Wrongful Convictions And Forensic Science: The Need To Regulate Crime Labs, Paul C. Giannelli Mar 2006

Wrongful Convictions And Forensic Science: The Need To Regulate Crime Labs, Paul C. Giannelli

Faculty Publications

DNA testing has exonerated over 200 convicts, some of whom were on death row. Studies show that a substantial number of these miscarriages of justice involved scientific fraud or junk science. This article documents the failures of crime labs and some forensic techniques, such as microscopic hair comparison and bullet lead analysis. Some cases involved incompetence and sloppy procedures, while others entailed deceit, but the extent of the derelictions - the number of episodes and the duration of some of the abuses, covering decades in several instances - demonstrates that the problems are systemic.

Paradoxically, the most scientifically sound procedure …

The Judgment-Proof Society, Stephen G. Gilles Mar 2006

The Judgment-Proof Society, Stephen G. Gilles

ExpressO

This article presents the first article-length treatment of the legal rules that enable uninsured and underinsured individuals to escape tort liability by sheltering their income and assets from collection. These legal barriers to collecting tort judgments include limits on wage garnishment, homestead exemptions, retirement-plan exemptions, discharge in bankruptcy, spendthrift trusts, offshore asset protection trusts, and more. Of course, indigent persons would be judgment-proof even without these rules, because they have so few assets and so little income. Contrary to the myth of personal tort liability that is standard in torts scholarship and teaching, however, these legal rules enable huge numbers …

I Want A Divorce: When The Professional Becomes Personal In Academics, Angela West Crews, Gordon A. Crews, Mark L. Dantzker, Reid C. Toth, Jeffrey P. Rush Mar 2006

I Want A Divorce: When The Professional Becomes Personal In Academics, Angela West Crews, Gordon A. Crews, Mark L. Dantzker, Reid C. Toth, Jeffrey P. Rush

Criminal Justice Faculty Research

Contractual relationships between faculty members and departments are like marriages and tenured relationships like marriages with children. If either party wants out, the implications can be personally and professionally devastating. While faculty quality is periodically evaluated by performance in teaching, scholarship, and service, one’s ability to develop and maintain successful personal relationships within academic environments may impact, even override, acceptable professional performance. Roundtable participants will discuss leaving institutions and being asked to leave institutions due to the personal affecting the professional, seeking other employment after an academic “divorce” ("remarriage"), professional versus personal loyalties, and other related topics.

To Protect Or To Serve: Confidentiality, Client Protection And Domestic Violence, Dana Harrington-Conner Mar 2006

To Protect Or To Serve: Confidentiality, Client Protection And Domestic Violence, Dana Harrington-Conner

ExpressO

This article addresses the ethical dilemma of whether and when the attorney for an adult victim of domestic violence can or should disclose confidential communications for the protection of his or her own client.

Advocates maintain that domestic violence is the single major cause of injury to women in the United States. The risks are undeniable. An attorney representing a client who remains in or voluntarily returns to a violent relationship may confront conflicting ethical duties because it is difficult, if not impossible, for the attorney to determine which cases will end in further violence and which will not.

This …

The first part of the article reviews the principal differences in the two systems as it affects trial procedure. The article then reviews those aspects of accusatorial trial proceedings that caused the greatest degree of discomfort to the foreign lawyers. Finally, the article attempts to posit a few recommendations that should help not only to ease the transition process but also to anticipate the next level of procedural and substantive obstacles.

Enforcing Fourth Amendment Rights Through Federal Habeas Corpus, Steven Semeraro Mar 2006

Enforcing Fourth Amendment Rights Through Federal Habeas Corpus, Steven Semeraro

ExpressO

This article reassesses the use of federal habeas corpus to enforce the Fourth Amendment’s protection against unreasonable searches and seizures. In 1976, the U.S. Supreme Court prohibited virtually all substantive review of search-and-seizure claims in federal habeas proceedings. A wave of critical commentary followed, arguing that there was no legitimate reason to distinguish the Fourth Amendment from other constitutional rights. In recent years, however, this anomaly in habeas corpus practice has gone almost entirely unexamined despite dramatic changes in the law governing both the Fourth Amendment and habeas corpus itself.

This article does two things. First, it reviews the history …

Facial Challenges, Legislative Purpose, And The Commerce Clause, David L. Franklin Mar 2006

Facial Challenges, Legislative Purpose, And The Commerce Clause, David L. Franklin

ExpressO

Over the past decade or so, the Supreme Court has issued an extraordinary and highly controversial series of decisions concerning the scope of Congress’s power. Yet beneath the surface of the debate over the federalism cases lies a parallel dispute that has received far less academic notice. This dispute concerns the proper mode of judicial review in cases testing the scope of congressional power. The uncertainty is greatest in the Commerce Clause area, where the Court’s recent cases—including its 2005 decision in Gonzales v. Raich—have shown a strong preference for facial challenges, in sharp contrast to the Court’s traditional inclination …

Mahon Lecture, Patrick E. Higginbotham Mar 2006

Mahon Lecture, Patrick E. Higginbotham

Texas Wesleyan Law Review

The law of federal courts is now a free-standing subject in every law school curriculum, taught in law schools as federal jurisdiction and in distinct courses as federal practice and civil procedure. So much of this is recent. After all, the Federal Rules of Civil Procedure which fueled a sea of change in American litigation are only 65 years old. Its youth in the law is easily demonstrated. For example, the doctrine of standing did not appear in anything like its present form until after World War II, responding as it did to the growth of public law and the …
