Signaling Conformity: Changing Norms In Japan And China, David Nelken Jan 2006

Signaling Conformity: Changing Norms In Japan And China, David Nelken

Michigan Journal of International Law

Whatever their differences, the articles in this issue also have much in common in addition to their regional focus. The author of this Comment shall discuss in turn three (related) theoretical issues that arise, to a greater or lesser degree, in all four contributions. The first Part of this Comment considers the insights of these articles on the need to move from discussing transplants to focusing on transnational legal processes. The second Part examines what the contributions tell us about culture, legal culture, and the so-called "norm of conformity." I shall concentrate in particular on the cultural sources of choices …

Transitional Justice In Times Of Conflict: Colombia's Ley De Justicia Y Paz, Lisa J. Laplante, Kimberly Theidon Jan 2006

Transitional Justice In Times Of Conflict: Colombia's Ley De Justicia Y Paz, Lisa J. Laplante, Kimberly Theidon

Michigan Journal of International Law

The authors of this Article were committed to researching the impact of the paramilitary demobilization process "on the ground"-that is, conducting qualitative research that would allow us to test the validity of different debates with the goal of generating recommendations on how future conflict and post-conflict countries might benefit from the merging of DDR and transitional justice. In this text we draw upon the preliminary results of our research on the individual and collective demobilization programs. The first stage of the project included 112 in-depth interviews with demobilized combatants from the Fuerzas Armadas Revolucionarias de Colombia-Ej rcito del Pueblo (FARC-EP) …

Nookaler Ambitions: A Social-Psychological Analysis Of Persuasive Speech, Eric Gladstone Jan 2006

Nookaler Ambitions: A Social-Psychological Analysis Of Persuasive Speech, Eric Gladstone

McNair Scholars Journal

This study proposes a general model of persuasion based in social-psychology and cognitive information processing theory and is composed of an ideal listener/speaker/environment interaction. Drawing upon research conducted by Lowenthal and Guterman (1950), Erich Hoffer (1952), and Prakanis and Aranson (1992), the model is oriented towards post-911 presidential communications for testing. Presidential rhetoric is organized into seventeen themes, and these themes are analyzed so as to determine what effect, if any, said persuasive trends have on the individual listener. Insight into the characteristics and effects of persuasive communiqués is essential to the development of rational, critical psyches within persuasively-dense environments.

Cultural Cognition And Public Policy, Donald Braman, Dan M. Kahan Jan 2006

Cultural Cognition And Public Policy, Donald Braman, Dan M. Kahan

GW Law Faculty Publications & Other Works

People disagree about the empirical dimensions of various public policy issues. It's not surprising that people have different beliefs about the deterrent effect of the death penalty, the impact of handgun ownership on crime, the significance of global warming, the public health consequences of promiscuous sex, etc. The mystery concerns the origins of such disagreement. Were either the indeterminacy of scientific evidence or the uneven dissemination of convincing data responsible, we would expect divergent beliefs on such issues to be distributed almost randomly across the population, and beliefs about seemingly unrelated questions (whether, say, the death penalty deters and whether …

And Power Corrupts…: Theology And The Disciplinary Matrix Of Bioethics, M. Therese Lysaught Jan 2006

And Power Corrupts…: Theology And The Disciplinary Matrix Of Bioethics, M. Therese Lysaught

Theology Faculty Research and Publications

What role should religion play in a religiously pluralistic liberal society? Public bioethics unavoidably raises this question in a particularly insistent fashion. As the 20 papers in this collection demonstrate, the issues are complex and multifaceted. The authors address specific and highly contested issues as assisted suicide, stem cell research, cloning, reproductive health, and alternative medicine as well as more general questions such as who legitimately speaks for religion in public bioethics, what religion can add to our understanding of justice, and the value of faith-based contributions to healthcare. Christian (Catholic and Protestant), Jewish, Islamic, and Buddhist viewpoints are represented. …

Asian Americans On The Streets: Strategies For Prevention And Intervention, James Diego Vigil, Tomson H. Nguyen, Jesse Cheng Jan 2006

Asian Americans On The Streets: Strategies For Prevention And Intervention, James Diego Vigil, Tomson H. Nguyen, Jesse Cheng

Social and Cultural Sciences Faculty Research and Publications

Notably lacking in the literature on Vietnamese and Cambodian youth gangs in the United States and particularly Southern California have been solutions that address the underlying causative factors of gang involvement. Relying on life histories collected over a span of fifteen years, the authors propose a multi-faceted prevention and intervention strategy that includes the community and schools to heighten cultural awareness for children and parents. It is also recommended that policies take into account nuanced differences between Asian communities and bring together multiple stakeholders including officials and hard-core gang members to improve communicative problems that have resulted in gang-policy failures.

Academic data of all students tested for learning disabilities from summer, 1999 through spring, 2002 (61 students total) were analyzed before testing and then at least one year later to determine the impact testing and accommodations had …

A Review Of Landholder Motivations And Determinants For Participation In Conservation Covenanting Programmes, Thomas Kabii, Pierre Horwitz Jan 2006

A Review Of Landholder Motivations And Determinants For Participation In Conservation Covenanting Programmes, Thomas Kabii, Pierre Horwitz

Research outputs pre 2011

Conservation covenants (or easements) are flexible but legally enforceable documents attached to a land title restricting the use of that land, providing for the protection of important conservation values, while allowing the landholder to retain possession. Given the attractiveness of covenants to those who seek to expand national and regional nature conservation initiatives, it is important to understand landholder motivations for participation in programmes that covenant for nature conservation. This paper examines the likely influences on landholder decision making when it comes to conservation initiatives. A review of literature highlights key motivations and determinants, such as landholder demographics and the …

Values And M-Services Adoption, Craig Standing, Patricia Mcmanus, Susan Standing, Heikki Karjaluoto Jan 2006

Values And M-Services Adoption, Craig Standing, Patricia Mcmanus, Susan Standing, Heikki Karjaluoto

Research outputs pre 2011

The use of mobile services has increased rapidly in recent. Although research has been conducted on which services people use and the benefits they attach to those services, the values associated with the adoption and use of m-services at the individual level is still unclear. This formation systems field various technology adoption models have been proposed and validated in relation to technology adoption within an organisational setting but personal adoption and use of technology is less researched. To help uncover the values behind adoption of m-services we use means-end chains and laddering techniques. The analysis of the interviews shows that …

Producing Safety: Evaluating Structuration Theory As A Framework For Exploring The Values In Action Within The Civil Construction Industry In Wa, Susanne Bahn, Llandis Barratt-Pugh Jan 2006

Producing Safety: Evaluating Structuration Theory As A Framework For Exploring The Values In Action Within The Civil Construction Industry In Wa, Susanne Bahn, Llandis Barratt-Pugh

Research outputs pre 2011

In this paper we argue that occupational safety and health (OS&H) in the workplace is a production of values in action. We propose that such relations may best be explored through the structuration lens generated by Giddens (1984). We both use structuration theory to conceptualise the relations that produce safety and evaluate the utility of the theory as a research framework. We provide a detailed discussion of the context of, and rationale for a proposed study. The paper then analyses the components of structuration theory and frames the production of safety within these conceptual relations. The paper argues that the …

Developing A Positive Experience Of Introductory Information Systems For Women At Two Australasian Universities, Rosemary Stockdale, Susan Stoney Jan 2006

Developing A Positive Experience Of Introductory Information Systems For Women At Two Australasian Universities, Rosemary Stockdale, Susan Stoney

Research outputs pre 2011

This paper examines how academics can contribute to encouraging greater uptake of IS majors by women. Using a qualitative reflective approach we identify the perceptions and experiences of female undergraduates taking introductory IS courses in two universities, one in Australia and one in New Zealand, and discuss ways in which to improve their learning experience. We examine ways to improve the delivery of introductory IS courses in order to make information systems more relevant and less dreary to women undergraduates. The paper concludes with some recommendations for marketing courses and areas of further research.

Cultural Sensitivity Beyond Ethnicity: A Universal Precautions Model, Deborah Dysart Gale Jan 2006

Cultural Sensitivity Beyond Ethnicity: A Universal Precautions Model, Deborah Dysart Gale

Internet Journal of Allied Health Sciences and Practice

Cross-cultural healthcare research has grown exponentially in recent years, focusing primarily on the healthcare-related needs of ethnic and linguistic minorities. However, by approaching cultural sensitivity from an ethnic/linguistic perspective, the practitioner runs the risk of relying on essentialized or stereotyped accounts of cultural groups, as well as overlooking the needs of other groups (e.g., gays, elderly, physically challenged) that may validly be viewed as cultures and profitably studied with the tools of cross-cultural scholarship. This essay argues that Hofstede’s paradigm of cultural dimensions can serve as a useful foundation for providing culturally sensitive care following the model of Universal Precautions …

Teaching The Ethical Foundations Of Economics: The Principles Course, Jonathan B. Wight Jan 2006

Teaching The Ethical Foundations Of Economics: The Principles Course, Jonathan B. Wight

Economics Faculty Publications

When we analyze the source of humor, one ingredient is surely incongruity, the juxtaposition of opposites. So when Tom Lehrer, the consummate Harvard mathematician, openly calls for plagiarism, this is funny because it is exactly the opposite of what we expect - it is absurd. And yet, from the viewpoint of modern economics, is plagiarism really so absurd? We teach our students to maximize short-term profits (in a moral vacuum). We drill them that producers minimize private costs of production (without reference to ethical codes of conduct). We expect economic agents to operate with atomistic selfishness, assuring them that this …

The Cult Of Love, Michal Paul Jan 2006

The Cult Of Love, Michal Paul

All Volumes (2001-2008)

There can be no doubt that romantic love is, at a minimum, a cultural preoccupation; arguably, it closer resembles a frenzied obsession. Love is the subject of song lyrics, television shows, films, books, watercooler conversation, gossip, scandal, historic tragedy, and uncountable daydreams and fantasies. Type “romantic love” into a Google search and you will retrieve over 4,570,000 hits for websites featuring the topic. We even recognize a national holiday in its honor. Certainly one could say that love is an ultimate concern in American culture. Just how deep, though, is our devotion to its tenets? I argue that people live …

Vranizan, Gregory M. M.S. Autumn 2006 Environmental Studies RHETORIC AND THE RESTORATION LANDSCAPE: FOREST RESTORATION IN ENVIRONMENTAL DEBATE Committee Chairperson: Phil Condon Forest restoration on federal land has become the focus of an ongoing public debate in the West. Interest groups on various sides have engaged in a rhetorical contest to define restoration in ways that accord with their own ideas about the use and management of the nation’s public lands. This study examines the positions taken by different groups and considers the rhetorical claims they make. Disputes over meanings and practices have thus far limited the chances for a …

The Next ‘New Wave’: Law-Genre Documentaries, Lawyering In Support Of The Creative Process, And Visual Legal Advocacy, Regina Austin Jan 2006

The Next ‘New Wave’: Law-Genre Documentaries, Lawyering In Support Of The Creative Process, And Visual Legal Advocacy, Regina Austin

Fordham Intellectual Property, Media and Entertainment Law Journal

This Article challenges stereotypes and misconceptions about law-genre documentaries. Part I will propose a working definition of law-genre documentaries because such a categorization is a necessary precursor to thinking or writing about the relevance of documentary films to lawyers, law students, and anyone interested in law and the pursuit of justice. The Article will go on from there to describe in Part II the various rhetorical or narrative styles or modes of filmmaking that documentarians employ. Although these styles or modes contribute to the impenetrability of documentary films, an understanding of their limitations can open up documentary films to critical …
