An Investigation Into The Use Of Information And Communication Technology (Ict) By Senior Educators In Thailand, Nattavee Utakrit
Theses: Doctorates and Masters
Information and Communication Technology (lCT) may not just be for younger people or people who are still working. This study shows that it can be of importance lar groups of senior people who are healthy and still have the desire to use their skills, abilities, and knowledge to assist or support our modern society. The particulnr groups of senior people concemed in this sludy were Thai senior educators above 60 from universities in Thailand living in Bangkok. The aims of this study concentrate on how they use lCT to attain their professional goals (research and teaching activities). It explores their …

Other People's Country: A Memoir; And, Developing A Trustworthy Narrator: An Essay, Maureen Helen
Theses: Doctorates and Masters
This thesis comprises two interrelated sections. The first section is a substantial piece of creative writing, which l have cailed 'Other People's Country: A Memoir, in the genre of travel memoir, and an essay. The memoir borrows techniques from fiction, drama and poetry to tell a story of a middle-aged, middle-class city nurse, who travels to a remote settlement at the edge of the Western Desert of Western Australia to provide health care for a fluctuating population of around 400 people, for whom English is a third or fourth language.
Writing that includes stories about vulnerable people from another culture, …

Discovery Agent : An Interactive Approach For The Discovery Of Inclusion Dependencies, Dhaval B. Patel
Discovery Agent : An Interactive Approach For The Discovery Of Inclusion Dependencies, Dhaval B. Patel
Theses, Dissertations and Culminating Projects
The information integration problem is a hard yet important problem in the field of databases. The goal of information integration is to provide unified views on diverse data among several resources. This subject has been studied for a long time. The integration can be performed using several ways. Schema integration using inclusion dependency constraints is one of them. The problem of discovering inclusion dependencies among input relations is NP-complete in terms of the number of attributes.
Two significant algorithms address this problem: FIND2 by Andreas Koeller and Zigzag by Fabien De Marchi. Both algorithms discover inclusion dependencies among input …
Semi-Automated Grading Of Novice Java Programs For An Online Grading System, Micheal Alexis Ponniah
Semi-Automated Grading Of Novice Java Programs For An Online Grading System, Micheal Alexis Ponniah
Theses, Dissertations and Culminating Projects
In recent years, World Wide Web usage for teaching and learning has increased rapidly. At the same time, even with some computerized works involved, the traditional grading of home works have not changed too much. Clearly an online grading system would be a highly desirable addition to the educational tool-kit, particularly if it can provide less costly and more effective outcome. The task of grading student programs is neither simple nor entirely mechanical; rather, it is often a tedious and laborious process that is prone to human error. Recently there are a lot of researches in automating this job. Of …
Thirst: A Short History Of Drinking Water, James Salzman
Thirst: A Short History Of Drinking Water, James Salzman
Faculty Scholarship
From earliest times, human societies have faced the challenge of supplying adequate quality and quantities of drinking water. Whether limited by arid environments or urbanization, provision of clean drinking water is a prerequisite of any enduring society, but it is a daunting task for drinking water is a multi-faceted resource. Drinking water is most obviously a physical resource, one of the few truly essential requirements for life. Drinking water is also a cultural resource, of religious significance in many societies. A social resource, access to water reveals much about membership in society. A political resource, the provision of water to …
Who’S Afraid Of The Apa? What The Patent System Can Learn From Administrative Law, Stuart M. Benjamin, Arti K. Rai
Who’S Afraid Of The Apa? What The Patent System Can Learn From Administrative Law, Stuart M. Benjamin, Arti K. Rai
Faculty Scholarship
In recent years, widespread dissatisfaction with the perceived poor quality of issued patents has spurred a diverse range of groups to call for reform of administrative procedures. Strikingly, however, most calls for reform pay little attention to principles of administrative law. Similarly, judges (in particular the judges of the Federal Circuit) have treated patent law as an exception to the Administrative Procedure Act, and to administrative law more generally. In this Article, Professors Benjamin and Rai contend that this treatment is doctrinally incorrect and normatively undesirable. Standard principles of administrative law provide the appropriate approach for judicial review in the …
Harnessing And Sharing The Benefits Of State Sponsored Research, Arti K. Rai, Rebecca S. Eisenberg
Harnessing And Sharing The Benefits Of State Sponsored Research, Arti K. Rai, Rebecca S. Eisenberg
Faculty Scholarship
In recent years data-sharing has been a recurring focus of struggle within the scientific research community as improvements in information technology and digital networks have expanded the ways that data can be produced, disseminated, and used. Information technology makes it easier to share data in publicly accessible archives that aggregate data from multiple sources. Such sharing and aggregation facilitate observations that would otherwise be impossible. But data disclosure poses a dilemma for scientists. Data have long been the stock in trade of working scientists, lending credibility to their claims while highlighting new questions that are worthy of future research funding. …
The Story Of Ingersoll-Rand V. Ciavatta: Employee Inventors In Corporate Research & Development — Reconciling Innovation With Entrepreneurship, Catherine Fisk
The Story Of Ingersoll-Rand V. Ciavatta: Employee Inventors In Corporate Research & Development — Reconciling Innovation With Entrepreneurship, Catherine Fisk
Faculty Scholarship
Most inventors work as employees for the majority of their careers and are often required as a condition of employment to sign a contract drafted by the firm's lawyers giving the firm exclusive control over as broad a range of economically valuable information and innovation that the lawyers think is legally feasible. Such contracts typically claim as firm property - both during and after an employee's term of employment - the nebulous category of "proprietary information," along with the slightly more clearly (though still poorly) defined category of "trade secrets." These contracts, variously known as "invention assignment agreements" or "holdover …
The Promise (And Limits) Of Neuroeconomics, Jedediah Purdy
The Promise (And Limits) Of Neuroeconomics, Jedediah Purdy
Faculty Scholarship
Neuroeconomics - the study of brain activity in people engaged in tasks of reasoning and choice - looks set to be the next behavioral economics: a set of findings about how people make decisions that casts both light and doubt on widely accepted premises about rationality and social life. This essay explains what is most exciting about the new field and lays out some specific research tasks for it. By enabling researchers to view the mind at work, neuroeconomics calls into question the value of a methodological premise of twentieth-century empiricism, sometimes called positivism or behaviorism: that people are black …

The King Of Rockingham County And The Original Bridge To Nowhere, Barak D. Richman
Faculty Scholarship
This chapter, reveals the story -- the clash of personalities, the economic tensions, and the political significance -- behind Rockingham County v. Luten Bridge Co. Since its publication in 1929, the opinion has proceeded to leave an impression on generations of law students. Luten Bridge, a staple in most contracts casebooks, is known today as the paradigmatic case that demonstrates the duty to mitigate damages in contract law, whereby a nonbreaching party is not compensated for performance that occurs after the other party announces an intention to breach. This chapter takes on three objectives: it identifies the case's original importance, …
In Defense Of Regulatory Peer Review, James Salzman, J.B. Ruhl
In Defense Of Regulatory Peer Review, James Salzman, J.B. Ruhl
Faculty Scholarship
The debate over application of peer review to the regulatory decisions of administrative agencies has heated up in the last year. Part of the larger and controversial sound science movement, mandating peer review for certain types of agency decisions has recently been championed by the White House and proponents in Congress. Indeed, this past January the Office of Management and Budget finalized guidelines requiring peer review for large classes of agency activities. These initiatives have not gone unchallenged, and a fierce debate has resulted between those who claim peer review will strengthen the scientific basis of agency decisions and those …
Contesting Anticompetitive Actions Taken In The Name Of The State: State Action Immunity And Health Care Markets, Clark C. Havighurst
Contesting Anticompetitive Actions Taken In The Name Of The State: State Action Immunity And Health Care Markets, Clark C. Havighurst
Faculty Scholarship
The so-called state action doctrine is a judicially created formula for resolving conflicts between federal antitrust policy and state policies that seem to authorize conduct that antitrust law would prohibit. Against the background of recent commentaries by the federal antitrust agencies, this article reviews the doctrine and discusses it's application in the health care sector, focusing on the ability of states to immunize anticompetitive actions by state licensing and regulatory boards, hospital medical staffs, and public hospitals, as well as anticompetitive mergers and agreements. Although states are free, as sovereign governments, to restrict competition, the state action doctrine requires that …
Contract As Statute, Mitu Gulati, Stephen J. Choi
Contract As Statute, Mitu Gulati, Stephen J. Choi
Faculty Scholarship
Formalists contend that courts should apply strict textual analysis in interpreting contracts between sophisticated commercial parties. Sophisticated parties have the expertise and means to record their intentions in writing, reducing the litigation and uncertainty costs surrounding incomplete contracts. Moreover, to the extent courts misinterpret contracts, sophisticated parties may simply rewrite their contracts to clarify their true intent. We argue that the formalist approach imposes large costs on even sophisticated parties in the context of boilerplate contracts. Where courts make errors in interpreting boilerplate terms, parties face large collective action problems in rewriting existing boilerplate provisions. Any single party that attempts …
Understanding Change In International Organizations: Globalization And Innovation In The Ilo, Laurence R. Helfer
Understanding Change In International Organizations: Globalization And Innovation In The Ilo, Laurence R. Helfer
Faculty Scholarship
This Article uses an interdisciplinary approach to explain why the International Labor Organization (ILO) has been given surprisingly short shrift in recent debates over the role of IOs in addressing the many transborder collective action problems that globalization has fostered. I review the ILO's past and its present with two broad objectives in mind. First, I seek to correct a misperception among international lawyers and legal scholars that the ILO is a weak and ineffective institution. The organization's effectiveness in creating and monitoring international labor standards has fluctuated widely during its nearly ninety-year existence. Over the last decade, however, the …
Criminal Justice Collapse: The Constitution After Hurricane Katrina, Brandon L. Garrett, Tania Tetlow
Criminal Justice Collapse: The Constitution After Hurricane Katrina, Brandon L. Garrett, Tania Tetlow
Faculty Scholarship
The New Orleans criminal justice system collapsed after Hurricane Katrina, resulting in a constitutional crisis. Eight thousand people, mostly indigent and charged with misdemeanors such as public drunkenness or failure to pay traffic tickets, languished indefinitely in state prisons. The court system shut its doors, the police department fell into disarray, few prosecutors remained, and a handful of public defenders could not meet with, much less represent, the thousands detained. This dire situation persisted for many months, long after the system should have been able to recover. We present a narrative of the collapse of the New Orleans area criminal …

Biotechnology Education In The State Of Iowa: A Survey Of Teachers And Factors Affecting Inclusion, Jason Allen Lang
Dissertations and Theses @ UNI
This research studied biology, agricultural education, and family and consumer science teachers in Iowa regarding the topic of biotechnology in their classrooms. The survey study involved collecting demographic information about respondents, which could then be used to characterize those who teach biotechnology and those who do not. The survey also asked about perceived barriers to teaching biotechnology. As the first large scale sampling of Iowa teachers (1477), the survey attempted to provide a picture of biotechnology education in the state. Demographic data showed an aging teaching population, a teaching load of some teachers, especially those in FCS and Ag Ed, …
Welfare Polls: A Synthesis, Matthew D. Adler
Welfare Polls: A Synthesis, Matthew D. Adler
Faculty Scholarship
"Welfare polls" are survey instruments that seek to quantify the determinants of human well-being. Currently, three welfare polling formats are dominant: contingent valuation (CV) surveys, quality-adjusted life year (QALY) surveys, and happiness surveys. Each format has generated a large, specialized, scholarly literature, but no comprehensive discussion of welfare polling as a general enterprise exists. This Article seeks to fill that gap.
Part I describes the trio of existing formats. Part II discusses the current and potential uses of welfare polls in governmental decisionmaking. Part III analyzes in detail the obstacles that welfare polls must overcome to provide useful well-being information, and …

This essay was published as a chapter in Reforming the Supreme Court: Term Limits for Justices (Paul D. Carrington & Roger Cramton eds, Carolina Academic Press 2006). Its point is that Congress has long neglected its duty implicit in the constitutional doctrine of separation of powers to constrain the tendency of the Court, the academy and the legal profession to inflate the Court's status and power. The term "life tenure" is a significant source of a sense of royal status having not only the adverse cultural effects noted by Nagel, but also doleful effects on the administration and enforcement of …
The Kyoto Protocol's Clean Development Mechanism: Prospects For Japan-Philippines Partnership, Rosalina Palanca-Tan
The Kyoto Protocol's Clean Development Mechanism: Prospects For Japan-Philippines Partnership, Rosalina Palanca-Tan
Economics Department Faculty Publications
The Kyoto Protocol's Clean Development Mechanism (CDM) is a system by which a developed country can earn carbon emission reduction (ER) credits through an emission-mitigating project undertaken in a developing country. While allowing developed countries to meet their Kyoto Protocol commitments at less cost, CDM benefits the host developing countries with new capital investments and the transfer of clean technologies. In view of the potential supply of ERs on the Philippine side and a pressing demand on Japan's side, this article explores the relatively low level of CDM cooperation between the Philippines and Japan, and suggests ways of moving forward.

Reflections On An Aesthetics Of Touch, Smell And Taste, Mădălina Diaconu
Contemporary Aesthetics (Journal Archive)
Modern aesthetics regards sight and hearing as the only senses which were able to produce art. Touch, smell and taste might offer pleasant stimuli, but can never achieve the status of art objects. What are the arguments for this rejection, and are they still sustainable? This paper focuses on the general and specific difficulties of forming an aesthetics of touch, smell and taste; some can be overcome, while others are still waiting for a proper answer. At the same time, artistic movements, as well as changes in recent discussions of the aesthetics of everyday life prove the necessity of extending …
Expanding The Conceptual, Mathematical And Practical Methods For Map Comparison, Gilmore Robert Pontius, John Connors
Expanding The Conceptual, Mathematical And Practical Methods For Map Comparison, Gilmore Robert Pontius, John Connors
Geography
Conventional methods of map comparison frequently produce unhelpful results for a variety of reasons. In particular, conventional methods usually analyze pixels at a single default scale and frequently insist that each pixel belongs to exactly one category. The purpose of this paper is to offer improved methods so that scientists can obtain more helpful results by performing multiple resolution analysis on pixels that belong simultaneously to several categories. This paper examines the fundamentals of map comparison beginning from the elementary comparison between two pixels that have partial membership to multiple categories. We examine the conceptual foundation of three methods to …

This case study examines the activities of the Croton Watershed Clean Water Coalition from 1996 until 2004. The Coalition opposed construction of a filtration plant for the Croton water supply. The study traces the Coalition’s campaign against filtration, which took place in the context of the widely heralded New York City Watershed Memorandum of Agreement (1997). Although the Agreement permitted New York City to avoid filtration for its Catskill and Delaware water supplies, plans were laid for filtration of the Croton supply.

The Intersection Of Race, Gender, And Class In Social Transitions: Caribbean Immigrant Women Negotiating United States Higher Education, Tracy A. Mcfarlane
Dissertations, Theses, and Capstone Projects
The experiences of immigrant women of color within US higher education provide a unique opportunity to understand the complex influences of intersecting identities within changing social contexts. This study was designed to determine how the social categories of gender, class, race, and nationality operate in Caribbean immigrant women's experience of being college students. Focus groups and life story interviews were conducted with 27 English-speaking Caribbean-born women attending CUNY undergraduate colleges. The data yielded four main findings: First, Caribbean gender roles and traditions are not homogenous; hence, there is variation in the ways in which these affect women's experiences in the …

Members of planning and zoning boards and local legislative bodies constantly make decisions that may be worth millions of dollars to applicants and that may have serious impacts on public health and safety. Unlike other players in the land use decision making process members of local legislative bodies and land use boards have no specific education or training in land use matters prior to their election or appointment putting them in the position to learn solely from “on the job training”. Five (5) states currently require mandatory training and continuing education courses for members of planning boards and zoning boards …
