Laparoscopy is abdominal surgery performed with long tools inserted through small incisions. The use of small incisions reduces patient trauma, but also eliminates the surgeon’s ability to view and touch the surgical environment directly. These limitations generally restrict the application of laparoscopy to procedures less complex than those performed during open surgery. This paper presents a theoretical and experimental analysis of miniature, wheeled, in vivo robots to support laparoscopy. The objective is to develop a wireless mobile imaging robot that can be placed inside the abdominal cavity during surgery. Such robots will allow the surgeon to view the surgical environment …

Lost In Translation: The Economic Analysis Of Law In The United States And Europe, Kenneth G. Dau-Schmidt, Carmen L. Brun

Articles by Maurer Faculty

In this Essay, we examine the reasons why the economic analysis of law has not flourished in European countries as it has in the United States. In particular, we focus on three European countries-the United Kingdom, Germany, and France. We argue that differences in culture, the legal system, and the academy have led to differing degrees of success of the law and economics movement in each country. We speculate that, although there is currently less interest in the economic analysis of the law in Europe than in the United States, European interest could dramatically increase if scholars adopt more communitarian …

Transnational Regulatory Litigation, Hannah Buxbaum Jan 2006

Transnational Regulatory Litigation, Hannah Buxbaum

Articles by Maurer Faculty

Recent years have seen much debate about the role of national courts in addressing global harms. That debate has focused on the application by domestic courts of international law - for instance, in civil actions brought in U.S. courts to enforce human rights law. This article identifies a parallel development in the area of economic regulation. It classifies and analyzes a category of cases that seek the application of regulatory law by domestic courts in situations involving global economic misconduct. Like the public international law cases, these cases highlight the tension between the benefits to be gained by enhanced enforcement …

Regarding Pained Sympathy And Sympathy Pains: Morality, And Empathy In The Civil Adjudication Of Pain, Jody L. Madeira Jan 2006

Regarding Pained Sympathy And Sympathy Pains: Morality, And Empathy In The Civil Adjudication Of Pain, Jody L. Madeira

Articles by Maurer Faculty

This Essay considers the legal propriety of the empathic responses of jurors to suffering plaintiffs. To that end, Part II first explicates the legal contours of a tension between what is experiential or physical (objective) and what is expressionistic or non-physical (subjective). This tension is a foundational jurisprudential concern in personal injury litigation because the subjective is seen to threaten the rule of law: the perceived primacy of reason and logic. Thus, this tension is also what the parties' attorneys seek to exploit and what the court seeks to constrain. Part III explores why an empathic identification is indeed a …

Recognizing Odysseus' Scar: Reconceptualizing Pain And Its Empathic Role In Civil Adjudication, Jody L. Madeira Jan 2006

Recognizing Odysseus' Scar: Reconceptualizing Pain And Its Empathic Role In Civil Adjudication, Jody L. Madeira

Articles by Maurer Faculty

This Article proffers a consideration of how the expression of pain impacts the interpersonal dimensions of personal injury proceedings, contesting through philosophical logic and textual analyses of case law and legal practitioners' texts the conclusion of scholars such as Elaine Scarry and Robert Cover that pain unmakes both the word and the world. Seeing pain as something that can and must be communicated, albeit in a different form than pain embodied, makes pain a much more profound force, comports with our understanding of pain as a physical yet interpersonally meaningful sensation, and has many evidentiary ramifications. Taking as its premise …

Towards A Cosmopolitan Vision Of International Law: Identifying And Defining Cil Post Sosa V. Alvarez-Machain, Christiana Ochoa Jan 2006

Towards A Cosmopolitan Vision Of International Law: Identifying And Defining Cil Post Sosa V. Alvarez-Machain, Christiana Ochoa

Articles by Maurer Faculty

In the wake of the Supreme Court's decision in Sosa v. Alvarez-Machain, future Alien Tort Claims Act (ATCA) litigants seemingly will be asked to demonstrate that the norms giving rise to their actions are violations of clearly established Customary International Law (CIL). Given the mutable character of CIL, especially in the area of human rights, this will surely fuel the already voluminous literature on the content of the CIL of human rights.

While debate will certainly arise over the norms that have been become CIL, significant attention must be also be devoted to the problems inherent in the CIL of …

Lawyering For A Cause And Experiences From Abroad, Jayanth K. Krishnan Jan 2006

Lawyering For A Cause And Experiences From Abroad, Jayanth K. Krishnan

Articles by Maurer Faculty

For more than a decade, there has been a steady growth in what is now commonly referred to as the 'cause lawyering' literature. Partly as a response to those who were critical of the legal profession during the 1970s and 1980s, cause lawyering scholars have sought to rebut these critics' charges, as well as more comprehensively illustrate what, why, and how cause lawyers do what they do. While the critics of cause lawyers on the one hand, and cause lawyering scholars on the other, have made enormous contributions to the debate, only recently has the discourse shifted to examining an …

The Common Law Of England In Virgina From 1776 To 1830, J. Thomas Wren Jan 2006

The Common Law Of England In Virgina From 1776 To 1830, J. Thomas Wren

Jepson School of Leadership Studies articles, book chapters and other publications

The Virginia Court of Appeals embraced, on the whole, the English legal heritage, despite the violent separation from Great Britain in 1776. This loyalty to English precedents was an illustration of the conservative tenor of the Revolution in Virginia. The English common law continued to be revered because it was perceived to be a bulwark of English, and hence American, liberty. Adherence to English precedent also maintained stable rules of law, which in turn protected existing property rights. At the same time, however, the Court of Appeals was not slavishly devoted to the common law, and the court's departures from …

The "Actual State Of Things": Teaching About Law In Political And Historical Context, David E. Wilkins Jan 2006

The "Actual State Of Things": Teaching About Law In Political And Historical Context, David E. Wilkins

Jepson School of Leadership Studies articles, book chapters and other publications

Vine Deloria, Jr., the most prolific Native writer and one of the most gifted intellectuals in American history, left a deep imprint in many of the fields he so artfully plowed, including: education, religion, politics, cultural critic, history, and indigenous knowledge. His scholarship on specific subjects came in waves, with each wave building upon the previous one before reaching its remarkable crest.

Deloria's scholastic and pragmatic legacy in federal Indian law and policy and indigenous governance is one that has produced several major books and numerous articles, which, in the pantheon of Deloria's prodigious body of works, rank highly in …

Scaling A Dataflow Testing Methodology To The Multiparadigm World Of Commercial Spreadsheets, Marc Randall Fisher Ii, Gregg Rothermel, Tyler Creelan, Margaret Burnett Jan 2006

Scaling A Dataflow Testing Methodology To The Multiparadigm World Of Commercial Spreadsheets, Marc Randall Fisher Ii, Gregg Rothermel, Tyler Creelan, Margaret Burnett

School of Computing: Technical Reports

Spreadsheets are widely used but often contain faults. Thus, in prior work we presented a dataflow testing methodology for use with spreadsheets, which studies have shown can be used cost-effectively by end-user programmers. To date, however, the methodology has been investigated across a limited set of spreadsheet language features. Commercial spreadsheet environments are multiparadigm languages, utilizing features not accommodated by our prior approaches. In addition, most spreadsheets contain large numbers of replicated formulas that severely limit the efficiency of dataflow testing approaches. We show how to handle these two issues with a new dataflow adequacy criterion and automated detection of …

Deliberating Debate’S Digital Futures, Carly Woods, Matthew Brigham, Brent Heavner, Takuzo Konishi, John Rief, Brent Saindon, Gordon R. Mitchell Jan 2006

Deliberating Debate’S Digital Futures, Carly Woods, Matthew Brigham, Brent Heavner, Takuzo Konishi, John Rief, Brent Saindon, Gordon R. Mitchell

Department of Communication Studies: Faculty Publications

Human communities can use collective deliberation to make considered decisions regarding their relationship to technology. Such reflection is particularly warranted, because as sociologist Langdon Winner (1986) observes, "technological artifacts have politics" (p. 19). In other words, choices about technology carry political implications, because patterns of sociality are embedded within technical tools (McMillan and Hyde, 2000). Fortunately, Winner notes, "by far the greatest latitude of choice exists the very first time a particular instrument, system, or technique is introduced" (Winner 1986, p. 29). Winner's insight punctuates the salience and timeliness of this forum exchange, which comes at a moment when the …

Spatial Correlation-Based Collaborative Medium Access Control In Wireless Sensor Networks, Mehmet C. Vuran, Ian F. Akyildiz Jan 2006

Spatial Correlation-Based Collaborative Medium Access Control In Wireless Sensor Networks, Mehmet C. Vuran, Ian F. Akyildiz

School of Computing: Faculty Publications

Wireless Sensor Networks (WSN) are mainly characterized by dense deployment of sensor nodes which collectively transmit information about sensed events to the sink. Due to the spatial correlation between sensor nodes subject to observed events, it may not be necessary for every sensor node to transmit its data. This paper shows how the spatial correlation can be exploited on the Medium Access Control (MAC) layer. To the best of our knowledge, this is the first effort which exploits spatial correlation in WSN on the MAC layer. A theoretical framework is developed for transmission regulation of sensor nodes under a distortion …

Stochastic Algorithm For Improved Operations At Isolated High Speed Intersections, Anuj Sharma, Darcy M. Bullock, Srinivas Peeta Jan 2006

Stochastic Algorithm For Improved Operations At Isolated High Speed Intersections, Anuj Sharma, Darcy M. Bullock, Srinivas Peeta

Department of Civil and Environmental Engineering: Faculty Publications

The current practice of specifying simultaneous gap out logic at isolated high speed signalized intersections places constraints on the signal controller logic that cannot be satisfied under high congestion level. Further, it often results in degraded signal efficiency and dilemma zone protection. A stochastic approach is proposed in this paper with the objective of increasing safety and efficiency at these intersections.

Coupling Between Primary Terrestrial Succession And The Trophic Development Of Lakes At Glacier Bay, Alaska, D. R. Engstrom, Sherilyn C. Fritz Jan 2006

Coupling Between Primary Terrestrial Succession And The Trophic Development Of Lakes At Glacier Bay, Alaska, D. R. Engstrom, Sherilyn C. Fritz

Department of Earth and Atmospheric Sciences: Faculty Publications

The natural eutrophication of lakes is still an accepted concept in limnology, arising as it does from the earliest efforts to classify lakes and place them in an evolutionary sequence. Recent studies of newly formed lakes at Glacier Bay, Alaska, only partially support this idea, and suggest more variable trends in lake trophic development which are under local (catchment-level) control. Here we use sediment cores from several lakes in Glacier Bay National Park to examine the relationship between successional changes in catchment vegetation and trends in water-column nitrogen (a limiting nutrient) and lake primary production. Terrestrial succession at Glacier Bay …

Whole Earth Telescope Observations Of The Zz Ceti Star Hl Tau 76, Noël Dolez, Matt A. Wood, Thomas J. Ahrens, Nicole Silvestri

Aerospace, Physics, and Space Science Faculty Publications

This paper analyses the Whole Earth Telescope observations of HL Tau 76, the first discovered pulsating DA white dwarf. The star was observed during two Whole Earth Telescope campaigns. It was a second priority target during the XCOV13 campaign in 1996 and the first priority one during the XCOV18 campaign in 1999. The 1999 campaign reached 66.5% duty cycle. With a total duration of 18 days, the frequency resolution achieved is 0.68 μHz. With such a frequency resolution, we were able to find as many as 78 significant frequencies in the power spectrum, of which 34 are independent frequencies after …

The Impact Of Open Source On Preinvention Assignment Contracts, Michael Mattioli Jan 2006

The Impact Of Open Source On Preinvention Assignment Contracts, Michael Mattioli

Articles by Maurer Faculty

This comment studies the implications of open source on pre-invention assignment agreements. Part I analyzes the basis for past enforcement of these contracts, with an eye toward distinctions between open source projects and more traditional commercial endeavors. Part II briefly reviews the history of patents and explores constitutional and contract-based arguments against the pre-invention assignment. Part III begins with a discussion of open source and then explores how this new phenomenon perfectly fulfills the goals behind the Patent Act. With these addressed, the central inquiry of pre-invention assignment agreements, as they could conflict with open source inventions, will be addressed. …
