Creating A "Hydra In Government": Federal Recourse To State Law In Crime Fighting, Wayne A. Logan

Traditionally, U.S.-state criminal justice relations have been conceived in two-dimensional terms, with concern primarily dedicated to U.S. usurpations of state authority. As this Article makes clear, however, U.S.-state relations are in significant measure also multi-dimensional and synergistic: rather than being solely engaged in a zero-sum power competition with states, the U.S. in actuality often defers to state laws and outcomes, despite the highly variegated normative positions they embody. As a consequence of this deference, the U.S. at once increases the scope, content and effect of its own criminal justice enterprise, and elevates (not reduces) the sovereign authority of states. The …

Transparency And Participation In Criminal Procedure, Stephanos Bibas
Public Law and Legal Theory Working Papers
The insiders who run the criminal justice system–judges, police, and especially prosecutors–have information, power, and self-interests that greatly influence the criminal justice process and outcomes. Outsiders–crime victims, bystanders, and most of the general public–find the system frustratingly opaque, insular, and unconcerned with proper retribution. As a result, a spiral ensues: insiders twist rules as they see fit, outsiders try to constrain them, and insiders find new ways to evade or manipulate the new rules. The gulf between insiders and outsiders undercuts the instrumental, moral, and expressive efficacy of criminal procedure in serving the criminal law’s substantive goals. The gulf clouds …

Separation Of Powers And The Criminal Law, Rachel E. Barkow
Separation Of Powers And The Criminal Law, Rachel E. Barkow
Faculty Articles
Scholars have written volumes about the separation of powers, but they have focused on the administrative state and have wholly ignored the criminal state. Judges, too, have failed to distinguish criminal from administrative matters. So, the conventional wisdom has been that whatever theory works for the administrative state should work for anything else, including crime. And because most scholars and judges have supported a flexible or functional approach to separation of powers in the regulatory sphere, they have failed to see a problem with the functional approach when it comes to criminal matters. Indeed, the Supreme Court has been even …
What Counts As Domestic Violence? A Conceptual Analysis, Michelle Madden Dempsey
What Counts As Domestic Violence? A Conceptual Analysis, Michelle Madden Dempsey
William & Mary Journal of Race, Gender, and Social Justice
This article analyzes the conceptual structure of domestic violence and critiques various influential accounts of domestic violence operating in the criminal justice system, legal and sociological academia, and the domestic violence advocacy community. Part I presents a preliminary philosophical analysis of domestic violence with the goal of furthering our understanding of the correct use of this concept. This analysis centers around three key elements of domestic violence: violence, domesticity, and structural inequality. Part II develops an explanatory model of domestic violence based upon these key elements. Part III examines and critiques four principal accounts of domestic violence, each of which …

Descriptive Analysis Of Sexual Assaults In Anchorage, Alaska: 2002/2003 Update, André B. Rosay, Jeannie Sanders, Sandra Smith, Bonnie Caladine, Donna Monahan
Reports
This brief report updates the previous report Descriptive Analysis of Sexual Assaults in Anchorage to document some of the changes in the nature of sexual assault in Anchorage, Alaska from 2000 to 2003. From 2000 to 2003, the rates of reported sexual assaults in Anchorage continue to be significantly higher than national rates; most victims continued to be female, and almost all suspects male; over half of sexual assaults continued to occur in private residences; and the Spenard and Fairview community council areas continued to experience the highest numbers of sexual assaults in the municipality. The Duress Defense's Uncharted Terrain: Applying It To Murder, Felony Murder, And The Mentally Retarded Defendant, Steven J. Mulroy
San Diego Law Review
This Article explores two issues of first impression in the federal courts raised by a recent Sixth Circuit case: the applicability of the duress defense to felony murder, and whether the mental retardation of the defendant is relevant to such a defense. No federal court has ruled on the applicability of duress to felony murder. A few state courts have so ruled, with mixed results. Prior to the August 2005 Sixth Circuit ruling, no federal court has ruled on the relevance (if any) of mental retardation in meeting the elements of duress. A few federal courts have ruled in the …

Models Of American Indian Education: Cultural Inclusion And The Family/Community/School Linkage, Adrienne Freng, Scott Freng, Helen A. Moore
Models Of American Indian Education: Cultural Inclusion And The Family/Community/School Linkage, Adrienne Freng, Scott Freng, Helen A. Moore
Department of Sociology: Faculty Publications
Educational research has explored the impact of culture and the linkage of families and communities to schools on student achievement among minority students. Little focus, however, has been placed on the family/community interactions with schools among culturally distinctive populations such as American Indians and students' perceptions of the educational process. This exploratory research examined the state of education from the perspective of American Indian young adults from various tribes in Nebraska. Instead of focusing on educational achievement, the emphasis of most educational research relating to American Indians, this study explored the model of education in existence. Additionally, researchers explored the …
