UIC Review of Intellectual Property Law
This article provides a close look at the development of intellectual property protection contrasted with the development of globalization. Specifically, the agreements forming the legal framework of the World Trade Organization are discussed and their impact on the economic development of developing countries examined. A closer look is given to China and India, where only recently intellectual property protection standards complying with mandatory rules of the TRIPS Agreement have been introduced, and where the most remarkable economic, scientific, and technological development can be observed. The use of multilateral treaties in the field of international commercial law has been in a state of steady decline. Traditional treaty law has been gradually replaced in recent years by softer methods of making international law, such as the use of restatements and model laws. Some scholars even claim that treaty law is dead or dying. This Article explains how the Cape Town Convention on International Interests in Mobile Equipment (which entered into force on March 1, 2006) provides an innovative approach to the creation of treaties that promises to revive the status of treaties in international law. This essay seeks to address a puzzling element of the current political and legal struggles over abortion in the United States: if, as pro-life activists insist, embryos are morally equivalent to born, living persons, then why do these activists not oppose in vitro fertilization (IVF) as aggressively as they oppose abortion? IVF accounts for a significant number of destroyed embryos. Constitutionally, IVF appears to be a much more vulnerable target than abortion. And yet, legislative and political attempts to attack and restrict IVF are few, while attempts to erode women's capability to terminate pregnancies are a constant feature of our …

The goal of this project is to elucidate the signaling pathway involved in the T cell integrin lymphocyte function-associated antigen 1 (LFA-1) engagement-mediated, HuR nuclear-to-cytoplasmic translocation and subsequent mRNA stabilization. To examine the pathway transducing LFA-1 engagement-mediated mRNA stabilization, we employed quantitative, real time RT-PCR in the presence of a transcriptional inhibitor to examine the half-life of interferon gamma (IFN-γ) mRNA, a labile cytokine transcript. We used immunofluorescence to observe the nuclear-to-cytoplasmic tranlocation of HuR, an mRNA-binding and stabilizing protein. The overarching goal of this study was two-fold; to determine the prevalence of perinatal onset or worsening of OCD symptoms in women attending a university-based research program, and to determine whether there is a continuity between perinatal onset or worsening of OCD and premenstrual exacerbation of such symptoms. Women ages 18 to 69 years old that were enrolled in the Yale OCD Research Program between 1990 and 1995 were interviewed by phone or in person regarding demographics, onset and course of OCD, types of primary OCD symptoms, treatment history, comorbid diagnoses including substance use/abuse, and the impact of pregnancy and …

Currently technologies such as EEG, EMG and EOG recordings are the established methods used in the analysis of sleep. But if these methods are to be employed to study sleep in rodents, extensive surgery and recovery is involved which can be both time consuming and costly. This thesis presents and analyzes a cost effective, non-invasive, high throughput system for detecting the sleep and wake patterns in mice using a piezoelectric sensor. A novel surface plasmon resonance sensor is fabricated to evaluate its use in biochemical sensing. The sensor can differentiate between bulk refractive index changes and surface binding reactions of interest. There has been a great interest in developing sensors to differentiate biological or chemical agents from interfering effects, but they still remain in research phase. In this work, a prism coupler is used to simultaneously excite both long and short range surface plasmon modes of the sensor. The differing sensitivities of the long and short range modes allow one to distinguish surface binding reactions of interest from refractive index fluctuations. …

There are two varieties of timing games in economics: In a war of attrition, more predecessors helps; in a pre-emption game, more predecessors hurts. In this paper, we introduce and explore a spanning class with rank-order payoffs that subsumes both as special cases. In this environment with unobserved actions and complete information, there are endogenously-timed phase transition moments. We identify equilibria with a rich enough structure to capture a wide array of economic and social timing phenomena — shifting between phases of smooth and explosive entry. We introduce a tractable general theory of this class of timing games based on …

The single kernel characterization system (SKCS) has been widely used in the wheat industry, and SKCS parameters have been linked to end-use quality in wheat. The SKCS has promise as a tool for evaluating sorghum grain quality. However, the SKCS was designed to analyze wheat, which has a different kernel structure from sorghum. To gain a better understanding of the meaning of SKCS predictions for grain sorghum, individual sorghum grains were measured for length, width, thickness (diameter), and weight by laboratory methods and by the SKCS. SKCS predictions for kernel weight and thickness were highly correlated to laboratory measurements. However, …

Knowing the geographic distribution of any species is an important first step toward understanding its ecology. Long-tailed weasels (Mustela frenata) are secretive and difficult to detect, so little is known about their distribution in Illinois. To fill this gap in the knowledge, we solicited information from museum curators about the sites where long-tailed weasel specimens were collected in Illinois and surveyed biologists and recreational trappers to document locations of where they had seen or captured long-tailed weasels. We present an updated map of long-tailed weasel distribution, documenting presence in at least 60 of the 102 counties in Illinois. Long-tailed weasels …

Post-Recruitment Survival Of White-Tailed Deer Fawns In Southern Illinois, John H. Rohm, Clayton K. Nielsen, Eric M. Schauber, Alan Woolf

Reliable estimates of survival for white-tailed deer (Odocoileus virginianus) fawns are needed for sound deer management. Several studies have estimated fawn survival prior to recruitment (i.e., before the onset of hunting season) but few have monitored fawns post-recruitment, especially in the lower Midwest or Southeast. We captured and radiocollared 166 neonatal fawns during 2002–2004 in southern Illinois. Ninety-one fawns survived to recruitment and were monitored for survival from 1 October until the end of the firearm hunting season (typically 8 December). Post-recruitment survival was 0.73 (95% CI = 0.63 – 0.83). Hunter harvest was the primary source of …

Stakeholder theory is a significant development in the drive to provide a foundation for intuitions concerning the moral responsibility connected to corporate decision making. The move to include the interests of workers, consumers, the communities and biological environment in which the corporations instantiations are located run counter to the view in which stakeholders' interests are paramount. The non-sale of the Hershey Foods company to Wrigley was the ultimate result of a massive call by stakeholders to put other interests before stakeholder financial stakes, yet the discussion was notably not held in terms of stakeholder theory. In this chapter, the impact of watershed acidification treatments on WS3 at the Fernow Experimental Forest (FEF) and at WS9 on vegetation is presented and summarized in a comprehensive way for the first time. WS7 is used as a vegetative reference basin for WS3, while untreated plots within WS9 are used as a vegetative reference for WS9. Bioindicators of acidification impacts that will be considered include several measures of tree and stand growth rates, foliar chemistry, bolewood chemistry, and herbaceous species composition and diversity. We describe the edopoid temnospondyl Nigerpeton ricqlesi from the Upper Permian Moradi Formation of northern Niger on the basis of two partial skulls and tentatively associated postcranial material. This crocodile-like taxon displays several edopoid characters states such as a long prenarial region with enlarged premaxillae, elongated vomers, large, posteriorly tapering choanae, and a jugal that broadens anteriorly. Nigerpeton possesses a unique carnivorous dentition. It is autapomorphic in its possession of an extremely elongate snout bearing a maxillary bulge that accommodates three hypertrophied caniniform teeth, inner premaxillary tusks, and anterior paired fenestrae, which pierce the skull roof. Phytochromes play critical roles in monitoring light quantity, quality, and periodicity in plants and they relay this photosensory information to a large number of signaling pathways that regulate plant growth and development. Given these complex functions, it is not surprising that the phytochrome apoproteins are encoded by small multigene families and that different forms of phytochrome regulate different aspects of photomorphogenesis. Over the course of the last decade, progress has been made in defining the number, molecular properties, and biological activities of the photoreceptors that constitute a plant R/FR sensing system.
