In recent years, proposals have been made to replace the federal income tax with a postpaid consumption tax - that is, a federal value added tax ("VAT"), a federal retail sales tax ("RST"), or a federal cash-flow (consumed income) tax. Because these taxes can be constructed so that they are indistinguishable at the level of the ultimate consumer in terms of their principal effects, and because a prominent recent proposal is the RST approach, I have written this article in terms of an RST/income tax comparison. International institutions are almost exclusively reactive to violations of international law. There are very few systemic methods of proactively trying to prevent egregious violations such as genocide; rather, international law seems to take punishing violators as its sole approach. In modern times, most of the punishment and post-event enforcement has come through international courts and tribunals. These courts and tribunals are astoundingly expensive and notoriously inefficient. More importantly, the threat of prosecution does not appear to act as an effective deterrent in preventing criminal acts. This is unacceptable. Geophysical Exploration For Groundwater Resources Potential Over Basement Formations At Kwandolwa And Mwisho Wa Shamba Villages, Korogwe District, Tanzania, Cuthbert Mhilu

In this paper results of geophysical exploration studies to identify potential areas with groundwater resources at Kwamndolwa and Mwisho wa Shamba Villages in Korogwe District have been presented. The resistivity curves of eight sites at the two study areas were obtained using field data measurements made based on the application of a vertical electrical sounding (VES) method. The resisivity values obtained for sites VES-K3 and VES-M2 were found to be 10.9 and 24.0 ohm-m respectively. The interpretation of the resisivity values made for the two sites gave also an indication of the presence of sedimentary rocks composed of sandstone materials …

Coastal Tanzania, A New Home To The Living Coelacanth: An Oceanographic Analysis, N. Nyandwi

Coelacanth is no longer a new fish in Tanzania. After it was first discovered in September 2003 off Kilwa Masoko in southern Tanzania and with awareness campaigns, fishermen have reported further landings since, mostly in Tanga, northern Tanzania at Kigombe village. Analysis of habitat conditions suitable for the coelacanth indicates that the oceanography may just be right for the fish to have a permanent residence as opposed to the theory of drifters from a natural home elsewhere. An assessment of the status of Lates stappersii (Boulenger, 1914) stock in the lift-net fishery in Lake Tanganyika, Kigoma area, was carried out from January to December 2003. Results indicated that breeding is seasonal with peaks in February, July-August and December, and so was catch composition, with peaks in March, May and July–August that followed the abundance of its prey, Stolothrissa tanganicae. Catch per unit effort was similar between wet and dry seasons and peaked synchronously at all study sites probably as an indication of its abundance during those months; but also it could mean that the fishes were caught …

Fired properties of talc-clay mixed bodies of different compositions were investigated for ceramic applications. Clays from Pugu and Malangali and talcs from two different sites in Kikombo deposits in Dodoma Region were used. Chemical analyses, X-ray analysis and Differential Thermal analysis for clays and talcs were used for the characterisation. Moulded mixed samples of clay and talc dried at room temperature at 1100C for 24 hours were fired at 1200, 1250, 1300 and 13500C for 6 hours. Both clay deposits consist mainly of kaolin. Talc1 - T1 is of higher purity than Talc - T2. Furthermore, the percentage shrinkage of …

A case of rhabdomyosarcoma in a 2 year old girl without a pre-existing predisposing factor visited the ENT Department of Sultan Qaboos University Hospital (SQUH). Her clinical condition did not point to the diagnosis, which came as a histological surprise. The histopathology report was alveolar rhabdomyosarcoma.

In this article, I expand upon a happy coincidence (for scholars) in reconciling the overlap between contract and fraud. Both the recent book by Ian Ayres and Gregory Klass and the Delaware Court of Chancery in Abry Partners Acquisition V, L.P. v. F& W Acquisition, LLC addressed the issue of promissory fraud – the making of a contract as to which the promisor had no intention of performing. Each treatment, however, in focusing on fraudulent affirmative representations, falls short of (a) recognizing the fundamental aspect of deceptive promising in a complex deal, namely the half-truth, (b) articulating an appropriate doctrinal …

Understanding basic neuronal mechanisms hold the hope for future treatment of brain disease. The 1st international conference on synapse, memory, drug addiction and pain was held in beautiful downtown Toronto, Canada on August 21-23, 2006. Unlike other traditional conferences, this new meeting focused on three major aims: (1) to promote new and cutting edge research in neuroscience; (2) to encourage international information exchange and scientific collaborations; and (3) to provide a platform for active scientists to discuss new findings. This phenomenon is problematical for putative fathers in adoption proceedings because it is difficult to protect such a father’s rights while advancing the child’s best interests. Many states, such as Missouri, have responded by enacting putative father registries. An unwed father may file his intent to claim paternity with the Missouri Putative Father Registry in a postcard to insure notice of any proceeding that may affect his parental rights. Seismic code provisions are now adopting performance-Based methodologies, where structures are designed to satisfy multiple performance objectives. Most codes rely on approximate methods to predict the desired seismic demand parameters. Most of these methods are based on simple SDOF models, and do not take into account neither MDOF nor degradation effects, which are major factors influencing structural behavior under earthquake excitations. More importantly, most of these models can not predict collapse explicitly under severe seismic loads.
