Revisiting The Legal Link Between Genetics And Crime, Deborah W. Denno

Law and Contemporary Problems

In 1994, convicted murderer Stephen Mobley became a cause celebre when he appealed his death sentence before the Georgia Supreme Court in the case of Mobley v. State. Denno describes the potential implications arising from the high-profile case of Stephen Mobley. He sought to introduce a then-cutting-edge theory that violence could be based on a genetic or neurochemical abnormality as mitigating evidence during capital sentencing.

Behavioral Genetics Research And Criminal Dna Databases, D. H. Kaye

Law and Contemporary Problems

Kaye discusses DNA databanks and the potential use of such databanks for behavioral genetics research. He addresses the concern that DNA databanks serve as a limitless repository for future research and that the samples used in the databanks could be used for research into a crime gene.

Counterterrorism In African Failed States: Challenges And Potential Solutions, Thomas A. Dempsey Colonel Apr 2006

Counterterrorism In African Failed States: Challenges And Potential Solutions, Thomas A. Dempsey Colonel

Books, Monographs & Collaborative Studies

Terrorist groups operating in Sub-Saharan Africa failed states have demonstrated the ability to avoid the scrutiny of Western counterterrorism officials, while supporting and facilitating terrorist attacks on the United States and its partners. The potential acquisition of nuclear weapons by terrorists makes terrorist groups operating from failed states especially dangerous. U.S. counterterrorism strategies largely have been unsuccessful in addressing this threat. A new strategy is called for, one that combines both military and law enforcement efforts in a fully integrated counterterrorism effort, supported by a synthesis of foreign intelligence capabilities with intelligence-led policing to identify, locate, and take into custody …

Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown, Jr. Apr 2006

Reconsidering The Corporate Attorney-Client Privilege: A Response To The Compelled-Voluntary Waiver Paradox, Lonnie T. Brown, Jr.

Scholarly Works

The Department of Justice (“DOJ”) has adopted guidelines that seem to make waiver of the attorney-client privilege and work product protection a prerequisite for being deemed “cooperative,” a significant designation that carries with it the prospect for more favorable penal treatment. In addition, the United States Sentencing Commission underscored the potential importance of such waivers by approving an amendment to the Federal Sentencing Guidelines in 2004 that, under certain circumstances, makes privilege waiver a factor in assessing a corporation's “culpability score,” which is used in determining the appropriate sentencing range.

This perceived ever-present concern has caused many corporate executives and …

Reflections On Standing: Challenges To Searches And Seizures In A High Technology World, José F. Anderson Apr 2006

Reflections On Standing: Challenges To Searches And Seizures In A High Technology World, José F. Anderson

All Faculty Scholarship

Among the profound issues that surround constitutional criminal procedure is the obscure often overlooked issue of who has standing to challenge an illegal search, seizure or confession. Privacy interests are often overlooked because without a legal status that allows a person to complain in court, there is no way to challenge whether one is constitutionally protected from personal invasions. Standing is that procedural barrier often imposed to prevent a person in a case from objecting to improper police conduct because of his or her relationship of ownership, proximity, location, or interest in an item searched or a thing seized. Although …

A Macro-Level Analysis Of Divorce Rates And Juvenile Violent Crime And Drug Abuse In Virginia, Bianca Maria Conn Apr 2006

A Macro-Level Analysis Of Divorce Rates And Juvenile Violent Crime And Drug Abuse In Virginia, Bianca Maria Conn

Sociology & Criminal Justice Theses & Dissertations

With one out of every two marriages statistically doomed to fail, we must ask ourselves: how does this affect children? This thesis examines the relationship between divorce rates in the 135 cities and counties in Virginia and rates of juvenile violent crime and drug abuse. Social disorganization, used as a main source of reference in this study, is helpful in understanding how divorce affects juveniles at the community level. Family disruption, due to parental divorce, supports the notion that there is less juvenile supervision in the home and in effect the community, which leads to juvenile delinquency.

The three different …

Person-Related And Treatment-Related Barriers To Alcohol Treatment, Stephen M. Saunders, Karen M. Zygowicz, Benjamin R. D'Angelo Apr 2006

Person-Related And Treatment-Related Barriers To Alcohol Treatment, Stephen M. Saunders, Karen M. Zygowicz, Benjamin R. D'Angelo

Psychology Faculty Research and Publications

Treatment underutilization by persons with alcohol use disorder is well-documented. This study examined barriers to treatment at the latter stages of the treatment-seeking process, which was conceptualized as recognizing the problem, deciding that change is necessary, deciding that professional help is required, and seeking care. All participants identified themselves as having a drinking problem that was severe enough to warrant treatment. Differences between those who had (Treatment Seekers) and those who had not (Comparison Controls) sought treatment were evaluated, including the experience of person-related (e.g., shame) and treatment-related (e.g., cost) barriers. Person-related barriers were more commonly endorsed by both groups …

Licence To Publish: Joseph Howe's Contribution To Libel Law In Nova Scotia, Lyndsay M. Campbell Apr 2006

Licence To Publish: Joseph Howe's Contribution To Libel Law In Nova Scotia, Lyndsay M. Campbell

Dalhousie Law Journal

In 1835, Joseph Howe was prosecuted for criminal libel after an attack on the Halifax magistracy appeared in his newspaper I argue that Howe's acquittal flowed from a combination of factors. Howe's newspaper was a reformist, but not radical, voice at a time when criticism of government was becoming legitimate and newspapers were becoming increasingly vociferous, despite uncertainty about how daring they could be. Howe was popular, and the magistrates and prosecution were not. Most remarkably, however, Howe used Starkies 1830 libel treatise to construct a novel defence-qualified privilege-which had considerable exculpatory potential. The judge declined to put it to …
