forfeiture By Wrongdoing: A Panacea For Victimless Domestic Violence Prosecutions, Andrew King-Ries Jan 2006

Forfeiture By Wrongdoing: A Panacea For Victimless Domestic Violence Prosecutions, Andrew King-Ries

Faculty Law Review Articles

In this article the author explores whether the rule of forfeiture by wrongdoing is the post-Crawford panacea for victimless domestic violence prosecutions. Section II briefly discusses the Crawford decision and the revitalization of the Confrontation Clause. The author highlights Crawford's recognition of the rule of forfeiture by wrongdoing and the traditional concept of forfeiture by wrongdoing. Section III presents difficulties with the rule of forfeiture by wrongdoing in the domestic violence context. In Section IV the author proposes solutions to these difficulties along with the additional requirements that are necessary when applying the rule in domestic violence cases …

Against Bipolar Black Masculinity: Intersectionality, Assimilation, Identity Performance, And Hierarchy, Frank Rudy Cooper Jan 2006

Against Bipolar Black Masculinity: Intersectionality, Assimilation, Identity Performance, And Hierarchy, Frank Rudy Cooper

Scholarly Works

In this article, Professor Frank Rudy Cooper contends that popular representations of heterosexual black men are bipolar. Those images alternate between a Bad Black Man who is crime-prone and hypersexual and a Good Black Man who distances himself from blackness and associates with white norms. The threat of the Bad Black Man label provides heterosexual black men with an assimilationist incentive to perform our identities consistent with the Good Black Man image.

The reason for bipolar black masculinity is that it helps resolve the white mainstream's post-civil rights anxiety. That anxiety results from the conflict between the nation's relatively recent …

Credit Cards, Consumer Credit, And Bankruptcy, Ronald J. Mann Jan 2006

Credit Cards, Consumer Credit, And Bankruptcy, Ronald J. Mann

Faculty Scholarship

This paper analyzes the effects of credit card use on broader economic indicators, specifically consumer credit, and consumer bankruptcy filings. Using aggregate nation-level data from Australia, Canada, Japan, the United Kingdom, and the United States, I find that credit card spending, lagged by 1-2 years, has a strong positive effect on consumer credit. Finally, I find a strong relation between credit card debt, lagged by 1-2 years, and bankruptcy, and a weaker relation between consumer credit, lagged by 1-2 years, and bankruptcy. The relations are robust across a variety of different lags and models that account for problems of multicollinearity …

Public Attitudes About The Culpability And Punishment Of Young Offenders, Elizabeth S. Scott, N. Dickon Reppucci, Jill Antonishak, Jennifer T. Degennaro Jan 2006

Public Attitudes About The Culpability And Punishment Of Young Offenders, Elizabeth S. Scott, N. Dickon Reppucci, Jill Antonishak, Jennifer T. Degennaro

Faculty Scholarship

Conventional wisdom holds that the public supports harsh punishment of juvenile offenders, and politicians often argue that the public demands tough policies. But public opinion is usually gauged through simplistic polls, often conducted in the wake of highly publicized violent crimes by juveniles. This study seeks to probe public opinion about the culpability of young offenders as compared to adult counterparts through more nuanced and comprehensive measures in a neutral setting (i.e. not in response to a high profile crime or during a political campaign when the media focuses on the issue). The opinions of 788 community adults were individually …

Under Pressure: Controlling Factors Faced By Classroom Literacy Teachers As They Work Through A Professional Development Program, Faith H. Wallace Jan 2006

Under Pressure: Controlling Factors Faced By Classroom Literacy Teachers As They Work Through A Professional Development Program, Faith H. Wallace

Faculty Articles

This critical constructivist inquiry was designed to understand controlling factors faced by classroom literacy teachers involved in a professional development program. Two guiding questions framed this critical inquiry: (1) how can I describe controlling factors faced by teachers in their respective school cultures and (2) what is the resultant impact of these controlling factors on the teachers' classroom instruction. Findings indicated that participants felt pressure to conform to a particular school philosophy, but empowered themselves by solidifying their own philosophies of instruction.

Rational Choice And Developmental Influences On Recidivism Among Adolescent Felony Offenders, Jeffrey Fagan, Alex R. Piquero Jan 2006

Rational Choice And Developmental Influences On Recidivism Among Adolescent Felony Offenders, Jeffrey Fagan, Alex R. Piquero

Faculty Scholarship

Recent law and scholarship has claimed that the developmental limitations of adolescents affect their capacity for control and decision making with respect to crime, diminishing their culpability and reducing their exposure to punishment. Social science has focused on two concurrent adolescent developmental influence: the internalization of legal rules and norms that regulate social and antisocial behaviors, and the development of rational thought to frame behavioral choices and decisions. The interaction of these two developmental processes, and the identification of one domain of socialization and development as the primary source of motivation or restraint in adolescence, is the focus of this …

Effects Of Retinal Image Degradation On Pre-Attentive Visual Search (Pavs) Efficiency For Flicker, Movment And Orientation Stimuli, Peter Davison, James Loughman Jan 2006

Effects Of Retinal Image Degradation On Pre-Attentive Visual Search (Pavs) Efficiency For Flicker, Movment And Orientation Stimuli, Peter Davison, James Loughman

Articles

Background: Previous research has shown that several clinical conditions cause increased pre-attentive visual search (PAVS) times, implying reduced parallel search capabilities in glaucoma and DLB dementia. The purpose of the research reported here was to examine for the first time the resistance of PAVS to dioptric blur using targets differing from the background in terms of flicker, vertical displacement, and orientation. Resistance would enhance the applicability of PAVS as a screening method for glaucoma and other clinical conditions affecting performance of a substantial area of the retina. Method: Computer generated flicker, orientation and vertical displacement targets were used to assess …

Symmetrical Womanhood: Poetry In The Woman's Building Library, Angela Sorby Jan 2006

Symmetrical Womanhood: Poetry In The Woman's Building Library, Angela Sorby

English Faculty Research and Publications

Late-nineteenth-century women poets shed midcentury sentimentality unevenly and at some cost, losing a sense of privacy, a (Christian) frame of reference, and an "imagined community" of women who shared their worldview. They also gained more public, secular, and professional sources of identity. The exact nature of this postsentimental self was unclear. Postsentimental poets often wrote in the "genteel tradition," which trumpeted eternal truth and beauty while working from a position of subjective instability. Ultimately, their verses must be seen as powerfully fluid and transitional, registering (like the Woman's Building Library) women's struggle to inhabit more public forms of authority.

Participatory Prototyping: Improving Faculty Participation In Technology-Mediated Instruction, Jason K. Mcdonald Jan 2006

Participatory Prototyping: Improving Faculty Participation In Technology-Mediated Instruction, Jason K. Mcdonald

Faculty Publications

This paper reports the results of a trial to help university faculty members better participate in the devel- opment of technology-mediated instruction, as well as to develop methods for faculty to create their own media that maintains an acceptable level of instructional quality. Using low-cost technology development tools and software templates, faculty members produced a technology-mediated lesson for a university statistics course. While the quality of their attempt was not acceptable to help facilitate student learning, this trial ultimately acted as a prototype of different instructional strategies for the course, which later were produced using higher-quality media. We called this …

The Ethics Teacher's Bittersweet Revenge: Virtue And Risk Management, William H. Simon Jan 2006

The Ethics Teacher's Bittersweet Revenge: Virtue And Risk Management, William H. Simon

Faculty Scholarship

Insurance companies have come to play a role in professional responsibility compliance that rivals that of courts and disciplinary agencies. The insurers, however, depart from the judicial perspective of the traditional enforcement agencies. Instead, they take the risk management perspective that Anthony Alfieri describes.

I agree with Alfieri that risk management poses real dangers of cynicism and Babbittry. Nevertheless, I also see more upside than he does. The new perspective is valuable, not just as a strategy for attracting student attention, but as an antidote to real and basic deficiencies in mainstream ethics teaching and traditional professional practice. In this …

Optimizing Consumer Credit Markets And Bankruptcy Policy, Ronald J. Mann Jan 2006

Optimizing Consumer Credit Markets And Bankruptcy Policy, Ronald J. Mann

Faculty Scholarship

This Article explores the relationship between consumer credit markets and bankruptcy policy. In general, I argue that the causative relationships running between borrowing and bankruptcy compel a new strategy for policing the conduct of lenders and borrowers in modern consumer credit markets. The strategy must be sensitive to the role of the credit card in lending markets and must recognize that both issuers and cardholders are well placed to respond to the increased levels of spending and indebtedness. In the latter parts of the Article, I recommend mandatory minimum payment requirements, a tax on distressed credit card debt, and the …

The Politics Of Same-Sex Marriage Politics, Katherine M. Franke Jan 2006

The Politics Of Same-Sex Marriage Politics, Katherine M. Franke

Faculty Scholarship

In this Essay I would like to share some reflections on the politics of same-sex marriage politics. In a very short period of time, this issue has moved to the center of the gay and lesbian rights movement as well as larger mainstream political and legal debates. Some have even argued that this issue affected, if not determined, the outcome of the 2004 presidential election. This, I believe, is rather an overstatement, but I must concede that the issue has gained traction in ways that most of us would not have predicted five years ago. The states of Vermont and …

Gendered Subjects Of Transitional Justice, Katherine M. Franke Jan 2006

Gendered Subjects Of Transitional Justice, Katherine M. Franke

Faculty Scholarship

Transitional societies must contend with a range of complex challenges as they seek to come to terms with and move beyond an immediate past saturated with mass murder, rape, torture, exploitation, disappearance, displacement, starvation, and all other manner of human suffering. Questions of justice figure prominently in these transitional moments, and they do so in a dual fashion that is at once backward and forward looking. Successor governments must think creatively about building institutions that bring justice to the past, while at the same time demonstrate a commitment that justice will form a bedrock of governance in the present and …

The Sympathetic Discriminator: Mental Illness, Hedonic Costs, And The Ada, Elizabeth F. Emens Jan 2006

The Sympathetic Discriminator: Mental Illness, Hedonic Costs, And The Ada, Elizabeth F. Emens

Faculty Scholarship

Social discrimination against people with mental illness is widespread. Treating people differently on the basis of mental illness does not provoke the same moral outrage as that inspired by differential treatment on the basis of race, sex, or even physical disability. Indeed, many people would freely admit preferring someone who does not have a mental illness as a neighbor, dinner party guest, parent, partner, or person in the next seat on the subway. Moreover, more than ten years after the Americans with Disabilities Act (the "ADA" or "Act") expressly prohibited private employers from discriminating on the basis of mental, as …
