A Giant Without Limbs: The International Criminal Court’S State-Centric Cooperation Regime, Jackson N. Maogoto
A Giant Without Limbs: The International Criminal Court’S State-Centric Cooperation Regime, Jackson N. Maogoto
ExpressO
The International Criminal Court is one of the great international institutions in mankind’s history with the potential to reconfigure significant aspects of the international system with regard to criminal jurisdiction. But like the international penal institutions before it, the success of the ICC revolves around international cooperation. An institutional check on the ICC’s power is that it will have to work through States. States Parties will be asked to arrest and surrender suspects, investigate and collect evidence, extend privileges and immunities to ICC officials, protect witnesses, enforce ICC orders for fines and forfeiture and, at times, prosecute those who have …
The International Criminal Tribunal For Rwanda: A Paper Umbrella In The Rain? Initial Pitfalls And Brighter Prospects, Jackson N. Maogoto
The International Criminal Tribunal For Rwanda: A Paper Umbrella In The Rain? Initial Pitfalls And Brighter Prospects, Jackson N. Maogoto
ExpressO
The tragedy which befell Rwanda in 1994 deserves a special place in the bloodstained pages of history. The Rwandan genocide merits distinction primarily because of its shocking efficiency, its scale and its proportional dimensions among the victim population. The Security Council's resolution establishing the ICTR articulates a set of decisions, assumptions, wishes, and objectives. Primarily, the States that voted in favour of the creation of the ICTR indicated that the root of the problem was individual violations of international criminal law. Only one State that voted for the resolution did not equate ipso facto ICTR actions with justice. That State …
America’S War On Terror: Rattling International Law With Raw Power? , Jackson N. Maogoto
America’S War On Terror: Rattling International Law With Raw Power? , Jackson N. Maogoto
ExpressO
The need for more dramatic targets has led to the new and somewhat exaggerated emphasis on a unilateral right of pre-emptive self-defence by the United States. What is most striking about the new US policy is that it portrays state-sponsored terrorism and rogue states possessing weapons of mass destruction as a new problem, and unilateral action as the only way of dealing with them. It is dangerous to marginalise the UN and increase the role of multilateral global coalitions or unilateral action in policing “evil-doing” as this has the potential to supplant what initially was designed as the role of …
Sovereignty In Transition: Human Rights And International Justice, Jackson N. Maogoto
Sovereignty In Transition: Human Rights And International Justice, Jackson N. Maogoto
ExpressO
Sovereign excesses in the twentieth century resulted in the murder of approximately 170,000,000 persons by their sovereign. This statistic, a potent testimony of sovereign excesses through gross and systematic human rights violations firmly places human rights and humanitarian problems on the international plane. This reality (identified and articulated in the Report of the Secretary General’s High-level Panel on Threats, Challenges and Change) firmly places human rights problems on the international plane and mandates a fundamental rethinking about the basis of sovereignty’s political and associational organization in the new millennium. This Article has as its modest aim an examination and analysis …
Contemporary Private Military Firms Under International Law: An Unregulated “Gold Rush”, Jackson N. Maogoto
Contemporary Private Military Firms Under International Law: An Unregulated “Gold Rush”, Jackson N. Maogoto
ExpressO
The Article addresses the legal issues raised by the ascendance of contemporary Private Military Firms. This article has as its aim an exploration of the thorny legal issues raised by the commodification of force. It discusses the nature of the contemporary PMF noting that it bears vestiges of yester year mercenaries. It then grapples with their uncertain status under international law despite the fact that they potentially pose problems for state authority and the direct control of states over the use of force. At the heart of the argument is the reality that PMFs maintain the ability to inflict violence …

To Catch A Sex Thief: The Burden Of Performance In Rape And Sexual Assault Trials, Corey Rayburn Yung
To Catch A Sex Thief: The Burden Of Performance In Rape And Sexual Assault Trials, Corey Rayburn Yung
ExpressO
Despite decades of efforts to reform American rape law, prosecution and conviction rates remain low compared to similar crimes. While activists led legislatures to adopt important statutory changes for rape and sexual assault, only modest effects in the levels of sexual violence have been observed. Nonetheless, reform-minded scholars continue to focus on statutory and rule tinkering as a means to quell sexual violence.
This article argues against the commonly-held belief that the crucial factors in determining the outcome of rape trials are substantive and procedural in nature. Rather, the issues of performance, representation, and language often pre-determine the outcomes of …

Privacy And Access To Public Records In The Information Age, Sol Bermann
Privacy And Access To Public Records In The Information Age, Sol Bermann
ExpressO
Online public record access brings a wealth of benefits ranging from greater government access and accountability to increased cost-savings and efficiencies. However, due to the presence of highly sensitive, personal data, an increase in public records access also brings potential dangers, including heightened risk of identity theft and frivolous snooping into the affairs of others.
Historically, public records have had some measure of public accessibility in order to empower citizens with the ability to observe the goings-on of government, leading to greater government accountability. Until the rise of the internet, citizens have had their privacy protected through practical obscurity (the …

Five Approaches To Literacy In Correctional Education, Thom Gehring, Gary H. Sherwin
Journal of Critical Issues in Educational Practice
This article introduces literacy from a few “big picture” perspectives, and then reviews five paradigms that have shaped the teaching and learning of literacy in residential confinement institutions for juveniles and adults. The paradigms are specific to correctional education, but they will be familiar to all alternative teachers and advocates of literacy instruction.

Rethinking Transitional Justice: Cambodia, Genocide, And A Victim-Centered Model, Isabelle Chan
Rethinking Transitional Justice: Cambodia, Genocide, And A Victim-Centered Model, Isabelle Chan
International Studies Honors Projects
Through a normative and explanatory approach, this thesis explores the historical and political factors that could influence the pursuit of transitional justice in Cambodia. The study suggests that a victim-centered model will meet the goals of reconciliation, truth, and healing advocated by the Cambodian Government and the international community. Recognizing the necessities and positive potentialities inherent in a combined prosecutorial and restorative approach of transitional justice, this research calls upon historical and comparative lessons to bring forth public policy recommendations for the Hun Sen Government and the United Nations. The study concludes with avenues for additional research on Cambodia, transitional …
