Women And War: A Bibliography Of Recent Works, Annette Demers
Women And War: A Bibliography Of Recent Works, Annette Demers
International Journal of Legal Information
Since the end of the Cold War, a number of regional conflicts worldwide have devastated innocent populations. The conflicts in Rwanda and in the Balkans come to mind as prominent examples. With these developments the literature about women and war has proliferated.
In particular, there is a growing emphasis on the impact of war on women. The literature emphasizes a number of concerns. In most countries, women form the center of the family and bear the economic and social burden of keeping their families together throughout times of conflict and upheaval. Women's essential role in childbearing and procreation makes them …

Reflections On The Death Penalty And Catholic Social Teaching, Dr. Roger C. Barnes Ph.D.
Reflections On The Death Penalty And Catholic Social Teaching, Dr. Roger C. Barnes Ph.D.
Verbum Incarnatum: An Academic Journal of Social Justice
Catholic social teaching has a great deal to guide us on the topic of the death penalty. especially with respect to the inherent dignity of the human person. The death penalty remains a staple of the American criminal justice system.for a majority ofthefifiy slates and.federal government, hut public sentiment is becoming increasingly skeptical about its ultimate effectiveness. In thefollmrinx I revinv that part of Catholic social teaching that speaks to the death penalty and I reflect on the struggle to abolish the death penalty.

Does It Really Matter? Conservative Courts In A Conservative Era, Mark A. Graber
Does It Really Matter? Conservative Courts In A Conservative Era, Mark A. Graber
Faculty Scholarship
This essay explores the likelihood that conservative federal courts in the near future will be agents of conservative social change. In particular, the paper assesses whether conservative justices on some issues will support more conservative policies than conservative elected officials are presently willing to enact and whether such judicial decisions will influence public policy. My primary conclusion is that, as long as conservatives remain politically ascendant in the elected branches of government, the Roberts Court is likely to influence American politics at the margins. The new conservative judicial majority is likely to be more libertarian than conservative majorities in the …
Connecting Theory And Reality: Teaching Gideon And Indigent Defendants' Non-Right To Counsel At Bail, Douglas L. Colbert
Connecting Theory And Reality: Teaching Gideon And Indigent Defendants' Non-Right To Counsel At Bail, Douglas L. Colbert
Faculty Scholarship
In my article, I critique criminal procedure textbooks' and law professors' limited treatment of the constitutional right to counsel at the bail stage. While explaining that casebook authors usually praise the Supreme Court's landmark decisions in Gideon v. Wainwright and Argersinger v. Hamlin for guaranteeing trial counsel to indigent state defendants, I suggest that they shed minimal light on Gideon's irrelevance to most state defendants when they first appear before a judicial officer. Reviewing leading criminal procedure casebooks, I demonstrate that it is the rare text which informs law students that accused defendants should not expect to find a defense …

Balancing The Rights Of Employer, General Public, And The Ex-Offender: To What Extent Should Criminal Records Be Considered In Employment Decisions And What Are The Implications For Policy, Tyrone Bush
Seminar Research Paper Series
"We know from experience that if former prisoners can’t find work, or a home, or help, they are much more likely to commit more crimes and return to prison…. America is the land of the second chance, and when the gates of the prison open, the path ahead should lead to a better life." – President George W. Bush, 2004

The Price Of Pretrial Release: Can We Afford To Keep Our Fourth Amendment Rights?, Melanie D. Wilson
The Price Of Pretrial Release: Can We Afford To Keep Our Fourth Amendment Rights?, Melanie D. Wilson
Scholarly Articles
The Fourth Amendment serves an important constitutional function. It protects the privacy of Americans from intrusions on their personal security. Few rights are held more sacred. When a person is arrested and faces the real likelihood of pretrial detention in jail, the person risks not only a reduction in his privacy rights, but also a loss of his liberty. In such circumstances, the arrested person should be able to bargain away some of his Fourth Amendment rights in exchange for the additional freedoms associated with release to home.
Undoubtedly, defendants forced to choose between incarceration and Fourth Amendment rights will …

A King Who Devours His People: Jiang Zemin And The Falun Gong Crackdown: A Bibliography, Michael J. Greenlee
A King Who Devours His People: Jiang Zemin And The Falun Gong Crackdown: A Bibliography, Michael J. Greenlee
International Journal of Legal Information
In July 1999, the government of the People’s Republic of China (PRC) and the Chinese Communist Party (CCP) began an official crackdown against the qigong cultivation group known as Falun Gong. Intended to quickly contain and eliminate what the PRC considers an evil or heretical cult (xiejiao), the suppression has instead created the longest sustained and, since the Tiananmen Square protests of June 1989, most widely known human rights protest conducted in the PRC. The Falun Gong has received worldwide recognition and support while the crackdown continues to provoke harsh criticism against the PRC as new allegations of human rights …

Exploring The Relationship Between Intimate Partner Violence And Hiv Risk Propensity In African American Women, Lauren Lois Josephs
Electronic Theses and Dissertations
This study explored the relationship between Intimate Partner Violence and HIV Risk-Propensity in African-American women. Current literature on HIV reveals that one of the groups most seriously impacted by the continued scourge of HIV is African-American heterosexual women. An anonymous questionnaire was completed by a community based sample of 200 African American women with a varied history of intimate partner violence to (1) explore whether a relationship exists between Intimate Partner Violence and sexual coercion in African-American women (2) determine whether a relationship exists between sexual coercion and HIV Risk in African-American women (3) determine if the frequency of intimate …
