Framing Bad Art: A Semiotic View Of Nathaniel Hawthorne's The Blithedale Romance, Scott B. Givonetti
Framing Bad Art: A Semiotic View Of Nathaniel Hawthorne's The Blithedale Romance, Scott B. Givonetti
Electronic Theses and Dissertations 2000 - 2009
Nathaniel Hawthorne's The Blithedale Romance has been criticized contemporaneously and subsequently by such figures as F. O. Matthiessen, Mark Van Doren, and Rudolph Von Abele for its lack of romanticism or realism, depending upon the critic. This thesis uses a semiotic approach to explore Hawthorne's deconstruction of his first-person narrator, Miles Coverdale, and the resulting confusion among critics regarding authorial control in what some call his "anti-romance." Coverdale, as a detached artist, is responsible for reality's misinterpretation and misrepresentation, somewhat lampooning Transcendentalism. The triadic relationship of object, sign, and interpretant modeled by Charles Sanders Peirce is discussed using Liszka, Sebeok, …
Foucault's Techniques Of Power In Street-Level Organizations, Kathleen A. Mcginn
Foucault's Techniques Of Power In Street-Level Organizations, Kathleen A. Mcginn
Electronic Theses and Dissertations 2000 - 2009
This study uses Foucault's (1979, 1983, 1995) theoretical work as a guide in examining relation of power and resistance within the unique context of street-level bureaucracies (Lipsky, 1980). It explores relationships by asking how employees and managers are objectified within street level organizations, if there are any similarities in objectifications across organizations providing different government services, and how these objectifications intersect within relations of power and resistance. As an artifact of the relations of power between street-level bureaucrats and managers, ten purposively selected collectively bargained contract documents from public organizations in Florida are analyzed in this research. Ethnographic Content Analysis …
Genistein Targets Only Proliferating But Not Quiescent Cells: Potential Therapeutic Significance In Breast Cancer, Sreedevi. Bodepudi
Genistein Targets Only Proliferating But Not Quiescent Cells: Potential Therapeutic Significance In Breast Cancer, Sreedevi. Bodepudi
Electronic Theses and Dissertations 2000 - 2009
Phytochemicals are biologically active secondary plant metabolites that could mimic biological activities. In this study genistein isoflavone, a phytochemical present in soy was investigated to determine its effect on the growth of human breast cancer cell line GI-101 and normal breast epithelial cells in vitro. The cells were exposed to varying concentrations of genistein isoflavone for 24 and 48 hour time periods and the effect was determined using post-treatment assays: MTT and Trypan Blue for cell viability; LDH assay for cytotoxicity; Rhodamine 123/Propidium Iodide and Ethidium Bromide/Acridine Orange assays for treatment-induced apoptosis and FAM Poly caspase assay for mechanism of …
Global Feedback In Hierarchical Motion Pattern Formation, Stacey W. Brownlow
Global Feedback In Hierarchical Motion Pattern Formation, Stacey W. Brownlow
Electronic Theses and Dissertations 2000 - 2009
An array of four motion quartets (stimuli for which either horizontal or vertical motion is perceived depending on quartet aspect ratio) is arranged in a diamond configuration such that two global motion patterns are formed: (1) Rotation---alternating counterclockwise and clockwise motion is perceived, and (2) Parallel path motion---the perceived motions of all the elements are simultaneously horizontal or simultaneously vertical. The perception of rotation resulted in global feedback that biases the motion perceived for an individual component motion quartet to be more consistent with rotation than aspect ratio. Stronger rotation produced greater bias. Under certain conditions, the feedback-induced bias occurred …
Heartbeat Of A Caring Leader, Lynn K. Robbins
Heartbeat Of A Caring Leader, Lynn K. Robbins
Electronic Theses and Dissertations 2000 - 2009
This doctoral dissertation explores the life of an African-American female elementary school principal using a unifying qualitative method incorporating biography, portraiture and anthropology called A renaissance method for studying leadership: A caring perspective. A portrait of the principal was derived using this method where verbatim statements were taken from friends, family, teachers, colleagues and supervisors as well as the principal herself at the school site and the town where she was raised to identify emerging themes. The findings indicate that her humanistic approach to leading in high poverty and minority schools was grounded on her ethic of caring, one that …
Hamiltonian Methods In The Quantization Of Gauge Systems, Ruslan Vaulin
Hamiltonian Methods In The Quantization Of Gauge Systems, Ruslan Vaulin
Electronic Theses and Dissertations 2000 - 2009
The new formalism for quantization of gauge systems based on the concept of the dynamical Hamiltonian recently introduced as a basis for the canonical theory of quantum gravity was considered in the context of general gauge theories. This and other Hamiltonian methods, that include Dirac's theory of extended Hamiltonian and the Hamiltonian reduction formalism were critically examined. It was established that the classical theories of constrained gauge systems formulated within the framework of either of the approaches are equivalent. The central to the proof of equivalence was the fact that the gauge symmetries resuIt in the constraints of the first …
Heartland Germans: Cultural Maintenance In Mid-Nineteenth Century America, Madelyn Witt Lavigne
Heartland Germans: Cultural Maintenance In Mid-Nineteenth Century America, Madelyn Witt Lavigne
Electronic Theses and Dissertations 2000 - 2009
Midwestern Germans who populated Indianapolis, St. Louis, Chicago and St. Paul represented a kind of cultural identity that revealed an ethnic pride. Through the church, the press, their language, social organizations and political involvement, these Germans demonstrated the tenacity of a people willing to risk the security of their homeland for a better life in America and in the process established a set of cultural norms that reflected a significant attempt to maintain their ethnic identity. During the years 1830-1870, the pull of cheap and available land fueled the chain migration that led to the largest influx of German immigrants …
Instructional Leadership: Principals Making A Difference With High-Poverty And Minority Populations To Improve Instruction And Increase Student Achievement, Julie. Hopkins
Electronic Theses and Dissertations 2000 - 2009
The purpose of the study was to examine instructional leadership through an in-depth multi-case study of three high poverty and high minority elementary school sites where the principals had been identified as instructional leaders. The study identified how schools with unique populations practiced instructional leadership and compared the methods used to the six standards described by the NAESP. In addition, the research identified actions of instructional leaders used to enhance school improvement efforts in schools serving high poverty and high minority populations while contributing to the understanding of the principal's role as an instructional leader. The three findings were: that …

Iptv On Copper-Lines Converging Into "All-Optical" Trunk Transport: A Next-Generation Local-Loop Solution, Angela S. Perez
Electronic Theses and Dissertations 2000 - 2009
A promising next-generation version of service that could be availed from local exchange carriers (LECs) refers to streaming Internet protocol based television (IPTV) programs into subscriber premises via traditional copper pairs. The present study addresses provisioning economically-budgeted and optimally-engineered bit rates (EBRs) in implementing IPTV technology in the local-loop via copper-pairs using the so-called (ADSL2/ADSL2+) technology (with high-speed/large bandwidth considerations plus copper-bonding for bandwidth sharing capabilities). Also studied is the way to extend the backhaul transport of IPTV on copper-lines (plus any other local-loop transmissions that may co-exist) onto an "all-optical" trunk of the inter-office facilities (IOFs) in the edge/core …
Marketing The Television Apparatus For American Consumption: Producing Meaning In Contemporary Magazine Advertisements, Kimberly J. Maskevich
Marketing The Television Apparatus For American Consumption: Producing Meaning In Contemporary Magazine Advertisements, Kimberly J. Maskevich
Electronic Theses and Dissertations 2000 - 2009
Contemporary magazine ads for television sets have much in common with their post WWII counterparts, the latter being produced during an era when the new technology was first getting installed in homes across the United States. Much has changed in the TV landscape since the postwar years. In particular, digital technology has altered the general terrain and set choices themselves are more diverse. Digital television began penetrating the marketplace in the 1990s and is predicted to become mainstream by 2010. Even though the cultural climate has shifted since the postwar era, along with the concept of the familial and traditional …
Isolation, Characterization And Synthesis Of New Diterpenes From Pseudopterogorgia Elisabethae, Zhongliang Wan
Isolation, Characterization And Synthesis Of New Diterpenes From Pseudopterogorgia Elisabethae, Zhongliang Wan
Electronic Theses and Dissertations 2000 - 2009
Pseudopterogorgia elisabethae is a known source of structurally interesting bioactive metabolites. A detailed search for new, related compounds was undertaken in this study which resulted in the isolation and characterization of more than ten new diterpenes with serrulatane and ileabethane skeletons. Some of the new compounds isolated are closely related terpenes with significant biological activity and others are likely to be key biosynthetic intermediates. As a component of the development of a production method of anti-inflammatory compounds such as seco-pseudopterosin and elisabethadione, a synthesis of a seco-pseudoperosin aglycone from elisabethatriene was developed.
Markers Of Hypoxic Stress In Fishes Of The Kissimmee River, Lynda J. Dirk
Markers Of Hypoxic Stress In Fishes Of The Kissimmee River, Lynda J. Dirk
Electronic Theses and Dissertations 2000 - 2009
The channelized Kissimmee River experiences seasonally low dissolved oxygen levels which have changed the ecosystem to favor air-breathing species, while gamefish populations have declined greatly. In 2001 , the central portion of the river (Pool C) was physically restored. To evaluate the usefulness of various stress markers and assess the success of the partial restoration, the stress responses were analyzed (brain monoamines, heat shock proteins, and plasma cortisol) of air-breathing fish (bowfin, Florida gar), versus gamefish (largemouth bass and bluegill sunfish). Fish were collected from hypoxic and normoxic water at three sites in the Kissimmee River. Statistical analysis (MANOV A) …
Mitigating Worm Propagation On Virtual Lans, Xiaoguang. Sun
Mitigating Worm Propagation On Virtual Lans, Xiaoguang. Sun
Electronic Theses and Dissertations 2000 - 2009
Recent worms have used sophisticated propagation techniques to propagate faster than the patch distribution and have utilized previously unknown vulnerabilities. To mitigate repetition of such epidemics in future, active defense mechanisms are needed that not only identify malicious activity, but can also defend against widespread outbreak. We provide a framework capable of reacting quickly to quarantine infections. The fundamental components of our framework are detector and VLAN switch. We have provided a proof of concept implementation, where we use the Blaster worm as an example, and demonstrate that detection of worms is possible, and individual infected hosts can be isolated …
Modeling Of Flexible Pipe For Culvert Application Under Shallow Burial Condition, Terdkiat Limpeteeprakarn
Modeling Of Flexible Pipe For Culvert Application Under Shallow Burial Condition, Terdkiat Limpeteeprakarn
Electronic Theses and Dissertations 2000 - 2009
Flexible thermoplastic p1pes under field and laboratory loading conditions have been examined in the present study. The flexible pipes were tested under truck loading application with shallow soil cover. The pipe-soil system response includes soil stresses around and above the buried pipes, vertical pipe crown diametral strain, and circumferential pipe wall strains. Modeling the pipe-soil system is made using plane strain and thin ring assumptions. A thin ring model using Castigliano's theorem is developed to analyze the behavior and response of a flexible pipe under well defined loading conditions and simulate the behavior of the buried pipe under the live …
Negro Para La Nacion: Raza E Identidad Nacional En Las Obras De Alejo Carpentier Y Jacques Roumain, Walteria C. Tucker
Negro Para La Nacion: Raza E Identidad Nacional En Las Obras De Alejo Carpentier Y Jacques Roumain, Walteria C. Tucker
Electronic Theses and Dissertations 2000 - 2009
This study questions the representation of the "black subject" in Alejo Carpentier's ¡Ecue Yamba O! (1933) and Jacques Roumain's Gouverneurs de la rosee (1944), in order to discuss the mechanisms of inclusion and/or "cooptation" employed by the liberal-marxist elite in their nationalist/anticolonial efforts. During the time period in which these two works were written, the ideological, economic and political interventionism of the United States inspired various movements or artistic resistence against "yankee" power in the Caribbean. My study shows how Carpentier and Roumain incorporate the "black subject" in their narratives tin order to generate a national identity to be used …
Mothering And Male Masochism In Mary Elizabeth Braddon's Aurora Floyd, Denise Hunter Gravatt
Mothering And Male Masochism In Mary Elizabeth Braddon's Aurora Floyd, Denise Hunter Gravatt
Electronic Theses and Dissertations 2000 - 2009
Feminist literary critics often praise Mary Elizabeth Braddon's sensation novels for undermining Victorian gender ideologies, and yet by failing to scrutinize aspects of maternity and female sexuality, they overlook some of her work's most subversive potential. In Aurora Floyd, for instance, Braddon deploys the trope of the missing mother to deconstruct the Victorian maternal ideal of a pure, passive angel in the house. Her text proposes a notion of motherhood, which is more concerned with internal goodness and vitality, rather than with the Victorian era's emphasis on external proprieties and socially constructed notions of femininity. Braddon's Aurora is a motherless …
Nutrire: Nurture, Nursing A Material Culture Analysis Of Invalid/Infant Feeders And The Aesthetics And Caring Of Nursing, Nancy K. Smith
Nutrire: Nurture, Nursing A Material Culture Analysis Of Invalid/Infant Feeders And The Aesthetics And Caring Of Nursing, Nancy K. Smith
Electronic Theses and Dissertations 2000 - 2009
This dissertation analyzes a nursing artifact: the infant/invalid feeder. A material culture analysis, developed by the author, is utilized for the in depth study of 12 feeders. This work assumes that Caring is the core value of what constitutes nursing and nursing practice. The expression of the aesthetics of nursing through the act of feeding and use of infant/invalid feeders, aesthetic knowing and expression of that knowing, links caring and caring presence. The act of feeding another, whether sick or infant has been the domestic sphere of women throughout history and is also considered one of the most important duties …
Multicultural Discourse: A Comparative Case Study Of Government Practices In Facilitation Of Multicultural Public Discourse In South Florida, Dragan M. Stanisevski
Multicultural Discourse: A Comparative Case Study Of Government Practices In Facilitation Of Multicultural Public Discourse In South Florida, Dragan M. Stanisevski
Electronic Theses and Dissertations 2000 - 2009
Modern societies are increasingly becoming more culturally diverse. In theories of multiculturalism and governance two approaches to government involvement in managing the dynamics of multicultural interactions prevail, majoritarian and consociational models of democracy. The discursive model of democracy is offered in this study as an alternative model that allows for citizen engagement in public deliberations of conflicting issues. I argue that government has an active role in facilitating multicultural discourses in communities. In facilitation of multicultural discourses I consider public recognition of cultural differences as one important element for citizen inclusion in public deliberations. The practices of three county governments …
Posttranscriptional Regulation Of Tropomyosin Expression By Myofibril Inducing Rna (Mir) During Axolotl Embryonic Heart Development, Pingping Jia
Electronic Theses and Dissertations 2000 - 2009
A naturally-occurring recessive lethal mutation in axolotls, Ambystoma mexicanum, is an intriguing model for studying tropomyosin expression regulation. Homozygous embryos(c/c) form hearts that are deficient in tropomyosin, lack organized myofibrils and fail to beat. Previous studies have shown that a non-coding RNA gene, MIR (Myofibril Inducing RNA), is sufficient to rescue the non-beating homozygous recessive mutant hearts by promoting sarcomeric tropomyosin expression that leads to formation of organized myofibrils and beating hearts. Real time RT-PCR reveals that mutant hearts express the same level mRNA of the alpha-tropomyosin and TM4 type tropomyosin (ATmC-3) gene as normal embryonic hearts. These genes show …
Penny Stock Ipos As Investments, Daniel K. Konku
Penny Stock Ipos As Investments, Daniel K. Konku
Electronic Theses and Dissertations 2000 - 2009
Researchers of Initial Public Offerings, IPOs, have, traditionally, filtered out low-priced stocks with cut-off prices depending on individual study. This study examines underpricing, short- and long-run performance of one special class of such low-priced stocks. I examine IPOs filed for and issued as Penny Stocks, as defined by the amended SEC Act of 1990. The study finds average first-day excess returns of 128% over a benchmark NASDAQ Decile 1 Index. The excess returns on nonpenny IPOs issued on the same markets as the penny stocks are 7.6% over the S&P 500 Index. Cross-sectional analyses show that lower-priced penny stocks and …
Putin Administration's Policies And Russian Initiatives To Rebuild A Eurasian Empire, Julie M. Mura
Putin Administration's Policies And Russian Initiatives To Rebuild A Eurasian Empire, Julie M. Mura
Electronic Theses and Dissertations 2000 - 2009
As the current President of Russia, Vladimir Putin, nears the end of his reign, the shift in his foreign policy has become clear as well as the direction on which he has set the nation for his predecessors to continue. The shift in policy has come from above as represented by the Russian elite and central government, as well as a noticeable ideological shift from below by the Russian citizens, both of which focus on the anti-West rhetoric known as Eurasianism. The school of thought known as Eurasianism seeks Russia to reestablish itself as a Eurasian empire. The contention of …
Quorum Based Ip Autoconfiguration In Mobile Ad Hoc Networks, Tinghui. Xu
Quorum Based Ip Autoconfiguration In Mobile Ad Hoc Networks, Tinghui. Xu
Electronic Theses and Dissertations 2000 - 2009
IP address autoconfiguration poses a challenge for mobile ad-hoc networks (MANETs) because it has to be done to ensure correct routing. An IP autoconfiguration protocol that is based on quorum voting is proposed. Nodes are distributed configured when a write quorum can be collected. Making the compromise between message overhead and data consistency, quorum voting enforces data consistency by ensuring fresh read on every access so that each node is configured with a unique IP address. The protocol is scalable since the configuration information is maintained locally and no central server is involved. Extensive experiments are carried out comparing the …
Response Of Tropical Marine Macroalgae To Thermal Stress, Brent C. Anderson
Response Of Tropical Marine Macroalgae To Thermal Stress, Brent C. Anderson
Electronic Theses and Dissertations 2000 - 2009
Short-term increases in temperatures above 31°C have been shown to influence the structure and diversity of coral reefs through coral bleaching episodes, but quantitative information on how these thermal events affect macroalgae on coral reef communities has rarely been described. Using laboratory mesocosm experiments, I examined six species of commonly occurring macroalgae from two functional form groups on the Florida Keys reef tract to determine their temperature thresholds, quantified by the point at which photosynthesis, quantum yield (Fv/Fm), and mortality rates were significantly affected. Red crustose coralline sp., classified in the calcareous group, showed no significant changes in Fv/Fm, and …

Does The Public Understand Intellectual Property Law? Do Lawyers?, David Vaver
All Papers
I was given a speaker's dream brief: to talk about whatever I wanted so long as it had something to do with the theme of the conference - intellectual property ("IP"). A few suggestions were made in a nice, non-authoritarian way. These could, of course, have been treated the way IP lawyers usually proceed, i.e., by entirely ignoring them. That is called purposive construction, and Canadian and British courts do it all the time. So a British court has read a patent claim to say that "vertical" can also mean "leaning", a decision that comforted builders everywhere. Not to be …

Popping Patented Pills: Europe And A Decade's Dose Of Trips, David Vaver, Shamnad Basheer
All Papers
This paper considers some features of Europe's approach to medicine, public health and patents as it has developed during the decade since TRIPs came into force. It then reviews what rights users have in relation to such patents and what duties right holders may owe users. The following issues are discussed: 1. How patents on medicines are viewed in Europe, 2. How TRIPs has affected European law, 3. How bilateral agreements since TRIPs have affected Europe, 4. How user rights should be viewed under TRIPs, 5. Whether patents in the public health field are a special case.

What does the public want of publishers? As book buyers, they want ready access to cheap and varied books in their language of choice. They don't want to be told a book is out of stock or in some language they can't read, and that they have to trudge round to some public library or antiquarian bookstore, or do their own surreptitious translation. As writers and users, they want fair access to the world's literature to have and to hold, to enjoy, to make fun of if they want, to build on it, and also to benefit and let others …
Foreword: Representation Without Party: Lessons From State Constitutional Attempts To Control Gerrymandering, James A. Gardner
Foreword: Representation Without Party: Lessons From State Constitutional Attempts To Control Gerrymandering, James A. Gardner
Journal Articles
Since the founding, all gerrymandering of election districts, at both the state and congressional levels, has been accomplished by state actors operating almost exclusively under state law. State constitutions have often served as a first line of defense against publicly disfavored practices, and the treatment of gerrymandering is no exception. The state constitutional record reveals a gradual introduction, diffusion, and evolution of a wide variety of provisions intended to control gerrymandering, including requirements of contiguity, compactness, respect for local political boundaries, and preservation of communities of interest, among others. Indeed, such provisions have been validated by the U.S. Supreme Court …

William H. Rehnquist: A Life Lived Greatly, And Well, Richard W. Garnett
Journal Articles
Chief Justice Rehnquist leaves behind a formidable and important legacy in constitutional law. His work on the Court was animated and guided by the view that We the People, through our Constitution, have authorized our federal courts, legislators, and administrators to do many things - but not everything. Because the Nation's powers are few and defined, Congress may not pursue every good idea or smart policy, nor should courts invalidate every foolish or immoral one. However, for those of us who knew, worked with, learned from, and cared about William Rehnquist, it is his unassuming manner, the care he took …
Defending Human Rights In The "War" Against Terror, Douglass Cassel
Defending Human Rights In The "War" Against Terror, Douglass Cassel
Journal Articles
Safeguarding human rights in our "war" against terrorism is both the right and the smart thing to do. It is right because human rights embody our fundamental values as Americans and as Christians. Our Constitution stands for freedom; our Creator teaches us to respect the God-given dignity of each human soul. Christians are called to cherish human dignity, not only of innocents, and not only of captives in war whose status as combatant or civilian may be uncertain, but also of cardinal sinners, the terrorists themselves. Christ Jesus teaches us to hate the sin, but somehow to bring ourselves to …

Introduction: Religion, Division, And The Constitution, Richard W. Garnett
Journal Articles
Thirty-five years ago, in his landmark Lemon v. Kurtzman opinion, Chief Justice Warren Burger declared that state actions could "excessive[ly]"—and, therefore, unconstitutionally—"entangle" government and religion, not only by requiring or allowing intrusive monitoring by officials of religious institutions and activities, but also through their "divisive political potential." He worried that government actions burdened with this "potential" pose a "threat to the normal political process and "divert attention from the myriad issues and problems that confront every level of government." And, he insisted that "political division along religious lines was one of the principal evils against which the First Amendment was …
