Privilege Through Prayer: Examining Bible-Based Prison Rehabilitation Programs Under The Establishment Clause, Nathaniel J. Odle

In early June of 2006, an Iowa federal judge found a publicly-funded prison ministry to be in violation of the Establishment Clause and ordered it stopped. The program in question, the InnerChange Freedom Initiative, conceived and maintained by Prison Fellowship Ministries, utilized an overtly Christian model to rehabilitate inmates through spiritual and moral regeneration. In the eyes of the court, the failure of the state of Iowa to provide a reasonable secular alternative had the primary effect of advancing religion and fostered excessive governmental entanglement under a traditional Lemon analysis. Behaviorally-Based Disorders: The Historical Social Construction Of Youths' Most Prevalent Psychiatric Diagnoses, Christopher A. Mallett

The article discusses the historical social construction of the most prevalent diagnosis of youth in the U.S. The country's psychiatry controls the definitions of mental health disorders and diagnosis through required practice utilization of the Diagnostic and Statistical Manual of Mental Disorders. A research is conducted through a social construction theoretical paradigm to identify diagnostic classification systems, nosology changes, and critical time periods.

Can juror bias be predicted after a thorough voir dire is conducted by a trained forensic psychologist? Most cases involve complex laws that require jurors to be more critical and thoughtful about their decisions and ultimately their verdicts. It is not enough to observe a jury pool and assess non-verbal cues. A trained trial consultant must have the psychological background to completely predict behavior of jurors based not only on non-verbal behaviors but also on socioeconomic, racial and gender factors as well as experience. All jurors are biased, but it is the trial consultant's duty to filter through those biases …

Using Foucauldian qualitative research methods, this study will compare al-Qaeda and the Aryan Nations for similarities while attempting to uncover new insights from preexisting information. Little or no research had been conducted comparing these two organizations. The underlying theory is that these two organizations share similar rhetoric, enemies and goals and that these similarities will have implications in the fields of politics, law enforcement, education, research and United States national security.

Dred Scott: Tiered Citizenship And Tiered Personhood, Henry L. Chambers Jr.

The Dred Scott Court accepted and perpetuated the notion that our Constitution afforded multiple tiers of citizenship and multiple tiers of personhood through which different groups of citizens and different groups of persons would receive varying sets of rights. Through their language and interpretation, the Reconstruction Amendments largely resolved this issue by providing a formal equality that created a single tier of citizenship and a single tier of personhood. Though, as a formal matter, tiered citizenship and tiered personhood are unacceptable, the issue is not fully resolved as a practical matter. This study was conducted to examine the impact that extreme economic deprivation has on adolescent social development. Data for this study was collected from the 2000 U.S. Census Bureau. This study uses the Developmental Prevention model as a theoretical basis, a theory which posits that extreme economic deprivation, as measured by income, poverty, crime rates, racial composition of neighborhoods, and prevalence of mothers and grandparents as sole caregivers, is a risk factor for all delinquent behaviors. The specific delinquent behaviors examined in this study were teen pregnancy, school dropout, poor school attendance, and criminality. A study was conducted to compare …

This study addresses the perception of the use of force and some differences that exist between males and females within law enforcement. A survey was distributed to five average sized police departments across the United States to survey the perceptions of the men and women in blue. The hypothesis is that women officers use less force to successfully accomplish the same desired outcomes in police/citizen contacts. At the time of this study, there have been no formal surveys on this subject. The survey response rate was 50% and the responses were tabulated to determine officers' perceptions on the use of …

This Article provides a survey of death penalty case law in Georgia from June 1, 2005 through May 31, 2006. The cases include those that the Georgia Supreme Court heard on interim appeal, direct appeal, and on review of habeas corpus decisions. Two recent decisions of the United States Supreme Court are also included because of their relevance to Georgia death penalty law. While there have been recent significant statutory changes affecting capital litigation in Georgia, those changes are beyond the purview of this Article and therefore will not be discussed.
