An Empirical Study Of Parental Responsibility Laws: Sending Messages, But Wat Kind And To Whom?, Leslie Joan Harris Jan 2006

An Empirical Study Of Parental Responsibility Laws: Sending Messages, But Wat Kind And To Whom?, Leslie Joan Harris

Utah Law Review

Finally, parental responsibility laws define youth crime as a private problem born of familial failure rather than behavior that, at low levels, is a usual part of the maturation process and, at higher levels, may call for collective efforts to engage teenagers in positive ways, including helping parents in difficult situations. The laws provide politicians with a cheap and easy way of avoiding meaningful efforts to address significant social issues.

Living Up To Their Name: Profamilia Takes On Gender-Based Violence, Claudia Garcia-Moreno, Rachel E. Goldberg

Poverty, Gender, and Youth

This issue of Quality/Calidad/Qualité describes the evolution of Profamilia through its work on gender-based violence in the Domincan Republic.Their project was conceived along two simultaneous paths: providing support services directly to women and girls who had experienced violence and initiating advocacy in the wider policy arena. Profamilia joined the commission that ultimately designed and promoted a law to increase protection against violence, especially domestic violence against women and children. Although the clinics now run a dynamic service program, the agency has also sustained its advocacy activities. Most of Profamilia’s advocacy work is undertaken in partnership with other NGOs or with …

Richmond Public Interest Law Review

This Comment will argue that jury nullification is not only a power enjoyed by juries throughout America, but a duty conferred on jurors, and a part of the criminal justice system that should be embraced, not hidden from sight. Part I will highlight the historical origins and justifications of jury nullification. It will also discuss jury nullification in its contemporary context. Part II will address some of the criticisms of jury nullification and provide responses to those criticisms. Finally, Part III will propose a framework for integrating jury nullification into the regular criminal justice process.

Compelling War Correspondents To Testify: A Prerogative Of International Criminal Tribunals?, Jennifer S. Jones

Dalhousie Journal of Legal Studies

A qualified testimonial privilege for war correspondents was recognized by the Appeals Chamber of the International Criminal Tribunal for the Former Yugoslavia in the case of Prosecutor v. Brdjanin. This article examines whether war correspondents should enjoy such a privilege in international criminal tribunals. The author illustrates that, to maintain their legitimacy, international criminal tribunals must be able to make factually accurate findings. She further illustrates that the ability of international criminal tribunals to make factually accurate findings is dependant upon their ability to obtain reliable evidence, including witness testimony. The suggestion is made that, as testimonial privileges reduce the …

The Design Of An Undergraduate Degree Program In Computer & Digital Forensics, Gary C. Kessler, Michael E. Schirling

Journal of Digital Forensics, Security and Law

Champlain College formally started an undergraduate degree program in Computer & Digital Forensics in 2003. The underlying goals were that the program be multidisciplinary, bringing together the law, computer technology, and the basics of digital investigations; would be available as on online and oncampus offering; and would have a process-oriented focus. Success of this program has largely been due to working closely with practitioners, maintaining activity in events related to both industry and academia, and flexibility to respond to ever-changing needs. This paper provides an overview of how this program was conceived, developed, and implemented; its evolution over time; and …

Police Prosecution In Rhode Island: The Unauthorized Practice Of Law, Andrew Horwitz, John R. Grasso Jan 2006

Police Prosecution In Rhode Island: The Unauthorized Practice Of Law, Andrew Horwitz, John R. Grasso

Law Faculty Scholarship

Every day in Rhode Island, police officers are practicing law without a license in both the District Court and the Traffic Tribunal. They do so with the full stamp of approval of the judges before whom they appear, despite the fact that the unauthorized practice of law is a crime in Rhode Island, as it is in every other state in the country. While one can certainly speculate about reasons why this practice has developed, there is nothing in any published decision of the Supreme Court of Rhode Island or in any state statute that appears to permit or justify …

The Cultural, Political, And Legal Climate Behind The Fight To Stop Trafficking In Women: William J. Clinton's Legacy To Women's Rights, Susan Tiefenbrun

Cardozo Journal of Equal Rights & Social Justice

The article examines the Clinton Administration's significant contributions to advancing women's rights, particularly through landmark legislation such as the Family and Medical Leave Act (FMLA) and the Trafficking Victims Protection Act (TVPA). These efforts, including the appointment of women to high office, reflect a cultural shift toward valuing women's roles and protecting them from exploitation. The TVPA, reauthorized under subsequent administrations, has had a lasting domestic and international impact in combating human trafficking and supporting victims. The article highlights the importance of legislative and judicial approaches in addressing violence against women and promoting gender equality.

The Importance Of Realizing "Other Rights" To Prevent Sex Trafficking, Jonathan Todres Jan 2006

The Importance Of Realizing "Other Rights" To Prevent Sex Trafficking, Jonathan Todres

Cardozo Journal of Equal Rights & Social Justice

The article argues that effectively combating sex trafficking requires a broader approach that goes beyond criminalization and victim assistance. It emphasizes the importance of realizing "other rights" under international human rights law, such as the right to be free from gender-based violence, discrimination, and the rights to birth registration, health, and education. Ensuring these rights addresses the systemic issues that make marginalized populations vulnerable to trafficking and fosters sustainable development, which is critical for long-term prevention.
